BOARD OF COMMISSIONERS
June 3, 1968
The Board of Commissioners for the County of Orange, North Carolina met at 10:00
o'clock A.M. in regular session on June 3, 1968 at the County Courthouse in Hillsborough,
North Carolina.
Members Present: Harvey D. Bennett, Chairman, and Commissioners William C. Ray,
Carl M. Smith, Ira A. Ward and Henry S. Walker.
Members Absent: None
Minutes for meetings held during May were read and approved.
Ed Barnes, Farm Extension Agent and Elizabeth Meldau, District Home Economist,
were present to present Mrs. Sarah Sears as the replacement for Mrs. Arleen Tyler,
Assistant Rome Demonstration Agent. Mrs. Meldau requested that the salary for Mrs.
Sears be raised an additional $250.00 over the salary being paid to Mrs. Tyler and
she justified her request for additional said salary by virtue of the fact that Mrs.
Sears had had four years of experience in Home Demonstration work.
Upon motion of Commissioner Ward, seconded by Commissioner Ray, it was moved and
adopted, that Mrs. Sarah Sears be employed as the Assistant Home Demonstration Agent
for Orange County and that the recommendation of Mrs. Meldau relative to the salary
of said employee be approved.
Paul Alston, Director of the Orange-Chatham Community Action and Fred Cates,
Mayor for the Town of Hillsborough, were present. The County Administrator announced
that this was the time and place for the public hearing pertaining to the designating
of an agency or agencies who would administer the various monies received for
Community Action programs.
Chairman Bennett requested that Paul Alston give a progress report for the
programs being instituted by the Orange-Chatham Community Action committee. A
question and answer session ensued.
Upon motion of Commissioner Ward, seconded by Commissioner Smith, it was moved
and adopted, that the Orange-Chatham Community Action Committee be designated as the
agency for political jurisdiction.
Fred Cates, Mayor Town of Hillsborough, requested that the Board of Commissioners
join with the Town of Hillsborough in the appointment of a Human Relations Council.
Chairman Bennett read a letter which he had received from D. S. Coltrane, Chairman
North Carolina Good Neighbor Council, in which Mr. Coltrane had suggested that such
a council be organized for the Town of Hillsborough and the County of Orange
Mrs. Donald Thomas, President of the League of Women Voters presented the following
telegram:
"As a result of League Studies of Local Planning and National Water Resources
Carried on Since 1958, The League Of Women Voters Of Chapel Hill strongly supports
the Regional, State and Local Planners, Mr. Marshall Staton of the North Carolina
State Board of Health and Dr. Daniel Okun of the School of Public Health,
University of North Carolina in their opposition to the rezoning of the Forrest
Heath property in the University Lake Watershed."
Chairman Bennett read a resolution which had been adopted by the Town of Chapel
Hill:

WHEREAS an adequate supply of good water is one of the most important resources
of any urban area, and;
WHEREAS excessive development in the watershed serving as a municipal water
supply, can, unless public sewer is provided, endanger the quality of the water and
the health of those who use the water, and;
WHEREAS, control by zoning is a practical method for protecting the watershed
while permitting reasonable development,
NOW, THEREFORE BE IT RESOLVED that the orange County Board of Commissioners
be requested to establish whithin the watershed above the University Lake a single
family district with a maximum density of one family per acre for residences not
connected to a public sanitary sewer system, and to extend its zoning jurisdiction
beyond Chapel Hill Township to that portion of Bingham Township which lies in the
watershed of the University Lade.

ORANGE COUNTY, NORTH CAROLINA

At the regular meeting of the North Carolina State Board of Health at
Pinehurst, North Carolina, on the 15th day of May, 1968, the roll call was as

On the motion of Dr. Dawsey, which was duly seconded by Dr. Hiatt, the
following resolutions were passed creating the Dogwood Acres Sanitary District
in Orange County, North Carolina, sll in accordance with the provisions of
Chapter 130, Article 12, General Statutes of North Carolina, as amended.
BE IT RESOLVED: That the North Carolina State Board of Health, upon
giving due consideration to the proposal to create the Dogwood Acres Sanitary
District, Orange County, North Carolina, finds the following facts relating
thereto, to-wit:
(A) That the petition, containing the names of over fifty-one per cent
(51%) of the resident freeholders requesing the creation of said
proposed sanitary district as prescribed by law, was filed with the
Board of Commissioners of Orange County, North Carolina, and duly
approved by said Board.
(B) The State Board of Health was duly notified through the Chairman
of the Board of Commissioners of Orange-County; therefore, the
State Health Director of the State of North Carolina and the
Chairman of the Board of Commissioners of Orange County, mutually
set the date and place for the joint public hearing to be held on
Thursday, May 9, 1968, at 8 P.M. at the George Spransey residence
located within the boundary lines of the proposed sanitary district.
(C) Notice of the joint public hearing was duly given the general
public by posting a notice on the bulletin board at the Orange
County Courthouse and publishing the notice of the public hearing
for four (4) successive weeks in the "Chapel Hill Weekly," a
newspaper published in Chapel Rill, North Carolina, and having
general circulation within the territory to be included in the
proposed sanitary district.
(D) That a joint public hearing was held by the Board of Commissioners
of Orange County and representatives of the North Carolina State
Board of Health, to-wit: Mr. M. 0: Caton, Regional Engineer, and
Mr. Charles E. Rundgren, Assistant Regional Engineer, Sanitary
Engineering Division, upom the question of creating the Dogwood
Acres Sanitary District, Orange County. The joint public hearing
having been held in accordance with the publication of said notice
on Thursday, May 9, 1968, at 8 P.M. at the George Spransey residence
located within the boundaries of the proposed sanitary district.
(E) That at said joint public hearing opposition to the creation of the
sanitary district was made by Mr. Leslie B. Cohen, a representative
.of Southeastern Water and Utilities Company, which operates a water
system in the area. According to information presented at the public
hearing the people of the area desire water service other than now
provided. Therefore, the Board of Commissioners of Orange County,
and the representatives of the State Board of Health agree that
the creation of the Dogwood Acres Sanitary District should be approved.
The Board of Commissioners of Orange County adopted a resolution to
that effect and requested that the State Board of Health create the
District. Therefore, the representatives of the State Board of Health
recommend to the State Board of Health at its next regular meeting
that the proposed Dogwood Acres Sanitary District be approved and
created.
THEREFORE, BE IT RESOLVED FURTHER, that in the opinion of the State Board
of Health of North Carolina, the territory described in said petition should be
created as a sanitary district and it is for the best interest of the residents
and inhabitants of the said proposed district for the purpose of preserving and
promoting the public health the said proposed sanitary district be created, and
that same be and is hereby created and established as a sanitary district, all in
accordance with and pursuant to the provisions of Chapter 130, Article 12, General
Statutes of North Carolina, as amended.

The said district as described in the said petition and resolution heretofore
adopted described and set out as follows: to-wit:
BEGINNING at a concrete monument located on the northern right-of-way line of
Dogwood Drive, being State Road 1962, at the Southwest corner of Lot 64 of
Dogwood Acres Subdivision according to the map thereof recorded in Map Book 41
Page 113 of the Orange County Register; running thence along the southern line
of said Lot 64 South 86 degrees 55 minutes East 278 feet to an iron pipe in the
Southeastern corner of said Lot 64 of Dogwood Acres Subdivision. Thence North
8 degrees 03 minutes East 302 feet to an iron pipe located in the eastern corner
of Lot 66 Dogwood Acres Subdivision; thence North 32 degrees 55.minutes West
1162.5 feet to an iron pipe in a rock pile in the line of Lot 74 of said Dogwood
Acres Subdivision; running thence North 77 degrees 15 minutes West 1514 feet to
An iron pipe and pointers located in the Northwestern corner of Lot 87, Dogwood
Acres Subdivision; thence North 5 degrees 45 minutes East 200 feet to an iron
pipe, a corner of the Dogwood Acres Subdivision, thence North 84 degrees 53
minutes West 1552 feet to a point in the eastern right-of-way line of the Smith
Level Road, being State Road 1919, an iron located in the Northwest corner of
Lot 1, Dogwood Acres Subdivision; thence along the eastern right-of-wag line of
the Smith Level Road South 10 degrees 15 minutes West 300 feet, South 4 degrees
30 minutes West 162.6 feet to a point, thence continuing along the right-of-way
line of the Smith Level Road South 8 degrees 40 minutes Fast 777 feet to an iron
pipe located in the Southwestern corner of Lot 14, Dogwood Acres Subdivision;
thence South 83 degrees 52 minutes East 1381 feet to an iron pipe located in
the Northwest corner of Lot 34, Dogwood Acres Subdivision; thence South 7 degrees
40 minutes West 458 feet to an iron, a common corner of Dogwood Acres Subdivision.
and Dogwood Acres Subdivision Extension; thence South 6 degrees 01 minutes West
1047.03 feet to a rock pile located in the most Southerly corner of Lot 12
Dogwood Acres Subdivision Extension according to a map thereof prepared by John
R. Gove dated December 1954; it being a corner of property now or formerly
belonging to Sidney Crabtree; thence South 86 degrees 27 minutes East 1022.05
feet to a rock pile located in the Southeast corner of Lot 17 of Dogwood Acres
Subdivision Extension, thence South 25 degrees 44 minutes East 535 feet to a point,
a corner of the. Leroy Merritt property; running thence along the lines of the
Leroy Merritt property South 11 degrees East 918 feet, North 33 degrees East 397
feet, South 14 degrees East 500 feet, South 37 degrees 30 minutes 560.10 feet to
an iron pin in the northern right-of-way line of U. S. Highway 15-501; thence
along the northern right-of-way of U. S. Highway 15-501 North 53 degrees 38
minutes East 246.56 feet to an iron stake, a common corner between Leroy Merritt's _
and E. G. Merritt's property; thence along the dividing line between E. G.
Merritt's and Leroy Merritt's property North 1 degree 16 minutes East 1766.30
feet to an iron stake in the southern right-of-way line of Dogwood Drive; thence
within and along Dogwood Drive the following courses and distances: North 43
degrees 37 minutes West 83.56 feet, North 36 degrees 24 minutes West 68.01 feet, =
North 29 degrees 29 minutes West 438.81 feet, North 10 degrees 28 minutes West
326.01 feet, North 11 degrees 28 minutes East 308.71 feet to the point of
BEGINNING. See attached map.
BE IT FURTHER RESOLVED, that all said territory be and is hereby created and
established as a sanitary district to be identified by the name of Dogwood Acres
Sanitary District, which is located in Orange County, North Carolina.
BE IT FURTHER RESOLVED, that the Secretary to the State Board of Health of
North Carolina cause a certified copy of these resolutions to be sent to the Board
of Commissioners of Orange County, North Carolina, to the and that said commissioners
may proceed further with the completion of the creation, formation, and organization
of said sanitary district, all as provided by law.

I, Jacob Koomen, Secretary and State Health Director, do hereby certify that the
foregoing is a true and correct copy of a resolution adopted by the North Carolina
State Board of Health at a meeting duly called and held in Pinehurst, North
Carolina, on the 15th day of May, 1968, relative to the creation of the Dogwood
Acres Sanitary District located in Orange County, North Carolina.

Upon motion of Commissioner Ward, seconded by Commissioner Ray, it was moved and
adopted, that Chairman Bennett be authorized to sign the annual audit contract with
Ernst and Ernst of Raleigh, North Carolina.
The clerk was instructed to forward the following road petitions to the State
Highway Commission: SR #1124 and SR 1950.

There being no further business to come before the Board said meeting was adjourned
to most again on Thursday.. June 6, 1968 at 8 P.M. for a Recreational meeting and on
Thursday, June 20, 1968, at 4 P.M. for the purpose of canvassing the Special South
Orange Fire District Election.

June 6, 1968
The Board of Commissioners for the County of Orange, North Carolina met at 8:00 P.M.
in adjourned session on June 6, 1968 in the Commissioners Room at the Courthouse in
Hillaborough, North Carolina.
Members Present: Chairman Harvey D. Bennett and Commissioners William C. Ray, Henry
S. Walker and Ira A. Ward.
Members Absent: Commissioner Carl M. Smith.
J. L. Beasley, County Wildlife Protector, informed the Board of the steps which must
be taken in order to declare Lake Orange a spawning area. The County Administrator was
directed.to investigaito this matter further and to make an appropriate report to the
Board of his findings.
