Members Present: Chairman Harvey D. Bennett, and Commissioners William C. Ray, Carl M. Smith,-Henry Walker and Ira A. Ward. Members Absent: None Minutes read and approved. Norman Long, Zoning Officer, and Tyson Clayton presented the following recommendations from the County Planning Board: That the request of Paul Blair for the extension of his existing mobile home park be approved. Upon motion of Commissioner Ward, seconded by Commissioner Ray, it was moved and unanimously adopted, that the recommendation of the County Planning Board relative to the request of Paul Blair be approved. That the request of Brach Pearson to establish a mobile home park be approved. Upon motion of Commissioner Ray, seconded by Commissioner Walker, it was moved and unanimously adopted that the Board of Commissioners take no action on the recommendation relative to Mr. Pearson's request until further study is made into the matter. That the recommendation relative to Hickory Forest Subdivision be accepted upon the receipt of a final plat of said subdivision. No action was taken on this recommendation. Chairman Bennett was authorized to sign the following Blind Aid Grants: AID TO THE BLIND AGENDA November 4, 1968 NAME EFF. Marshall, Chairman of Board of Education,requested that the Sheriff of the county be authorized by the Board of Commissioners to station deputies in the halls of Orange High School for as long as this action is necessary. Upon motion of Commissioner Ray, seconded by Commissioner Walker, it was moved and unanimously adopted that the Board of Commissioners grant the request of the Board of Education in requesting the Sheriff of Orange County to dispurse to Orange High School as many deputies as he has available to help maintain order within the school building. 1'0;h t race 1l i6 Robert Page, Attorney for Spence & Lester Developers of the Colony Woods Subdivision, presented plats of said subdivision and pointed out that the Durham- Orange County line, as recently established, ran through a number of lots in the subdivision. Mr. Page inquired whether or not there had been or would be an agreement between Durham and Orange County relative to the taxation policy of the property located in both counties. The County Administrator advised Mr. Page that the problem of location of property in both counties had been discussed with the Durham County Manager and that an agreement of taxation policy would be signed and that Mr. Page will be notified of the taxation policy once an agreement has been reached. North Central Piedmont Resources Conservation Commissioner Ray and G. A. Brown, representative of-the/and Development Program of North Carolina. requested that the Board of Commissioners schedule a district meeting for the Conservation and Development Committee members, Boards of Commissioners and other interested agencies on Monday, November 25th in Hillsborough. Mr. Brown was requested to see if the banks, the Building and Loan and Graham Production Credit Association would assist and help sponsor the dinner and the meeting. Upon motion of Commissioner Ray, seconded by Commissioner Walker, it was moved and unanimously adopted, that Orange County would be host on Monday, November 25, 1968 to the Conservation and Development Committee members, Boards of Commissioners and other interested agencies from the district and G. A. Brown was authorized to proceed with the plans for said meeting. The County Attorney presented the following resolution: Commissioner Ward introducted the following resolution which was read: RESOLUTION CALLING A SPECIAL BOND ELECTION IN DOGWOOD ACRES SANITARY DISTRICT BE IT RESOLVED by the Board of Commissioners for the County of Orange: Section 1. The Board of Commissioners has determined and does hereby find and declare that it has received certified copies of two resolutions passed by the Sanitary District Board of the Dogwood Acres Sanitary District on October 21, 1968, entitled: RESOLUTION AUTHORIZING $100,000 WATER BONDS OF DOGWOOD ACRES SANITARY DISTRICT, AND RESOLUTION DIRECTING THE SECRETARY OF THE SANITARY DISTRICT BOARD TO PUBLISH THE BOND RESOLUTION AUTHORIZING $100,000 WATER BONDS OF DOGWOOD ACRES SANITARY DISTRICT, AND REQUESTING THE BOARD OF COMMISSIONERS FOR THE COUNTY OF ORANGE TO CALL AN ELECTION UPON THE ISSUANCE OF THE BONDS AUTHORIZED THEREBY. Section 2. A special bond election is hereby ordered to be held in the Dogwood Acres Sanitary District, in OrangeCounty, North Carolina, on Saturday, December 21, 1968, between 6:30 A.M. and 6:30 P.M., at which there shall be submitted to the qualified registered voters of said Dogwood Acres Sanitary District the following proposition: Issuing not exceeding $100,000 Water Bonds for the purpose of providing funds for the construction of a water system for the Dog- wood Acres District, including the installation of water mains and lines, as authorized by a bond resolution adopted by the Sanitary District Board of said District on October 21, 1968, and the levy of a tax for the payment thereof. Section 3. There shall be a new registration of voters for said election, the books for such new registration to be open from 9:00 A.M. until sunset on each day beginning Saturday, November 23, 1968, and ending Saturday, December 7, 1968. On each Saturday during such period said books shall be kept open at the voting place. Saturday, December l4, 1968, shall be Challenge Day. Section 4. Notice of said election and new registration shall be published once a week for three successive weeks, the first publication to be at least thirty (30) days before the close of the registration books, in The Chapel Hill Weekly, a newspaper published in Oran ge County and circulating in said District, which notice shall be in substantially the following form: 566K 6,U 3,41 NOTICE OF SPECIAL BOND ELECTION AND NEW REGISTRATION IN DOGWOOD ACRES SANITARY DISTRICT A special bond election will be held between 6:30 A.M. and 6:30 P.M., Saturday, December 21, 1968, at which there will be submitted to the qualified registered voters of the Dogwood Acres Sanitary District, in Orange County, North Carolina, which District comprises the territory hereinafter described, the following proposition: Issuing not exceeding $100,000 Water Bonds for the purpose of providing funds for the Construc- tion of a water system for the District, including the installation of water mains and lines, as authorized by a bond resolution adopted by the Sanitary District Board of said District on October 21, 1968, and the levy of a tax for the payment thereof. The boundary lines of said Dogwood Acres Sanitary District are as follows: BEGINNING at a concrete monument located on the northern right-of-way line of Dogwood Drive, being State Road 1962, at the Southwest corner of Lot 64 of Do ood Acres Subdivision according to the map thereof recorded in Map Book },, page 113 of the Orange County Register; running thence along the southern line of said Lot 64 South 86 degrees 55 minutes East 278 feet to an iron pipe in the Southeastern corner of said Lot 64 of Dogwood Acres Subdivision. Thence North 8 degrees 03 minutes East 302 feet to an iron pipe located in the eastern corner of Lot 66 Dogwood Acres Subdivision; thence North 32 degrees 55 minutes West 1162.5 feet to an iron pipe in a rock pile in the line of Lot 74 of said Dogwood Acres Subdivision; running thence North 77 degrees 15 minutes West 1514 feet to an iron pipe and pointers located in the Northwestern corner of Lot 87, Dogwood Acres Subdivision; thence North 5 degrees 45 minutes East 200 feet to an iron pipe, a corner of the Dogwood Acres Subdivision; thence North 84 degrees 53 minutes West 1552 feet to a point in the eastern right-of-way line of the Smith Level Road, being State Road 1919, an iron located in the Northwest corner of Lot 1, Dogwood Acres Subdivision; thence along the eastern right-of-way line of the Smith Level Road South 10 degrees 15 minutes West 300 feet, South 4 degrees 30 minutes West 162.6 feet to a point, thence continuing along the right-of-way line of the Smith Level Road South 8 degrees 40 minutes East 777 feet to an iron pipe located in the Southwestern corner of Lot 14 Dogwood Acres Subdivision; thence South 83 degrees 52 minutes East 1381 feet to an iron pipe located in the Northwest corner of Lot 34 Dogwood Acres Subdivision; thence South 7 degrees 40 minutes West 456 feet to an iron, a common corner of Dogwood Acres Subdivision and.Dogwood Acres Subdivision Extension; thence South 6 degrees 01 minutes West 1047.03 feet to a rock pile located in the most Southerly corner of Lot 12 Dogwood Acres Subdiviaion Extension according to a map thereof prepared by John R. Gove dated December 1954; it being a corner of property now or formerly belonging to Sidney Crabtree; thence South 66 degrees 27 minutes East 1022.05 feet to rock pile located in the Southeast corner of Lot 17 of Dogwood Acres Subdivision Extension; thence South 25 degrees 44 minutes East 535 feet to a point, a corner of the Leroy Merritt property; running thence along the lines of the Leroy Merritt property South 11 degrees East 918 feet, North 33 degrees East 397 feet, South 14 degrees East 500 feet, South 37 degrees 30 minutes East 560.10 feet to an iron pin in the northern right-of-way line of U. S. ---- Highway 15-501; thence along the northern right-of-way of U. S. Highway 15-501 North 53 degrees 38 minutes East 246.56 feet to an iron stake, a common corner between Leroy Merritt's and E. G. Merritt's property; thence along the dividing line between E. G. Merritt's and Leroy Merritt's property North 1 degree 16 minutes East 1768.30 feet to an iron stake in the southern right-of-way line of Dogwood Drive; thence within and along Dogwood Drive the following courses and distances: North 43 degrees 37 minutes West 63.56 feet, North 36 degrees 24 minutes West 68.01 feet, North 29 degrees 29 minutes West 438.81 feet, North 10 degrees 28 minutes West 326.01 feet, North 11 degrees 28 minutes East 308.71 feet to the point of beginning. The proposition hereinabove set forth contains a statement of the purpose for which the bonds are authorized by the resolution referred to in such proposition. If said bonds shall be issued a tax will be levied upon all taxable property within said Dogwood Acres Sanitary District sufficient to pay the principal of and the interest on said bonds. A new registration of voters has been ordered and no one will be permitted to vote unless registered anew. The books for such new registration will be open from 9:00 A.M. until sunset on each day beginning Saturday, November 23, 1968, and ending Saturday, December 7, 1968. On each Saturday during such registration period said books will be kept open at the voting place. Saturday, December 14, 1968, is Challenge Day. Facsimile o signature of Clerk of Board of Commissioners Commissioner Ward moved the passage of the foregoing resolution entitled: "RESOLUTION CALLING A SPECIAL BOND ELECTION IN DOGWOOD ACRES SANITARY DISTRICT", Commissioner Smith seconded the motion, and the resolution was passed by the following vote: Ayes: Commissioners.Bennett, Ray, Smith, Walker and Ward. Noes: None i _i E'U6Y , r'i1Cl i`1J' Dr. Dorothy Kivster and representatives of the Cedar Grove Housing Corporation were present and Dick Hutchins presented a resume of the proposed project plans which included the consideration of a joint housing authority for Orange and Chatham Counties. A road petition for roads # 1320, 1316, 1313 and 1315 was received and the clerk was authorized to forward same to the State Highway Commission. There being no further business to come before the Board said meeting was adjourned to meet again on Wednesday, November 6, 1968 at 7:30 P.M. for the purpose of conducting a joint-public hearing with the County Planning Board. Members Present: Chairman Harvey D. Bennett and Commissioners William C. Ray, Carl M. Smith, Henry Walker and Ira A. Ward. Members Absent: None The Chairman declared that this was the time and place as duly advertised for the public hearing with the County Planning Board. For minutes of said public hearing see the minute docket book df the Orange County Planning Board. The Chairman then declared the public hearing adjourned. The Board of Commissioners began consideration on the Brack Pearson recommendation which had been received by the Board of Commissioners from the County Planning Board on Monday, November 4, 1968. Discussion ensued. Upon motion of Commissioner Walker, seconded by Commissioner Ward, it was moved and unanimously adopted that the recommendation of the County Planning Board relative to the Brack Pearson request to rezone his property from a residential area to a mobile home park area be denied.
