The Bo'erd of County Commissioners of Orange County met in regular session
at 10 o~clock A,M, on Monday, April 6, 1970, in the Commissioners Room at the
Courthouse in Rillsborough, North Carolina.
Members Present: Chairman Carl M. Smith and Commissioners Harvey D. Sennett,
William C. Ray, Remy S. Walker and Ira A. Ward.
Members Absent: None
Minutes of the previous meetings were read and approved.
Norman Long, County Zoning Dfficer, advised the Board that he currently had on
file three renuesta for re-zoning in Eno Township and that the Planning Board had
three amendments to the Zoning Ordinance which must be submitted to a public hearing.
The public hearing was scheduled for Tuesday, April 28, 1970, at 8 P. M. in the
Courtroom at the Courthouse in Hillsborough, North Carolina.
Wiley Perry delivered to the Board a letter signed by Sune Grumpier relative
to the property tax assessment on the Orange-Alamance Water Systems, Tna. Chairman
Smith referred the letter to the Tax Supervisor and advised Mr. Perry that the
matter would be placed on the agenda of the Board of Equalization and Review.
The matter of a feasibility study far sewerage services was raised and the
County Administrator reported that L. A. Alley, Engineer, had agreed to conduct
the survey for $4,1FOO.CO plus publination coat. The County Administrator further
stated that the Research Triangle Regional Planning Commission had reviewed the
scope of the survey and had found same to be satisfactory. Chairman Smith appointed
Commissioner Ward, Conmiisaioner Ray and the County Administrator as members o£ a
Committee to investigate the q..ueation of the feasibility study. Chairman Smith
reouested that the Committee make a report at the May meeting.
Donald Roberts, Chairman of the United States Department of Agriculture Civil
Defense Committee, requested the Board tv appoint a Civil Defense Director.
Discussion ensued. Commissioner Rap advised the Board that Burch Compton, former
Civil Defense Director, had agreed to accept this position on a temporary basis and
that Gladys Bunker had agreed to serve as Assistant.Civ31 Defense Director.
IIpon motion of Commissioner Ward, seconded by Commissioner Walker, it was
~- moved and unanimously adopted, that Burch Compton be appointed as Civil Defense
Director for Orange County, and that Gladys Bunker be 'appointed to serve as
Assistant Civil Defense Director.
Chairman Smith reported that he had mat with a representative group on Saturday,
April L~., 197D, at the Boliday Inn in Chapel Hill, North Carolina, for the purpose
of discussing the creation of a Council of Governments. He stated that he would
keep the Board informed as to the results of any future meetings.
The County Attorney advised the Board that the 1969 General Assembly did amend
the General Statutes by providing that the Board of Adjustments could have as many
members as the County Board of Cotrmiiasionera desired to appoint. The only
exception being that each area zoned must have representation on the Board of
Adjustment..
The County Zoning Officer advised the Board that the term of George 7enkina,
member of the Board of Adjustments, expired o,n February 28, 1970,
Upon motion of Conaaisaioner Ray, seconded by Commissioner Walker, it was
moved and unanimously adopted that Marshall Link be appointed as a member of the
County Board of Adjustments £or a term of three years beginning as of April 6, 1970,
and that George Senkins be re-appointed as a member of th® County Board of
Adjustments for a term of three years to be reatroactive to the expiration data
of his previous term.
Chairman Smith announced that the public hearing scheduled for 11 o~clock A. M.
had been cancelled because of some technicality involving the legal requirements
relative to advertising. The Chairman directed the County Attorney to re-publish
the advertlaement with the announoement that the public hearing, relative to an
abandonment of a road, would be scheduled Por Monday, May 1{., 1970, at 11 o~alock A.M.
Vpon motion of Commissioner Ray, seconded by Commissioner Walker, it was moved
and unanimously adopted that Daniel Brady, David Hook and Dempsey Whitted be
appointed to the Orange County Human Relations Council.
Petitions for Secondary Road x'131-1.3 and Secondary Road #1330 were presented
and the Clerk was requested to forward same to the State Highway Commission.

Chairman Smith read a letter from the Cedar Grove Raritan Club relating to
the improvement needed on certain roads in the Cedar Grove area. Aiacusaion ensued.
The Clerk was directed to forward this correspondence, along with the two road
petitions, tv the State Highway Commission.
Dr. O, David Garvin, District Health Officer, preeented a report on the
activities of the Health Department and a report on the agency concerned with
administering home health sere and other needed services to the aged and infirmed
of the Chapel Hill area. Chairman Smith requested Dr. Garvin to keev the Board
advised of the progress of both agencies.
Chairman Smith stated that he had been advised, by the Orange County Planning
Board, that the request of C, P. Buckner to re-zone, Prom a residential area to a
rural commercial area, a small tract of land on Mt. Carmel Road had been approved
by the County Planning Board on the basis of a three to one vote.
Chairman Smith recognized John T. Manning, Attorney at Law from Chapel Ai 11,
North Carolina, who spoke in opposition to the proposed re-zoning of the C. P.
Buckner property.
Chairman Smith then recognized Eddie Williams of Chanel Hill, North Carolina,
who spoke in favor of the reouest for re-zoning as submitted by C. P. Suclmer.
Discussion ensued.
Upon motion of Commissioner Ward, seconded by Commissioner Bennett, it was
moved and unanimously adopted, that the recommendation of the County Planning Board,
relative to the re-zoning of the C. P. Buckner property, be denied.

-f~~ A document entitled "Memorandum of Understanding Between Orange County, Orange
Soil sad Water Conservation District; and the United States Department of Agriculture
Soil Conservation Service" was preeented to the Board by the County Administrator
for their aavroval and signature.
Chairman Smith stated that the Soil Conservation Service would conduct preliminary
tests of the suggested water storage site in order to establish the suitability of
said site and that the exploration would be expensive and the Conservation Department
would be unable to proceed w3,th the tests unless the memorandum was duly executed.
The County Attorney stated that the memorandum specified the responsibilities which
moat be asslaued by both the County of Orange and the United States Department of
Agriculture Soil Conservation Service, however, the axeaution of the contract would
not be valid if the County decided not to proceed with the survey project.
Unon motion of Commissioner Ray, seconded by Commissioner Bennett, it was moved
and unanimously adopted, that Chairman Smith be authorized to sign the memorandum
entitled "Memorandum of Understanding Between Orange County, Orange Soil and Water
Conservation District; and the United States Department of Agriculture Soil Conservatien ~~~~
Service".

Two petitions for the naming of atreeta outside the City Limits were submitted
to the Board by the County Administrator. Mr, Gattis explained that the need for
establishing a name for each of these streets was pursuant to the extension of
city delivery service, because postal regulations requires that each street be
named and cash house be numbered, The property owners on County Road ~'llsl.F were
petitioning that said road be designated as Oak Road and the property owners on
County Road x'1152 were petitioning that said road be designated as i4cAdama Road,
Mr, Gattis stated further that the Rillsborough postmaster had advised him that
if these atreeta were duly named, by the County, then city mail delivery would
be instituted in the area, .
Upon motion of Commissioner Rey, seconded by Commissioner Ward, it was
moved and unanimously adopted, that Secondary Road #I1$(.~. be named Oak Road and
that Seaondary Road X11$2 be named Mc4dama Road,
The Clerk was renuested to advise the Hillsborough Postmaster and the State
Highway Cotrnnieaion of the action relative to the naming oP the two seoondary
roads,
A request for the Carolina Union to hold a fireworks display in Chapel Rill
on Saturday, May 2, 1970, was submitted to the Board,
Upon motion of Commissioner Bennett, seconded by Commissioner Ward, it was
moved and unanimously adopted, that a permit be issued to the Carolina IInion
on the condition that the fireworks display would be held under the supervision
of some member of the Chapel Rill Fire Department,
Chairman Smith directed the County Administrator to advise the head of each
department that due to the death of Judge Leo Carr the Courthouse would be _
closed from 10 o~clock A. M, until 1 o~alock P, M, on Tuesday, April 7, 1970,
Chairman Smith advised the Board that, by way of letter, the Health Planning
Council for Central North Carolina unanimously endorsed the nomination of Dr,
William J. Cromartie, i4rs, Frances Taylor and Dr. 0. David Garvin ea members of
the Board of Directors representing Orange County, These appointments will ba
effective for terms ending June 18, 1972, i
Chairman Smith filed the following items with the Clark:

Thera being no further business to come before the Board the meeting was
adjourned to meet again on Tuesday, April 28, 1970, for a joint meeting with the
County Planning Board,
