NC General Statutes regarding CJPP and JCPC PURPOSE: To establish the Criminal Justice Partnership Program Advisory Board and the Juvenile Crime Prevention Council as a separate entity of the Orange-Chatham Justice Partnership. BACKGROUND: Orange County receives funding from the NC Department of Correction to implement the Criminal Justice Partnership Program (CJPP). These funds are used to provide services for adult offenders. The County also receives funding from the NC Department of Juvenile Justice & Delinquency Prevention (DJJDP) to implement the Juvenile Crime Prevention Council (JCPC). These funds are used to provide services for juvenile offenders. The Leadership Council of the Orange-Chatham Justice Partnership has served as the official CJPP and JCPC. Commissioner Moses Carey, Jr. has served as the co-chair of the Leadership Council since its inception. Commissioner Carey has been involved with the implementation of CJPP and JCPC programs since 1995. The mission of the Leadership Council is to promote a spirit of cooperation through the development of community-based policies and programs that seamlessly prevent and address court-imposed sanctions and treatment needs of offenders, their families and communities in the interest of public safety and community well-being. Within the Leadership Council, are the adult and juvenile sub-committees that have been responsible for: • Assessing the needs of juveniles and adults involved in the local criminal justice system; • Recommending funding for community-based programs; • Identifying gaps and proposing strategies for improving the local criminal justice system; and • Monitoring and evaluating programs to ensure compliance. Both sub-committees meet monthly, have developed by-laws, and work to fulfill the state mandated requirements. Last year, the Leadership Council approved a request to allow the adult and juvenile committees to function as the official CJPP Board and JCPC Board respectively. By doing so, this would allow the boards, who actively conduct the mandated requirements, to make funding recommendations directly to the county commissioners. These boards would continue to advise the Leadership Council on juvenile and adult offender concerns in the community and have a representative on the Council. The Leadership Council also agreed to meet on an as needed basis with a focus on educational topics. Attachment 1 includes the recommended members to serve on the CJPP Advisory Board and the JCPC for Orange County. These individuals have been regularly participating on the sub- committees and have the expertise to fulfill the requirements of the board. (Note: Commissioner Carey is not included in the appointments since his term as County Commissioner will end on December 1, 2008.) FINANCIAL IMPACT: None RECOMMENDATION(S): The Manager recommends the Board establish the Orange County CJPP and JCPC and appoint the list of recommended individuals for the indicated positions and terms. Juvenile Crime Prevention Councils. § 143B-543. Legislative intent. It is the intent of the General Assembly to prevent juveniles who are at risk from becoming delinquent. The primary intent of this Part is to develop community-based alternatives to youth development centers and to provide community-based delinquency and substance abuse prevention strategies and programs. Additionally, it is the intent of the General Assembly to provide noninstitutional dispositional alternatives that will protect the community and the juveniles. These programs and services shall be planned and organized at the community level and developed in partnership with the State. These planning efforts shall include appropriate representation from local government, local public and private agencies serving juveniles and their families, local business leaders, citizens with an interest in youth problems, youth representatives, and others as may be appropriate in a particular community. The planning bodies at the local level shall be the Juvenile Crime Prevention Councils. The council includes the local school superintendent(s), a chief of police, the local sheriff, the district attorney, the chief court counselor, the director of the area mental health, developmental disabilities Search and substance abuse authority, the director of the county department of !la^Yxc~u~ social services, the county manager, a substance abuse professional, a ~~..p..+w member of the faith community, a county commissioner, two persons under vYV1rW.~~$'~ the age of 18, a juvenile defense attorney, the chief district court judge, a member of the business community, the focal health director, a representative from the United Way or other nonprofit agency, a representative of a local parks and recreation program and up to seven members of the public to be appointed by the county board of commissioners. The statute allows for some of the listed public agency heads to designate a representative from their agency for the council. Each year, the JCPCs conduct a planning process which includes a review of the needs of juveniles in the county who are at risk of delinquency or who have been adjudicated undisciplined or delinquent and review the resources available to address those needs. The Councils then prioritize community risk factors for youth, for families and for the community and determine the services needed to address those problem areas. The councils develop and advertise a request for proposal process and submit a written plan of action for the expenditure of juvenile sanction and prevention funds to the board of county commissioners for its approval. In addition, the JCPCs evaluate the performance of programs for juveniles and the services they provide, work to increase public awareness of the causes of delinquency and of strategies to reduce the problem, develop strategies to intervene and appropriately respond to and treat the needs of juveniles at risk of delinquency and provide funds for services for treatment, counseling, or rehabilitation for juveniles and their families. D]]DP Regional Consultants from the Prevention/Intervention Division provide technical assistance and support to each Juvenile Crime Prevention Council, to county government for juvenile justice planning and fiscal management and to local programs for program development and compliance with operating and performance standards. The Intervention and Prevention Division state office provides overall program planning and management to assure uniform service standards, coordinates and provides training and consultation for local staff, collects data, responds to legislators' and other requests for information or recommendations, and develops policies and procedures for the Division. The Department of Juvenile Justice and Delinquency Prevention through the Intervention Division, manages aid to county funds allocated from the North Carolina General Assembly for county government development and continuation of local juvenile justice programs as planned and recommended by the Juvenile Justice Crime Prevention Councils. http://www.ncdjjdp.org/jcpc/general_statutes.html 11/7/2008
