Clarion Contract Addendum for Services Gene Bell, Planner III, 245-2589 Margaret Hauth, Hillsborough Planning Director-732-1270 x86 PURPOSE: To consider approving a contract with Clarion Associates for Phase II of the Hillsborough Area-Orange County Strategic Growth Plan: Preparation of an Interlocal Agreement. . • BACKGROUND: On February 20, 2007, the BOCC adopted a RESOLUTIONACCEPTING A STRATEGIC GROWTH PLAN AND CALLING FOR PREPARATION OF AN /NTERLOCAL AGREEMENT (Attachment 1). The resolution identified four maps that were to be part of the agreement plus provisions concerning. enactment of Town zoning in certain areas of County jurisdiction and provisions for courtesy review and information sharing between the Town and County. Additionally, the resolution called for "...extensive outreach to people in those communities with ample opportunities informally and formally to ask questions and find out more about densities or other factors..." Town of Hillsborough and Orange County Planning staff met with Roger Waldon of Clarion Associates in early December concerning the Interlocal Agreement phase of the Strategic Growth Plan. Attachment 2 (Proposal for Services -Draft Interlocal Agreement) is the outcome of that meeting. To address public outreach concerns, the proposal calls for a public information meeting at the outset of the process and another after a draft agreement has been developed. In between, there will be at least one additional meeting in Hillsborough and up to two additional meetings in unincorporated areas that may be affected by terms of the interlocal agreement. FINANCIAL IMPACT: Total costs for preparation of the Interlocal Agreement (maps, text, and meetings) are projected at $16,500. As with Phase I of the Strategic Growth Plan, this is a shared project with the Town of Hillsborough. Orange County's portion of the funding will be 50% or $8,250. The FY 2007-08 BOCC Initiatives Budget has sufficient funds to cover this amount which was estimated at $10,000. RECOMMENDATION(S): The Manager recommends that the Board approve an addendum to the Clarion'contract to include services for preparation of the Interlocal Agreement for the Town • of Hillsborough/Orange County Strategic Growth Plan Phase II. flE28t?27'])~{]l' 2 • RESOLUTION ACCEPTING A STRATEGIC GROWTH PLAN AND GALLING FOR PREPARATION OF AN INTERLOCAL h+GRE1r1V1ENT WHEREAS, Orange County and the Town of Hillsborough have worked cooperatively to prepare a Strategic Growth Plan far areas surrounding the Town of Hillsborough; and WHEREAS, a Strategic Growth Plan Report (dated November, 2006) has been produced as a result of this initiative, documenting existing conditions, constraints, and opportunities, and . suggesting patterns far jursdiction over land management policies and regulations; and WHEREAS, the P.eporf provides a tratr~ework for additiana[ discussions regarding jurisdiciicn and land use patterns; and WHEREAS, a map has been prepared, attached to this Reso-ution, • suggesting general areas where low-density development and/or conservation should be given priority, and suggesting a conceptual area for consideration as Hillsborough's future limits far services and annexation; NOW THEREFORE BE IT RESOLVED by the Orange County Board of Commissioners that the November Strategic Grovvfh Plan is hereby accepted as statement of conditions and source of policy recommendations for consideratien and continued discussion. This current proposal is based on a proposal we drafted earlier this year (April, `07), and is modified to reflect our most recent discussions (12/7!07), The Orange County Board of Commissioners and the Hillsborough Town Board of Commissioners have agreed to initiate discussions intended to develop, for execution, an Interlocal Agreement. The provisions that are to be included in this Interiocal Agreement are to include: p. A map indicating formal and lega{[y-binding changes to Hillsborough's Extraterritorial Jurisdiction (ETJ~. The starting point for discussion about these changes shall be recommendations in the Navember 2006 Strategic Growth Plan Report. b. A map indicating a jointly agreed-upon boundary for land that .can be considered for future annexation by the Town of Hillsborough. The starting point for discussion about this boundary shall be the Annexation Boundary recommended in the November 2006 Strategic Growth Plan Report. c. Clarion Associates proposes to serve as facilitator for the process of preparing this Interlocal Agreement and its component parts for consideration by the Hillsborough Town Board and the Orange County Board of Commissioners. The scope of work for this initiative will include the following; Committee Meetin_ s: It is anticipated that an Interlocal Agreement Committee will be established with represen#atives from Hillsborough and Orange County. This committee may be assembled starting with an invitation to the former Steering Committee for the Strategic Growth Plan. Members from that Committee may be asked to vrork on this follow-up task, or a new Committee made up of representatives from each of the Planning Boards might be assembled, It would be helpful to have a representative from each of the governing boards involved. We expect that it will take approximately three-four meetings of this committee to discuss a draft Interlocal Agreement and its components. Clarion will prepare meeting agendas and materials to present at meetings, in consultation with Hillsborough and Orange County staff. Draft Agreement: Clarion v~rill prepare the four draft maps described above, along with revisions to those maps as directed by the Steering Committee. Clarion will prepare a draft Interlocal Agreement as described above for consideration and recommendation by the Steering Committee, with revisions as directed by staff and the Steering Gommittee. Clarion will present the draft agreement with accompanying maps to meetings of the Hillsborough Planning Board and Town Board and the Orange County Planning Board and Board of Commissioners for consideration and action. It is anticipated that two meetings each of the Hillsborough Town Board and the Orange County Board of Commissioners will be needed. Public Outreach: The main change since our discussions last spring is increased interest in a robust citizen engagement strategy. At a minimum, the initiative will need a Public Information Meeting at the outset. of the effort and another after a draft agreement has been developed, to review the proposal. In-between we anticipate, scheduling meetings and briefings in locations that reflect the interests of stakeholders~in this process: at least one additional meeting in Hillsborough and likely one or two meetings in venues located in unincorporated areas around Hillsborough that may be affected by the terms of the agreement. We wi11 work +aith local organizations to find the best times and locations for these meetings. The purpose of the meetings will be to present concepts and respond to ideas and suggestions. As the project moves to a point of being ready to put a specific proposal before the Hillsborough and Orange .County governing boards, a final public briefing will be arranged so that citizens fully understand what is being proposed, and are in a position to offer comments to the governing boards. Hillsborough and Orange County staff will arrange for logistics for these meetings, including publishing notices. We had stated in April that we expected approximately nine meetings of various types to be scheduled. With a revised approach more intensively engaging citizens in dialogue, we now project four additional meetings, for a target total of 13 meetings. We anticipate cos#s of approximately $500 per meeting for time and expenses. For the materials, eve continue to anticipate that there will likely be two drafts of the Agreement and its component parts, including the mapping component, and estimate a cost of approximately X10,000 for preparation and revision of the Agreement. The final deliverable product will be an Interlocal Agreement tivith component parts as described above, in a form that is ready for adoption and execution.
