BOARD OF COMMISSIONERS
January s, 1970
The Board of Commiasionera of Orange County met in regular session on
Monday, January s, 1970, at 10:00 o'clock A.M, in the Co:maiasconers Room at
the Courthouse in Hillsborough, North Carolina.
Members Present: Chairman Carl M. Smith and Commissioners Harvey D. Bennett,
William C. Ray, Henry S. Walker and Ira A. Ward.
Members Absent: Nape
Minutes of the previous meeting was read and approved.
Commissioner Ward reported that the North Carolina National Bank had oPPered
the use of a office facility for the License Examiners Office, which building is
located in Carrboro, at no coat to either the County or the City. Mr. Ward
stated that he assumed that this arrangement would last until such time as the
bank needed the office space.
Chairman Smith recognized Mra. Lana Moore and representatives of the
Hillsborough Historical Society. Mrs. Moore stated that the group had learned
that the County wee proposing to cut two hemlock trees which are located in front
of the old courthouse. Mrs. Moore asked why the trees were to be removed.
Chairman Smith stated that he had no knowledge of such a proposal and then requested
the County Administrator to explain the actuation to the members of the Board
and to the representatives. Mr. Gattis stated that the trees were blocking the
view of the colonial building and that one of the trees had grown to such a height
that it cnterferred with the flagpole and that he had considered replacing the
hemlocks with another type of tree. Discussion ensued relative to the advantages
of retaining the hemlocks. Chairman Smith advised the repreaentatcvea that the
Board would look into the matter.
Cache Boggs, Dog Warden, submitted reports on the dog program for the years of
1967, 1968 and 1969.
The County Administrator introduced Joseph Ward, Route 1, Mebane, North
Carolina. Mr. Ward stated that in 1961 he obtacned a loan from First Savings &
Loan Association in Mebane and that the Savings & Loan 9asooiation paid the 1961
taxes and that he had assumed that the Savings & Loan Association was paying his
County tales until he received his 196q tax bill. He stated that the penalty
and interest on his taxes amounted to $1,?1~.9.66. He requested that the Board
remove a portion of the percentage oP penalty from his tax bill. Discussion
ensued relative to Mr. Ward's reason for not paying his taxes. Chairman Smith
advised lax. Ward that the Board would take cation bn his request and notify him as
to their decision.
-._ - 'Wiley Perry, representative of the Orange-Alamance Water Syst®m, Inc, and
Lawrence Alley, Engineer, ware recognized by Chairman Smith. Mr. Perry stated that
the Orange-Alamance Water System, Inc. wanted to conduct a feasibility study of
sewerage needs for the Efland-Cheeks community, but the funds for such a study
ware not available from the Orange-Alamance Water System, Inc. He requested that
the County assist in this project by making available the funds for said survey.
Chairman Smith inquired of Mr. Alley the approximate cost figure for said survey.
Mr. A11ey stated he would estimate the approximate coat far said study, to be
$L},500.00. Chairman Smith advised Mr. Perry that the Board must consult with the
County Attorney relative to statutory authority before any decision could be

reached.
C. W. Davis, Orange County's representative on the Resource & Conservation
Development Commission,invited the members of the Board and their wives to attend
a Commission dinner meeting which had been scheduled at Elon College on Monday,
January 12, 1970.
Marshall Cates, Chairman Orange County Board of Elea tiona, presented a
"Voter's Handbook" to each Board member. A review of a pertain portion of the
book was undertaken. Discussion ensued relative to the residency requirements
for students. Chairman Cates explained the Election Board's position relative
to this requirement and said that difficulties were encountered beaauae this
was an individual choice of the student as to whether or not he considered Orange
County as his resident county. Mr. Cates thanked the Board of Commissioners for
their cooperation cn establishing the Eleatcon office and for the aonaideration
given to other areas relative to the election office.

C. W. Davis brought to the attention of the Board that project ,101 as
included in the Resource & Conservation Development Commissions program wee a
sewerage proposal for the area Weat of Hillsborough. Mr. Davin stated that the
purpose 3n oalling this to the Board's attention was to inquire if the Board
wished to change the priorities as established in the Resource & Conservation
Development program. This would mean that the project which involved the
reservoir on Seven Mile Creak could b® placed below the sewerage project thus
allowing the sewerage project to become a priority project. The Board informed
Mr. Davis that they had no desire to change the priorities o#' the Resource
Conservation & Development's program.

Coolidge Porterfield requested that the Board designate a day meeting in
order that they might inspect various Public Rouging Authority Projects. Saturday,
January l7th was designated as the day for said Public Rousing Authority meeting.
Chairman Smith read a letter from Lester C. Lemon of 79 Ramilton Road,
Chapel Hill, North Carolina. Mr. Lemon was requesting that the late fee charged -
against his personal property tax bill be released.
Norman Long, Zoning Officer, was present to present the following
recommendations from^the County Planning Board: f
1. The request of Mr. A. T. Williams that property of Mr. & Mrs.
Clarence Dixion, be re-zoned Prom a Residential District to a
Creneral Commercial Diatriat. This property is boated on the
West aide of Righway 86 North of Chapel Hill and is adjacent
to property presently in a General Commercial District. 2.25 acres.
IIpon motion of Commissioner Ward, aeaonded by Commissioner Walker,
it was moved and unanimously adopted, that the recommendation of the
County Planning Board relative to the request oP Mr. & Mr a. Clarence
Dixion be approved.
2. That the request from Mra. Althea Beecher for re-zoning of her
property located on the West aide of Murphy School Road from a
Residential District to a Mobile Rom® Park District be approved.
This property contains 5 acres.
Upvn motion oP Commissioner Walker, aeaonded by Commissioner Ray,
it wee moved and unanimously adopted, that the recovanandation of the
County Planning Board relative to the request of Mrs. Althea Beecher
be approved.
3. The request of Mr. Walton Lloyd that his property containing 15,000
square feet be re-zoned from a Residential District to a Rural
Commercial District. This property is on the Last aide of Righway
86 North of Chapel Rill and has on it commercial businesses at
this time.
Upon motion of Commissioner Bennett, aeaonded by Commissioner
Ward, it wsa monad and unanimously adopted, that the recommendation of
the County Planning Board relative to the request of Mr. Walton Lloyd
be approved.
!}. That a new Section 10.5 be added to the Zoning Ordinance setting
standards and procedure for granting of permits for Radio, Television,
and Micro-Wave Relay Transmission Facilities.
IIpon motion of Commissioner Walker, aeaonded by Commissioner Ray,
it was moved and unanimously adopted, that the recommendation of the
County Planning Board relative to adding a new Section 10.5 be approved.
Section 10.5 Radio;.Teleniaion, and Micro-Wave Relay Transmission
Facilities
Tha Orange County Board of Adjustment shall be empowered to issue Radio,
Televiaivn, and Micro-Wave Relay Transmission Facilities Installation
permits when it shall make the following findings:
10.5.1. That the minimum lot area provided shall. be 5 acres.
10.5.2. That a buffer strip oP not lase than 150 feet measured
from all exterior property lines and main traveled road-
way right-of-way lines be provided within which no
structures are erected, within which no vehicular parking
is permitted, and within which no storage of materials is
allowed.
10.5.3. That there be np radio or television studio buildings
on the premises, that structures be used to house trans-
mission equipment and personnel only.
The Board of Adjustment shall impose such reasonable and appropriate
terms, conditions, safeguards and requirements upon the issuance of a
Radio, Television and Micro-Wave Relay Transmission Facilities Installation
permit as it may deem necessary to protect the publin and neighboring
property ownors against adverse effects, including the requirement that
there be no diolation of the above findings.

Whenever the Board of Adjustment shall determine that any of the terms,
conditions, safeguards and requirements upon the issuance of a Radio,
Television, and Micro Wave Relay Transmission Facilities Installation
permit are not met, after notice of ouch violation has been given the
permit holder by the Zoning Officer, the Board of Adjustment may
revoke said permit. In every case of revocation the Radio, Television,
and Micro-Wave Relay Transmission Facilities Installation for whioh
the permit was issued shall automatically be In violation oP this
ordinance.
5. There is also a recommendation from the Planning Board that
consideration be given and a public hearing scheduled for the
purpose of removing from the Zoning Ordinance for Chapel Hill
Township Section 7.3 which pertains to existing Mobile Home
Parks complying with the Zoning Ordinance within a certain
time. The County Attorney aonaurra in this recommendation.
It was agreed that the Board of Commissivnera would consider the
recommendation of item 5 at a public hearing.
Tom Ward, Social Services Director, presented the following Blind Aid

Chairman Smith reviewed a meeting which he had held with the Welfare Rights
Committee and read correspondence relative to the many problems which had
occurred, during the past month, in the Department of Social Services. Mr. Ward
stated that it currently appeared that the sum of $1,51y3.00 in additional monies
would be needed for the Social Services Program. Discuasi.on ensued relative tv
the financing of the defecit and inquiries were made as to what County Fund would
be used in supplying the dafecit. The County Administrator explained that the monies
to cover the defecit,:if such a defecit occurred, must be expended within the
Social Sexwices Budget from the County Contingency Fund.
Upon motion of Cotarnisaioner Ray, seconded by Commissioner Bennett, it was
moved and unanimously adopted that the six percent increase (6;L) in Social
Services AFDC Public Assistance recipients aheaka be approved and that the State
Department of Sooial Services be advised that County funds to implement this
increase would be provided.
Commissioner Ray auggeated that the Board of Coaaritssionera tour the two'
achcol systems in aonjunation with members of the respective school boards. Tt
was agreed that auah a school tour should be arranged.
r" Chairman Smith referred to the memorandum dated December 5th from the County
Administrator which cited the problems being encountered by Alamanca County
relative to the three hundred and eighty-five children (385) why are currently
attending school in Alamanae County. The memorandum further stated that both
~- County School Boards feel that the County Commissioners are involved indirectly
in this matter. The following letter from John Deacon, Superintendent of the
Alamance County Public Schools addressed to Homer Andrews, Chairman of the
Alamance Board of Commisaionere was presented:

"Tn accordance with your written request that negotiations con-
cerning tuition payments for Orange County pupils attending Alamanae
County Schools be initiated by the Alamance County Board of Education
with the Orange County Board of Education, meatinga of the two boards
were held in FIillaborough on October 7.~, and in Graham on November 11.
These dissuasions resulted in the following aoncluaiona:
(1) The Orange County Board of Education desires those pupils
residing in Orange to attend Orange County Sahoola although they do
realise the historioal background of Mebane residents (and those in
close proximity to Mebane) traditionally attending Alamance County _•
Sohools. The main concern of the Orange County Board of Education 3s
that further eroding of the Orange County School System be stopped.
(2) Approximately 38s Orange County residents attend Alamance
County Sohools. The pupils have attended in Alamanae County traditionally.
It is the desire of the Alamance County Board of Education that arrange-
manta be made for them to continua.
Whether tuition payments should be levied on pupils residing in
another district; whether a payment covering per pupil expenditures from
the tax levying authorities should be made; or whether some other arrange-
menta is more proferable should be considered by the Orange and Alsmance
County Boards of Commissioners soon. Plans for the 1970-71 school year
are being developed currently. Staffing and pupil organization procedures
are considerations which should merit your Further advice on the status of
pupils not residing in Alamance County as soon as possible."
A resolution adopted by the Orange County Board of Education on December 1,
1969, reads as follows:
"(1) "Resolved that the aehool district line be the county line;
exception, that those students who live in the city 13mita of
Mebane be released to the Alamanae County Board of Education if they
so desire. This resolution is to be put into effect for the 1970-
71 school year.
(2) Resolved that Alamanee County buses shall not some into the -
Orange County district for the purpose of picking up students."
Discussion ensued and it was pointed out that a similar situation could
result within Durham County in connection with the Colony Woods area. No action
was taken on this matter. --
Chairman Smith read a letter from the State Jail Inspector relative to the
Fact that a security screen should b® installed in the Sail. The County Administrator
explained that he and the Sheriff had discussed this item and that the Sheriff
currently planned to provide a visitors room. This room would provide privacy and
security for those individuals visiting in the fail and would eliminate the need
for a security screen.
A road petition for Hillarest Dive was submitted and the clerk was authorized
to forward same to the State Highway Commission.
Chairman Smith brought to the attention of the Board the request of Joseph
Ward and Lester Lemon for release of interest on tax bills. It was agreed that to
exempt these two individuals from the interest penalty would be setting a precedent
and therefore the Board declined the request of Mr. Ward and Mr. Lemon.
Discussion ensued on the matter of the road program for Orange County. Chairman
Smith stated that Clifton Benson, Highway Commissioner, had agreed to schedule a
meeting with P. L. Welch and Earl Hoover and advise Chairman Smith as to the place
and date for said meeting. The clerk was instructed to write Commissioner Benson
as to a convenient date for a 5oint meeting with Benson and representatives of the
Highway Commission.
Chairman Smith read a letter from the Town of Chapel Hill relative to the
closing of road ~17L~0. It was decided to investigate this matter further.
The clerk was instructed to write to each County School Superintendent ~
requesting a date which would be convenient for a tour oP school facilities and
a review of school programs.
The County Administrator filed with each member of the Board a report of
office facilities For t$e Chapel H111 area.

There being no further business to come before the Board said meeting was
adjovraed to meet again on Saturday, January 17, 1970 at 1 o~clock P.M. for
the purpose of a Publio Housingg Authorit~* inspection tour and to meet again on
Thursday, January 29, 1970 at 8 o~clock P.M. for the purpose of holding a Public
Hearing on the Ekto Township Zoning petition.
