PURPOSE: To consider approval of a Worksharing Agreement between Orange County
Human Relations Commission and the Equal Employment Opportunity Commission (EEOC) for
Fiscal Year 2001.
BACKGROUND: On September 7, 1999, the Board of County Commissioners approved a
Worksharing Agreement between Orange County and the EEOC for a period of October 1,
1999 through September 30, 2000. The Worksharing Agreement designates the Orange
County Human Relations Commission as Fair Employment Practices Agency (FEPA) under
Title VII of the Civil Rights Act of 1964. This designation provides for a dual filing of charges
with substantially equivalent state and local agencies and EEOC for the purpose of preserving
private suit rights, prom{at resolution of charges, and to avoid duplication of effort. EEOC
awards annual contracts to FEPA's, under funding principles approved by EEOC, meet certain
standards of capability and perfom~ance. A contracting FEPA agrees to enter into a
Worksharing Agreement and to investigate a minimum number of charges at a fixed price per
charge.
EEOC proposes an extension of the FY 2000 Worksharing Agreement covering the period
from the 15t day of October 2000 to the 30th day of September 2001, which may be renewed or
modified by the mutual consent of the parties.
FINANCIAL IMPACT: The EEOC reimburses the Human Relation Commission in the amount of
$500 per closed case and $50 per intake. The Human Relations Commission has requested
that EEOC contract with Orange County for 46 cases and 8 intakes.
RECOMMENDATION(S): The Manager recommends that the Board approve the Worksharing
Agreement and authorize the Chair to sign the extension of the Worksharing Agreement.
FY 2001 EXTENSION OF WOR SHARING AGREEMENT
Inasmuch as there have been no substantive changes in the processes, procedures, statutes,
policies or regulations that would adversely affect or substantially alter the worksharing
agreement between the Charlotte District Office and the County of Orange Human Relations
Commission, or that would affect the processing of charges filed under the pertinent Federal,
state or local statutes, the parties agree to extend the current worksharing agreement that was
executed on October 1, 1999 through the FY 2001 Charge Resolution Contract Option Period.
This agreement, as well as the attendant Worksharing Agreement may be reopened and
amended by mutual consent of the parties.
