BACKGROUND: In 1989, the Boards of Commissioners of Orange and Chatham Counties reached agreement on the physical location of the line separating the two counties. Both county staffs have been notified by the Office of State Planning that there are a number of administrative steps that must be completed in Orange and Chatham Counties, and in the Secretary of State's Office, to satisfy all the provisions of the statutes relating to the definition of county boundary lines. Mr. Rodger Durham, who has been appointed the State's representative to oversee these administrative steps, has requested that each County appoint a "co- special commissioner ", as provided for in NCGS1 53A-1 8a, to carry out any remaining functions that will finalize the boundary. The Manager recommends that the Board appoint Land Records and GIS Director Roscoe Reeve to accomplish this work. FINANCIAL IMPACT: There is no direct financial impact associated with the proposed designation. Work will be carried out by existing County staff. RECOMMENDATION(S): The Manager recommends that the Board approve the attached letter appointing Roscoe Reeve as "co- special commissioner' for the finalization of the Orange /Chatham County line, and authorize the Chair to sign the letter. November 16, 1999 Mr. Roscoe Reeve, Director Orange County Land Records and GIS PO Box 8181 Hillsborough, NC 27278 Dear Roscoe: 2 In a letter dated October 13, 1999, Rodger Durham of the State Office of the North Carolina Geodetic Survey asked the County to appoint a co- special commissioner to assist his office in finalizing the boundary between Orange and Chatham County. The intention was to have someone available from each county to coordinate with Geodetic Survey -in completing the paperwork to record a boundary map agreed to by both counties in 1988. It is my understanding that the map produced by Geodetic Survey will be (1) approved by the Board of Commissioners (BOC) from both counties, (2) recorded in the Register of Deeds office in both counties, and (3) recorded in the Office of Secretary of State. On November 16, 1999, in accordance with NCGS 153A- 18(a), the Orange County Board of Commissioners appointed you to serve as Co- Special Commissioner for Orange County in the above described matter, as the two counties seek completion of their boundary agreement per NCGS 153A- 18(c). Your appointment takes effect on November 16, 1999 and ends with the recording of the boundary map in the office of the Secretary of State. It is anticipated that you will fulfill your duties according to the appropriate statutes and the agreements made, hereto, by the Orange County Board of Commissioners. Sincerely, Alice M. Cameron Street Hillsborough, NC 27278 Dear Roscoe and John: Thank you for meeting on October 11, 1999, to discuss the status of the Chatham/ Orange County boundary. I have answers to some of the questions that you raised. You asked if Linda Edmondson, a North Carolina private surveyor, had provided coordinate information for the angle points around the two bubbles in the Chatham / Orange County boundary? Yes, NCGS has obtained that information from Ms. Edmondson. Second, you inquired as to the location of the original composite orthophoto upon which the agreed 1989 Chatham / Orange County boundary was drawn? NCGS has the orthophoto, and it is now in my office. Next, you wondered if Chatham County had a record indicating that the Chatham County Commissioners officially approved the agreed Chatham / Orange County boundary? You also asked about the status of the agreed 1988 boundary in Chatham County? I do not know the line's status. I am in the process of contacting Kimberly Horton, Chatham County Tax Administrator, and Keith Megginson, Chatham County Planner, to learn the line's status. I understand that Orange County Commissioners have recognized the agreed boundary and that you are sending me a copy of the resolution of ratification. Further, I understand that you are forwarding to Chatham County a print of a map showing the county line and individual parcels along the line. Fourth, you wanted to know the status of the monumentation along the agreed Chatham / Orange County line? Per conversation this week with Gary Thompson, Director of N.C.G.S., our agency has set monuments at various I road crossings along the agreed boundary. The easterly terminus common with Durham County is monumented. The westerly terminus at the Haw River is not monumented nor referenced except by coordinates. Bubble No. 1 (Wolf's Pond on the west side of Poythress Rd, SR 1534/1939) has either a nail or subdivision monuments at the angle points. Bubble No. 2 (Atwater Tract on Collins Mountain Road, SR 1542/1954) has nails set at the four angle points. General Statute 153A -18a and upon request of the counties, the North Carolina Geodetic Survey is pleased to offer its technical expertise to assist Chatham and Orange Counties in reaffirming the 1989 agreed boundary, or any other boundary upon which both counties mutually agree. Recommend that one or both of you approach the Orange County manager or your Board of Commissioners to have yourselves appointed as co- special commissioners to resolve and finalize the boundary. Please mail me a copy of your appointment letter. I will need the same from Chatham County. Meanwhile, I plan to meet this month with Chatham County officials and afterwards hold a joint meeting with the special commissioners. N.C.G.S. will pay all costs except for time and expenses of the special commissioners and your GIS department.
