BACKGROUND: Request Applicant: Steve Yuhasz, agent for Ryland Pool and Clarksville Jewelry by Ann, Inc. • Subdivision follows the conventional subdivision section of the regulations • 60 single-family lots on a 77.24 acres tract (including rights-of--way) Location The property, located in Little River Township along both sides of NC 157, is at the intersection of Berry Road (SR 1523) and NC 157. A USGS designated stream is located along the southern boundary of the western side of the tract. Lick Creek is along the eastern boundary of the eastern portion of the property. Existing Site Conditions Zoning:. • Agricultural Residential (AR) and Flat River Protected Watershed (maximum impervious surface coverage is twelve (12) percent) • Adjacent land uses: single-family residential and agricultural Physical Description: • Hardwoods covertwo-thirds of the property with the remainder as open fields. G:/robertlmeridth.doc/nov99/rpd 2 Proposed Site Conditions Roads: • Access to subdivision is from NC 157 near the intersection of Berry Road (SR1523) (1997 NCDOT Average Daily Traffic: 2100 VPD at Guess Road intersection) • Proposed public streets to be built to NCDOT standards • Access to the western tract from NC 157 is at the southernmost part of the property to allow for better site visibility Water and Sewer: • Individual well and septic system on each lot • Health Department verified on original plan that each lot contains provisionally suitable soils to locate a septic system Parks and Recreation: • Stream buffers along Lick Creek and Tilman Branch • Payment in-lieu-of parkland dedication (i.e. $455 per recorded lot) will total $26,845 for 60 lots Agency Comments • Requests for agency review were -sent to: NCDOT, Erosion Control, NRCS, Recreation and Parks, Orange County Schools, County Attorney and Fire Marshall Develoament Process. Schedule and Action Planning Board: • First Action: Concept Plan approved by the Planning Board (by a unanimous vote) May 6, 1999, with the two following conditions: 1. Each lot shall contain an adequate area for septic disposal, and repair area, approved by the Orange County Division of Environmental Health; 2. .All septic systems shall be located outside of any stream buffer. • Preliminary Plan addressed all conditions of approval of the Concept Plan. • Second Action: Planning Board recommended Preliminary Plan approval September 1, 1999 • Recommended a left southbound turn lane for Old Lick Road be constructed within NC 157 rig ht-of--way • Recommended the NC 157 entrance to the western tract be shifted to the southernmost point • Developer revised preliminary map to reflect Planning Board conditions • Developer increased bufferyard along NC 157 to 75 feet • Third Action: Board of County Commissioners to consider the Preliminary Plan Options: 1. Action within forty-five (45) days of this meeting or within such further time consented to in writing by the applicant. 2. If the Board of County Commissioners fails to act within the specified time period, approval is directed without conditions. 3. If Preliminary Plan is approved by the County Commissioners the applicant shall have one (1) year to prepare and file a Final Plat or to request aone-year extension from the Planning Director. G:/roberdmeridth.doc/nov99/rpd 4 RESOLUTION AF THE ORANGE COUNTY BOARD OF COUNTY COMMISSIONERS Date of Meeting: December 7, 1999 Name of Subdivision: Old Meredith Place Owner/Applicant: Steve Yuhasz, agent for Ryland Pool and Clarksville Jewelry by Ann, Inc. The Board of County Commissioners hereby approves Old Meredith Place subdivision Preliminary Plat, dated July 1, 1999, revised on August 6, 1999, October 29, 1999 and November 23, 1999 and containing 60 lots, subject to the fulfillment of requirements specified herein. All roads shall be irrevocably dedicated to the general public and be constructed to standards of the North Carolina Department of Transportation (NCDOT). The approval of this resolution authorizes and directs the Orange County Manager to accept for the County and on behalf of the public generally, the offer of dedication of Meredith Drive, Pool Road, Lick Creek Road, Macon Lane and Wiley Road. This acceptance of dedication to the general public shall be without maintenance responsibility. These roads shall be maintained by the owner/applicant (Clarksville Jewelry by Ann, Inc. and Ryland Pool) until such time as they are accepted for maintenance by NCDOT or some other governmental body. Before the Final Plat of Old Meredith Place can be recorded: A. Sewage Disposal 1. Each residential lot shall contain an adequate area for well, septic disposal and repair area, approved by the Orange County Division of Environmental Health. 2. Disclosure that the septic system location may restrict the size and location of improvements shall be included in a document describing development restrictions to be recorded concurrently with the Final Plat. The document shall also disclose that information regarding the tentative location of septic systems and is available from the Orange County Health Deparhnent, Division of Environmental Health. B. Roads and Access 1. Meredith Drive, Pool Road, Macon Lane, Wiley Road and Lick Creek Road shall be constructed to NCDOT standards within a 50-foot right-of--way with 5' utility easements on each side. Construction shall be inspected and approved by NCDOT. OR f:planning/robert/merideth/merdtres.doGnov99/rpd A letter of credit or escrow agreement or other security shall be submitted to secure construction of Meredith Drive, Pool Road, Macon Lane, Wiley Road and Lick Creek Road to NCDOT_standards. An estimate of the construction cost must be prepared by a certified/licensed engineer or grading contractor and submitted to the Orange County Planning Department. The financial guarantee must reflect 110 percent of that estimate and be issued by an accredited financial institution licensed to do business in North Carolina. The document describing development restrictions.to be recorded with the Final Plat shall state that the financial guarantee will not be released until the road construction has been inspected and approved by NCDOT. 2. An erosion control plan for construction of all streets shall be submitted by the applicant for review and approved by the Orange County Erosion Control Division prior to any disturbance on the site. 3 Prior to any construction or any alteration of any existing access within the right- of-way of NC 157, the developer/owner shall secure a driveway permit from the NCDOT District Office. Submit a copy of the NCDOT- approved permit and letter to the Planning Departrent at the same time as the request for Planning Department signatures on the Final Plat. Sight distance triangles shall be shown at all intersections within the subdivision, or included within the right-of--way of the proposed street. 4. All lots shall secure access from an internal street within the subdivision. No corner lot access shall be allowed within 50 feet of the right-of--way of an intersection. This restriction shall be stated in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. 5. Approved street name signs shall be erected at the intersection of streets as required in Section IV-B-3-c-12 of the Orange County Subdivision Regulations. Evidence shall be submitted by the applicant that the signs are in place or a copy of the receipt for purchase of the signs shall be submitted to the Planning Department at time of request to record the Final Plat. 6. Dedicate to the Department of Transportation the entire property between NC 157 and Berry Road for future road improvements. Record the dedication and reference the Deed Book and Page Number on the Final Plat. 7. Wiley Road right-of--way shall be extended to the northern property line as shown on the preliminary plat and in accordance with NCDOT standards. Additionally, 20' construction easements shall be shown on the Final Plat on both sides of the unimproved section of Wiley Road. Meredith Drive right-of--way shall be extended to the western property line as shown on the preliminary plat and in accordance with NCDOT street standards. Additionally, 20' construction easements shall be shown on the Final Plat on both sides of the unimproved section of Meredith Drive. Indicate on the final plat "Subject to future extension". 9. Dedicate to NCDOT additional right-of--way along the entire frontage of both sides of NC 157 to obtain a 100-foot cross-section. For property that fronts on only one side NC 157, dedicate fifty (50) feet from centerline of existing right-of- way. Property lines to stop at the right-of--way line of all streets. 10. Build, to NCDOT standards, a center turn lane for the south bound lane of NC 157 at the entrance to Old Lick Road. 11. A sight distance easement on the inside radius of NC 157 shall be shown on the fmal plat as indicated. on the preliminary plan. C. Land Use Buffers and Landscaping Landscaping shall be preserved as indicated on the approved landscape plan, and must be inspected and approved by the Planning and Inspections Department prior to Planning Department signatures on the final plat. Landscaping shall be placed behind the sight distance triangles at intersections. 2. Provisions for protection of existing trees as shown on the approved landscape plan shall be included in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. 3. A Type E Land Use Buffer shall be provided along the eastern side of NC 157 and lalong the western side of NC 157 exclusive of the area designated as sight distance easement. The buffer shall be 75 feet in width as shown on the Preliminary Plan and shall provide sufficient vegetation to meet the standards of Section IV-B-8-e of the Subdivision Regulations. Said buffer shall be so noted on the final plat, and described in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. D. Drainage 1. The floodway and floodway fringe of the USGA intermittent streams shall be noted on the face of the Final Plat. Development restrictions within the floodplain shall be specified on a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. Impervious surface data, as pursuant to Article 6.23.3c.1 of the Zoning Ordinance shall be included in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. 3. A stream buffer shall be provided in accordance with Section 6.32.7 of the Zoning Ordinance. The width of the buffer shall be stated on the face of plat. Development restrictions within the buffer shall be specified in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. 4. Locate drainage easements as required following review and approval of the Erosion Control Plan. E. Parkland The payment in-lieu-of parkland dedication fee shall be paid prior Planning Department signatures on the Final Plat. The fee is $455 per recorded lot. F. Miscellaneous 1. The Final Plat shall contain a title block and vicinity map in accordance with Section V-D-2 and V-D-3 of the Orange. County Subdivision Regulations. 2. The following easements shall be shown on the plat: a. drainage easements as required by D.4 above. 3. The minimum building setback requirements and impervious surface maximums shall be stated on the Final Plat, and in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. G. Certifications 1. A Certificate of Survey and Accuracy signed by a Professional Land Surveyor shall be notarized on the face of the Final Plat. 2. A Certificate of Dedication and Maintenance in the form provided in Section V-D-6-b of the Orange County Subdivision Regulations signed by the landowner and developer shall be on the face of the plat and included in a document describing development restrictions to be recorded concurrently with the Final Plat. A Certificate of Approval signed by the Orange County Planning and Inspections Department. 5. Benedict stated that the Board could. suggest something that they would be more comfortable with. The Board suggested to change the existing 75 feet to -100 feet fora 50 foot wide road corridor and 125 feet fora 60+ wide road corridor. Dedication to be shown on the final plat. • Ultimate right-of-way along NC 157 to be 100 feet per recommendation of Land Use Element of the Comprehensive Plan. Fifty (50) feet from centerline of existing right-of--way will be required on the final plat along the entire frontage of NC 157 (i.e. both sides of NC 157). A. Prior to any construction or any alteration of any existing access within the right- . of-way of NC 157, the developer/owner shall secure a driveway permit from the NCDOT District Office. Submit a copy of the NCDOT- approved permit and letter to the Planning Department at the same time as the request for Planning Department signatures on the Final Plat. Sight distance triangles shall be shown at all intersections within the subdivision, or included within the right-of--way of -the proposed street. 5. All lots shall secure access from an internal street within the subdivision. No corner lot access shall be allowed within 50 feet of the right-of--way of an intersection. This restriction shall be stated in a .document describing development restrictions and requirements to be prepazed by Planning Staff and recorded concurrently with the Final Plat. 6. Approved street name signs shall be erected at the intersection of streets as required in Section 1V-B-3-c-12 of the Orange County Subdivision Regulations. Evidence shall be submitted by the applicant that the signs aze in place or a copy of the receipt for purchase of the signs shall be submitted to the Planning Department. 7. Dedicate to the Department of Transportation the entire property between NC 157 and Berry Road for future road improvements. Record the dedication and reference the Deed Book and Page Number on the Final Plat. 8. The western entrance (i.e. Meredith Drive) to NC 157 shall be shifted to the south to the southern property line of Rebecca Parker. NCDOT standazds of construction shall be met. 15 9. Extend either Lick Creek Road or Wiley Road (developer's choice) to the northern property line. Provide a temporary turn around until such time as the road is extended. Indicate on fmal plat "Subject to future extension". 10. Extend either Meredith Drive or Morrell Street (developer's choice) to the western property line. Provide a temporary turn around until such time as the road is extended. Indicate on the final plat "Subject to future extension".. 11. Dedicate to NCDOT additional right-of--way along the entire frontage of both sides of NC 157 to obtain a 100-foot cross-section. For property that fronts on only one side NC 157, dedicate fifty (50) feet from centerline of existing right-of- way. Property lines to stop at the right-of-way line of all streets. C. -Land Use Buffers and Landscaping 1. Landscaping shall be preserved as indicated on the approved landscape plan, and must be inspected and approved by the Planning and Inspections Department prior to Planning Department signatures on the final plat. Landscaping shall be placed behind the sight distance triangles at intersections. 2. Provisions for protection of existing trees as shown on the approved landscape plan shall be included in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. 3. A Type A Land Use Buffer shall be provided along the eastern side of NC 157 and along the western side of NC 157 exclusive of the area designated as sight distance easement. The buffer shall be 30 feet in width as shown on the Preliminary Plan and shall provide sufficient vegetation to meet the standards of Section TV-B-8-e of the Subdivision Regulations. Said buffer shall be so noted on the fmal plat, and described in a document describing development. restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. D. Drainage 1. The floodway and floodway fringe of the USGA intermittent stream shall be noted on the face of the Final Plat. Development restrictions within the floodplain shall be specified on a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. - 2. Impervious surface data, as pursuant to Article 6.23.3c.1 of the Zoning Ordinance shall be included in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. 3. A stream buffer shall be provided in accordance with Section 6.32.7 of the Zoning Ordinance. 'The, width of the buffer shall be stated on the face of plat. Development restrictions within the buffer shall be specified in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. 4. Locate drainage easements as required following review and approval of the Erosion Control Plan. 16 E. Parkland 1. The payment in-lieu-of parkland dedication fee shall be paid prior Planning Department signatures on the Final Plat. The fee is $455 per recorded lot. F. Miscellaneous 1. The Final Plat shall contain a title block and vicinity map iri accordance with Section V-D-2 and V-D-3 of the Orange County Subdivision Regulations. 2. The following easements shill be shown on the plat: a. drainage easements as required by D.4 above. 3. The minimum building setback requirements and impervious surface maximums shall be stated on the Final Plat, and in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. G. Certifications A Certificate of Survey and Accuracy signed by a Professional Land Surveyor shall be notarized on the face of the Final Plat. 2. A Certificate of Dedication and Maintenance in the form provided in Section V-D-6-b of the Orange County Subdivision Regulations signed by the landowner and developer shall be on the face of the plat and included in a document describing development restrictions to be recorded concurrently with the Final Plat. 3. The Division of Environmental Health shall certify that each lot contains a suitable area for septic disposal. 4. A Certificate of Approval signed by the Orange County Planning and Inspections Department. 5. NCDOT shall certify that Morrell Street, Meredith Drive, Pool Street, Wiley Road, Lick Creek Road and Macon Lane have been constructed or that construction plans have been approved. Barrows asked if lot 4 could be reduced so that the road could come through that lot and avoid the stream buffer. Davis responded that the constraint is not the lot, but a triangular piece of land that belongs to a Ms. Parker that comes across the road and she has not been cooperative up until this point. He stated that if the 50 feet is dedicated from the centerline, the right-of--way will come back and there is a good chance that the road will be out of the stream buffer by the time it gets to the property. Barrows asked if site number 31 will be buildable after the site distance easement. Yuhasz responded that this site could be used for installation of a septic system. Carl Crabtree expressed concern with the traffic and safety issues. He also expressed concern with the size of area that will be used for the septic systems. He noted that some septic systems in the area have failed in the past. He also stated that the number of wells that are proposed will probably affect some of the existing wells. 17 Allison asked about the driveway for lot 34. Davis~responded that lot 34 would have to access Lick Creek Road. Katz asked if there have been any assessments estimating ground water. Benedict responded that the Environmental Health Department has not put any restrictions on this development based on water capacity. Barrows noted that the access is too close to the curve and since there have been a.number of accidents there she would recommend a turn lane. Lincoln noted that the Board could make this a condition of approval. MOTION: Strayhorn moved to approve the preliminary plan for Old Meredith Place per the Resolution of Approval and adding the condition that the developer shall construct a southbound center turn lane. Seconded by Selkirk. Prior to construction of -any new access or alteration of any existing access within the right of way, the developer/owner is required to secure a permit with this office. It is the responsibility of the owner/developer to obtain a permit. 2. NCDOT will require a 650' sight Distance along the inside curve of NC 157. The revised plans reflect this requirement; however, they are showing a Type A landscape buffer in front of the easement. The buffer needs to relocated behind the easement so two do not conflict. If the county requires all of their buffer along the right of way then the owner/developer may need to dedicate the proposed easement as additional right of way. 3. NCDOT will require the owner/developer to dedicate additional right of way at the intersection of SR 1523 and NC 157. The additional right of way is needed for intersection improvements. 4. The owner/developer should dedicate 10' x 70' Sight Triangles at each proposed. intersection. Please refer to the attached figure regarding the minimum design. 5. We are concerned with the proposed future stub outs between lots 54 8c 55 and Lots 12 & 13. In the past, these types of stub outs have been plagued with problems. Some of the problems included but not limited to poor connections between phases, inadequate right of way or construction easements, and ultimately designs that do not meet Minimum State guidelines for subdivision roads. This office would recommend the proposed roadways be extended to the property lines to avoid the stub outs or have roadways at Teat designed and approved as part of the subdivision approval. By reviewing the proposed design, we can check all design standazds and construction needs to insure the future roadway will be acceptable. 6. The proposed cul-de-sac around lots 19, 28, 29 and 30 is unacceptable. The cul-de-sac is functioning as a bulb and should be eliminated. 7. We are concerned about the reverse curve between lots 7 & 17. The attached plans do not provide enough detail to review the design; therefore, we will need to review this section of roadway again before any final plans are approved. The owner/developer. should provide a minimum centerline radius between 230' for local roads and 310' for collectors. 8. Prior to any construction, the owner-~laveloper will need to submit their final plans for review. The final plans should include the horizontal and_ vertical alignment information, a typical. section, drainage facilities, vicinity map, and the number of lots with the proposed driveway location. 9. The owner/developer should be awaze of General Statute 136-102.2, in which new roads are not eligible for the State Maintenance system unless certain requirements are met. An explanation of these requirements can be found on pages 13, 14 and 15 of the current (January 1999) NCDOT Subdivision Roads Manual. All roads shall be irrevocably .dedicated to the general public and be constructed to standards of the North Carolina Department of Transportation (NCDOT). The approval of this resolution authorizes and directs the Orange County Manager to accept for the County and on behalf of the public generally, the offer of dedication of Meredith Drive, Pool Road, Lick Creek Road, Macon Lane and Wiley Road. This acceptance of dedication to the general public shall be without maintenance responsibility. These roads shall be maintained by the owner/applicant (Clarksville • Jewelry by Ann, Inc. and Ryland Pool) until such time as they are accepted for maintenance by NCDOT or some other governmental body. Before the Final Plat of Old Meredith Place can be recorded: A. Sewage Disposal 1. Each residential lot shall contain adequate areas for a well, and a conventionally- sized septic disposal system and its associated repair area, approved by the Orange County Division of Environmental Health. 2. Disclosure that the septic system location may restrict the size and location of improvements. shall be included in a document describing development restrictions to be recorded concurrently with the Final Plat. The document shall also disclose that information regarding the tentative location of septic systems and is available from the Orange County Health Department, Division of Environmental Health.. B. Roads and Access 1. Meredith.Drive, Pool Road, Macon Lane, Wiley Road and Lick Creek Road shall ', • be constructed to NCDOT standards within a 50-foot right-of--way with 5' utility easements on each side.. Construction shall be inspected and approved by NCDOT. An estimate of the construction cost must be prepared by a certified/licensed engineer or grading contractor and submitted to the Orange County Planning Department. The financial guarantee must reflect 110 percent of that .estimate and be issued by an accredited financial institution licensed to do business in North Carolina. The document describing development restrictions to be recorded with the Final Plat shall state that the financial guarantee will not be .released until the road construction has been inspected and approved by NCDOT. • 2. An erosion control plan for construction of all streets shall be submitted by the applicant for review and approved by the Orange County Erosion Control Division prior to any disturbance on the site. 3. .Prior to any construction or any alteration of any existing access within the right- of-way of NC 157, the developer/owner shall secure a driveway permit from the NCDOT District Office. Submit a copy of the NCDOT- approved permit and letter to the Planning Department at the same time as the request for Planning Department signatures on the Final Plat. Sight distance triangles shall be shown at all intersections within the subdivision, or included within the right-of--way of the proposed street. _ 4. All lots shall secure access from an internal street within the subdivision. No corner lot access shall be allowed within 50 feet of the right-of--way of an intersection. This restriction shall be stated in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. 5. Approved street name signs shall be erected at the intersection of streets as required in Section IV-B-3-c-12 of the Orange County Subdivision Regulations. Evidence shall be submitted by the applicant that the signs are in place or a copy of the receipt for purchase of the signs shall be submitted to the Planning Department at time of request to record the Final-Plat. 6. Dedicate to .the Department of Transportation the entire property between NC 157. .and Berry Road for future road improvements. Record the dedication and reference the Deed Book and Page Number on the Final Plat. 7. Wiley Road right-of--way shall be extended to the northern property line as shown on the preliminary plat and in accordance with NCDOT standards.. Dedicate to NCDOT additional right-of--way along the entire frontage of both sides of NC 157 to obtain a 100-foot cross-section. For property that fronts on only one side NC 157, dedicate fifty (50) feet from centerline of existing right-of- way. Property lines to stop at the right-of--way line of all streets. Build, to NCDOT standards, a center turn lane for the south bound lane of NC 157 at the entrance to Lick Creek Road. A sight distance easement on the inside radius of NC157 shall be shown on the final plat as indicated on the preliminary plan. C. Land Use Buffers and Landscaping 1. Landscaping shall be preserved as indicated on the approved landscape plan, and must be inspected and approved by the Planning and Inspections Department prior to Planning Department signatures on the final plat. Landscaping shall be placed. behind the sight distance triangles at intersections. 2. Provisions for protection of existing trees as shown on the approved landscape plan shall be included in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. 3. A Type E Land Use Buffer shall be provided along the eastern side of NC .157 and aalong the western side of NC 157 exclusive of the area designated as sight distance easement. The buffer shall be 75 feet in width as shown on the Preliminary Plan and shall provide sufficient vegetation to meet the standards of Section IV-B-8-e of the Subdivision Regulations. Said buffer shall be so noted on the final plat, and described in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. D. Drainage 1. The floodway and floodway fringe of the USGA intermittent streams shall. be noted on the face of the Final Plat.
