Today, the Director of Human Rights and Relations, Annette Moore, informed me
that she had received notification from HUD on Monday, September 27, 1999.of a
Second Amendment to our HUD FFY'99 Cooperative Agreement. The Cooperative
Agreement allocates funding to the County for enforcement of fair housing in Orange
County. On September 29,.1999, as is our custom, Annette contacted HUD to inform
them that the BOCC could not act on this item until the next BOCC meeting, and.
requested an extension to October 6, 1999. The HUD representative denied the request
and indicated that the agreement had to be signed by September 30, 1999, or the County
would Iose $53,500.
The amendment is a continuation of our original agreement with HUD, signed in
1995, and does not change the original agreement. I am requesting that the item be
placed on the consent agenda tonight for the Board consideration, so the County does not
lose the .$53,000. I will send correspondence to HUD, this week outlining the time line
for approving contracts and I hope that this situation does not occur in the future.:

PURPOSE: To consider approving an amendment to the Cooperative Agreement between Orange
County and the. U. S. Department of Housing and Urban Development (HUD) for services performed as a
Capacity Building Agency during FFY 99.
BACKGROUND: On September 29, 1998, the Boazd of Commissioners approved a Cooperative
Agreement with HUD for the period beginning the first (1~ day of October 1998 to the thirtieth (30`x) day
of September 1999. On May 20, 1999, HUD amended the Cooperative Agreement proposing that
Capacity Building Agencies funded at $115,000 in FY'99, instead of $100,000.. On the. September 27,
1999, the Department of Human Rights and Relations received a "Second Amendment -Cooperative
Agreement FY' 1999", from HUD proposing funding in the amount of $53,500 for the FFY beginning
October 1, 1999.
FINANCIAL IMPACTS This amendment would authorize the County to receive of $53,500, for
enforcement of Fair Housing activites in Orange Counties.
RECOMMENDATION(S): The Manager recommends that the Boazd approve the amendment and
authorize the Chair to sign the amendment.

We have enclosed five copies of the HUD Form 1044 for the 2nd Amendment to the
FY'99 Cooperative Agreement for your immediate execution. Please sign each copy. with
an original. signature. After the documents have been. signed by the appropriate
authorizing official, please retain one copy for your records and return the remaining four
copies to this office by overnight mail. along with a HUD Form 270 for the full amount
indicated below. The funding for this Amendment includes:

Training: $18,000.00

In addition, we have enclosed a checklist with this letter.. Please complete the
checklist by placing your initials in the appropriate space. By placing your .initials in the
appropriate space, you certify that you have submitted the information to HUD, or have the
information in your possession to support: processing of the current voucher. Failure to
submit the documentation along with your voucher will. result in the denial of payment, and
potentially, the loss of those funds appropriated for your agency. -~
