BOARD OF COMMISSIONERS
September 3, 1968.
The Board of County Commissioners of Orange County met in regular session at
10:00 o clock A.M. on Tuesday, September 3, 1968 in the Commissioners room of the
Courthouse in Hillaborough, North Carolina.
Members Present: Chairman Harvey D. Bennett, and Commissioners William C. Ray,
Carl M. Smith, Henry S. Walker and Ira A. Ward.
Members Absent: None
Minutes of the August meeting were read and approved.
Chairman Bennett read reports from the Veterans Service Officer and the
Recorder's Court.
Chairman Bennett read a notice from John Morrissey, Executive Director of.
the Commissioners Association, in which he requested that the Orange County Board
of Commissioners adopt of resolution in recogniticn of service for William E.

Upon motion of Commissioner Ward, seconded by Commissioner Ray, it was moved
and unanimously adopted that the County Administrator have the County Attorney
draw a resolution of appreciation for Mr. Easterling.
Chairman Bennett read a letter from Emmett Pendergraph. Said letter requested
that the Board of Commissioners advise him as to the status of road designated as
SR 1937. The clerk was instructed to mail a copy of Mr. Pendergraph's letter to
Mr. P. L. Welch, Division Engineer, requesting that the highway commission answer
Mr. Pendergraphis inquiry.
It was agreed by the Board that road designated as SR 1945 should be considered

Chairman Bennett read a letter from George Stockbridge, Executive Secretary
for the Health Planning Council for Central North Carolina. Mr. Stockbridge advised
the Board that it was the recommendation of the Health Planning Council that Henry
Lewis be appointed to serve as an Orange County representative during the leave of
absence of Dr. Fred Weaver.
Upon motion of Commissioner Smith, seconded by commissioner Ward, it was moved
and unanimously adopted that Henry Lewis be appointed to serve during the leave
of absence of Dr. Fred Weaver as a representative on the Health Planning Council
for Central North Carolina.
The County Administrator read a letter from The Town of Mebane which stated
that the Town of Mebane is exercising its right to plan and zone the area one mile
outside its city limits. To do this a part of the membership of the Planning Board
must be residents of the area effected and these members must be appointed by the
Orange County Board of Commissioners.
Upon motion of Commissioner Ray, it was moved and unanimously adopted, that Mrs.
Carolyn Bean, Winder Long and Willard Oakley be appointed for a three year term on
the Mebane Planning Board and that Bill York be appointed for.a three year term on
the Mebane Board of Adjustments. All terms to become effective at the date when
the Town of Mebane decides to exercise its right to zone the area one mile outside
its city limits.
"In Re: THE DURHAM-ORANGE COUNTY BOUNDARY LINE
Mr. Sam M- Gattis, County Manager, presented the Report of the Commissioners,
heretofore appointed by the Board of Commissioners of Orange County and the Board of
Commissioners of Durham County, for the purpose of establishing theBoundary Line
between Durham and Orange County, stating that the Commissioners have by unanimously
determined the said Boundary Line between the said Counties subject to the approval
of the respective Boards of County Commissioners of said Counties as by law provided.
The following resolution was presented:
RESOLUTION RATIFYING AND APPROVING the Report of the DURHAM-ORANGE
COUNTY COMMISSION TO ESTABLISH the DURHAM-CRANGE COUNTY LINE.
WHEREAS, a controversy had arisen over the location of the
Boundary line between Durham and Orange County, and

WHEREAS, under the provisions of Section 153-11 of the General Statutes
of North Carolina, the respective Boards of County Commissioners of
Orange County and Durham County did appoint commissioners representing
each of said Counties to determine the dividing line between said Counties;
AND WHEREAS, said commissioners so appointed have submitted their report,
wherein they have determined the dividing line, caused the line to be
surveyed with appropriate monuments put in place at intervals along the
same, and a map made of the line, indicating the location of said monuments;
NOW THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of
orange County:
1. That the Report of the Commissioners duly appointed for the purpose of
determining the Boundary Line between Durham County and Orange County and
submitted to the respective Boards of said County on September 3, 1968 be
and the same is hereby ratified and approved.
2. That a copy of said Report, together with the map prepared under the
direction of said Durham-Orange County Commission be recorded in the office
of the Register of Deeds of Orange County.
BE IT FURTHER RESOLVED
That the County Manager of Orange County be and he is hereby authorized
to cause the said Report of the Durham-Orange County Commission together
with a copy of the map prepared under the direction of the said commission
to be recorded in the office of the Secretary of State of the State of
North Carolina as by law provided.
Motion was duly made by Commissioner Ward, seconded by Commissioner
Smith, that the foregoing resolution be adopted. All members present voting
aye.

To the Board of County Commissioners of Orange County:
We, the undersigned, Dewey S. Scarboro and Howard Easley, duly appointed
Commissioners by the Board of County Commissioners of Durham County on July
4, 1967 and Ira Ward and Carl Smith, duly appointed Commissioners of Orange
County on July 24, 1967; all of said appointments by the respective Boards
being made for the purpose of creating a commission for determining the joint
boundary line between the respective counties, as by law provided, do hereby
submit the following report:
1.
That pursuant to the appointment of your commissioners, and the employment
of Credle Engineering Company of Durham County and Engineering Surveys, Inc.
of Orange County, your commissioners, with the assistance of the Engineers so
employed have determined the joint boundary line between Durham and Orange
Counties to be as follows:
BEGINNING at a point in the South Boundary line of Person County
90 feet in a southern direction from the point of intersection of
the center line of N. C. Highway 57 and the center line of County
Line Road at monument No. 35 as shown on the map hereinafter referred
to (said monument being the Northwest corner of Durham County $nd the
Northeast corner of Orange County), and running thence South 8 03'

County in Plat Book page to which reference (both
counties) is hereby7~made for a more particular description of same.
Said Plat (Sections I and II) also being on file in t:he office of
the Secretary of State, State of North Carolina, RalE:igh, I~orth
Carolina as provided by law.

That the beginning point designated as monument No. 35 in the South Boundary
line of Person County was established with the approval of the Commissioners of
Person County.
3.
That Credle Engineering Company of Durham County and Engir~eering
Surveys, Inc. of Orange County, the firms employed by your comn~issioners,
have run and marked the line b~ appropriate monuments of the s~~id
Boundary line as hereinbefore described and have made a map, wr~ich raap is hereto
attached and made a part of this report.

Chairman Bennett advised the Board that he had appointed W. D. "Bi11" Anderson
as one oP the representatives of the Oran~e County Board of CommCasioners to the
Citizens For Airport Planning Committee.

Tyson Clayton, Secretary of the Board of Adjustments, presented the
following letter which was read by Chairman Bennett:
"The Orange County Board of Adjustment at its meeting on Thursday,
August 22, 1968, voted to call to the attention of the County Commissioners
that there seems to be some confusion about the type of development that
will take place in the area of Triangle Nursing Home No. II. The evidence
of this consists of the appearance of the same group on at least two
occasions before the Board of Adjustment, and the fact that the area is
within the New Hope Creek watershed.
It appears to the Board of Adjustment that the area should be studied
by the Planning Board for rezoning into specific districts. The Board
feels that there will be additional cases coming before the Board unless
the area is rezoned.
The Board of Adjustment respectfully requests the Board of Commissioners
to ask the Planning Board to study the area in question to determine whether
rezoning would be advisable."
This matter was taken under advisement.
Tyson Clayton, Zoning officer, reported on the matter of Landmark, Inc.
relative to the revoking of the building permit which had been granted by Orange
County.
Tyson Clayton submitted his resignation as Zoning Officer for Orange County.
The County Administrator recommended that the resignation of Mr. Clayton as
Zoning Officer be accepted and that the Board appoint Norman Long as Zoning
Officer for Orange County with said appointment being immediately effective.
Upon motion of Commissioner Ray, seconded by Commissioner Smith, it was
moved and unanimously adopted that the recommendation of the County Administrator
relative to the resignation of Mr. Clayton be accepted and that Norman Long be
appointed, as of this date, as the Zoning Officer for Orange County.
he following persons were present: A. H. Graham, County Attorney; Fred
Cates, Mayor Town of Hillsborough; John Roberts, Alderman Jown of Hillsborough;
Don Matheson, Member Industrial Commission; Joe Augustine and E. J. Owens,
representatives of the Chapel Hill Chamber of Commerce; R. J. Smith, Jr., Member
of the Hillsborough Planning Board; Pearson Stewart, representative of the
Research Triangle Regional Planning Commission; Wiley Perry, representative of
the Orange-Alamaaee Water Systems, Ina. for the purpose of participating in the
discussion relative to the Orange-Alamance Water Systems, Inc. request for
approval of their proposed water plan extension.
Pearson Stewart presented, by map and diagram, the possible future sites
for water reservoirs in Orange County. Mr. Stewart estimated that these
reservoirs could supply approximately 40,000 persons as the safe yield from
these reservoirs could be expected. Discussion ensued relative to Mr.
Stewart's presentation.
Mayor Cates read correspondence, from various agencies, relative to the
water agreement being proposed by the Town of Hillsborough with the Orange-
Alamance Water Systems, Inc. Mayor Cates stated further that the Town of
Hillsborough intended to fulfill its first committment, made previously, to the
Orange-Alamance Water Systems, Inc., but that he would be opposed to any
additional committment. Mayor Cates presented a contract which stipulated that
the Town of Hillsborough and the County of orange would agree to furnish one
million gallons of water per day to the Orange-Alamance Water Systems, Inc.
and requested that the Orange County Board of Commissioners approve this contract.
Discussion ensued relative to the contract and no decision was reached on said
matter.
Wiley Perry stated that the Town of Graham had agreed that it would sell
800,000 gallons of water per day for a price of thirty (30¢) cents per one
thousand (1,000) gallons to the Orange-Alamanee Water Systems, Inc. He stated
further that the Orange-Alamance Water Systems, Inc. had not at this time
entered into any agreement with the Town of Graham for the purchase of any
water and he further requested that the Orange County Board of Commissioners
withdraw the objections filed by letter with Melvin Hearn, State Director
Farmers Rome Administration.
The following persona spoke in opposition to the proposed extension plans
of the Orange-Alamance Water Systems, Inc.: A. H. Graham, E. J. Owens and Don
Matheson.

' Upon motion of Commissioner Ray, seconded by Commissioner Walker, it was
moved that Orange County withdraw its apposition to the Orange-Alamance Water
Systems, Inc. contingent upon the proviso that Hillsborough and the Orange-
Alamance Water Systems, Inc, work out its contract to furnish one million gallons
of water per,..day. Chairman Bennett called for a vote on said motion and there
were two ayes and three nays. Chairman Bennett declared the motion defeated.
It was moved by Commissioner Ward, that Chairman Bennett write Melvin
Hearn, State Director Farmers Home Administration, advising him that the position
of the Orange County Board of Commissioners is the same position as that stated
in a letter to him from S. M. Gattis, County Administrator. This motion died for
the lack of a second
C. W. Davis, Orange County's representative on the Conservation and Development
Resource Committee,requesting that a meeting of all committee members and Commissioners
representing the six counties be planned. Chairman Bennett advised Mr. Davis
that the Board would be in favor for such a meeting and asked that he arrange said
meeting.
Mr. Davis requested that the orange County Board of Commissioners approach
Donald Stanford, Orange County's Legislator, and have him to exempt Orange County
from the General Statutes which prohibits the destruction and/or killing of coons.
Commissioner Ray suggested that an open season not be declared in order to protect
other small game but that a season for the hunting of coons be adopted instead.
Upon motion of Commissioner Walker, seconded by Commissioner Ray, Chairman
Bennett was authorized to sign the foiling Aid to the Blind Agenda:

There being no further business to come before the meeting said meeting
was adjourned.
