HomeMy WebLinkAboutMinutes - 19690902MINUTES OF THE ORANGE COUNTY BOARD OF COMMISSIONERS September 2, 1969 The Orange County Board of Commissioners met in regular session on Tuesday, September 2, 1969, at 10 o'clock A.M. in the Commissioners Room at the Courthouse in Hillsborough. Members Present: Chairman Carl M. Smith and Commissioners Harvey D. Bennett, William C. Ray, Henry S. Walker and Ira A. Ward. Members Absent: None Minutes of the previous meetings were read and approved after corrections. Chairman Smith advised the Board that he had received a letter from Robert L. Dietrich, President of Fiber Industries. Chairman Smith read the following letter to the Board: "Thank you for sending me the enclosures in your letter of August 4, 1969. Your statement was very complimentary to Fiber Industries and we appreciate it. I am sorry that things worked out the way they did. In response to your questions, let me advise that., 1) There are no strings on the site. We own it in fee simple and are free to hold it or dispose of it. We have no current Dlans or decision in either direction. I 2) In retrospect, it is evident that the original negotiations and pro- curement of this site were premature. This was not anyonets fault, but was the result of the march of events. We do not intend to repeat the error, and while we will look for another site, we will make neither decisions nor announcements until construction plans are in hand. 3) We will look throughout the entire southeast for the best available site. We will not rule out Orange County for you have some fine people and some very desirable features. You can appreciate that we will be a bit "gun shy". i You and the Orange County Commissioners have been marvelous and we appreciate it. We will be glad to hear from you in the future. At the moment, we want to keep quiet and go about our business." Chairman Smith then read his reply addressed to Mr. Dietrich. Same being as follows: "Dear Mr. Dietrich: Sincerely appreciate your letter of August 7th and its contents. We understand fully that you would be "gun shy" about Orange County but we hope to be able to convince you in the days ahead that you are wanted here and that Orange County is strategically located for you. We also respect your statement "At the moment, we want to keep quiet and go about our business". However, there are two things that prompt my wanting to write you at this time. First, Dr. William C. Friday, President of the University of North Carolina and Dr. J. Carlyle Sitterson, Chancellor of the University of North Carolina at Chapel Hill did today try to reach you to let you know that they are hopeful you will come to Orange County at another location. I am sure they will put this in writing if you feel it is necessary. Dr. Friday will likely call on you on one of his trips to the Charlotte campus. Second, I wanted to let you know that many faculty people have been to see me to state their embarrassment at the turn of events that promoted your decision. The Negro community is still in a state of shock that such action would be brought about by action of the liberal Universities that they felt were always on their side. As to the upper part of our county, they are going through a slow burn which will not be helpful to the University at Chapel Hill over the long pull. Thus it is necessary that we continue to do what we can to resolve all these differences by having Fiber Industries in our midst. Nothing else will bring these people together in the foresee- able future. I have sent Dick Sahlie maps on the C. W. Davis property which is centrally located within the county. In addition, we have had offers of two other sites on I-85 and another one close to I-85. None of these are the ones that some of the local realtors have written to Dick concerning. Any time, you feel it appropriate, we will be glad to show any of your people over these sites. As you know, we had planned to go ahead and rezone your site in Orange and felt that we should do nothing toward attempting to interest you in another site as long as you wanted to go ahead on the Blackwood Station site. Now, that you have made that decision, we hope you will give us the opportunity to show you what we have. I-85, as the Main Street of the South from Washington to Atlanta, should have advantages for you, the Research Triangle Park close by should be appealing, and we feel that our area is a fine place for people of good taste to live. In the meantime, we will go ahead as ouietly as we can to build another reservoir above the Hillsborough treatment plant and to build a water storage tank on a high point on 2-85. We will wait patiently for you to contact us when you are ready to move and want to assure you that we hope you will call on us if there is anything that you would like for us to do." Commissioner Ward expressed his appreciation to Chairman Smith for the position he had taken relative to the Fiber Industries matter. Each member of the Board concurred with the statement made by Commissioner Ward. Norman Long, Zoning Officer, stated that there were several items which should be considered. One being the recuest of Kenneth Cheek for re-zoning, and the other being the fact that the term of Preston Hogan, member of the County Planning Board, will expire September 28, 1969. The Board advised Mr. Long that they would take these items under consideration. Lucius Cheshire, County Attorney, explained the legal requirements for the passage of Ordinances by the County Board of Commissioners. The County Attorney presented two Ordinances which had been prepared byy the Governor's Committee on Law & Order and were entitled "AN ORDINANCE AUTHORIZING THE CHAIRMAN OF THE BOARD OF COMMISSIONERS TO PROCLAIM RESTRICTIONS IN RESPONSE TO THE NEEDS OF AN EMERGENCY" and "API ORDINANCE TO PERMIT DISPERSAL OF ASSEMBLIES DURING AN EMERGENCY". He explained that the Town of Hillsborough had already adopted the ordinances. Discussion ensued. In order to meet the requirements, the County Attorney read each ordinance in its entirety. It was agreed that the ordinances should be amended to read that the Board of Commissioners and the Chairman of the Board of Commissioners shall have the authority to issue proclamations. Unon motion of Commissioner Ray, seconded by Commissioner Bennett, it was moved and adopted that the Board proceed with the necessary legal requirements in order that said ordinances might be adopted. Paul Alston and Coolidge Porterfield were present and Chairman Smith advised the Board that the matter of the establishing of a County Housing Authority would not be open for discussion. Commissioner Ward innuired of the other Board members if there had been any change in the sentiment of the opponents to the County Rousing Authority. Commissioner Walker stated that there had been some change in the attitude of those persons who had contacted him, but there was still opposition which existed. Commissioner Ward stated that the public hearing had established as a positive fact that there is a tremendous housing need in the County and that the Federal and State Government were endeavoring to do something about the needs, and that the citizens of Orange County could not take advantage of the programs being offered by the Federal Government unless the County establishes a Public Housing Authority. Commissioner Ward stated further that the establishment of such an authority was frought with headaches and that he, for one, was reluctant to assume additional duties over and above those already being borne by each member on the Board, but that he saw no alternative other than the establishment of a Public Housing Authority with the Board of Commissioners being the designated housing authority. Commissioner Ray stated that he would vote for a motion which would establish the Housing; Authority, but that he felt the Board was creating a monster that will eat as all up, however, he could not and would not deny the privilege of Orange County -citizens being in the position to purchase their own homes. Re stated further that he was hopeful that all parts of Orange County would receive equal treatment in dispensation of Public Housing Authority funds. The Chairman announced that a petition having been filed with the Register of Deeds and ex officio Clerk to the Board of Commissioners of Orange County, by the reouisite number of residents of the County, setting forth that there is a need for a Rousing Authority to function in the County of Orange, as provided by the "Housing Authorities Law" of the State of North Carolina, and the Register of reds and ex officio Clerk having given due and proper notice of a public hearing to be held at this time and place, at which the Board of Commissioners would determine the need for such an Authority in the County, the said Clerk was directed to read such notice and the proof of publication thereof reeuired by said Housing Authorities Law, which notice and proof of publication were ordered spread upon the minutes as follows: "NOTICE Orange County North Carolina The Orange County Board of Commissioners will hold a Public Hearing in the Superior Courtroom of the Oran a County Courthouse in Hillsborough, North Carolina at 8*00 p.m, on Monday August 9, 1969 to determine the public sentiment regarding creation of a Public Rousing Authority for Orange County. Ray Notary Public My Commission Expires 4-30-71 A full opportunity to be heard on said cuestion having been granted to all residents and taxpayers of the County of Orange and to all other interested persons, the following resolution was introduced by Mr. ward, who moved its adoption: A RESOLUTION DECLARING THE NEED FOR A HOUSING AUTHORITY TO FUNCTION IN THE COUNTY OF ORANGE, NORTH CAROLINA. i BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF ORANGE COUNTY, NORTH CAROLINA: That a petition having been filed with the Register of Deeds and ex officio Clerk to the Board of Commissioners of Orange County by twenty-five (25) residents thereof, setting forth that there is a need for a Housing Authority to function therein, and a public hearing having been held, upon due notice given by said Register of Deeds and ex officio Clerk, all pursuant to the "Housing Authorities Law" of the State of North Carolina, the Board of Commissioners of Orange County finds, determines and declares, that: 1. Insanitary and unsafe inhabited dwelling aceomodations exist in the County of Orange, North Carolina; and 2. There is a lack of safe and sanitary dwelling accommodations in the County of Orange, North Carolina, available for all the inhabitants thereof; and 3. There is need for a Housing Authority to function in the County of Orange, North Carolina; and 4. A petition setting forth the need for a Housing Authority to function in the County of Orange, North Carolina, has not been denied by the Board of Commissioners i of Orange County thereof within three months of the date of the filing of the aforesaid petition; and 5. The Chairman of the Board of Commissioners of Orange County, North Carolina, be promptly notified of the adoption of this resolution; and 6. The Chairman be and he hereby is directed to file in the office of the Register of Deeds and ex officio Clerk of said Board of Commissioners of orange County, North Carolina, the necessary certificate evidencing the appointment of the Commissioners and designation of the first Chairman of the Housing Authority, pursuant to the "Housing Authorities Law'' of the State of North Carolina; and 7. Said lack of safe and sanitary dwelling accommodations in the County of Orange, North Carolina, available for all the inhabitants thereof, at rents which persons of low income can afford, compels such persons to occupy overcrowded and congested dwelling accommodations; that the aforesaid conditions cause an increase in and spread of disease and crime; that the clearance and reconstruction of the areas in which insanitary or unsafe housing conditions exist are public uses and purposes, and that it is in the public interest that work on such projects be instituted as soon as possible in order to relieve unemployment which now constitutes an emergency, that it is necessary to the immediate preservation of the public peace, health, and safety that this resolution become effective without delay, and, therefore, the same shall take effect and be in force immediately upon its adoption. The amelioration of the conditions enumerated above and the creation of a Housing Authority to carry out the purposes of the "Housing Authorities Law; are hereby declared to be a public purpose. The motion to adopt said resolution was seconded by Mr. Ward, and upon roll call the following voted Aye: Messrs. Smith, Bennett, Ray, Walker and Ward. Nay: None. Thereupon the Chairman declared said resolution duly adopted and passed. Mr. Ward then moved that said resolution go into effect immediately, as provided in Section 7 thereof, which section was then read in full. The motion was seconded by Mr. Ray and thereupon the Chairman put the question on the adoption of said motion, and upon roll call the following voted Aye: Messrs. Smith, Bennett, Rap, Walker and Ward. Nay: None. Whereupon the Chairman stated that said motion had received an affirmative majority vote and declared the same duly adopted. CERTIFICATE OF APPOINTMENT OF COMMISSIONERS OF THE ORANGE COUNTY HOUSING AUTHORITY AND DESIGNATION OF THE FIRST CHAIR4J WHEREAS, the Board of Commissioners of Orange County, North Carolina, held a duly authorized regular meeting on the 2nd day of September, 1969; and WHEREAS, at said meeting the following resolution was passed and adopted, entitled "A RESOLUTION DECLARING THE NEED FOR A HOUSING AUTHORITY IN THE COUNTY OF ORANGE, NORTH CAROLINA." NOW, THEREFORE, pursuant to the provisions of the "Housing Authorities Law: of the State of North Carolina, and by virtue of my office as Chairman, I hereby appoint the five persons hereinafter named to serve as Commissioners of the Orange County Housing Authority, and to serve until the date appearing after their names, respectively, from the 3rd day of November, 1969. BOCK . .,7 PAGE 225 Upon motion of Commissioner Ray, seconded by Commissioner 'Nalker, it was moved and unanimously adopted that the following resolution be adopted: RESOLUTION TO ENTER AGREEMENT FOR NCRTF CAROLINA LOCAL GOVERMENTAL EI?PLCYEES' RETIRr_21NT SYSTEM TO PROVIDE E;rPLOYEE DEATH BENEFITS WHEREAS, the 1969 General Assembly amended the North-Carolina Local _ Governmental Employees' Retirement System laws so as Co permit agreements for providing death benefits for employee members pursuant to G. S. 128-27(1); and 7,SEREAS, the governing body of this Unit realizes the desirability of providing its employees with the security and protection provided by a plan for death benefits; and WHEREAS, Article 3 of Chapter 128 of the General Statutes of North Carolina provides that any employer governmental unit desiring to provide death benefits for its employee members must execute an agreement therefor with the Director of the North Carolina Local Governmental Employees' Retirement System: NCIAT, MREFORE, BE IT RESOLVED BY TIM Orange County Board of Commissioners in regular session, 1. That the Orange County Board of Commissioners hereby elects to secure death benefits for its employees in the North Carolina Local Governmental Employees' Retirement System. 2. That the Orange County Board of Commissioners hereby agrees to comply with all provisions of the North Carolina Local Governmental Employees' Retire- ment System as defined in Article 3, Chapter 128 of the General Statutes of North Carolina, as amended, and to make such increased employer's contributions as the Local Governmental Employees' Retirement System may determine to be necessary in order to provide employee death benefits 3. That the Orange County Board of Commissioners is hereby ordered and directed to execute an agreement with the Director of the North Carolina Local Governmental Employees' Retirement System to implement the employee death benefits of G. S. 128-27(1). L_r. Elliott requested that the Orange County Board of Commissioners appoint some- one who would be responsible for advising his office of the events occurring in the County. Upon motion of Commissioner Ray, seconded by Commissioner Bennett, it was moved and unanimously adopted, that the clerk to the Board was requested to forward to Jerry Elliott items of interest. Chairman Smith read a letter from Clarence Jones which advised the Board that airs. Dorothy Efland of Efland, North Carolina and Joe Pope of Cedar :rove, North Carolina had resigned as members of the Human Relations Council. Upon motion of Commissioner ':Walker, seconded by Commissioner Ward, Mrs. r- Van L. Kenyon of Route 2, Hillsborough, North Carolina, Hugh Wilson of Route 3, Hillsborough, North Carolina and Remus Smith, Tr., of Mitchell Street, were named as members of the Orange County Human Relations Council and Marion Clark of Ruffin Street, Hillsborough, North Carolina, was named as an alternate appointee should either of the three persons previously appointed declinee to serve on said council. Chairman Smith advised the Board that there were two vacancies on the Health Planning Council which should be filled and that one vacancy on the Chapel Hill. Board of Adjustments and one vacancy for the alternate member on the County Flanning Board. BOOK ' PACE 226 Upon motion of Commissioner Ray, seconded by Commissioner ?lard, it was moved and unanimously adopted, that Freston Bogen be re-appointed to a three year term as a member of the County Flanning Board. Said term to run consecutive with his current term. Chairman Smith presented a letter from Hubert Patterson which stated that he planned to present to the Durham-Orange idedieal Society certain grievances relative to the State Medical Examiner. Upon motion of Commissioner Ray, seconded by Commissioner Walker, it was moved and unanimously adopted, that the recommendation of the County Planning Board relative to the request of Kenneth Cheek to re-zone from a residential area to a commercial area be approved. Chairman Smith called for a vote on this motion. Commissioners Ray, Walker and Bennett voted aye. Commissioner Ward voted nay. Chairman Smith declared the motion passed. Commissioner Ray made the request that the Board have the clerk write Clifton L. Benson, District Highway Commissioner, and request that the highway coma-ission proceed, as fast as possible, to undertake improvements on highway 86 North. Corir._issioner Ray stated that it was his understanding that the necessary monies had been allocated for.this project. The County administrator was requested to write Pearson Stewart and schedule a meeting in order that all interested uovernmental Boards and Planning Boards might meet with representatives of the Research Triangle Commission to review the report on open land usage. Commissioner 77ard stated that it was only two months before the election on the Sales Tax Referendum would be held and that he was of the opinion that the Board should make a concentrated effort to solidify the efforts of the proponents of the sales tax. It was agreed that the members of the two school boards and the three :municipal boards should meet on Thursday, September 11, 1969, for the purpose of discussing the Sales Tax Referendum. Chairman Smith presented a letter from Dr. Hudson, State -fedical Examiner. Said letter advised the Board that his department had accepted the resignation of Dr. 3ubert Fatterson as Crange County's Chief Ledical Examiner. Mrs. duentin Patterson, Idember of the Resource, Conservation and Development Commission, John Howell, Representative-of the State Fecreation Commission, Bob Powell, Representative of the Resource Conservation and Development Commission and John Vance, Representative of the Resource Conservation and Development Recreation Division were present to present suggestions and evaluations as to the need for a Countywide Recreation Commission. Copies of a Node1 Recreation Commission Ordinance was presented to the Board. It was pointed out that vacant schools-could be utilized as facilities to house the recreation program. Discussion ensued as to the methods which could be applied for the implementation of a recreation commission. ?ors. Patterson stated teat they were not in a position, at this time, to submit positive plans for the establishment of a recreation cormission, but t.-at she wished to request that the Board consider retaining the current vacant school plants looking towards the time when such a commission could be established. :qrs. Fatterson stated further that any programs must be initiated in varying degrees and that the program would enroll both the youth and the adults of the county. The Recreation Commission Ordinance was referred to the County kttorney for evaluation. action on this matter was deferred. Upon motion of Commissioner Bennett, seconded by Commissioner Ray, it was moved and unanimously adopted that the County administrator reimburse A. Gordon Neville in the amount of $40.00 as authorized under C.S. 105-405.1 and under C. S. 105-228.29. The clerk wqs instructed to inquire as to the disposition of the Lake Orange road petition. Chairman Smith filed the following items with the clerk. 1. Letter dated July 14, 1969, relative to road way entering Freeland Feights. 2. Copy of Recreation Enabling Law and Recreation in North Carolina booklets. 3. Letter from Pearson H. Stewart concerning Cori.:.issioner Ward's request for reclassification survey. 4. Solid Waste h1anagement material. 5. Letter from Paul N. Guthrie, Jr., supporting the establishment of a County Housing Authority. 6. There being no further business to come before the Board the meeting was adjourned to meet again at 8 o'clock P.M. on Tuesday, September 2, 19690 in the Courtroom of the Courthouse in Fillsborough, North Carolina for a public hearing with the members of the County Flanning Eoard and to meet again on Thursday, September 11, 1969 at 8 o'clock F.M. in the Courtroom'of the Courthouse in Hillsborough, North Carolina with members of the Board of Aldermen from Hillsborough, Chapel Hill and Carrboro. Smith, Chairman Betty June Hayes, Acting Clerk .wINUTES OF THE ORANOR COUNTY BOARD OF C0I24ISSIONERS September 2, 1969 The Board of County Commissioners of Orange County met in joint session with the Orange County Planning Board at 8 o'clock P.Y. on Tuesday, September 2, 1969, in the Courtroom of the Orange County Courthouse in Hillsborough, North Carolina. Members Present: Chairman Carl IA. Smith, and Commissioners Harvey D. Bennett, William C. Ray, Henry S. Walker and Ira A. Ward. Nembers Absent: None This meeting was held for the purpose of conducting a joint Public Fearing on certain amendments to the County Zoning Ordinance. Members of the County Planning Board were present. Chairman Smith called the meeting to order and then turned the chair over to Charles Johnston, Chairman of the County Planning Board, who conducted the hearing. The following amendments to the Chapel Hill Township Zoning Ordinance were presented for consideration: Amend definition of structure, Add new definition- Lot and/or parcel, Add new section - Single Family Residences on Zoning Lots and Change Section 6.9 under District Provision. Gattis, Acting Clerk TYTINUTr.S CF THE CRAN=E CCLNTY BCARD CF CCb!.!:1SSICNERS September 11, 1969 The Orange County Board of Commissioners met in special session in the District Courtroom of the Orange County Courthouse in Hillsborough, North Carolina at 7:15 o'clock F.H. on Thursday, September 11, 1969. Members Present: Chairman Carl Y. Smith, and Commissioners Harvey D. Bennett, William C. Ray, Henry S. ',talker and Ira A. Wnrd. Lembers Absent:: None Dr. 0. D. Garvin, District Health Director, Dr. Woods, assistant Health Director, and Paul Alston, Joint Orange-Chatham Community Action Executive Director, were present and discussed with the Board of Commissioners the possibility of Orange County becoming involved with the University of North Carolina Medical School, North Carolina Memorial Hospital, the County Community Akction Agency and the Federal - Government in a "Comprehensive Health Frogram". Chairman Smith read a letter of resignation from Bill Ivey, a county appointee to the Chapel rill Board of Adjustments. This resignation was accepted with regrets. Upon motion of Commissioner Bennett, it was moved that, Hobert H. Frey of Old Lystra Road, Chapel Hill, North Carolina, be appointed to fill ter. Ivey's unexpired term on the Chapel Hill Board of Adjustmen" . The place of meeting, was then moved to the Superior Courtroom for the purpose of discussing the Local Cption Sales Tax Referendum. Chairman Smith called the meeting to order and explained the purpose of the meeting. Chairman Smith turned the chair over to Vice Chairman !balker and explained that he must leave the meeting. Vice Chairman 7oalker conducted the remainder of the meeting. Discussion ensued relative to the Sales Tax Referendum Election. It was decided that the Board would appoint a steering committee to formulate and to organize plans for said election. Members Absent: None This meeting was held for the purpose of conducting a joint Public Fearing on certain amendments to the County Zoning Ordinance.
