M, on Monday, December 7, 1970, in the Commissioners Room at the Courthouse in Hillsborough, North Carolina. Members Present: Chairman Carl M. Smith and Commissioners Harvey D. Bennett, William C. Ray, Henry S. Walker, Ira 9. Ward and C. Norman Walker. Members Absent: None The Board adjourned to the Courtroom to witness the Oath taking ceremony far the three new Board members, the Sheriff, the Clerk of Court and the Register of Deeds. The minutes were read and approved by the Board after aorreationa were made in the minutes of the November 2, 1970, and November 17, 1970, meetings. Chairman Smith exnresaed to the Board members his appreciation for the cooperation and the friendship he had made during the past eight years as a member of the Board. He called attention to the speeoh that he had delivered ' in Chapel FIill relative to the growth and improvement which had occurred during ~ the past eight years and he suggested that the facts colleoted be used as e progress report and be inserted in the minute docket. Vice Chairman Walker presented tc Chairman Smith the following resolution: ' "WHEREAS, Carl M. Smith was nominated by the voters of Orange County to the Orange County Board of Commissioners in the Democratic Primary of May 1962, and WHEREAS, Carl M. Smith was elected by the voters of Orange County to the Board of County Commissioners of Orange County in the General Election of November, 1962, and WHEREAS, Carl M. Smith was again nominated in the Democratic Primary of 1966 and again elected in the General Eleatien of 1966 to the Orange County Board of Commissioners, and WHEREAS, Carl M. Smith was elected by his fellow County Commissioners as Chairman of this board in December of 1968 and has held this position continuously since that date, and WHEREAS, Carl M. Smith through his broad business experience and keen insight has shown to this board and to the people of Orange County the pathway towards better local government, and WHEREAS, in May of 1970 Carl M. Smith did not seek re-nomination to the Orange County Soard oP Commissioners but instead was nominated and later elected as a member of the North Carolina House of Representatives from Orange County. THEREFDRE, BE IT RESDLVED, that the Orange County Board of Commissioners, acting through its members Harvey D. Sennett, William C. Ray, Henry S. Walker, and Ira A. Ward, now takes this means of expressing to Carl M. Smith its sincere appreciation and deep gratitude for hie faithful service, able leadership, and progressive ideas, and it wishes him and his family every happiness is the years ahead. Let a copy of this resolution be presented to the said Carl M. Smith, a copy sent to the press, and the resolution be spread on the minutes of this meeting, this 7th day oP December, 1970." The County Administrator, in behalf of the Covilty employees, presented to Chairman Smith a silver trap which, had been engraved. Chairman Smith than recognized Norman Walker who would be repleaing him on the Board of Commissioners. Mr. Walker was seated with the Board. Ballots were given to members of the Board by the County Administrator and Commissioner Rarvey D. Bennett was elected to serve as Chairman of the Board Por a term of one year and Coxrmizsaioner Henry S. Walker was Bleated to serve as Vice Chairman of the Board for a term of vna year. Chairman Bennett welcomed Norman Walker as a member of the Board. Chairman Bennett then recognized Jahn T, Wilder who had been duly elected Hillsborough Township Constable in the November 3, 1970, General Election. Mr. W11der presented his certificate of office from the Orange County Board of Elections and a letter from the Ballard-Williams Tnaurance Agency certifying the Constable Bond 'of $1,D00.00 in favor of Orange County Board of Commissioners. Chairman Bennett then administered the oath of office to John T. Wilder. Y 60G'( ~ PACE 32~ Chairman Bennett then recognized Coolidge Porterfield, P3ceautive Secretary of the Orange County Houaing Authority. Chairman Bennett adjourned the Board of Commissioners and said meeting was re-convened as a Board of Commissioners for the Orange County Houaing Authority. Copies of the oaths of Commisaionera of the Oran.~e County Housing Authority are filed on pages 330 to 332. The origins].-oaths are filed with the Clerk of the Court. For other business of this meeting see minute docket of the Orange County Housing Authority. Chairman Bennett adjourned the Board of Commissioners for the Orange County -- __ Housing Authority meeting and said meeting was re-convened as a Board of County Commissioners. Chairman Bennett recognized Norman Long, Zoning Officer. Mr. Long stated that there was only one item of business for a public hearing. Discussion ensued relative to the items which had been presented by Mr. Long at the November meeting. Commissioner Ward inouired as to the request of Berini Brothers Investment Corporation and iP certain additional information had been filed with the County Planning Board, since the November meeting. Mr. Long stated that the percolation teat had been received. Commissioner Ward inquired of the County Attorney if the information could be received by the Board of Commissioners at this meeting. The County Attorney advised the Board that any information could be received, but that he wsa of the opinion any oral presentation should be made at a public hearing in order to allow the County Planning Board the advantage of the presentation. Marshall Spear a, Attorney for the Berini Brothers, stated that hie cl3enta wished to amend their previous reaueat for zoning and request that all property be zoned to a mobile home park area. Tt was agreed by the County Attorney and Mr. Swears that the Berini Brothers Investment Corporation would withdraw their 'current request and re-submit their application for re-zoning. The County Zoning Officer was req_ueated to schedule a public hearing for Monday, January 4, 1971, at 8 P.M. at the Courthouse in Hillsborough. The Board reviewed the following request for re-zoning: 1. Amendment to re-zone from a Residential District to a Mobile Home Park District, property located on the East side of State Road 1$6b and North of Highway 70 and containing 17.$3 acres. This property is located on Ptxo Township Map 22 Lot 89 and is listed in the name of Tad M, and Nancy Williams. The County Zoning Officer reported that the County Planning Board had recommended that the request of Ted M. and Nancy Williams to re-zone 17.83 scree in Eno Township b® denied. IIpon motion of Commissioner Ray, seconded by Commissioner Ward it was moved that the recommendation of the County Planning Board to re-zone 17.3 acres of property owned by Ted M. & Nanoy Williams from a Residential District to a Mobile Home Park District be accepted. Chairman Bennett Dolled for a vote. The following voted Aye: Chairman Harvey D. Bennett and Commissioners William C. 13sy, Henry S. Walker and Ira A. Ward. Commissioner Norman Walker abstained from voting as he did not feel he had the proper background information on the matter. 2. Amendment to rezone from a Residential District to a Mobile Home Park District, property located on the West aide of State Road 1716 approximately one- half mile South of Couch Road and aontaina eight aarea out of a twenty-two acre tract. This property is located on Chapel Hill Township Tax Map L} Lat 3$ and is listed in the name of W. Malcolm Hicks. The County Zoning Officer reported that the County Planning Board had recommended that the request of W. Malcolm Hicks to re-zone eight acres in Chapel Hill Township be approved. Upon motion of Commissioner Ray, seconded by Commisaicnera Henry S. Walker and Ira A, Ward, it was moved that the recommendation of the County P1anf-ing Board ,___ to re-zone eight acres of property owned by W. Malcolm Hicks in Chapel Hill Township from a Residents&1 District to a Mobile Home Park be approved. Chairman Bennett called for a vote. The following noted Aye: Chairman Harvey D. Bennett and Comtrd.saionera William C, I2ay, Benny S, Walker and Ira A. Ward. Amendment to re-zone from a Residential District to a f3eneral Commercial District, an area looated along the North side of highway 70 and in front of the above reaueat, and contains 2.62 acres. This property is looated on Eho Township Man 25, Lot 51~. and is listed to Berini Brothers Investment Corporation. The Zoning Officer informed the Board that this reouest had been withdrawn, but that it was his understanding that it would be re-submitted to the County Planning Board. ~. Amendment to re-zone from a Residential Diatriat to a Mobile Home Park Diatriot, 59 cares and to a Rural Commercial District 2 acres, loaated on the North aide of iQew Hope Road (State Road 1723). This prvperty is located on Chapel Hi11 Tax Map 10 and part of Lot 5 and is listed in the name of Ted Tillman. The Zoning Officer informed the Board that this request had been withdrawn, but that it was hie understanding that it would be re-submitted to the County j Flanning Bvard. li Chairman Bennett recognized W. W. Barkor who presented a road petition for SR 1127. Discussion ensued relative to said petition. ii IIpon motion of Commissioner Henry Walker, seconded by Commissioner Ira A. Ward, it was moved and adopted that the clerk forward said road petition to the State Highway Department. Chairman Bennett recognized Fred Cates, Mayer of the Town of Hillsborough. Mayor Catee stated that he had been in contact with the State Highway Department relative to securing an access road from I-8S into the West Hillsborough area ~ and he wished tv have the support of :the Board oP Commissioners in his efforts _ to obtain said road. Therefore, h® was r®auasting that the memo®rs of the Soard accompany him bn an inspection.tour of SR 11l~8. i Chairman Bennett advised the Soard that the Highway Coxranission had advised him that the Jack Phelps road had been scheduled for paving sometime in the ~• Doming pear. Discussion ensued relative to the road program for Orange County. Tha Clerk was directed to write Mr. Welsh and request that a point meeting be scheduled between representatives of the State Highway Commission and members of the Board for the month of January, 1971. Discussion ensued relative to prospective members. The County Administrator was requested to secure reao~endations for membership from Clarence Jones, Chairman of the Council. . .--_s---. .. ... ~ .. .~ BDDK ~ PAGE 32B Chairman Sennett read the eorreapondence received from the State Highway Commiiasion relative to the provisions of providing a walk area along Estes brine. Discussion ensued. The Clerk was directed to write the State Highway Commission advising the Commission that the Orange County Board of Commissioners did endorse the prevision that a graded out level walking area back of the curb be provided along Eaten Drive in Chapel Hill. Chairman Bennett read s letter of appreciation from the residents of Davis s Read. I I Discussion ensued relative to the routing of I-!}0 and as to whether or not the public hearing had bean held vn said matter. It was agreed that at least -~ one member of the Board should attend the public hearing. Upon motion of Commissioner William C. Ray, seconded by Commissioner Tra A. Ward, it was moved and adopted, that the Clerk advise Clifton Benson, Highway Commissioner, that the Orange County Board of Commissioners did endorse the routing of T-(~.0 through Crange County and that they wished to be advised as to the date, time and place of the proposed public hearing relative to I-L~.O. Chairman Benaett recognized the County Administrator who advised the Board that if they wished tv pursue the matter of a Local Salsa Tsa Election, then the Board must adopt a resolution revuesting the Board of Elections to call a special election. Discussion ensued as to the time required to call said election and a date for said election. It was suggested that the last Tuesday in February or the first Tuesday in March would provide the necessary time, if said election was passed, to begin the collection of the one cant salsa tax as of July 1, 1971. IIpon motion of Commissioner Ira 1A. Ward, seconded by Commissioner William C. Ray, the following Resolution was unanimously adopted: "BE IT RESOLVED That the Board of Commissioners of Orange County does, as provided by G.S. 10~-16l~..1+8, request the Orange County Board of Elections to call a special election for the purpose of submitting to the voters of Orange County the question of whether or not a one per cent local option salsa and use tax shall be levied." The County Administrator present®d a auestionaire from the Department of Local Affairs relative to the establishmen£ of a State Law Library System for each courthouse. It was suggested that the auestionaire be turned over to the County Bar Aasaciation for recotmnendations. No further cation was taken. Chairman Bennett presented a letter from the North Carolina American Revolution Bicentennial Commission. Said letter requested that the County appoint a County Committee who will work in conjunction with the State Committe® on the Bicentennial Committee. The Clerk was instructed to send a duplicate copy of the correspondence and the purposes and policies of the Commisaian along with a cover letter to the League of Women Voters, the County DAR Chapter, the Towns of Hillsborough, Carrboro, Chapel Hi11 and Mebane, the two Boards of Eduastion, the Hillsborough Historical Commission and the Chapel Hi11 and Hillsborough Historical Society. The County Administrator reported that the current contract far ambulance service would expire on December 37„ 1970, and that he had had no correspondence from the Durham Ambulance Service. He stated that when the Ambulance committee met with repreaentativea of the Town of Chapel H311 it was indicated that some money, from the town, would be made available for ambulance service, however, the town had requested a proposal from another ambulance operator who was interested in providing service for the Southern end of the county. Mr. Gattis stated that upon receipt of these proposals a joint meeting would be scheduled between the Board of Commissioners and the towns of Chapel Hill and Carrboro. Chairman Bennett read a letter from E. II. Bane, resident of Dogwood Acres Sanitary District. Said letter objected to the special tea being imposed by the Sanitary Diatriat upon residents of the area. The Chairman requested the County Administrator to explain how the sanitary district was created. Mr. Gattis presented the legal requirements which had to be met before the district was established. Chairman Bennett requested that Mr. Gattis answer Mr. Banes letter. Chairman Bennett recognized the County Attorney who advised the Board that under G.S. 18-13 any tea paid liquor, which was confiscated by the Court, automatically bsoomes the property of the County and that the Board of Commissioners _~ do have the authority to dispose of the whiskey. Discussion ensued. aaoK ~ PAGE 327 The County Administrator brought to the attention of the Board that the `ABC stores often received whiskey which had been damaged in shipment and that this damaged merahandiae could not be utilized for sale and that he felt that this would be a better source of supply for Dc. b4ai.ng rather than the confiscated court liouor, in that, the lieuor seized by the court was in most cases only a small amount. Mr. Gattis was instructed to review the matter with the proper ABC authorities to see if the ABC Board had the authority tv turn damaged merchandise over to medical research. Upon motion oP Commissioner William_ C, Hay, seconded by Commissioner Ira A. Ward, it was moved and adopted, that the Sheriff be authorized to turn all confiscated alcoholic beverages over to the Center oP Alcoholic Studies sa requea.ted by Dr, John Ewring. The County Attorney advised the Board that the State Building Code would be automatically effective in all counties of the State. That the State Code did exempt apartment buildings and private dwellings, however, the Board could adopt a local Ordinance which would include apartment buildings and private dwellings, The County Administrator was reouested to investigate the cost factor involved in the administering of the code. He was reouested to include inspection fees and permit spate in his report to the Board. Presentation made by Chairman Carl M. Smith on November 21}, 1970, to the Chapel Hill $iwanis Club. Contained herein is information relative to the progress of Orange County during the past eight year a. Tt is good to appear again before the Chapel Hill giwanis Club. Gray has asked me to talk to you about Orange County. This I am glad to do, because we live in a time of so many tensions and hatreds that one seldom considers the progress being made about him. From the stories you read ,in the papers, you would know some oP ovr problems, many real and a few imagined, and the intentions of so mang misdirected local pressure groups but you would not know the exoitement, the growth, and the vibrancy that is Orange County. I asked for some reports such as highway, register of deeds, election board, many others would be impressive such as health, mental health, welfare, etc. In December 1962, after going through the usually trying Orange County political proaesaea, I started my first term as Orange County Commissioner :`. and while I know it is hard to keep statistics interesting, I.thought I would talk to you about what happened in your county during this eight year period. ~ Let me hasten to say that I certainly am not taking credit for these impressive accomplishments but do have a sense of pride at being a party to them. Let me start by saying that Orange Count is fiscally sound and thus enjoys i a good credit rating. Its annual budget is $},759,005 up from $2,189,095 i in 1962. The last census figures show that our county was second in the State to Cumberland in the percent of our increase which was 33.6. Chapel I Bill was first among the aitiea with a population of more than 10,000 by jumping up 59.6, Our total valuation during this period increased by 105 I from $10L~.,1~.06,000 to $214,500,000. During 1961, property was revalued under State Law and our valuation in that year went up 33`g. Thus starting with a j tax rate oP $1.10 in 1962, we were able to drop this to 90¢ in 1965, due to the revaluation and for the aurreat year, we are levying $1.20 ar an increase in the tax rate of 9~ over a 9 year period. Revaluation must be done every eight years and we are scheduled Por this in 1972. .~-- 1. ~` Since one oP my major interest has been in our public schools, let me ~ tall you what has happened here. Student enrollment in the county has increased 20~ during this period and the rate of increase is now slowing down. We have increased our current expense appropriation from $38 per child to $88 par child or an increase of over 130, ~In addition, we have increased ~ our annual appropriation for capital outlay from $500,000 to $1,DOD,000 or 100, In 1967, a $3,000,000 bond issue was passed in this county Por school capital outlay purposes. In addition, the people of Chapel Hill increased ', their local supplementary tax for schools from 20~ to 35¢ and this together with the property valuation increase of 113 in Chapel Hill resulted in an ~, increase per child from $29.58 to $95.$0 or over 222, ; . i On November 8th, 1966, the voters in this county approved a $650,000 ~" bond issue. In 1967, we spent over $!{.00,000 to provide water and sewer ' facilities for an industrial park in the west-central part of the county ~ near Mebane. This principal plus interest is scheduled to be repaid to Orange County by Mebane who will than own the lines and the water tank. This has ~-- already attracted some industry within the pork and some near by vn these same facilities. Additional ones are expected very soon. Alav, in 1967 at a coat of approximately $272,000 Lake Orange was built. From a gift of 200 acres by seven civic minded families who retained the recreation rights, the county built s 150 acre lake behind a 45 foot dam. This lake with a watershed of 6,500 sores has a reservoir of 500,000,000 gallons of water with a daily draw of !1.,000,000 gallons. This is a tremendous asset for the county and before it was filled the drought of 1968 hit and this water was used to maintain the Hillsborough water supply. Dn two recent occasions, water from this reservoir has been released to augment stream flow for ecological purposes. This coming year the county plans to build the first of three sediment structure a, as ; . BOG'f ~ PAGE 32a ~•• recommended by the U. S. Soil Conservation Service, to control Puture silting. Aa great as this asset is, the oounty is working on additional reservoirs for the future so that Orange County will not be caught with ton little acceptable water as is common place in so mush of the world. Along the same line, during this period, we put $100,000 Into enlarging the sewer line to the new Chapel Hi11 high School so that the area between the Town and the High School could be developed properly; we put $27,000 into enlarging part of the water line for orange-Alamanca Water System so that the beat use could be made of this system for both residential and industrial growth as well as adequate - two-way flow aonnectiona to neighboring systems; and we put $28,000 into enlarging _ -- the water line for Hillsborough so that future growth oould be served along with industrial growth that might come. These advances should prone to be good economy for the oounty in the years ahead, r- ~ - Tn 1967 Chapel Hill Township was zoned and in 1970 Sno Townahin was coned. We now have dedicated citizens of Orange serving vn the County Planning and Adjustment Boards and doing a very fine ~vb. The value to the county of their efforts will b® seen in the future. Several. pieces of land were acquired during this period to take sere of the expansion of oounty services. On these in 1968 we built a County Health Building at a cost of $123,000. In 1969, we built a County Sooial Services Building at a coat of $2!}3,000 to house the rapidly expanding program of this department. The coat of this building will be paid back by the federal government through monthly payments. I hesitate to mention the rapid growth of our "welfare" program but it is now Weak and neck with public education, each being about 11.5 of our total budget, and will soon move ahead. Time does not permit my going into mush detail about many of your oounty agencies but I would like to cotmnent on our register oP deeds office which is recognized as having one of the most progressive and modern offices in the State. This office is headed by Misa Betty June Hayes, who was recently Tar Heel of The Week, and is a past presideat of her state association and in 1969-1970 served as President of the National Association of County Recorders and Clerks. Revenues have increased from less than 2017 to almost l}217 in the last six years. Some highlights of the past eight years include on November 1, 1969, the converting of all records to 16mm microfilm. This resulted in a savings from over $1 per document in the old deed yr deed of trust books down to less than 1~ per document. The cartridge miorofilm is viewed through r~}'1.~00 Reader Printers of which the county now owns four. All vital statistics: births, deaths, and marriages have bean placed on 16mm - film for the purpose of saving storage space. There are about 80,000 of these vital statistics and they are contained on L~.2 cartridges. A11 plate have been placed on 35mm aperture cards and these cards are viewed through a #200 Reader Printer. It is estimated that this change of recording method will add 100 years of recording space to the Register of Deeds Office. The total cost of converting all records to film was about $]1.,200 as compared to the construction of a new vault which would have cost at least $lOD,000. Also, as of November 1, 1969, a data processing system of indexing of deeds and deeds of trust and all related instruments was instituted. Upon receiving a print out this new system will alphabetize all surnames and group together in one place all the transactions of a given individual and/or company. The new indexing system contains a brief description of the property being conveyed and upon completion oP the tax mapping in the county, the Register of beads is hopeful of being able to tie each land transfer in with the tax man number. There has been a complete survey of marriages from 1911 through 196(}. The Register of Deeds has created a master index[ for all brides. Heretofore, it was impossible to locate the name of the bride unless you knew the name of the groom. This at times caused problems in the search of this record. If the woman had re married her former record could not be located. New master indexes were also created for the grooms. The reason for this survey being that the office had no record of licenses which had been issued but which were not returned. There was no way that you could prove that the couple had secured a marriage license. The license stub books for the stated period were located and the survey was made from these stubs against the original license. There has also bean created an index far all minutes of the Orange County Board of Commissioners for the period of 1951} through the current date. This is an invaluable regard, in that, items can ba located by subSact. Prior to the creation of this index book you had to read each set of minutes in order to locate the needed reference. Upon transfer of the Corporate Charter records from the Clerk of Courts office there was created a master index for all corporate records and related instruments. No index had existed prior to 196$ except in the front of each Corporate Charter Book. J BOOK ~ PACE S29 During the past eight years the Orange County Board oP Commissioners have endorsed legislation which has resulted in a State Uniform Fee Bi11, @uelification of Notaries, authvritq for the Register of Deeds to sot as a notary public and to administer oaths, the aaceptanae of out of state phyaiaal examination for marriage applicants and other legislation which was being proposed by the North Carolina Register of Deeds Asaooiation. ' !"' The Register of Deeds quarters were enlarged as were the Clerk of Courts, Sheriffs, Tax Collectors, and a new court room was completed for - the expanded court system. Quarters for the full time registration bq the Board of Elections was provided as was apace for many other a. 2 am not sure that the people of this county fully realize the advantages of fill time registration with its loose leaf booklets and its permanent sgatem which was added during this peripd. The State Board of Elections has been very complimentarq. New programs such as the Community Action Agency with its mgriad of activities, the Mental Health Association from which you well could have an entire program, the Human Relations Council, and too many others to list were added during this period. Two fire districts which later were taken into the Town of Chapel Hill and ono west of Carrboro were established. Of interest to everyone should be the road programs during this period. The State either by contrast or with their own crews on about 37 miles did about'$3,000,000 of work; such as, the work on East Franklin Street and the Airport Road, the widening of 15-501 at Eastgata, the paving of some streets in Hillsborough and Mebane, the establishing of a truck weighing station on I-85, the improving and paving of NC 86 from near New Hope Church to 2-85 and from US 70 tp the Caswell County line, and the resurfacing of two sections oP primary and eight sections of secondary roads. The County Commissioners were slightly involved in the rest oP the programs which spent about $3,500,000. This aoasiated of the secondary road program ($2,217,615 over eight years), and Governor Moores Bond Pro,jeata ($971,100 over five pears} which together paved 112.75 miles and stabilized far future paving another !}.2.75 miles, the addition of about 21 miles to the secondary system at a cost of $35,000, the fixing of access roads to public schools at a coat of $238,332 and access roads to industry at a coat of $31,000, and the establishing of signals at intersections at a coat oP $35,830. This is a grand total pf $6,500,000. For your information, the 2¢ per gallon gaaoline tax will permit the same amount of work to be done annually as was done with stat®-wide bonds issued during Governor Moores term. The state spends about $275,000 per year. Moores bonds about $195,000 per year. This is about $195,000 per year to go with the Status regular annual expenditure in Orange of about $275,000. On the horizon and of keen interest to you is the improving of Hi hway 5)L from Graham to the Carrbaro bq-pass, the four-lancing of Highway 5~ from Orange County to the Research Triangle Park, and the coming of Interstate !}0 aaroas Orange County from near Hillsborough to the Research Triangle Park and an to I-95 near Smithfield. It has been my proud pleasure to serve during this peripd with Commisaionera Donald Stanford, Gordon Cleveland, Henry Walker, Harvey Bennett, William Ray, and Ira Ward.
