PURPOSE: To provide historical information on the issue of the Alamance/Orange County
Boundary Line and a status report to the BOCC on boundary issues and strategies.
BACKGROUND: The issue of the field location of the Alamance/Orange County line was
raised again in 1996 after prior attempts to resolve it and remains unresolved. There is
renewed interest in the issue because of increased development occurring on or near the
boundary line. Orange and Alamance Counties continue to experience frustrated citizens and
developers who have not been able to situs their properties and know what services are linked
to the specific location.
The lack of a definitive boundary line can lead to legal ramifications. If the issue is resolved, the
Assessors of each county will not have to make `arrangements' about an unknown or estimated
line and the citizens will be able to identify their services providers.
Field Research
On May 20, 2008, the Boards of Commissioners of Alamance and Orange counties approved
separate but similar resolutions that requested assistance from the State of North Carolina in
resolving the uncertain boundary between the two counties. The North Carolina Geodetic
Survey (NCGS) section of the Department of Environment and Natural Resources (NCDENR) is
designated and funded to help counties survey ambiguous county boundaries. in accordance
with the provisions of the North Carolina General Statutes §153A-18 (a) and (c). NCGS has
proceeded with surveying, monumenting, and developing a proposed preliminary plat of the

county boundary based on extensive field and office research conducted by NCGS during the
past few months.
The North Carolina Geodetic Survey (NCGS) has surveyed the line. The purpose of the survey
was to correctly map the original 1849 Alamance/County line using modern technology. The
survey is an effort to place monuments in the ground to mark critical points along the survey
line.
Public Information Sessions
After the NCGS completed their work, Orange County and Alamance County were able to
assess which properties were affected and sent out a letter to 422 individuals that were in the
vicinity of the verified line as well as previous approximations of the boundary location.
On September 3`d and 4th, 2008, meetings were held at the Hebron United Methodist Church
and the Mebane Arts Center. Total attendance at the two meetings was approximately 160
people (125 attending the Methodist Church meeting and approximately 35 attending the
Mebane Arts Center meeting). The purpose of the meetings, hosted by staff from both
counties, was to explain to attendees:

The results of these meetings are summarized to the best of staff recording by the attached
charts and tables in Attachments 1 c and 2a-e. The maps in Attachment 3 depict two areas of
special concern along the entire county boundary. The NCGS proposed line is noted in green.
The Orange County GIS line is noted in orange and the Alamance County GIS line is noted in
purple. If the NCGS line is chosen, the maps show in orange which properties would be added
to Orange County and in purple which properties would be added to Alamance County.
FINANCIAL IMPACT: To date, there has been no financial impact for the survey other than
existing staff time to address the issue. Based upon future direction from elected officials to
staff, there may be costs involved if the boundary line is adjusted or altered to mitigate impact.
RECOMMENDATION(S): The Manager recommends that the Board:
(1) receive the report for information,
(2) request staff to continue the progress to remedy the boundary line issue, and
(3) discuss the timeframe for a possible public hearing.

The Boards of County Commissioners of Alamance County and Orange County have requested that the North
Carolina Geodetic Survey (NCGS), an agency of the State of North Carolina, prepare an initial survey of the
Alamance/Orange County line. The purpose of this undertaking is to correctly map the original 1849
Alamance/Orange County line using modern survey methods. The State's survey and mapping efforts will not
change the county line, but will establish its physical location on the ground which may vary from the lines
developed by the tax departments over the years.
There are differences between where county officials believe the line is situated on the ground and on maps and
where it actually is (see the attached map showing where Orange County [orange line] and Alamance County
[purple line] have noted boundaries in their respective land records). With an increase of residential and
commercial development along the Alamance/Orange line, it has become increasingly important to be able to tell
people with certainty in which county all or portions of their property lies. The two Boards of Commissioners are
pursuing a process established in North Carolina law to deal with situations, such as this one, where the location
of a boundary between counties is uncertain. The process will provide a permanent resolution as to the location
of the county line.
An important part of the process for both counties is to receive public input before the two Boards of
Commissioners take any formal action to legally finalize the physical location of the county line and its mapping.
The Geodetic Survey team worked in the field throughout June and July of this year to place monuments in the
ground to mark critical points along the surveyed line. Once the survey is completed, they will prepare maps and
provide information to both counties. A copy of the preliminary map of the NCGS proposed line in the vicinity of
your property is provided with this letter. Please note, however, the line is not yet finalized and will not be
finalized until after NCGS completes its work, and the Boards receive and consider public input. Property lines
shown are approximations based on data from both jurisdictions.
Two public information meetings will be held regarding the County line and citizens are
encouraged to attend a meeting to learn more and ask questions. The dates, times, and locations
of the public information meetings are as follows:
Wednesday, September 3, 2008, 6:30 p.m. Hebron United Methodist Church -Fellowship Hall,
2325 Mebane Oaks Road, Mebane.
Thursday, September 4, 2008 6:30 p.m. Mebane Arts and Community Center, 622 Corregidor
Street, Mebane.

to communicate directly with Alamance County and Orange County officials about any questions or concerns you
may have about how the final determination of the county line's location may impact you, your family; or your
property. You also may wonder how this process may affect your tax bill; who will provide fire protection to
your property; where your children may go to school; where you may vote; or about many other understandable
concerns.
Please contact us by August 25 with any specific considerations you would like to bring to the attention of both
governing boards before they conduct a more formal public input process in September and October. The earlier
we hear from potentially affected•property owners and citizens, the better job we are likely to do in planning for
government service delivery changes. Primary points of contact for each county staff follow our signatures at the
end of this letter.
Both county governments are aware from past experience that the process of determining the location. of uncertain
boundaries can be unsettling and frustrating for citizens affected by a boundary line's location. We recognize
that, in the end, we may not be able to satisfy every consideration that every property owner may wish to see
addressed. Please be assured that we want to know of your concerns and will do our best to ensure that issues you
may identify to us will receive consideration from governing boards and staff as we work with the State to resolve
the location of the Alamance/Orange boundary line.
If the County Boards of Commissioners decide to make changes to the initial survey map following the public
input process, the North Carolina Geodetic Survey will perform additional field work reflecting the agreed upon
changes and the revised map will be submitted for approval. The Boards would meet again for final survey
approval. Once the map is approved by both Boards of Commissioners, a final survey plat will be prepared by the
North Carolina Geodetic Survey and recorded with the respective Register of Deeds in both counties and in the
records of the North Carolina Secretary of State.
At a future date to be determined, real property will be taxed based on the county in which it is physically located,
as set forth on the final survey. County staff and atton~eys will work with School Boards and staff to try to
develop any agreements that may be possible between the School Boards of both counties to allow students of
affected families to attend school in the system they may already be attending. County staffs will also work
together to coordinate service delivery planning considerations related to voter registration, public safety, human
services, and many other county services.
It is the intention of both counties to provide notice of the surveying of the boundary line to all residents and
property owners who could potentially be impacted by the final determination of the location, of the boundaly
line. If you believe we may have overlooked one or more of your neighbors in the notification process, please
feel flee to share this letter with them and invite them to contact us as well with any questions or concerns about
the process.

Observations:
~ Roughly 160 people showed up, 125 first day 50 the second day with about 15 people coming both days.

Tim Bradley 352 -City Councilman -Came both days. 1980 built house told not in Orange. Consider Service, Suggests
parcel lines as county line, no grandfather clause because of broken promises when local government turns over. Says
State won't stand by what they say. (They have in court) Follow time honored agreements. They let Mill Creek be
approved without checking to see if it is right. Eminent Domain? Recommend that the Line follow agreements last
number of years. 1960s 1900s agreements?
Ann Robins 333 -Letter. Came to both meetings. Can't pay any more taxes. Petition people, they did not know about
the issue? Everybody polled stated that they were in Alamance except one woman. Had to pay to have her kids in
Alamance. 1977 Orange County let them into Alamance. Started 1978. 1948 Tax maps show line where they think it
is. All about money. Quotes from Commissioners. "Please consider moving the line, or leave us as we are:' 15 year
old and 4 year old for schools? How they came up with line. Petition? People said they were in Alamance County. Not
Consistent. Son had trouble, when they went to both counties.
Janet Evens 336 -Came both days.. We are in Mebane city limits? Rescue had to wait. Buses. Disability. DSS Medicaid
Too Emotional an issue..Husband Died. We are destroying everything. Leave us alone. Delay from one county to
another? DSS Services Transition? Poor.
Todd Bradley 353 -Split Property. Problem allowed by the government. Least Impact because. "Who is going to pay
for Grandfather clause?" Problems to keep up with grandfather clauses though. What happens when Govt. turnover
of staff? Then things could change again?

through property and is deeded in both counties. One of three in Mill Creek. Would have to move. Money? Why are
we here? Plat line is wrong. Mebane Checked? Want to stay. Honor what you have told me (Mebane and Surveyor
told him?).

for the schools. You don't want to wait 10 years for Tax $value to match what you paid in Orange.
Elizabeth Hillborn 140 -Orange County for 25 years no indication. Cut off from Alamance because of River Access. A
physical boundary is dividing the line.
Carolyn McCormick & Marlc Peifer 88 - Way in Alamance -Care less if Kids stay in Orange. Grandfathering good as
long as we don't pay extra. "Known that they were in Alamance for years:' Knows Peter Childress.

payments don't matter? Attorney General Opinion 1977: Rufus Edmonson. 156 Claims Property always had been
Orange County. Subjective Survey. Resale value. Mr. Moore Land $ Value. Most Land in Orange.
Tadd Schopler 21 -Vacant lot SPLT, - 27 Other prop split but household stay in Orange -Bisects the line. "How many
(hands) want to change counties?." Services can be handled with modern methods. Grandfather is only as good as the
previous government. As personnel changes so can the agreements. Allow the people that are affected let them pick
one way or another. And legislate it forever. Pay half in one county and half in another? (He does not understand as
well as others, thatsplits are the norm not the exception.) (1 believe he wants his household to stay in Orange County, but
was not sure listening to the recording of his statements. )

Robbie and Joe Web 181 & 184 -One parcel is all in Orange would switch all in Alamance. The other would be split
with old house in Orange and Land in Alamance. Said registered in 2 counties because property was split. Line has
changes from late 1960's. Knows where the tree was. In 1850's. Didn't care that much which county he would be put
in, but, want it settled forever.
Frances Poe - WANTED TO BE MOVED IN ALAMANCE Not sent letter, in orange, but was allowed to send her kids to
Alamance? 10t" Street on the Line in Orange. Tuition to move Alamance County? Double taxes. It's not right. Only had
an option with Alamance then went to $900 dollars. Been a dispute for 30 years. Mebane, Orange County, and CC
have not done a darn thing.
Luscious Macerella - WANTED TO BE MOVED IN ALAMANCE On 10t" Street. Alamance County Line. We have failed to
take action. 1977 312 N Ninth St. Alamance sent a letter saying that Orange had relinquished. This did not change the

line between the two counties. 1996 Orange and Alamance Staff USGS matched Line. 2002 Peter Childres USGS line
judicially stated. Feb 28t" 2000 NCGS offered to help counties in a resurvey to the line. Waste of Taxpayer time. "If you
want to not follow the law what are we going to abide by? Move me in too if you aren't gonna follow the law."
Everett Green -City Councilman Mill Creek. Fixed income. "Suggested a Strong Committee on how it would affect
people's lives." Showed up both days. 4 points. Western part of Hebron Church. Incorrect on east side (check
description).
Ed Hooks -City Councilman -Economics -Mill Creek (They allowed it.) Then some citizens disagreed with him.
John Smith (Orange Tax admin) -His Preference - "Is house on the Line or split be tax where you want it to be taxed. "
Don't want to split houses. Land can be split.
More Comments and Questions from the Crowd
• A citizen asked for a show of hands asking who wants to change counties? 4 or 5 raised their hands. Then he
asked who wanted it to stay where they were and almost everyone in the room raised their hands.
• Many believe this is a Land Grab
• "House on the Market. Can't sell."
• Many people spoke not at the podium at first...
• "Spend money on new Schools." New Yorker. Three boys to move. Stated she might as well go back to New
York.
Q. Why did Alamance allow County Line to Move West since the 1960's to happen?
Q. And if it did does get moved do people have the right to sue Orange for restitution?
