Bennett, and Commissioners William C. Rap, Henrq S. Walker, Ira A. Ward and C. Norman Walker. Members Absent: None The minutes were read and approved. Chairman Bennett adjourned the Board of Commissioners and said meeting was re-convened as a Board of Commissioners for the Orange County Housing Authority. Chairman Bennett recognized Coolidge Porterfield, Ekecutive Secretarq of the Orange County Housing Authority, Mr. Porterfield read the minutes of the last meeting of the Authority. For other business of this meeting see Minute Docket of the Orange County Rousing Authority. Chairman Bennett adjourned the Board of Commissioners for the Orange County Housing Authority meeting and said meeting was re-convened ae a Board of County Commissioners. Chairman Sennett recognized Gera P. Sykes. Mr. Sykes stated that hie reason for being present was to solicit the support of the Board for the establishment of an interchange from Interstate 85 onto the Dimmocks Mill Road. Mr. Sykes said that the eatabliahment oP this interchange would provide access tv the West Hillsborough area. Discussion ensued. The Clerk xea directed to write the Division Engineer reaueating that the State Highway Commission advise the Board of their reaction to the proposal. Chairman Sennett recognized Claude Graq, Jr. Mr. Gray inavdred as to the status of SR 1526. He stated that a petition for the paving of this road had __ been submitted in October, 19b9. The road files revealed that no correspondence had been received relative to plans for acid road. The Clerk was instructed to innuire as tv the status of acid road. Chairman Bennett recognized Hulan Bradshaw, who was the spokesman for the delegation which was present. Mr. Bradshaw stated that they wished to petition for the completion of the paving of SR 1~Li.3. Cotmnissioner Ray stated that the Town of Mebane and the Cedar Grove Ruritan Club had endorsed the paving of this road bq letters to the Governor. Discussion ensued. The Clerk was instructed to write the Division Engineer advising him that the Orange County Board of Commissioners did endorse the paving of SR 13(}3 with the provisions that said project be completed over a two or three gear period. Chairman Bennett recognized Burch Compton, Chief of the Orange County Rescue Souad. Mr. Compton stated that he was representing a Building and Site Committee which had been appointed by the Orange County Rescue Squad members. He stated that rescue anuada had bean formed in Cedar Grave and Efland and that it was the Plana of the group to continue training sessions for all members of the three souad unite. Mr. Compton then presented plans for a proposed souad building and requested that the land immediately behind the new courthouse be made available to the Orange County Rescue Squad for the purpose of construction of this building. Discussion ensued relative to this raouest and proposal. Cottanissioner Ray spoke in behalf of said building. The County Administrator suggested that the Board appoint a committee or that the entire Board meet to discuss the feasibility of future land acquisition, land use and future construction. Mr. Gattis stated that ha felt this would assist in determining what areas would be or could be made available for additional growth. Reece Horton of the Durham Ambulance Service, presented copies entitled "Proposals To Provide Ambulance Service to Southern Orange County" to sash member of the Board. It was agreed that the Board would meet with Mr. Horton - on Tuesday, March 9, 1971, at 9 p.M, in the Commissioners Room for the purpose of reviewing the presented proposals. SAME Clayton Roberson 1}/1/71 g7 ~ The Social Services Director reported to the Board that he had received a letter from the State Department of Social Services advising him that the ~ State Administrative Eoualization Funds would be revised effective duly 1 1971, and the formula which formerlq allotted Orange County thirteen (1381 per sent of its administration exnensss would now allot Orange County only five point sixty-eight (5,68;0 percent from the State Administrative ,I Equalization Find, It is estimated that this change in policy will cost Orange County an additional $15,000 per ysar. Commissioner Ray advised the Board that the Social Services Board had appealed this revision formula as it is being applied to Orange County. Upon motion of Commissioner Tra A. Ward, seconded by Commissioner FIenry 3, Walker, it was moved and adopted that the Board of Commissioners approve the action of the Board of Social Services in their appeal for a - review of the revised Formula, and that the County Administrator and the , Director of Social Services bs authorized to represent Orange County before the Commissioners of Social Services. ~ _ Chairman Bennett recognized Norman Long, Zoning Officer. The. final plat of P1ns V1ew Estates was presented with recommendations from the Planning Board that same be approved for filing. Upon motion of Commissioner Hsnry S. Walker, seconded by Commissioner Ira A, Ward, it was moved and adopted that the recommendation of the County Planning Board be accented and Chairman Rarvey Sennett was authorized to sign said plat. A public hearing for zoning matters was scheduled for Tuesday, April 6, 1971, at 8 P,M, at the Courthouse in Hillsborough, North Carolina. Chairman Sennett recognized Mr a. Robert Isleq, President of the j Hillsborough Historical Society. Mrs. Isleq introduced Don Matheson, Elizabeth Collins and Alexander Shepard to the Board. She stated that ~ they were present to diacusa with the Board what plans, if anq, the Cvuntq had relative to the Battle of Alamance B3,_Centennial Committee. Chairman Bennett informed the group that letters had been reaeived from each Historical group in the countq and that the Board would appoint a Committee made up oP members from each of these groups to proceed with the plans for Orange Cqunty~s partia.ipation in the Bi-Centennial. Chairman Bennett presented a resolution relative to the County~s ; participation in the program of the North Carolina Committee on Law and Order. 'Disausaion ensued. The County Administrator advised the Board that Orange County had not officially ~ginad the LAW AND ORDER TRIANf~LE COMMISSION and that before the Sheriff could participate a resolution must be adopted bq the Board. r- Upon motion of Commissioner Ira A. l+iard, seconded by Commissioner Renrq S, Walker the following resolution was adopted: ; 7 Pace 344 "WHEREAS, the county oP Orange County by resolution dated March 1, 1971, has agreed to participate in planning effort for the improve- ment of the criminal justice system in North Carolina; and WHEREAS, pursuant to statutory authority conferred upon muniaipalitiea by virtue of G. S. 16D-20D (I}5) and upon counties by virtue of G. S, 153-9 (60), municipalities and counties may create joint agencies to act For and on behalf of partici»ating municipalities and counties to plan and execute training and development programs for criminal justice agencies; _, NCW.THEREFDRE, BE IT RESOLVED THAT there is hereby created the TRIANGLE CDMMISSIDSI ON Criminal Justice Planning Agency to be composed of the following agencies, to wit: Raleigh Wane Forest Carrboro Johnston County Wake County Apex Hillsborough Smithfield Garner Fuquay Orange County ABC Benson Cary Durham Lea County Aenly Wendell Durham County Chatham County Selma Zebulon Orange County Siler City Clayton Chanel H311 Pittsboro The TRIANGLE COMMISSION on Criminal Justice Planning Agency aonaiata of: (l) one member representing each elected government unit (or county) within the planning region. One member representing each law enforcement unit (or count) within the planning region. At least two members of the Judiciary Superior or District). Cne Solicitor. One member from each Model pities group within the planning region. At least one parole officer stationed within the planning region. At least one probation officer stationed within the planning region. At least five members representing the general public. Consideration shall be given to female, minority and student representation. (2) An executive board shall consist of at least ten percent of the full policy board, No more than fifty percent of the executive board should be law enforcement personnel. There should be at least four members on the executive board being elected officials of the local units of government. At least two at large members (general public representatives) should be on the executive board, The planning agency shall have a full-time Planning Director who shall assume responsibility for coordinating the planning efforts for the TRIANGLE CDMMISSZgN on Criminal Justice Planning Agency. The purpose of the TRIANGLE COMMISSION on Criminal Justice Planning Agency is to prepare and adopt comprehensive criminal justice plans based on their evaluation of local problems of the criminal justice system. The Planning Agency may receive and disburse funds made available for the purpose of planning. It may prepare applications for action programs to improve criminal justice within the particular region involved and to this end may conduct surveys, studies, interviews and any other efforts necessary to prepare plans and programs for the improvement of criminal justice." Chairman Sennett read a letter from Dr. Charles H. Blake. Dr. Blake suggested that upon completion of the new facilities for the Board of Fduoation that the old Courthouse, in its entirety, be designated as a Historical Museum. No action was taken on acid renuest. The Clerk was instructed to forward to the State Highway Department petitions for SR 1129 and SR 1946. Chairman Sennett read a letter from Don Matheson, Chairman of the Library Board. Said letter reouested that Mrs. Bonnie Davis and Mrs. Virginia Warren be appointed as members of the Library Board. Upon motion of Commissioner Henry S, Walker, seconded by Commissioner Norman Walker, it was moved and adopted that Mrs. Bonnie Davie and Mrs. Virginia Warren be appointed as members of the Library Board. Chairman Bennett advised the Board that he had received a call from the editor of the Durham Sun reouesting that the Orange County Board of Commissioners consider offering a reward for evidence leading to the arrest and conviction of the party and/or parties responsible for the deaths of Patricia Mann and Jesse McBane. Disouaeion ensued. The Board inovired of the County Attorney if they could. legally offer such a reward. The County Attorney advised the Board that they could pass a resolution reaueating the Governor to offer the reward, Further dissuasion ensued. ~.. 7 PAGE 345` Upon motion of Commissioner William C. Ray, seconded by Commissioner Norman Walker, it was moved and adopted, that the Board reoueat the Governor to offer a reward for information leading to the arrest and conviction of that person or persons responsible for this heinous crime. Commissioner Henry Walker brought to the attention of the Board a memorandum which had been issued by Dr, Joaeoh Lowman, Mr, Ron Brown and Mr. Walter McDade, members of the Taster-Agency Council. This memo stated that a steering committee was interested in establishing sheltered workshops for - the Northern Orange County area and that a meeting was being scheduled for Wednesday, Maroh 10, 1971, at 2 P, M, in the District Health Department in Hillsborough, North Carolina. The Clerk was instructed to notify G. A, Brown of this meeting as he had expressed interest in the establishment of sheltered workshops, Chairman Bennett brought to the attention oP the Board that the matter of the Nutrition Aid program,which had been submitted by the Orange County F~tenaion Service, had not been acted upon by the Board, Discussion ensued, i Upon motion of Commissioner Ira:A, Ward, seconded by Commissioner Henry Walker, it was moved that Orange County approve the Nutrition Aid Program as submitted by the State F.~tension Service and which would be under the direction of the Crange County Extension Service. Chairman Bennett called for ~ a vote on the motion. Commissioners Henry Walker and Ira A, Ward voted aye. Commissioners William C. Rap and Norman Walker voted nay. Chairman Bennett, in order to break the tie, voted aye and then declared the motion carried, The County Administrator stated that ha had not received a report from ii the engineers on the Seven Mile Creek Reservoir pro~eat, Chairman Bennett stated that the Board needed to appoint a steering committee for the Battle of Alamance Bi-Centennial Committee. Upon motion of Commissioner William C, Ray, seconded by Commissioner Ira A. Ward, it was moved and adopted, that Chairman Harvey Bennett, William A. Graham, III, Mrs, Alfred Engstrom and Robert Stipe and the Presidents of each - Historical group in the county be appointed as members of the steering committee. Tt was further moved that Mrs. Alfred Engstrom be appointed as Temporary Chairman for the purpose of organizing the committee. Commissioner William C. Ray presented a list of names from Clarence U, Jones, Chairman of the Human Relations Council. Chairman Bennett read the names which were listed as possible nominees as council memoera, Upon motion of Commissioner Tra A, Ward, seconded by Commissioner Henry S, Walker and Conanisaioner Norman Walker, Don Cox, Mrs, Glenn Auman and Roosevelt Warner, Jr, were appointed as members of the Orange County Human Relations Council. Chairman Bennett recognised Lucius M. Cheshire, County Attorney, for the Pirst reading of the Ordinance entitled "ORDINANCE REGULATING EXPOSING TO VIEGT THE FEMALE BODY." Upon motion of Commissioner William C. Ray, seconded by Commissioner Norman Walker, the first reading, by the County Attorney, of the Crdinance entitled "ORDINANCE REGULATING EXP03zNG TC VIEW THE FEMALE BODY" was adopted in accordance with G,3, 153-9(55) and the public hearing for said Ordinance was scheduled for March 9, 1971, at 8 o'clock P,M, in the Commissioners Room at ~ the Courthouse in Hillsborough, The County Administrator advised the Board that an error had been made in the 1969 tax assessment on the property of Howard Tate and that Mr, Tate had renuested a refund in the amount of $l}O.L~.7, The Board inquired of the County Administrator if the refund was due Mr, Tate. Mr, Gatos stated that tha error had been corrected in the 1970 assessment and he felt the refund should be made. Upon motion of Commissioner Henry Walker, seconded by Commissioner Norman Walker, the Tax Supervisor was authorized to refund $1}C,la.7 to Howard Tate, because of an error in his 1969 tax assessment. The County Administrator advised the Board that G, S, 105-29f+ required the County to adopt an assessment ratio for the year of 1971. Upon motion oP Commissioner Henry Walker, seconded by Commissioner Norman Walker, it was moved and unanimously adopted, that Orange County establish its 1971 Assessment Ratio at seventy (70;b} percent of the 1966 value. - ~ ~ PAGE ~6 ,, The Coumty Administrator advised the Boar d that the Auditors had insisted that the tax releases on a mon thly basis be made a part of the Commissioners minutes. Walker, Tra 9, Ward and C. Norman Walker. Members Absent: None Chairman Bennett presented a letter from Gordon Kage, Representative of the j Chapel F1311 Kiwanis Club. Said letter reauested permission for the club to stage I a fireworks display on Sunday, duly 4, 1971 on the UNC campus. Upon motion oP Commissioner Henry Walker, seconded by Commissioner Ira A. Ward, it was mooed and adopted that the Chapel Hi11 Kiwanis Club be granted a permit for a fireworks display on July 4, 1971, with the condition that the display ba conducted under the supervision of the Chapel Hi11 Fira Department. 1 Chairman Bennett announced that this was the time and place scheduled for ~ the public hearing on the Ordinance entitled "AN ORDINANCE REGULATING THE E7CPOSURE TO VIEW THE HTIMAN BODY." He stated further that this public hearing was being ,.. conducted as per the reouiremsnts of G.S. 153_9(55)• Chairman Bsnn9tt than recognized L, M, Cheshire, County Attorney, for the second reading of said ordinance. Upon the completion of the reading of said ordinance Chairman Bennett reaueated that any persons present who wished to speak in support of said ordinance would at this time be recognized. Chairman Bennett recognized C. D, Knight, Sheriff of Orange County. Sheriff Knight stated that at the present time there was only one topless club which was operating in the county and that it had not caused any type of law enforcement problem. He stated further that he felt these types of establishments are nut ~ in the beat interest of the public morale and that they could cause a certain amount of bad influence for younger people, and that clubs of this tyre, which existed in other areas, had caused considerable problems for the law enforcement agencies. ec : '
