Minutes 7) Preliminary Plan PURPOSE: To review and act upon the Preliminary Plan for Lucas Farm at New Hope application. BACKGROUND: Request -Preliminary Plan Application Approval Applicant: Mark O'Neal, Agent for Ticon Properties, LLC Owner: Ticon Properties, LLC Subdivision application follows the Conventional Subdivision Plan approved at the concept stage that has 49.5°fo of open space. Subdivision Lots (Avg Total Density (Acres Open Space Acres of Open T e Lot Size Acrea a er unit Percenta e S ace Conventional g (2.3 ac.) 45.49 5.05 49.5 20.99 Plan Location • Northeast intersection of New Hope Church Road and Old NC 86 in Chapel Hill Township. • Located in a Rural Designated Area in the Growth Management System which for 9 lots follows the standard subdivision process (PB Concept; PB Preliminary; BOCC Preliminary). • Located at Northern end of JPA-Carrboro Review Area. There were no additional comments from Carrboro. Existing and Proposed Conditions Existing • Zoning: Rural Buffer (RB) (maximum density = 1 dwelling unit / 2 acres); the property is located within Jordan Lake Unprotected Watershed. Physical Features • Three designated streams are on the tract---New Hope Creek, plus two small tributaries. • There are a large number of mature canopy hardwoods [predominately along and within the 2 floodplain] on the portion of the tract offered for dedication to the County. Also, pine trees are located on the western side of the tract adjoining Old NC 86. • The topography is gently rolling with minimal rock outcrop area in buffer along New Hope Church Road. Adjacent Land Use • South across New Hope Church Road are 3 larger subdivided lots, which are 3.53 ac., 3.71 ac., and 4.9 acres in size. • To the north and the east are single-family residential lots approved as minor subdivisions. Lots to the north average 4.07 acres in size and lots to the east average 2.06 acres in size. • West across Old NC 86 is a large tract (78.77 acres) of undeveloped property. Proposed Roads • Access is from New Hope Church Road (SR 1723), an existing paved public road. • A proposed, public 575=foot cul-de-sac, built to NCDOT standards, will provide access to the subdivision. Connectivity to the north across New Hope Creek or to the east is not feasible due to existing recorded subdivisions to the north and east. • An additional 20 feet of right-of-way along Old NC 86 frontage will be dedicated. • An additional 5 feet of right-of--way along New Hope Church Road frontage will be dedicated. • NCDOT comments indicate the roads must provide a public right-of--way and meet all other NCDOT requirements prior to addition for State maintenance. The developer will submit road construction plans to be approved by NCDOT prior to recordation of the final plat. This adequately addresses NCDOT questions in attachment 5. • This subdivision is adjacent to the newly designated NC Scenic Byway corridor, which is along this section of Old NC 86. There is a 100-foot building setback including accessory structures, provided along Old NC 86, the eastern property line and along New Hope Church Road. Open Space/Buffers • ERCD and Parks and Recreation recommend that the 20.99 acres of common area open space (i.e. lot 10) be dedicated to Orange County. Only 9/20 acres is required. Until a determination of the future use of the land (i.e. nature preserve or part of a trail system) is agreed upon, ERCD will monitor the site. • Easement areas for signage and lot buffers will be retained and placed into a Homeowner's Association. • A Homeowner's Association will be formed to maintain the common areas and amenities which are not to be dedicated to Orange County (i.e. buffers, signage, and lights, if proposed). Water-Sewer • Individual wells • Individual septic systems • Extension of water and sewer is prohibited in the Rural Buffer, except for a public purpose or to address a health situation. Parks and Recreation • Chapel Hill District Park o The Parks and Recreation Advisory Council recommends: ^ that the County accept the 20.99 acres dedication as shown on the Conventional Plan; ^ that the developer provide for access to the open space at the end of the cul-de- sac for neighborhood residents only. No public access allowed at this point; ^ that the site designer at the final plat stage evaluate and preserve, to the extent possible, the large specimen trees near the old homestead. ^ Public access from NC Old 86 is available on the property dedicated to the County. ^ The 20.99 acres dedication satisfies the parkland payment-in-lieu requirement which would be 9/20 acre as referenced above. Schools • This subdivision is located within the Orange County School System area. The Orange County School Superintendent has approved the issuance of the certificate of Adequate Public Schools (CAPS) after BOCC approval of the Preliminary Plan. [See attached]. Development Process, Schedule, and Action . • First Action: Neighborhood Information Meeting held on April 21, 2008. Second Action: The Concept Plan was approved by the Planning Board on May 7, 2008 with the following conditions: 1. All intersection and road alignments on the Preliminary Plan shall meet NCDOT standards. 2. Homeowners Association documents that provide for maintenance of Open Space areas shall be submitted with the preliminary plan. This includes lands that will be in common ownership or will have easements retained on publicly dedicated lands. Provisions shall be included in the Homeowners Association documents that prohibit tree cutting in all Open Space areas, except for safety or maintenance purposes. 3. Show, on the Preliminary Plan along New Hope Church Road, an additional right-of- way dedication of 5 feet, or 35 feet from the centerline of existing R/W, whichever is greater. 4. Show, on the Preliminary Plan along Old NC 86, an additional right-of-way dedication of 20 feet, or 50 feet from centerline of existing R/W, whichever is greater. 5. Show five-foot utility easements along both sides of the fifty-foot right-of-way for the proposed cul-de-sac street. 6. Show a 5-foot non-vehicular access easement along the entire portion of the frontage of New Hope Church Road, with the exception of the new street location. 7. Show a 5-foot non-vehicular access easement along the entire frontage of Old NC 86, with the exception of the land dedicated to Orange County. 8. Show an easement location for a subdivision sign on the Preliminary Plan if a sign is planned. 9. All street lighting and sign lights, if proposed, shall be approved by Orange County Planning to ensure compliance with the Orange County Outside Lighting Standards. 10. Evaluate, and preserve to the extent possible, the large specimen trees in the general vicinity of the old homestead. 11. Protect, through the homeowner's association documents, the Old NC 86 Scenic Byway corridor to preserve trees and restrict uses in the 100-foot protection area (i.e. the building setback area along Old NC 86). Third Action: Planning Board reviewed the Preliminary Plan on October 1, 2008 and unanimously recommended approval in accordance with the attached Recommendation of the Orange County Planning Board. 3 The proposed Resolution of Approval follows the wording in the attached Recommendation of the Orange County Planning Board. The Planning Staff recommends Approval of the Preliminary Plan in accordance with the attached Resolution of Approval. • Fourth Action: Board of County Commissioners to hear Administration and Planning Board recommendations and then make decision on Preliminary Plan. 4 RECOMMENDATION(S): Administration recommends Approval, in accordance with the attached Resolution of Approval. 5 ATTACHMENTI RESOLUTION OF THE ORANGE COUNTY BOARD OF COUNTY COMMISSIONERS Date: November 18.2008 Name of Subdivision: Lucas Farm at New Hoae Owner/Applicant: Ticon Properties, LLC. The Board of County Commissioners hereby approves Lucas Farm at New Hope subdivision preliminary plat, dated July 9, 2008 as revised by surveyor Steve F. Yuhasz on August 29, 2008 containing 9 lots and an open space tract, subject to the fulfillment of requirements specified herein. Lucas Farm Road shall be irrevocably dedicated to the general public and constructed to standards of the North Carolina Department of Transportation. The approval of this resolution authorizes and directs the Orange County Manager to accept for Orange County and on behalf of the public generally, the offer of dedication of Lucas Farm Road. This acceptance by Orange County of the dedication to the general public of Lucas Farm Road shall be without maintenance responsibility. This road shall be maintained by the owner/applicant until such time as the North Carolina Department of Transportation or some other governmental body accepts it for maintenance. Before the Final Plat of Lucas Farm at New Hope can be recorded: A. Sewage Disposal Each residential lot shall contain an adequate area for septic disposal, and repair area, approved by the- Orange County Division of Environmental Health. 2. The septic system location may restrict the size and location of improvements. This disclosure shall be included in a document describing development restrictions to be recorded concurrently with the Final Plat. The document shall also disclose that information regarding the tentative location of septic systems is available from the Orange County Health Department, Division of Environmental Health. 3. Language shall be inserted into the Declarations requiring each lot owner to have the septic system serving their lot inspected by a licensee of the NC On-Site Wastewater Contractors and Inspectors Certification Board (the "Board"), who is properly registered to perform such inspections within Orange County, no less than one time in every five (5) year period (unless inspections are required more often by and rule or regulation of the Orange County Health Department) and to have the system pumped if recommended by the inspector. Payment for the inspections required under this condition shall be the responsibility of the individual lot owner or the homeowner's association as established by the governing Homeowner's Association declaration. 6 B. Roads and Access 1. Lucas Farm Road shall be constructed to standards of the North Carolina Department of Transportation, within a minimum 50-foot right-of-way with 5-foot utility easements on each side, and the construction shall be inspected and approved by NCDOT. OR A letter of credit or escrow agreement shall be submitted to secure construction of Lucas Farm Road to the standards of the North Carolina Department of Transportation. An estimate of the construction cost must be prepared by a certified/licensed engineer or grading contractor and submitted to the Planning and Inspections Department. The financial guarantee must reflect 110% of that estimate and be issued by an accredited financial institution licensed to do business in North Carolina. The document describing development restrictions to be recorded with the Final Plat shall state that the financial guarantee will not be released until the road construction has been inspected and approved by NCDOT. 2. All lots shall receive access from the internal subdivision road with the exception of the Open Space lot dedicated to Orange County. No driveway shall be permitted within 50' of a street intersection. The final plat shall contain a "No Vehicular Access Easement" for lots 5-9 of the subdivision abutting Old NC 86 and lots 1 and 9 abutting New Hope Road. 3. An erosion control plan for construction of Lucas Farm Road shall be submitted, by the financially responsible party, to the Orange County Erosion Control Division for review and approval prior to any land disturbing activity occurring on the site. 4. Approved double-bladed street name signs shall be erected at the intersection of Lucas Farm Road and New Hope Church Road prior to issuance of any building permit if road construction is not completed prior to recordation of the final plat. 5. Prior to any construction or alteration of any existing access within the right-of-way of New Hope Church Road, the owner/applicant shall secure a driveway permit from the NCDOT District Office. The owner/applicant shall submit a copy of the NCDOT-approved permit and NCDOT approval letter to the Planning Department prior to or at the same time as the request for a grading permit is requested, or before Planning Department signatures are affixed on the Final Plat, whichever is first. 6. Sight triangles (10'x 70') shall be shown on the Final Plat at the intersection of Lucas Farm Road with New Hope Church Road. 7. Show on the final plat, and dedicate in fee simple, twenty (20) feet of additional right-of-way, or 50 feet from the centerline of the existing right- of-way, whichever is greater, along the frontage of Old NC 86. 8. Show on the final plat, and dedicate in fee simple five (5) feet of additional right-of-way, or 35 feet from the centerline of the existing right-of-way, whichever is greater, along the frontage of New Hope Church Road. Said dedication shall meet major collector road right-of-way standards as identified in the Comprehensive Plan and required in Section IV-B-3-c-1 of the Subdivision Regulations. C. Land Use Buffers and Landscaping Landscaping shall be installed or preserved as indicated on the approved landscape plan, and shall be inspected and approved by the Planning and Inspections Department prior to signatures on final plat. No part of the landscaping shall encroach into the 10' x 70' sight triangles at the intersection. OR Guaranteed financially through a letter of credit or escrow agreement submitted to secure required landscape installation and preservation. An estimate of the cost for required preservation, plantings and their installation must be provided. The financial guarantee shall reflect 110 percent of the estimate and be issued by an accredited financial institution licensed to do business in North Carolina in a form approved by the County Attomey.~ Provisions for protection of existing trees as shown on the approved landscape plan shall be included in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. No clear cutting on individual lots is permitted pursuant to section IV-B-8-c of the Orange County Subdivision Regulations. 2. In accordance with Article 12.6 of the Orange County Zoning Ordinance a type E 75-foot buffer shall be maintained (i.e. left undisturbed) along existing Old NC 86. Language shall be provided in the Homeowners Association documents to the effect that clearing within the 75 foot buffer along existing Old NC 86 is not permitted with the exception of septic system repair areas. 3. In accordance with Article 12.6 of the Orange County Zoning Ordinance a type A 30-foot buffer shall be maintained (i.e. left undisturbed) along New Hope Church Road. Language shall be provided in the Homeowners. Association documents to the effect that clearing within the 30-foot buffer along New Hope Church Road is not permitted with the exception of septic system repair areas. 4. Common area landscaping trees and shrubs shall be of a native species and drought tolerant. D. Drainage 7 1. Drainage Easements shall be located on the final plat as required following review and approval of the erosion control plan by County staff. 8 2. Drainage culverts shall be sized and located appropriately by a licensed North Carolina Professional Engineer as required by NCDOT and Orange County Erosion Control. 3. Low Impact Design devices (LID) shall be incorporated into drainage-way to lessen the stormwater impact to the streams. E. Parkland 1. The open space dedication shall be shown and labeled accordingly on the final plat. The developer shall prepare a deed transferring, in fee simple, a total of 20.99 acres of open space (49.5%) to Orange County. The deed shall be recorded concurrently with the final plat with a copy of the recorded deed provided to ERCD and the Planning Department. This dedication will satisfy the public recreation payment-in-lieu requirement. F. Construction Waste 1. Per the Orange County Solid Waste Ordinance, clean wood waste, scrap metal and corrugated cardboard, and all construction waste shall be recycled. 2. All haulers of construction waste shall be properly licensed. Developer shall confirm that hauling contractors are licensed to haul waste in Orange County. 3. Prior to any demolition or construction activity on the site the applicant shall hold apre-demolition /pre-construction conference with the County's Solid Waste staff. This may be the same meeting held with other County officials. G. Miscellaneous 1. The Final Plat shall contain a title block and vicinity map in accordance with Section V-D-2 and V-D-3 of the Orange County Subdivision Regulations. 2. The open space not dedicated to Orange County shall be conveyed into the Homeowner's Association. Tree cutting in the 30-foot roadside open space is prohibited except for necessary maintenance purposes that have been approved by County staff prior to any such tree cutting taking place. The restrictive covenants applicable to the property shall be approved by the County Attorney. 3. If street lighting is proposed in the future, then a lighting plan shall be submitted to the Planning and Inspections Department for review and approval prior to the purchase of lighting fixtures from the utility provider or other vendor. All lighting shall meet the Outdoor Lighting Standards as set forth in section 6.31 of the Orange County Zoning Ordinance. 4. A sign permit shall be obtained from the Planning and Inspections Department for the subdivision sign located at or near the entrance of the subdivision prior to beginning construction. 5. Methods of disposal of trees, limbs, stumps and construction debris associated with construction activity shall be by some method other than open burning as stated in the Orange County Zoning Ordinance. 6. The correct PIN number for the property shall be labeled on the Final Plat. 7. Show on the final plat, and include in the declarations, the clearing limits on lot 4 that prohibits disturbance within the stream buffer. 8. The owner shall file, with the Planning Department and record with the Final Plat, a declaration of covenants and restrictions, articles of incorporation, where required, and/or by-laws, all as approved by the County Attorney, that will govern the maintenance and control of the improvements as set forth in Article III-E of the Orange County Subdivision Regulations. Said documents shall provide for ownership of open space and the dedication of easements to access open space, common area POSA's, drainage easements and buffers, for maintenance. The Owner has agreed that said documents shall not restrict the use of energy efficient measures, including but not limited to clotheslines by the lot owners, nor shall said documents require any lot owner to engage in water intensive lawn maintenance. D. Certifications 1. A Certificate of Survey and Accuracy signed by a Professional Land Surveyor shall be on the face of the Final Plat in the form provided in Section V-D-6-a of the Orange County Subdivision Regulations. 2. A Certificate of Declaration and Maintenance in the .form provided in Section V-D-6-b of the Orange County Subdivision Regulations signed by the landowner and developer shall be on the face of the plat and included in a document describing development restrictions to be recorded concurrently with the Final Plat. 3. The North Carolina Department of Transportation shall certify that the platted portion of Lucas Farm Road has been entirely constructed to State standards or if the road construction is secured by a Letter of Creditor escrow agreement, that construction plans have been approved prior to Planning Department signatures on final plat. 4. A Certificate of Approval signed by the Orange County Planning and Inspections Department and the Orange County Environmental Health Department shall appear on the face of the final plat in accordance with Section V-D-6-c of the Orange County Subdivision Regulations. 9 10 NOW THEREFORE BE IT RESOLVED by the Orange County Board of Commissioners that the Preliminary Plan for Lucas Farm at New Hope Subdivision is approved in accordance with the abovementioned conditions and attached Preliminary Plan dated July 9, 2008 as revised by surveyor Steve F. The Final Plat shall contain a title block and vicinity map in accordance with Section V-D-2 and V-D-3 of the Orange County Subdivision Regulations. 2. The open space not dedicated to Orange County shall be conveyed into the Homeowner's Association. Tree cutting in the roadside open space is prohibited except for necessary maintenance purposes that have been approved by County staff prior to any such tree cutting taking place. The restrictive covenants applicable to the property shall be approved by the County Attorney. 3. If street lighting is proposed in the future, then a lighting plan shall be submitted to the planning office for review and approval prior to purchase of lighting fixtures from the utility provider or other vender. Any lighting shall meet the Outdoor Lighting Standards as set forth in section 6.31 of the Orange County Zoning Ordinance. 4. A sign permit shall be obtained from Orange County for the subdivision sign located at or near the entrance of the subdivision prior to beginning construction. 5. Methods of disposal of trees, limbs, stumps and construction debris associated with construction activity shall be by some method other than Attachmerrt 2 15 open burning as required in the Orange County Zoning Ordinance. 6. The correct Parcel Identification Number for the property shall be listed on the Final Plat. 7. Show on the final plat, and include in the declarations, the clearing limits on lot 4 that prohibits disturbance within the stream buffer. H. Certifications A Certificate of Survey and Accuracy signed by a Professional Land Surveyor shall be on the face of the Final Plat in the form provided in Section V-D-6-a of the Orange County Subdivision Regulations. 2. A Certificate of Declaration and Maintenance in the form provided in Section V-D-6-b of the Orange County Subdivision Regulations signed by the landowner and developer shall be on the face of the plat and included in a document describing development restrictions to be recorded concurrently with the Final Plat. 3. The North Carolina Department of Transportation shall certify that the platted portion of Lucas Farm Road has been entirely constructed to State standards or that construction plans have been approved prior to Planning Department signatures on final plat. 4. A Certificate of Approval signed by the Orange County Planning and Inspections Department and the Orange County Environmental Health Department shall appear on the face of the final plat in accordance with Section V-D-6-c of the Orange County Subdivision Regulations. NOW THEREFORE BE IT RESOLVED by the Planning Board recommends that the Board of Orange County Commissioners approve the Preliminary Plat for Lucas Farm at New Hope Subdivision in accordance with the conditions referenced herein and the attached Preliminary Plat dated July 9, 2008 as revised by surveyor- Steve F. ERCD commented on two conceptual plans for this project in a memo dated Apn'I 22, 2008. In that memo ERCD suggested a preference for~the conventional plan, which would set aside 21 acres of Open Space for wildlife habitat and low-impact public recreational use. ERCD identified the following "conservation values" for the subject property: 1. The property is adjacent th a section of New Hope Creek that is recognized by the State of NC as providing habitat for aquatic spedes of state and regional significance. 2. The Orange County Comprehensive Plan recommends that this segment of New Hope Creek be protected as a permanent "Wildlife Corridor"' (330' on both sides of Creek). 3. Much of the proposed open space is within the 100-year floodplain 4. The northern 2/3 of the properly is identified in a 1999 inventory of prime forests suitable for native wildlife habitat (Triangle Land Conservancy). This hardwood Prime 1=crest has high conservation value, consistent with the proposed Wiidliife Coridor. 5. The existing Stanfield subdivision .(located north of New Hope Creek; across from the subject properly} has. a public trait easement along north side of New Hope Creek. The new Preliminary Plan (dated 7/9/08) appears tp.be consistent with the eaHier corcve~onal plan that proposed dedicating 21 acres of open space for public recreation/open spade pursuant to Section IV-B-7-b of the Subdivision Ordinance. The protection of this open space would heap iba implement the County's goals of pro'becting floodplains, wetlands, significant natural areas, and prime wildlife habitat. If the County were fio acquire this site, ERCD would recommend that only minimal (if arty) public faatities be constructed, such as a natural trail with interpretive signage and berxhes along New Hope Creek. signage would also be needed to help satisfy the notation on the Preliminary Plan stating that "Public access prohibited south of this line." Presenter: Eddie Kirk, Planner II Eddie Kirk: Reviewed Abstract. There are 20.99 that are going to be deeded to Orange County. Jay Bryan: I would like to make sure that the undisturbed 75 foot buffer begins on the outside of the right of way. Eddie Kirk: It will. Jay Bryan: Can it be stated. Eddie Kirk: Yes. Judith Wegner: I worry about the site distance for people coming out to New Hope Church Road because it's a downward slope. Steve Yuhasz: We did have the NCDOT examine this and they did approve site distance. It is generally eight seconds of visibility between the time you see a car and it gets to the location where you are. One of the things that was requested and will be done is to do some trimming of the trees along the right of way and within that site distance to make sure we maximize the visibility. Judith Wegner: That will help a lot of it. That's good. Jeffrey Schmitt: What are the depths of the wells? Steve Yuhasz: No idea. My experience is that one could be 200 feet and the next one could be 600 feet. Jeffrey Schmitt: We have seen information going from the northwest sector of the county which is the most prolific to the southeast section where you can hardly find water. 28 MonoN made by Judith Wegner to approve. On page 233, a.3, language shall be inserted into the Homeowner's Association declaration; there is no property that is going to be conveyed to anyone other than Orange County so there may be not be a need for a Homeowner's Association in a case where there wasn't a Homeowner's Association, I wouldn't want a condition of this kind that would require one to be created. Judith Wegner: Friendly amendment to my motion that language shall be inserted into the declaration striking the reference to the Homeowner's Association. Renee Price: Okay. Steve Yuhasz: On H.1, regarding the certificate of survey has not been required to be notarizes for over 10 years so the language needs to be taken out. Judith Wegner: That is something that the ordinance needs to change. Steve Yuhasz: That is a condition that would not be approved so we want to fulfill the conditions.
