BOARD OF COMMISSIONERS
May 6, 1968
The Board of Commissioners for the County of Orange, North Carolina, met in
regular session at the County Courthouse in Hillsborough, North Carolina, at 10
o'clock A.M., on Monday, May 6, 1968.
Present: Chairman Harvey D. Bennett, and Commissioners, William C. Ray,
Henry S. Walker, Carl M. Smith and Ira A. Ward.
Absent: None
Minutes for meetings held during April were read and approved.
Marshall Cates, Chairman County Board of Electiona, advised the Board of
Commissioners that the loose leaf registration sys-rem was now being used in all
the county precincts, but that there remained a considerable amount of work in
order to properly complete this system. Mr. Cates stated that the Board of Elections
had set three goals for the up dating of the voting registration system, they are:
1. Permanent registration of voters
2. Clarification of precinct lines
3. Voting machines for the larger precincts
Mr. Cates requested that the Board of Commissioners schedule a meeting with
Alex Brock, Secretary of the State Board of Elections, in order that all problems
might be discussed. The Board suggested to Mr. Cates that he make arrangements
for such a meeting.
Mrs. Harden Johnson, presented a petition reauesting that State Road #1117
be named Oak Grove Church Road. Said petition further ren__uested that appropriate
signs be erected to designate said road.
Upon motion of Commissioner Ray, seconded by Commissioner Smith, it was moved
and adopted, that State Road #1117 be named Oak Grove Church Road. The clerk was
directed to advise the State Highway Commission of this action.
The following road petitions were presented and the clerk was directed to
forward same to the State Highway Commission: 1320, Piney Mountain Road and
all roads in Forrest Hills.
L. J. Phipps, Chairman of the Historic Hillsborough Commission, requested
the Board of Commissioners to make a cash donation to the Commission. Said donation
would be applied to the restoration of the Burwell School project. Mr. Phipps stated
that $15,000.00 is needed for this restoration and that donations were being sought
from the County and the Town of Hillsborough and all other available sources. No
action was taken on said ouestion.
Fred Cates, Mayor of the Town of Hillsborough, Mrs. Quentin Patterson, Resource,
Conservation and Development Board Member, and Gordon Brown, President of the Orange
High School Student Body were present. The Board was advised that interested citizens
had met for the purpose of discussing suitable recreation for the county. The Board
of Commissioners agreed to meet with the interested citizens for the purpose of
discussing a recreation program for the county. These representatives requested that
the Board of Commissioners appoint a county recreation committee for the purpose of
coordinating the various recreation functions and planning towards the utilization of
the idle school recreation facilities during the summer months.
It was brought to the attention of the Board that a letter of inquiry relative
to the status of the Piney Mountain Road, from Earl F. Hoover, District Engineer,
contained inaccurate statistical data relative to the rating of said road. The clerk
was directed to advise Mr. Hoover of the inaccuracies and to request that the State
Highway Commission review and/or re-rate this road.
Tyson Clayton, Zoning Officer, presented the following letter from the County
Planning Board:
"At its meeting on April 23, 1968, the Orange County Planning Board acted on
Mr. Forrest Heath's rezoning request as follows: _
To recommend that the County Commissioners approve Mr. Heath's rezoning
request with the stipulation that the density of mobile home spaces be no more than
four (4) per acre, with no more than seventy-five spaces for the total twenty acre
tract, and that each septic tank have a minimum nitrofication line of two hundred
and forty (240) feet." Discussion ensued.

Discussion ensued on Commissioner Smiths motion and Commissioner Ray
suggested thatthe number of trailers proposed by the County Planning Board
be reduced to fifty in number and that a deed of restrictive covenants be
issued by Forrest Heath to the County stipulating that the density of mobile
home spaces be no more than four (4) per acre, with no more than seventy-five
spaces for the total twenty acre tract, and that each septic tank have a
minimum nitrofication line of two hundred and forty (240) feet. After further
discussion Commissioner Ray withdrew his suggestion relative to the issuance
of a restrictive covenants by Forrest Heath.
Commissioner Smith and Commissioner Walker withdrew their motion relative
to the adoption of the County Planning Boards recommendation that not more
than seventy-five trailer spaces be allocated to Forrest Heath.
Upon motion of Commissioner Walker, seconded by Commissioner Smith, it
was moved, that fifteen acres belonging to Forrest Reath be rezoned from a
residential area to a mobile home park area upon the condition that the
rezoned fifteen acres plus the five acres, presently zoned for a mobile
home park area, not exceed sixty trailer spaces which said trailer spaces
shall be evenly distributed throughout the entire twenty acres.
Chairman Bennett called for a vote on this motion. Commissioners
Walker, Smith and Bennett voted aye, and Commissioners Ray and Ward voted
nay.
Upon motion of Commissioner Ward, it was moved and adopted that
Commissioner William C. Ray be appointed for a three year term as a
member of the Orange County Welfare Board. Said term commencing as of
July 1, 1968.
Upon motion of Commissioner Ray, it was moved that the following
persons be invited to meet with the Board to discuss the possibilities
of creating a Countywide Recreation Committee:

A petition of relief relative to a barking dog signed by C. W. Ramsey-and
Betty Cole Hawkins was filed with the Board. The Board directed that copies
of this petition be forwarded to the Town of Hillsborough, the County Dog Warden
and the County Welfare Director.
Upon motion of Commissioner Ray, seconded by Commissioner Ward, Chairman
Bennett was authorized to sign the Blind Aid Agenda.
Upon motion of Commissioner Smith, duly seconded it was moved and adopted,
that W. E. Thompson of Estes Drive, Chapel Rill, N. C. be appointed for a three
year term, beginning April 1, 1968 through April 1, 1971, on the Orange County
ABC Board. Said term to commence at the expiration of his current term. It
was recommended that this nomination be submitted to the Board of Education
for their approval.
The Chairman announced that a petition has been received from the resident
freeholders living in an area designated as the South Orange Fire District,
which area lies immediately west of the City of Carrboro and which district is
specifically described by metes and bounds in the petition; and that said petition
recuests the holding of an election under the provisions of General Statutes
of North Carolina Section 69-25.1, and further asking that a tax be levied on all
taxable property in said district not exceeding ten cents of the one hundred
dollar valuation of property, for the purpose of providing fire protection in said
district.
The County Administrator reported to the Board that he had examined said
petition'and the signatures thereto and that said petition bears the names of
more than fifteen per cent of the freeholders within said district.
Thereupon, Commissioner Smith introduced the following resolation., which
was read:
RESOLUTION CALLING A SPECIAL ELECTION
Whereas, the Board of County Commissioners of orange county has received a
Detition bearing more than fifteen per cent of the resident freeholders living
in the boundaries of the South Orange Fire District, said district being described
as follows:

BEGINNING at a point (1) at the intersection of center line of Smith Level Road with
Hwy. #15-501 at the Chatham-Orange County line; thence in a Northeasterly direction to
a point (2) at the intersection of Watts Drive and Hwy. #15-501; thence in a North-
easterly direction to a point (3) on Dogwood Acres Drive, 0.8 mile East of its intersection
with Smith Level Road; thence in a northerly direction to a point (4) on N. C. #54 By-Pass,
0.5 mile Southeast of its intersection with Smith Level Road; thence in a Northwesterly
direction following N. C. #54 By-Pass to a point (5) where the north-bound connection
to Smith Level Road leaves N. C.#54 By-Pass including all property within 500 feet of
N. C. #54 By-Pass on the North side of the road; thence in a Northeasterly direction to
a point (6) on Knowles Street, 0.1 mile west of its intersection with Crest Drive; thence
in a Northeasterly and Northwesterly direction following the Town limits of Carrboro to a
point (7) where the Southern Railway track intersects the Carrboro Town limits north from
the Railway Freight Station thence in a Northwesterly direction following the Southern
Railway to a point (8) at the bridge over Bolin Creek; thence in a Northwesterly direction
to a point (9) where Hogan Creek intersects with Bolin Creek; thence in a Northerly
direction to a point (10) on homestead Road 71777, 1.2 miles East of Calvander on old
Hillsboro Road x#1009; thence in a Northwesterly direction to a point (11) on old Millsboro
Road #1009, 1.2 miles North of Calvander; thence in a Southwesterly direction to a point (12)
on Road #1111, 0.6 mile North of its intersection with Homestead Road ,#1112; thence in a
Southwesterly direction to a point (13) at the intersection of Homestead Road #1112 and
Bethel Church Road #1104; thence in a Southeasterly direction to a point (14) at the intersection
of Hwy. #54 and Road #1944; thence in a Southwesterly direction to a.point (15) at the
intersection of old Greensboro Highway #1005 and Road #1945; thence in a Southeasterly
direction to a point (16) at the intersection of Cedar Grove Road #1942 and Road '1946;
thence in a Southeasterly direction to a point (17) on Road #1939, 1.6 miles West of its
intersection with Smith Level Road; thence in an Easterly direction tc a point (18) on
Yorktown Drive, 0.4 mile West of its intersection with Smith Level Road; thence in a South-
easterly direction to a point (19) on Lexington Road, 0.2 mile West of its intersection with
Smith Level Road; thence in a Southeasterly direction to the point of BEGINNING.
NOW BE IT HEREBY RESOLVED by the Board of Commissioners for the County of Orange:
Section 1. A special election is hereby called to be held on Tuesday, June 18, 1968,
between 6:30 A. M. and 6:30 P. M., Eastern Daylight Saving Time, within the South Orange
Fire District, at which there shall be submitted to the qualified voters in said District,
the following question:
Shall a special tax on sll taxable property in South Oran" Fire District
of not exceeding ten cents on the one hundred dollar valuation of property,
for the purpose of providing fire protection in said district, be levied therein?
Section 2. For said special election there shall be a new registration of the
oualified voters residing in said South Orange Fire District and a new registration book
shall be open for the registration of the voters therein from 9:00 o'clock A.M. until
6:00 o'clock P.M. on each day, beginning May 14, 1968, and closing Tuesday, June 4, 1968.
On each Tuesday during such registration period such books shall be open at the polling
place hereinafter designated. Tuesday, June 11, 1968, shall be Challenge Day.
Section 3. The Clerk of the Board of Commissioners shall cause a notice to be
published in The Chapel Hill weekly at least thirty days before the election and there-
after twice between the election at intervals of at least one week between publications,
reading substantially as follows:
NOTICE OF SPECIAL ELECTION AND NEW REGISTRATION
IN THE SOUTH ORANGE FIRE DISTRICT
A special election will be held throughout the South Orange Fire District between
6:30 oleloek A.M. and 6:30 o'clock P. M., Eastern Daylight Saving Time, on Tuesday, June
18, 19682 at which there will be submitted to the qualified voters of said district the
following ouestion:
Shall a special tax on all taxable property in the South Orange Fire
District, of not exceeding ten cents of the one hundred dollar valuation
of property, for the purpose of providing fire protection in said district,
be levied therein?
The ouestion herein above set forth contains a statement of the nuroose of said
election and if a majority of the oualified voters voting at said election vote in
favor of levying and collecting a tax in said district for fire protection purposes,
then the Board of County Commissioners is authorized and directed to levy and collect a
tax in said district in such amount as may be deemed necessary not exceeding ten cents
on the one hundred dollar valuation of property in said district from year to year.
For said election a new registration is ordered within said district and a new
registration book shall be used and such book shall be open for the registration of
voters from 9:00 o'clock A. M. until 6:00 o'clock P. M. of each day beginning Tuesday,
May 14, 1968, and closing Tuesday, June 4, 1968. Tuesday June 11, 1968, will be
Challenge Day.
The polling place in the district and the registrar and judges are as follows:

Section 4. The location of the polling place and the name of the registrar and
judges set forth in the foregoing form of election notice is the Dolling place and the
registrar and judges appointed by the County.Board of Commissioners, and such polling
place and such registrar and judges shall be the polling place and registrar and judges
of said election.
Section 5. The form of the ballot to be used at said election shall be
substantially as follows:

Thereupon, upon motion of Commissioner Smith, seconded by Commissioner Walker,
the foregoing resolution was unanimously passed.
It was moved, seconded and adopted, that J. Alex McMahon be reappointed to the
Health Planning Council of Central North Carolina for a three year term, beginning
June 1, 1968 through May 1, 1971, commencing at the expiration of his current term.
It was moved, seconded, and adopted that Ben Loeb of Colony Woods Subdivision
be reappointed to the Colony Woods Fire District Board of Commissioners for a three
year term, beginning February 1, 1968 through January 1, 1971. Said term will
commence at the expiration of his current term.
It was moved, seconded, and adopted that Leo Wagoner of Colony Woods Subdivision
be appointed to fill the unexpired term of George Coltrane on the Colony Wrnods Fire
District Board of Commissioners. Said tam will expire on February 11 1969.
It was moved, seconded, and adopted that Forrest Heath be appointed to the
Orange County Board of Adjustments for a three year term beginning February 27, 1968
through February 1, 1971.
The Board directed that the following contract change orders for the Welfare
Building be signed:
1. Plumbing Contract $608.60 - Additional rock extration for water line
2. Water and Sewerage Improvement - $218.15 - Extending fire hydrants.
The Board directed the clerk to write the Town of Hillsborough and request that
parking on the South side of Margaret Lane between Churton Street and Court Street
be prohibited.
The County Administrator was directed to write the engineers employed by the
Water and Sewerage improvement project and request an explanation of the bill
received by Orange County from Mebane Home Telephone Company in the amount of
$499.35 for damages to the companies lines.
Upon motion duly made and unanimously passed, the Board adjourned to meet at
7:30 o'clock P.M. on Thursday, May 9, 1968, at the home of George Spransy in
Dogwood Acres, Chapel Hill, N. C., for the purpose of holding joint meeting with
representative of the State Board of Health on petition for the establishment of
Dogwood Acres Sanitary District.
