Members Present: Chairman Harvey D. Sennett, and Commissioners William C. Ray, Henry S. Walker, Ira A. Ward and C. Norman Walker. Members Absent: None The minutes were read and approved after corrections were made. Chairman Bennett recognized Coolidge Porterfield, Executive Secretary of the Orange County Housing Authority. Chairman Bennett adjourned the Board of Cotranissionera and said meeting was re-aoaveaed as a Hoard of Commissioners for the Orange County Housing Authority. Mr. Porterfield read the minutes of the leaf meeting of the Authority: For other business of this meeting sae Minute Docket of the Orange County Housing Authority. Chairman Sennett adjourned the Board of Conunissionera for the Orange County Housing Authority meeting and said meeting was re-convened as a Board of County Commissioners. Chairman Bennett reaognized Tom Ward, Director of Social Services. Mr. Ward presented the W~NN Budget in the amount of $28,73!}.00. This program is to train recipients for gainable employment which he had received from the State Department of Soaial Services. Mr. Ward advised the $oard that the Status recottanendation was oonaiderably higher than the recommendation which had been made by the Local Soaial Serviaea Board. He stated that the amount of funds that had bean approved by the Loaal Board would be adequate for this years program. Discussion ensued. Upon motion of Commissioner William C. Ray, seconded by Commissioner Ira A. Ward, it was moved and adopted, that the recommendation of the Local Board relative to the amount of funds needed by the W~NN Program be approved and that the forms which contained the estimate from the State Department be returned with same not being signed by Chairman Sennett. Mr. Long presented a plat entitled "SECTION THREE OF THE BLUFFS OF ENO' Por the approval of the Board. He stated that the plat met all the requirements of the Zoning Ordinance. Upon motion of Commissioner Henry Walker, seconded by Commissioner William - C. Ray, it was moved and adapted, that the plat entitled "SECTION THREE OF THE BLIIFF3 OF ENO" be approved for recordation and that Chairman Bennett be authorised to sign same. The Zoning Officer advised the Board that the County Planning Board, meeting on Monday, April 19, 1971, forwarded the following recommendations: 1. Approval of the request of William Coy Byrd for rezoning 5 acres of his property along the Hillsborough-Eno Township line from a Residential District to a Mobile Home Park District. IIpon motion of Commissioner William C. Ray, seconded by Commissioner Henry Walker, it was moved and adopted that the recommendation .of the County Planning Board relative to the raauest oP William Coy Byrd Por re-coning 5 fares oP his property along the Hillsborough-Eno Township line from a Residential District to a Mobile Home Park District be approved. 2. Dani&1 of the request of William Coy Byrd Por rezoning 1.05 acres from a Residential District to a Rural Commercial District, due to the lot not meeting the minimum reauirements of Section 6.3 Minims Lot Width of the Zoning Ordinance. This section calls for a minimum lot width of 200 at the setback line while this property is only 160 at the widest point. Commissioner Henry Walker moved that the recommendation of the County Planning Board relative to the request of William Coq Byrd for rezoning 1.05 scree Prom a Residential Distriot to a Rural Commercial Diatrlat, be denied. This motion died Por the lank oP a second. Further dissuasion ensued. It was agreed that the Commisainners would make an on the sight inspection of the premises. The County Attorney presented a letter from Bert Montague in behalf of the Clerk of Court. Said letter advised the Board that certain volumes oP law books ~~+ for the criminal court rooms could be acquired at a coat to the County of X235.12. ~~'k The County Attorney recommended the purchase of said books and gave as his reason • that the judges who were currently conducting court did not have any source of reference available to them. Upon motion of Commissioner Norman Walker, seconded by Commissioner William C. Ray, the Clerk of Court was authorized to purchase the books whfnh would be made available through the Administrative OPfioea oP the Court. Chairman Bennett presented a letter Prom the core of engineers which stated that a Plood plain level study could be made available to Orange County through the Research Triangle Regional Planning Commission. Discussion ensued as to the advantages fqr a P1ood plain level survey. IIpon motion of Commissioner Norman Walker, seconded by Commissioner Henry Walker, it was moved and adopted, that the County raauest a flood plain level survey be made. Chairman Bennett recognized Mark Burnham oP the Research Triangle Regional + Planning Commission. Mr. Burnham presented copies on the matter of solid waste entitled "NORTH CAROLINA STATE BOARD OF HEALTH RIILE.S AND REGULATIONS PROVIDING STANDARDS OF SOLID WASTE DISPOSALS". Mr. Burnham stated that the Board of Health would make a survey for the County similar to the one which had been made for Chatham County and that said survey would include lands available Por a land fill area, coat factor and other pertinent infoxaaation on the subject of solid waste. Discussion ensued as to the problems currently being encountered by the County. ~ Upon motion of Commissioner Ira A. Ward, seconded by Commissioner Henry Walker, the County Administrator was instructed to consult with Dr. 0. David Garvin, District Health Officer, and secure his approval to make the raauest that the State Health Department make a land fill study Por the County. Commissioner Ira A. Ward extended congratulations of the Board to Mark Burnham upon his recent marriage. ~~~'~ ~ PAGE 3~2 Chairman Bennett presented a letter from Senator Ralph Scott revuesting the support of the Board for hie Homestead Bill. Said bill would allow the exemption oP $5,000 on the property tax of persona sixty-five (65) years of age or older whose yearly income did not exaead $3,500. Discussion ensued. No action was taken on the bill. Chairman Bennett presented a memorandum from Lamar Gudger, Senator of the thirty first District, requesting the endorsement of the repeal of Article !} Chapter 13!} of the General Statutes. Said bill reauirea that a pity of'over 20,000 population and the county in which St is located were authorized in 1917 and thereafter "to establish jointly a reformatory or home for fallen women". Discussion ensued. No action was taken on the bill. _ Chairman Bennett presented a letter from B. Vernon Cox, Chairman Pitt County Board of Commissioners. Said letter requested the endorsement and the support of the Soard in behalf of the establishment of a Medical School at Fastern Carolina University. Discussion ensued. No cation wsa taken. Chairman Bennett presented a letter from J. F'. Mohn, Representative from the Fourth House District. Said letter requested support of House Bill !x"02 which would provide that the profits from the ABC system would be equally divided between the County and t41e State. Discussion ensued. IIpon motion dP Commissioner Ira A. Ward, seconded by Commissioner Henry Walker, it was mooed and adopted that the Board convey its support of Rvuae Bill 1,02 to Representative Mohr and that copies oP said letter be forwarded to the County~s Representatives in the General Assembly. Commissioner Ray brought to the attention of the Soard that the Sheriff was opposed to the provision which wsa contained in the proposed A$C bill that would allow the sale of bear and wine on Sunday. Dissuasion ensued. Chairman Bennett renognized Bill Dorsett. Mr. Dorsett stated that as President of the Orange County Farm Bureau he was present to seek the support oP the Board on Senate Bill 523 and Rouse bill 834 He stated that this proposed legislation would olassify farm land according to its use and that when same was converted to commercial or residential land use then the owner would be taxable for a three pear beak period on the new aeaeasment of said real estate. Discussion ensued. No action was taken on the request. Chairman Bennett invuired of the County Attorney sa to what wsa needed in _. order to the request of the State Highway to abandon 0.5 miles of SR 1193 and SR 1580. The County Attorney advised that he would have to institute legal proceedings before said road could ba designated as an abandoned road. Road petitions were received for SR 1533, SR 1325 (Cak Street} road off of SR 19la.B and SR 1318 and SR 1319 (Forrest Avenue and Central Avenue). The Clerk was instructed tc forward same to the State Highway Commission. Commissioner Ward presented a letter from Ola Shambley relative to SR 1102 in Bingham Township. Said letter requested that this road be paved. In reviewing the traffic count and the length of said road Commissioner Ira A. Ward reauested the Clerk"to advise Ms. Shambley that he felt it would be advisable for the citizens of the area to reauest that the southern half of the road be paved as the higher traffic taunt appeared in that area. Chairman Bennett presented a memorandum from Pearson Stewart of the Research Triangle Regional Planning Commission. Said memorandum stated that Federal Grant money needed for the Commissions operation for the months oP April, May and June will not be received until late in July. He requested that Orange County advance to the Research Triangle Regional Planning Commission 11.8, which amounts to $3,3a4".o0 of the 1971-1972 appropriations, with the understanding that this percentage and this amount wSll be deducted from the 1971-1972 appropriation to the Planning Commission. Upon motion of Commissioner William Ray, seconded by ComTiasioner Norman Walker, i+, was moved and adopted that $3,304.00 ba allocated to the Research Triangle Regional Plannirg Commission end that said s~!lount would be deducted from the '_971-1972 budget appropriation. Chairman Sennett presented a resutrle on John Cabe. _"2r. Cabe was a Miller and lievolutionary Patriot. Said letter was requesting that the Board of Commissioners endorse the procurement of a plaque which +aould be installed at the Cabe Mill Ford by the Department oP Archives and Riatory. Upon motion of Commissioner Ira A. Ward, seconded by Commissioner Willfam C. Say, Chairman Bennett was authorized to wr;te a letter of endorsement for the procurement of a historical plaque commemorating the life of John Cabe. _, . ~ PAGE ass Chairman Bennett brought to the attention of the Board that there was a vacancy on the Chapel Hill Board of Adjustments because of the resignation of F'. W. Herigeveld. Upon motion of Commissioner Ira A. Ward, seconded by Cgmmi.ssioner Henry Walker, Ar. David McFarland of Dogwood Acres was appointed to fill the unexpired term of F. W. Hengeveld on the Board of Adjustments. Chairman Sennett recognized the County Administrator. Mr. Gattis called _ attention to the copies of tax refund and releases which he had made for each member of the Board. Mr. Gattis explained that the refund to Bessie Edwards of 591.95 had occurred because the tax map showed too much acreage and Mrs. Edwards had been taxed in excess in the actual amount of land which she owned. Upon motion of Commissioner Norman Walker, seconded by Commissioner William Ray, the Tax Supervisor was authorized to refund to Mrs. Bessie Minor Edwards the sum of $91.95 which covered the taxable years of 1965-1969. Mr. Gattis stated that Irvin Womble had been erroneously charged $11.00 dog tax instead of the $2.00 fee which he had listed, therefore, Mr. Womble was due a refund of $9.00. Upon motion of Commissioner Henry Walker, seconded by Commissioner Norman Walker, the Tax Supervisor was authorized to refund 59.00 to Irvin Womble for the error which had occurred on his tax bill. Mr. Gattis explained that Coleman Dehymne Carter was requesting a refund of $22.71 as it had been because the tax on the 1966 Volkswagen owned by his father had been paid in Sampson County. Upon motion of Commissioner William C. Ray, seconded by Commissioner Norman Walker, the Tax Supervisor was authorized to refund $22.71 to Mr. Carter. Mr. Gattis presented a request from Roger E. Johnsgnborough for a refund in the amount of 567.00. This request was made on the basis that Mr. Johnsonborough, who was a member of the Armed Forces, had been transferred by direct orders to Chapel Hill and under the Soldiers and Sailors Military Act he was exempt from the paying of local personal property tax. Upon motion of Commissioner Ira A. Ward, seconded by Commissioner Henry Walker, the Tax Supervisor was authorized to refund $67.00 to Roger E. Johnsonborough because of the reason cited. Upon motion of Commissioner Henry Walker, seconded by Commissioner Ira A. Ward, it was moved and adopted that the April rel eases of the Tax Supervisor be approved. ,~:~;{ 7 Pact 364 Mr. Gattis advised the Hoard that it was now the time to schedule a meeting of the Board of Equalisation and Review. Discussion .ensued. It was agreed that the Board of Equalization and Review would convene on Monday, May 2A, 1971, at S P.M, in the Commissioners Raom at the Courthouse in Hillsborough. Chairman Hennett brought to the attention of the Board the fact that he had received correspondence relative to proposed legislation. Commissioner William C. Ray brought to the attention of the Board the ~~ fact that Representative Harris of Alamance County had introduced House Bill #663 relating to the annexation of a certain portion of Orange County into the Alamance County School Administrative Unit. Discussion ensued relative to this matter. Upon motion of Commissigner William C. Ray, it was moved that the=-Orange '' County Board of Commissioners go on record as opposing House Bill #663. This motion died for the lack of a second. Commissioner' William C. Ray brought to the attention of the Bard that Senate Bill #411 which dealt with the Governor's Commission on Law and Order being authorized to set a minimum and a maximum salary for all law enforcement personnel was being opppsed by the North Carolina Commissioners Association. Chairman Bennett advised the Board that Senate Bill #443 would amend the Social Services Lien Law. Discussion ensued. Upon motion of Commissioner Ira A. Ward, seconded by Commissioner Henry Walker, the Clerk was instructed to write Orange County's Representatives in the General Assembly advising them of the Boards opposition to Senate Bill #411 and Senate Bill #443. Commissioner Ray inquired as to what action the Board planned to take about the Ordinance entitled "AN ORDINANCE REGULATING THE EXPOSURE TO VIEW THE HUMAN BODY". He Stated that Sheriff Knight was still in favor of adopting the Ordinance because certain ABC laws does not pertain..to areas such as carnivals and fairs. Upon motion of Commissioner William C. Rays seconded by Commissioner Ira A. Ward, it was moved that the first reading of the Ordinance entitled "AN ORDINANCE REGULATING THE EXPOSURE TO VIEW THE HUMAN BODY" be approved and that the public hearing for said Ordinance would be Monday, May 17, 1971, _, at 8 P.M. in the Commissioners Room at the Courthouse in Hillsborough, North Carolina. Chairman Bennett called for a vote on the motion. Commissioners William C. Ray and Ira A. Ward voted aye. Commissioners Norman Walker and Henry Walker voted nay. Chairman Bennett broke the tie by voting aye and then declared the motion passed. There being no further busa.ness to come before the Hoard the meeting was adjourned to meet again on Monday, May 10, 1971 and Monday, May 17, 1971. Harvey D. Sennett, Chairman Betty June Hayes, Clerk
