PURPOSE: To provide an update to the Board on the status of Orange County EMS and Rescue
Squad.
BACKGROUND: The North Carolina Emergency Medical Services Act of 1973, Article 56 of Chapter
143 of the North Carolina General Statutes establishes a statewide system to support the provision of
emergency medical services throughout the state by regulating and providing technical support to the
service providers. The Department of Health and Human Services through the Office of Emergency
Medical Services (OEMS) has the responsibility for the North Carolina EMS program. The Act also
requires that counties establish Emergency Medical Services (EMS) systems and ensure that
emergency medical services are available to residents. The North Carolina Medical Care
Commission establishes rules and regulations for local EMS systems.
Orange County Legal Responsibilities
The County must submit an EMS System application to OEMS every six years to be recertified to
ensure compliance with Medical Care Commissions rules and regulations. (Orange County will apply
to be recertified in 2010) Orange County must identify the ambulances that will operate in its system
service area twenty -four (24) hours a day. The County is authorized to adopt an ordinance to
franchise ambulance services. In 1993, the Orange County Board of County Commissioners
approved the Emergency Management Ordinance which included a provision for the franchise of
ambulance and rescue services.
The Emergency Management Ordinance provides that the Emergency Services Director shall be
responsible to the County Manager "in regard to all phases of emergency management services" and
is "responsible for the planning, coordination and operation of the emergency management activities
in the County."

Franchise Aareement
The Orange County ordinance "Regulating Emergency Medical, First Responder, and Rescue
Services and Granting of Franchises and Contract to the Operators in the County of Orange Section
6.4 provides that a franchise may be granted if the County finds that: (a) the applicants meets
county /state standards and standards outlined in the franchise agreement; (b) The proposed service
will fit within the existing service so as not t adversely affect the level of service so operation of other
franchises to render services; and (c) a need exists for the rendered service in order to improve the
level of service available to residents of the County helping to assure the provision of adequate and
continuing service which preserves, protects, and promotes the public health, safety and welfare and
that granting the franchise is a cost effective and a reasonable manner of meeting the need.
On December 14, 2004, the Orange County Board of Commissioners approved the application for
ambulance franchise agreements of the two active volunteer rescue squads in the County, Orange
EMS and Rescue Squad and Technical Rescue Services, Inc d/b /a South Orange Rescue Squad.
Prior to approving the applications on November 16, 2004, the Board held a public hearing to
determine if the franchise was "necessary to assure the provision of adequate and continuing
ambulance service and to preserve, protect, and promote the public health, safety and welfare." On
August 16, 2005, the Board approved an Emergency Services Events and Facilitation Agreement
Renewal for both Rescue Squads. (See Attachment 1, Agreement Between Orange County Rescue
Squad and Orange County)
The EMS Services to be provided in the agreement were (1) Rescue Services: light and heavy
extrication, underwater (dive) rescue and wilderness and land search and (2) Primary Ambulance
Provider (Special Events Only). The franchise agreement is conditioned on the agreement that the
Grantees will comply at' all times with the "franchise and all applicable laws relating to health,
sanitation, safety, equipment, ambulance design or other EMS service vehicle design and all legal
requirements related to a Model EMS system and all other law and ordinances." The requirements
contained within, but not limited to are: staffing and performance requirements, vehicle and
equipment requirements, communication requirements and data collection and performance reporting
requirements.
Stand Down Decision
Earlier this year reports began to surface from staff, county fire services and other emergency
response members of unsafe and unprofessional practices by the Orange County EMS and Rescue
Squad. Initial information was gathered to research the basis and validity of the complaints and
concerns. Based on the information gathered, and to protect the health and safety of the residents of
Orange County on June 27, 2008, a decision was made to immediately stand down the OCRS squad
pending a more complete investigation of the reports. (See Attachment 2, Preliminary Report,
Orange County Rescue Squad, Inc.)
Some of the specific concerns were:
• In July 17, 2007, OCRS responded to a call of a victim in the water (dive response), OCRS
could not provide the service because they did not bring the right equipment or a boat.
• During an auto extrication call, the OCRS attempted to remove a women who had died
from the car accident, after an hour of unsuccessful attempts, the squad left the scene and
another provider had to remove the victim.
• OCRS responding to a call in June 2008 of an auto accident failed to secure the equipment
door on their unit, many pieces of equipment fell out of the unit along South Churton from
the station to the interstate, causing an unsafe road hazard and reducing the units'
capability to render aid.
• Sixteen incidents of self dispatching between May 30, 2007 and March 30, 2008, in
violation of Orange County Protocols and thereby reducing the efficiency and capability of
the Emergency Management System.
• In May 2008, on three different occasions when questioned about equipment location, tool
capacity and capabilities members of the rescue squad responses indicated a lack of
rudimentary knowledge of equipment, capabilities and limitations.
• May 2008 when responding to a shortness of breath call on Orange Grove Road, the unit
left the station in an unsafe manner, crossing the intersection causing cars to stop suddenly
and preceded at a rate of speed that was unsafe for the road conditions.
Additionally, in the eight weeks prior to July 1, 2008, staff reported many instances of unprofessional
behavior by the OCRS. Most of the complaints related to problems associated with Station 1 on
Churton Street, where Emergency Services has rented space for several years. The County rents
space at the building for $2,249 per /month and $20,000 per /year in in -kind services. Staff maintains
that the facility continues to be dirty, in disrepair and has little security. OCRS regularly puts personal
vehicles in the bay, displacing Emergency Services units; members and employees of the squad
bring their children to building, staying until 11:30 pm and running up and down the halls. In June
2008, OCRS members pulled vehicles out of the bay to create a wresting ring for horseplay.
Following the wrestling match, members began using the emergency self- contained breathing tanks
to air squirt each other, rendering the tanks unusable for immediate emergency calls. As a result of
the complaints, in order to ensure the safety of the EMS personnel who slept at the facility, the
Emergency Services Department had to make arrangements at a local motel so that staff could
remain in their response district and get adequate sleep.
Prior to the June 27th stand down order, Staff talked to all of the Orange County Fire Chiefs to find
out their view of OCRS and their capabilities in a potential stand down order. A majority of the Chiefs
were supportive and, it was their viewpoint, that the services provided by the OCRS were redundant
because the fire departments were providing the service in a more efficient and effective manner.
The Chiefs were advised on June 27th of the stand down order and they all agreed that with the
services they currently provided there would be no lapse in emergency capabilities. A majority of the
Orange County Fire Chiefs continue to believe that they can provide equivalent of superior services
than can be rendered by the OCRS. (See Attachment 3, Letter from Orange County Fire Chiefs)
Steps taken after the Stand Down Order
Following the stand down order, the County Manager, the Emergency Services Director and the Chair
and Vice Chair of the Board meet with the Orange County Rescue Squad to discuss a process to
move forward. It was decided that Emergency Management Services would conduct an assessment
of OCRS, similar to the assessment that was being conducted of the Fire Departments. This would
enable EMS to assess OCRS capabilities as determined by standards set forth by the National Fire
Protection Service, the North Carolina Association of Rescue Squads and Emergency Medical
Services (NCARSEMS), the State and Orange County as well as provide a recommendation to the
Board of County Commissioners as to whether, or not, the OCRS was performing up to standard as
provided in the Franchise Agreement.

Assessment
The North Carolina Association of Rescue and Emergency Medical Services, Inc., of which OCRS is
a member, provide certification of Rescue and Emergency Medical Services Providers. The OCRS is
listed with the North Carolina Association of Rescue and Emergency Medical Services as a "Heavy
Rescue Provider". Under this standard, they are required to have a minimum of eight personal
certified as rescue technicians or higher and medical responders or higher. The North Carolina
Fireman's and Rescue Squad Workers' Pension Fund provides a pension to eligible rescue squad
members who are members of rescue squads that are eligible for membership in the North Carolina
Association of Rescue and Emergency Medical Services, Inc. (NCARSEMS), and who have attended
36 hours of training and meetings in the last calendar year. This certification and eligibility in the
Pension fund is the criteria that the Emergency Services reviews to determine the rescue squad is
operating at the standard level of service.
On July 15, 2008, the OCRS was asked to provide training records, department standard operating
guidelines and procedures and a roster explaining the structure and function of the department
personnel. Emergency Services also contacted NCRSEMS, who provided documentation that the
OCRS had indicated to them that they had 34 members, but on July 21St, the squad removed 21
members from their membership roster. (See Attachment 4, Fax from NC Assoc. of Rescue and
EMS) After repeated telephone and emails to Chief Mathews and the OCRS, on August 5th, the
OCRS provided the personnel roster and the training documents to Emergency Services. (See
Attachment 5, Timeline) The OCRS personnel roster indicated that the squad has only seven (7)
members who are certified to provide Vehicle and Machinery Rescue service. (See Attachment 6,
Personnel Roster)
The OCRS also provides the County "Dive Rescue" services. At the July 24th meeting, Chief
Mathews informed Emergency Services staff that the Dive Rescue portion of the squad was no longer
a valid resource and had been unavailable for some time. This was the first notification to Emergency
Services that this service was no longer being provided.
The training documents provided by the OCRS indicated that of those seven person certified to
provide vehicle and machinery rescue services, none of the seven, including the . Chief, had
completed the 36 hours of trainings and meetings required by Pension fund in the 2007 calendar
year. (See Attachment 7, OCRS Training Attendance by Staff)
At this time the OCRS is not meeting the staffing and training standards set forth by either the
NCAEMRS or Orange County for a rescue squad in Orange County.
Next Steps
Based on the information provided above, Emergency Services Department shall continue the
dialogue with OCRS to determine what useful role OCRS can play in the Orange County Emergency
Services system. The department will conduct this dialogue over the next sixty days and come back
to the Board with a recommendation on this issue.
FINANCIAL IMPACT: The County currently provides $20,000 a year in in -kind services and $2,409
per /mo in rent to the OCRS.
RECOMMENDATION(S): The Manager recommends that Board review the information provided.

COUNTY OF ORANGE
AGREEMENT BETWEEN
ORANGE COUNTY RESCUE SQUAD, INC.

THIS AGREEMENT, made and entered into August 16, 2005 by and between Orange
County Rescue Squad, Inc., hereinafter referred to as `THE SQUAD" and Orange County,
North Carolina, hereinafter referred to as 'THE COUNTY ", for and on behalf of its Office of
Emergency Management Services.
WITNESSETH:
WHEREAS, THE COUNTY pursuant to the authority contained in N.C.G.S.153A- 250 (b),
wishes to have a private non - profit organization provide EMS Special Events coverage,
augment the County Staff in the EMS Transportation, and to provide leased space within the
Squad Building for County staff and vehicles; and
WHEREAS, THE COUNTY wishes to provide compensation for those goods and
services, in monetary and in -kind contributions annually; and
WHEREAS, THE SQUAD desires to provide these goods and services to THE COUNTY.
NOW, THEREFORE, in consideration of the premises and of the following mutual
promises, covenants and conditions, THE COUNTY and THE SQUAD agree as follows:
I. SQUAD RESPONSIBILITIES
A. To name a single point of contact for administrative business on behalf of
THE SQUAD. The name of this individual shall be provided to THE COUNTY
upon the signing of this agreement. THE SQUAD shall provide THE COUNTY
with notice of any change in the contact person 5 working days prior to the
effective date of the change.
B. To provide EMS staffing at special events. In no event shall THE SQUAD
permit the staffing of ambulances by individuals certified below the level of
Emergency Medical Technician.
C. To ensure that all EMS personnel are trained, certified and current in all
continuing education requirements pursuant to standards set by THE COUNTY,
and other licensing /certification boards as may be appropriate. Evidence of

certification required by NCGS 131E -159 shall be provided to THE COUNTY.
THE SQUAD shall ensure that these records are kept current.
D. To purchase items used by THE SQUAD for the provision of special event
medical coverage in accordance with Orange County purchasing policies and
procedures, and to maintain records of these purchases for periodic review by
THE COUNTY.
E. To maintain legal personnel documentation, including an appropriate
record of times worked by volunteer personnel, and to make these personnel
records available to THE COUNTY as needed, with appropriate prior notice.
F. To ensure that at all times when on duty, THE SQUAD's EMS personnel
are attired in a uniform approved by THE COUNTY.
G. To perform checkouts of each EMS unit, all supplies and equipment at the
beginning of each special event, and report any deficiencies to THE COUNTY in a
manner approved by THE COUNTY.
H. To properly maintain the vehicles provided by THE COUNTY in good
working order and to notify THE COUNTY of any needed maintenance or repairs.
THE SQUAD shall keep and maintain records of the operation and maintenance
of the vehicles in accordance with N.C.G.S. 131 E -156. Copies of these records
shall be furnished to THE COUNTY.
I. THE SQUAD shall provide and maintain evidence of a current Ambulance
Provider's License, issued pursuant to N.C.G.S. 131E-155.1, to THE COUNTY.
J. THE SQUAD shall make space available for county staff in the Squad's
Buildings and bay space to park the ambulances and / or other EMS vehicles as
agreed on by THE SQUAD and THE COUNTY.
K. THE SQUAD understands and agrees that the financial officer or designee
of THE COUNTY shall have the right to inspect, upon reasonable notice, all books
and records of THE SQUAD, and that with reasonable prior notice, THE COUNTY
will be given full and complete access to these records.
L. To ensure that THE SQUAD'S personnel conduct themselves in a
professional manner at all times and consistent with the conduct expectations of
the Orange County Personnel Ordinance and specifically comply with the policies
of THE SQUAD on file with THE COUNTY which address harassment,
discrimination, personal conduct, drug free work place, and employment of
relatives.
M. To identify an individual person as the point of contact for general EMS
operational or policy communications with THE COUNTY.
N. To utilize the National Incident Management System (NIMS) as appropriate
in THE SQUAD'S Standard Operating Procedures, Standard Operating
Guidelines, personnel training, exercising, and all other operations.

II. COUNTY RESPONSIBILITIES
A. To provide ambulances and other vehicles to support the staffing
requirements for special events of THE SQUAD. However, any ambulances
provided by THE COUNTY are and shall remain the property of THE COUNTY
and upon termination of this agreement are to be returned to THE COUNTY in
good working condition, reasonable wear and tear excepted. Additionally to
provide equipment and or vehicles to THE SQUAD for non - traditional EMS
purposes in support of its mission.
B. To approve a standard uniform for THE SQUAD personnel providing
services pursuant to this Agreement.
C. To provide necessary supplies, equipment, fuel, and other medical
essentials for units to allow THE SQUAD to staff additional ambulances during
crises and disasters.
D. To provide for the preventive maintenance and repair of all county vehicles
used by THE SQUAD to provide services pursuant to this Agreement. This
includes all vehicles used to provide services under this Agreement owned by
THE COUNTY.
E. To retain full authority and responsibility for the care and treatment of all
patients that use the EMS system, including those treated as part of special event
coverage, and to ensure that appropriate medical supervision is provided to THE
SQUAD. THE COUNTY will continue to allow members of THE SQUAD, certified
under the ALS program of THE COUNTY, to provide service at the EMT -B and
EMT - Paramedic Level with continuing education, medical protocols, medical
direction, and oversight provided by THE COUNTY.
F.. THE COUNTY'S medical director will provide medical care direction and
medical control to THE SQUAD.
G. THE COUNTY'S medical director will review and approve and THE
COUNTY will provide training and continuing education that will assure the
maintenance of all EMS certifications of the personnel of THE SQUAD.
H. To provide required health and safety programs including immunization,
medical evaluation, training, and post exposure management for the personnel of
THE SQUAD providing services pursuant to this Agreement.
I. To provide oversight of THE SQUAD's personnel during all activities related
to the provision of emergency medical services under this contract, pursuant to
NCGS 143 -508 and appropriate NC administrative rules.
J. To furnish to THE SQUAD a monthly cash stipend of $2,294, in addition to
the in -kind goods and services with an estimated annual equivalent value of
$20,000. In -kind goods and services includes, but is not limited to, the provision
of ambulance vehicles and medical equipment for the use of the SQUAD at
special events, the provision of medical direction and medical control services for
personnel of THE SQUAD who provide EMS services, the provision of infection
control and exposure management services for personnel of THE SQUAD, and
the provision of training, education, and quality assurance for personnel of THE
SQUAD. The cash stipend will be will be paid to THE SQUAD by the 1 O'h day of
each month.
K. To furnish to THE SQUAD reimbursement of the approved costs for special
event coverage requested by THE COUNTY within two weeks of receipt by THE
COUNTY from THE SQUAD of appropriate special event coverage report forms.
L. To identify an individual person as the point of contact for general EMS
operational, administrative, and policy communication with THE SQUAD.
III. INSURANCE
THE SQUAD will be responsible for the negligence of its personnel and agents. Further,
THE COUNTY shall define the amount and levels of insurance which THE SQUAD shall
maintain for the activities performed pursuant to this Agreement as well as the buildings
and equipment used to provide services under this Agreement. Any policies of insurance
purchased directly by THE SQUAD shall be through an insurance company acceptable
to THE COUNTY. The coverage amount of the insurance maintained by THE SQUAD
will be consistent with the requirements of the Orange County Ambulance Franchise
Ordinance.
IV. CONFIDENTIALITY
THE SQUAD and THE COUNTY agree to work jointly to protect the various confidential
medical information that is obtained and used in the provision of Emergency Medical
Services, in compliance with local, state, and federal confidentiality provisions. Nothing
in this agreement shall be construed to prevent THE SQUAD and THE COUNTY from
entering into other agreements to specify the exact requirements and procedures to be
used to protect the confidentiality of patients.

This agreement shall run from July 1, 2005 through June 30, 2006 and shall be reviewed
by March 1, 2006, for consideration of renewal.
VI. TERMINATION
The Agreement or its renewal may be terminated at any time without penalty by either
party provided that written notice of such termination is furnished to the other party at
least 60 days prior to termination. In the event of such termination any payment due
shall be prorated to the date of termination.
VII. MUTUAL UNDERSTANDING
THE SQUAD and THE COUNTY understand and agree that nothing in this agreement
shall be construed to create an exclusive arrangement between the parties, and THE
COUNTY is free to provide services by other means.
Vlll. ENTIRE UNDERSTANDING
The Agreement contains the entire understanding of the parties and shall not be altered,
amended or modified, except by an agreement in writing executed by the authorized
representative of both parties.
IX. SITUS
The laws of North Carolina shall govern the validity and interpretation of the provisions,
terms and conditions of this agreement.
IN WITNESS WHEREOF, the parties have hereunto signed this Agreement in
their official capacities of the day and year listed below.

Background
The Orange County Rescue Squad (OCRS) has operated within Orange
County, North Carolina in several forms. According to current members, the
unit's history spans forty years. At one time, it was part of a larger, unified
organization working with the current South Orange Rescue Squad (SORS)
unified at the insistence of former Emergency Services Director, Colonel Nick
Waters. Following several years of combined operation, the units split.
In its most recent iteration, the OCRS billed itself as a certified, all- hazard
rescue squad, providing rescue, extrication, dive team and special rescue
services responding throughout Orange County. The unit's base of
operations is a freestanding building located on Churton Street south of
downtown Hillsborough. Housed in and around the building is a collection of
ambulances, SUV's, trailers, vans and a heavy rescue vehicle named Rescue
1. By recent reports from their previous chief, the organization maintains a
roster of approximately forty -three members with more than twenty holding
officers' positions.
Within days of my arrival, reports began to surface from members of my staff,
the county fire services and other emergency response members of an
extensive history of unsafe and unprofessional practices, strange behavior by
rank - and -file members as well as their leadership. Following a brief
orientation of the county emergency service operations and the area,
information was gathered to research the basis and validity of complaints and
concerns.
This preliminary report is based on verbal and written accounts from staff
members, employees, area fire and rescue officers, and will list many of the
infractions, unsafe actions and unprofessional conduct. Because some of the
reports go back years, information must be hand - collated in many cases. The
intent of this report is to establish the reasons for the recent action ordering a
safety stand -down for OCRS and lay groundwork for future actions that may
be necessary to protect the interests of the County, OCRS members, Orange
County Emergency Services employees and the community at large.

OPERATIONAL AND SAFETY CONCERNS
The following accounts reflect unsafe or irresponsible actions taken by
members of OCRS as reported in verbal and written accounts by members of
the fire and rescue community.
Linden Road Auto Accident 12/09/05: Rescue 1 (OCRS) responded to an
auto accident with entrapment with Eno FD. Eno FD advised R1 to
reduce to non - emergency response as the situation was under control.
R1 refused and continued to respond emergency. A senior OCRS
member advised that the Eno FD did not have the authority to cancel
them, which is contrary to established protocols, tenets of NIMS/ICS,
tradition and perhaps NC State law. The scene was emotionally charged
because the victim's father was on the scene. EMS and fire department
crewmembers managed the scene and removed the patient who died
shortly after removal. The father wanted to see his expired son, the EMS
supervisor advised the father that he would attempt to arrange it, but a
short time later, a scuffle started between the father and the senior OCRS
member whereby the grieving father and /or the Eno fire chief was
threatened with arrest. This action was uncalled for and contributed to the
escalation of an already difficult situation.
OCRS members often take Rescue 1 out for drives throughout the county
and on more than one occasion in recent weeks have taken several
members to a local restaurant for lunch. In addition to the cost of fuel
borne by the County, the members were dressed in old, dirty clothes
projecting a very poor image of OCRS and Orange County.
• June 2008: Rescue 1 responded to an auto accident on 1-40. Failing to
secure the equipment door on their unit, many pieces of equipment fell out
of the unit along South Churton from the station to the interstate. Not only
did this create an unsafe road hazard for motorists and the public, it
reduced the unit's capabilities to render aid. This caused OCES staff to
endanger their safety to walk through the roadway to pick up the
equipment and debris.
• An auto accident with entrapment was commanded by Hillsborough FD
(date unknown) whereby senior members of OCRS began using a circular
cutting saw in their attempts to free the victim. The saw caused a shower
of sparks that were landing in a pool of gasoline in which the members
were standing. The HFD officer stopped the operation for the safety of
everyone on the scene. The OCRS switched locations to the back of the
damaged vehicle to continue attempts to free the man. After a long
session of attempts (approximately an hour), the squad members stopped

attempts, turned the rescue operation over to HFD, which successfully
completed the operation.
• During an auto extrication call (date unknown,) the OCRS attempted to
remove a dead women from a car. After an hour of unsuccessful
attempts, the squad quit and left the scene. Another FD (either HFD or
New Hope FD) continued the operation and successfully extricated the
body.
• Drowning at Ashley Lakes Apartments — 2007: OCRS responded for a
dive response to the call, but could not provide service because they did
not bring the right equipment nor a boat. Chapel Hill was called,
responded and completed the operation.
• During an extrication event reported by their former members, OCRS
crews prematurely cut stabilizing lines dropping a tree limb on a car with
an EMS member and a patient inside. The car became momentarily
destabilized jeopardizing the safety of the EMS member and patient.
• Muriatic acid was poured in the equipment bay of Station 1 (Churton
Street) in front of the doorway leading into the crew quarters from the
outside public -entrance. It is unclear why the, caustic and poisonous
substance was placed in the threshold, but it caused a potential for
serious inhalation injury to the on -duty crew who was in the immediate
vicinity as well as the public who use this entrance regularly.
• Eno State Park: A senior OCRS member requested Rescue 1 be
dispatched with Hillsborough FD and first responders to a call at the
Occoneechee State Park. It is not an individual's prerogative to requests
specific units. That task is left to the communications center, which knows
unit and resource availability and manages the deployment and control of
them in order to maintain effective, safe resource allocation. During the
event, it is reported that the OCRS member switched his radio call sign
and frequencies between rescue squad and police department, thus
further complicating the situation and rendering the operation confusing
and unsafe. This event was one of several self- dispatch incidents
attributed to the OCRS and its members.
Other instances of self- dispatching by OCRS, creating hazards to the public
with the addition of unnecessary emergency vehicles on the roads, reducing
the efficiency of communicators and reducing limited resources are:
o May 30, 2007: Chest Pain to 261 S. Churton Street
o July 17, 2007: Body in a lake.

• August 24, 2007: Heat exposure at Cedar Ridge High School.
• September 9, 2007: Auto accident with injury at Schley Road.
• September 20, 2007: Chest pain Old NC 86 and Lafayette.
• October 3, 2007: Sporting event standby 4801 West 10 Road.
• December 18, 2007: Direct, unauthorized dispatch of medic unit to
261 S. Churton Street.
o December 24, 2007: Cardiac arrest to 4406 Kerley Road.
o December 31, 2007: Sick call at assisted living home to 1911
Orange Grove Road based on "scanning calls ".
o January 04, 2008: Auto accident with injury to Eubanks Road and
Old NC 86.
o February 05, 2008: Head ache at 261 S. Churton Street.
o February 16, 2008: Fall at 3401 Alice Street.
o February 02, 2008: Responded to assist with lifting a patient at
3401 Alice Street. No request came through communications, nor
was the rescue squad initially dispatched to this call.
o February 22, 2008: Responded to an auto accident with injury at
Compton Road and NC 86 N. They were not sent on the initial
dispatch because the criteria did not meet the dispatch need for
rescue.
o March 15, 2008: Motor vehicle accident with reported no injuries to
1 -85.
o March 30, 2008: Motor vehicle accident with injuries at 1500
Lawrence Road.
The following are examples of unsafe, and inappropriate actions or behavior that I
have witnessed.
• May 2008: On more than three occasions, I was shown the equipment of
the heavy rescue squad by different members of the OCRS. I asked
specific questions of the members regarding equipment location, tool
capacities and capabilities. It is obvious from their responses that they

lack rudimentary knowledge of their equipment, capabilities and
limitations.
May 2008: 1 witnessed OCRS respond to a shortness of breath on
Orange Grove Road. I do not know if they self- dispatched. However, unit
left the station in an unsafe manner, crossing over the intersection causing
cars to stop short and the noted rate of speed was too fast for the road
width. The speed was estimated at 60 MPH, much too fast for a 25 -30 ton
vehicle on a curving, secondary roadway.
UNPROFESSIONAL BEHAVIOR
Just within the last eight weeks, I have met with Emergency Services Department
staff to discuss dozens of complaints lodged at the members and leadership of
the Orange County Rescue Squad. Most relate to problems associated with
Station 1 on Churton Street where Orange County Emergency Services has
rented space for several years. It is apparent to anyone who enters the building
that very little care has been given to the building and its upkeep.
During our tenure there, OCES members at station 1 have witnessed
unprofessional and bizarre activities and intolerable living conditions. The
following are accounts filed by Orange County EMS crewmembers who have
been stationed at Station 1.
• Orange County Emergency Services staff report OCRS members hanging
around in the building at 2:00 am while EMS members attempt to sleep.
• The facilities are dirty, in disrepair and have little security.
• There are on -going bug and insect problems.
• OCES staff does not feel safe at this location and have found members of
the community unattended inside of the building wandering through the
department's rented area.
• OCES staff have reported personal items missing and damaged after they
return from calls.
• OCES employees have reported Rescue Squad members looking at
inappropriate materials on the internet
• OCRS regularly crowd personal vehicles in the bay, displacing OCES
units causing them to remain outside in inclimate weather until late in the
night.

• Wrecked "practice vehicles" remain in the crowded parking lot for months
at a time, and extrication training has taken place in the bay causing an
excess of carbon monoxide and other fumes to seep into the EMS living
area.
• Members or employees of the squad bring children to the building. These
children are there as late as 11:30 pm.
• As recently as April 3, 2008 crews reported that children were running up
and down the stairs of Station 1 unattended.
• Members often bring significant others and children to the station when
responding to rescue calls. These visitors are left in the building until late
in the night while the member responds to the call, EMS crews attempt to
sleep or leave their personal items unprotected.
• The front door will not shut nor secure properly and has only been
repaired within the past few weeks. As recently as March 2008, a
community member walked into the station without the knowledge of the
crew.
• On April 29, 2008, while spreading gravel out back, members of the squad
began horse playing and yelling out obscenities. On this day, there was a
large number of people going in and out, then up and down the steps
slamming doors. Members of Orange County EMS did not recognize
these people as squad members. Doors were left open throughout this
day.
• Members are parking cars in the parking lot leaving OCES emergency
vehicles little to no room to park.
• The noise level created by OCRS members is increasing. The noise level
is creating a hostile work environment for OCES staff.
• Dirty OCRS underwear is scattered throughout the station.
• There has been trash left out in the parking lot, the bay, the bathrooms,
and the dayroom after OCES staff has completed daily cleanup.
• June 2008: OCRS members pulled vehicles out of the bays to create a
wrestling ring for horseplay.

• Following the wrestling match, members began using the emergency self -
contained breathing tanks to air squirt each other, rendering the tanks
unusable for immediate emergency calls.
These reports of unprofessional and unsafe actions have been submitted to
managers and superiors during previous administrations, but have not acted
upon. Following several years of fielding complaints, the Emergency Services
Department (formerly Emergency Management) stopped investigating, as it was
clear that no action would take place.
Orange County Emergency Services staff including me, former Acting Deputy
Director Jeanette Jones and EMS Operations Manager Kim Woodward met with
OCRS board president Dan Seip and board member Cliff Cates in June. During
that meeting, we discussed the deplorable condition of the station, intolerable
situation, living conditions, and safety concerns at Station 1. We were reassured
that repairs and changes would occur and the instability of leadership would
settle. This has not happened. To date the front door was painted and curtains
were installed in the front dayroom area. The building remains dirty and unsafe.
The instances have been collected from several sources as earlier stated. It is
my intent by submitting this report to fully apprise county management of the
situation that has caused me extreme concern about the safety of the OCRS and
its members, the unit's ability to perform at the level the community deserves,
and the safety of fellow emergency response members as they provide critical
services to the community.
In summary, I continue to feel justified in ordering the safety stand -down in light
of the many safety and leadership infractions, misjudgments and poor decisions
of the OCRS that will given time and opportunity result in tragedy. I recommend
that a follow -up assessment of the unit's capabilities be conducted to: 1)
Determine what level of rescue service is needed in Orange County, 2) Establish
performance standards for all rescue services within state and federal safety
guidelines, 3) Develop monitoring and control measures to ensure compliance
with those standards and 4) Determine the best approach to deliver a system-
wide rescue service in Orange County.

The Fire Chiefs of Orange County who have signed at the end of this statement wish to convey in
clear and precise terms our opinion on the matter of the safety stand -down of the Orange County
Rescue Squad.
We believe the safety stand -down was a necessary measure, and should stand as permanent, for
the safety of the public and that of other emergency responders from other agencies.
The primary reasons for the stand -down include consistently unsafe and unacceptable
performance as demonstrated by the Orange County Rescue Squad.
No consideration should be given to the reinstatement of the Orange County Rescue Squad
because rescue services are now available from many locations across the county through the
coordinated efforts of the Orange County and surrounding fire departments. These services are
in every case equivalent or superior to the services that could be rendered by the Orange County
Rescue Squad, so there is no justification for their continued operations.
