BACKGROUND: Due to the summer break the request for a public hearing notice is being submitted approximately 2 months in advance. Prior to the notice being advertised in mid August, staff will advertise an open house on July 12, 2000 to discuss a variety of comprehensive planning issues including, but not limited to, Upper Eno watershed planning and Neuse River rules. The next regular quarterly public hearing is scheduled. for August 28, 2000. A summary of each item proposed for public hearing is provided. The text of specific changes will be sent to the BOCC approximately August 14, 2000 and staff will be available for questions prior to the public hearing. Requests• U er Eno Watershed Densit Amendments • Promotes water quality protection issues in the Upper Eno Watershed • Starts the process of complying with the State-mandated Neuse River Basin Rules • Proposes watershed rules similar to those in the Cane Creek and University Lake Watersheds • Amends the transition areas for the Buckhom Economic Development District • Special meeting with Planning Board will start the Public Information Process Stream Buffer Amendments • Clarify the calculation section of the stream buffer section • Clarify the minimum stream buffer width and specify the location from which the stream buffer shall measured • Set minimum buildable areas on lots encumbered by stream buffers or conservation easements z Hillsborough North Planned Development Mixed Use (MU) District and Special Use Permit • Uses include single-family, multiple family, limited commercial, public/institutional and Open Space - • 489.1 + Acres ' • Adjacent to and north of Pathways School Site • Water and Sewer was extended fram Hillsborough for Pathways School • Orange County Solid Waste Department Class A. REC~MMENDATI~N(S): Administration recommends APPROVAL of the items for the August 28, 2000 Quarterly Public Hearing. 3 NOTICE OF PUBLIC HEARING ORANGE COUNTY BOARD OF COMMISSIONERS A public hearing will be held in the Judge F. Gordon Battle Superior Courtroom of the New Orange County Courthouse, 106 E. Margaret Lane, Hillsborough, North Carolina, on Monday, August 28, 2000, at~7:30 p.m. for the purpose of giving all interested citizens . an opportunity to speak for or against the following items: A. ORANGE COUNTY ZONING TEXT AMENDMENTS BOCC GOAL: Watershed Protection adopted June 21, 1999 PURPOSE: To regulate land development to promote water quality in the Neuse River Basin (specifically Upper Eno River Basin) and to reduce erosion and sedimentation. 1. Upper Eno Watershed Density Amendments a. Amend SECTION 6.23 EXTRA REQUIREMENTS FOR WATERSHED PROTECTION OVERLAY DISTRICTS to lower the permitted densities in a portion the Upper Eno Protected Watershed Area and Upper Ena Critical Area. b. Amend SECTION 0.23.2 RESIDENTIAL DENSITY to revise the maximum density allowed in a portion of the Protected Area and the Critical Area. The proposal would change current regulation to the 2- acre and 5-acre density that currently exists in the University Lake Watershed and the Cane Creek Watershed. The proposed changes would not apply to any portion of the I-85/Buckhorn Road Economic Development District (EDD), nar to the Rural Residential, transition area south of Interstate 40/85 adjacent to the I-85/Buckhorn Road EDD, nor to Rural Residential, transition area south of Hi h Rock Road and Lebanon Road as defined in the Land Use Element of the Orange County Comprehensive Plan. c. Amend SECTION 6.23.3c.1 Residential Development IMPERVIOUS SURFACE/DETENTION POND REQUIREMENTS (RESIDENTIAL for a portion of the Protected Area and Critical Area. The proposed changes would not apply to any portion of the I-85/Buckhorn Road Economic Development District (EDD), nor to the Rural Residential, transition area south of Interstate 40/85 adjacent to the I- 85/Buckhorn Road EDD, nor to Rural Residential, transition area south of Hi h Rock Road and Lebanon Road as defined in the Land Use Element of the Orange County Comprehensive Plan. d. Amend SECTION 6.23.3C.2 Non-Residential Development IMPERVIOUS SURFACE/DETENTION POND„.,REQUIREMENTS NON-RESIDENTIAL for a portion of the Protected Area and Critical Area. e. Amend SECTION 6.23.9 CLUSTERING and Section IV-B-9-b.g Ap~2lication Criteria of the Orange County Subdivision Regulations. 2. Stream Buffer Amendments Amend Section 6.23.7 STREAM BUFFERS to: 1) clarify that the location from which the stream buffer begins is at the outside edge of the floodplain; 2) set minimum lot areas on lots encumbered by stream buffers or conservation easements, and; 3) clarify the method of calculating the slope buffer. B. ORANGE COUNTY ZONING ATLAS AMENDMENT AND SPECIAL USE PERMITS 4 1. Hillsborough North - Planned Development Mixed .Use (MU) District and Special Use Permit Zoning Atlas Amendment and Special Use Permit fora Planned Development Mixed Use District; property is located between NC 57 and NC 86 adjacent to and north of the new Pathways School; property consists of 489+ acres (PD - 2000 - 01) 2. Orange County Solid Waste Department to Amend Class A, Special Use Permit To receive public comment on an amendment to an existing Class A Special Use Permit for recycling activities, including enclosures, on the property known as the Johnson Tract (PIN 9870-47-6422). Total tract is approximately 12.76 acres. The proposed change affects a minor portion of the area that the equipment service building is located. 3. Orange Gounty Telecommunications Tower Approval Requirements and Process To receive public comment on possible changes to existing ordinances regulating tower placement. SHAPING ORANGE COUNTY'S FUTURE Shaping Orange County's Future (SOCF), a joint planning project of the Towns of Chapel Hill and Carrboro and Orange County, in association with the Town of Hillsborough, began substantive work 3%z years ago with the responsibility of developing, for all of Orange County (both its towns and rural areas, a quality growth and community-building plan that addresses a multitude of issues with implications for the County's current and future quality of life. After over 400 hours of meetings, community forums, and outreach activities the SOCF Task Force has prepared a report describing a vision for a desirable future and recommendations on how that future can be achieved. Changes may be made in the advertised proposals that reflect debate, objections and discussion at the hearing. FROM: Gayle Wilson, Solid Waste Director DATE: June 27, 2000 RE: Request for Modification to Class A Special Use Permit CC: John Link, County Manager. Rod Visser, Assistant County Manager Craig Benedict, Planning Director An existing Class A Special Use Permit (SUP) authorizes landfill personnel to operate a recycling center on a pazcel of land (known as the Johnson Tract) located on the north side of Eubanks Road and on the west side of the closed landfill. We presently recycle glass, metal cans and plastic on a 7,500 square foot uncovered concrete pad. The existing SUP authorizes landfill personnel to construct two open sheds (600 square feet and 900 squaze feet) to protect personnel working on the pad from adverse weather conditions. We have been operating the recycling azea on and adjacent to the concrete pad for a yeaz, and have determined that the proposed open sheds would be too small to adequately protect the recycling personnel. We have investigated alternative methods of covering the recycling pad and have determined.that a building using truss arches to support the roof is the most practical method of construction and is the most economical. We are proposing to construct two separate buildings. The first would be 72 feet by SO feet and the second would be 72 feet by 35 feet. The total covered area will total 6,120 squaze feet. The employees will be able to work in a weatherproof area and the electrical equipment will also be protected. The existing SUP also. authorizes six open top containers to store recyclables. We have modified our operation by using three closed trailers instead of roll-off containers: The closed trailers are used to store baled plastic and metal cans and flattened aluminum cans. The roll-off containers aze used to store cleaz, brown and green glass. We want to increase the number of roll-offs to 12, due to the increased volume of recyclables currently being processed and anticipated to increase further iri the future. We have detected another. operational problem. The concrete pad needs to be extended an additional 1 S feet by 75 feet where the baler and can flattener/blower is located. The rock base does not stand up to the constant movement of the Bobcat Loader. Funding for all work noted herein is already available in the Solid Waste Enterprise budget, or will became available on July 1 as a result of the Board's recent adoption of the FY 2000-01 budget ordinance. I met with Craig Benedict, Orange County Planning Director to discuss our options with respect to the SUP. He explained that because we have a Class A Special Use Permit we have to go through a public hearing process. The next public hearing is August 28. Craig stated that the Commissioners, during their meeting on June 29~`, will approve the agenda for the public hearing and that we need to request that we be placed on the August 28~' hearing agenda.
