PURPOSE: To approve a resolution to close the entrance of Carolina Loop at St. Mary's Road
and to request that the North Carolina Board of Transportation (NCBOT) abandon that portion of
Carolina Loop pursuant to N.C.G.S. § 136-63.
BACKGROUND:
Request: A.H. Graham and Graham Family Investment L.P. have submitted an abandonment
petition to North Carolina Department of Transportation (NCDOT) to abandon approximately 360' of
Carolina Loop (SR 1586) from its intersection with St. Mary's Road (SR 1002) from the State
Maintained System. This road closing is secured by condition 14 of the Special Use Permit
approved by the Board of Commissioners for Scotswood (aka Churton Grove of Hillsborough)
Planned Development.
Location: Churton Grove is located along the north side of US 70 Bypass and St. Mary's Road
northeast of Hillsborough. The entrance of Carolina Loop (SR 1586) . on St. Mary's Road is
approximately 100' from center of US 70. This intersection will be unsafe with the development of
Churton Grove.
Existin and Pro osed Conditions
Existing: Carolina Loop is also known as Carolina Avenue (SR 1586) and Second Street (SR
1587) and intersects St. Mary's Road at two points. The intersection of SR 1586 with St. Mary's
Road is the one to be eliminated.

Proposed: Approximately 360' of SR 1586 from its intersection with St. Mary's Road is to be
abandoned and the termination of SR 1586 (Carolina Loop) will be made into a cul-de-sac.
Residents may access St. Mary's Road from the intersections at First Street (SR 1559) and at
Second Street (SR 1587).

• BOCC approved special use permit for planned development May 20, 1986.
• ,Special use permit became effective March 31, 1998.
• Applicant submitted abandonment petition to NCDOT April, 2000.
• BOCC considers resolution to request abandonment of 360' (approx.) of Carolina Loop
(SR 1586) from St. Mary's Road. Pursuant to N.C.G.S. § 136-63, the Board of County
Commissioners may requ®st the Board of Transportation to abandon any road in the
secondary system "when the best interest of the people of the county will be served
ther®by".
• NCBOT will consider request. Any. request by a board of county commissioners refused by the
BOT may be presented again upon ,expiration of 12 months.
• If abandonment is approved by NCBOT, NCDOT will prepare the Secondary Road
Abandonment Investigation Report and hold a public hearing to abandon maintenance of the
right-of-way.
FINANCIAL IMPACT: Nane to the County.
RECOMMENDATION: Administration Recommendation: Adopt the resolution to request
NCBOT to abandon 360' of SR 1586 from its intersection with St. Mary's Road.
RESOLUTION OF THE ORANGE COUNTY
BOARD OF COMMISSIONERS OF INTENT
TO CLOSE ARIGHT-OF-WAY
IN HILLSBOROUGH TOWNSHIP
WHEREAS, petitioners A. H. Graham and Graham Family Investment L.P. have filed a petition
before the Board of County Commissioner to close aright-of-way identified on the map which is part
of Exhibit A to this Resolution (hereinafter "the abandoned right-of-way"); and
WHEREAS, it appears that no individual, firm or corporation owns property in the vicinity of said right-
of-way without a reasonable means of ingress and egress to his, her or its property; and
WHEREAS, the Class A Special Use Permit for a Planned Development Rezoning recorded in Book
1709 Page 101 in the Orange County Register of Deeds Office includes a condition that a cul-de-sac
be constructed at the southwestern end of Carolina Avenue during the development of Phase I and
that the entrance on St. Mary's Road (SR 1002) be closed by governmental action, which action shall
be initiated upon the effective date of the special use pem~it; and
WHEREAS, the Class A Special Use Permit became effective March 20, 1998;
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of Orange County that i
intends to close the abandoned right-of--way and the Board of Commissioners of Orange County call:
upon and requests the Board of Transportation, pursuant to N.C. G. S.. § 136-63, to abandon 36(
feet (approximately) of Carolina Loop (SR 1586) from its intersection with St. Mary's Road it
Hillsborough Township.

Article 3. State Highway System
§ 136-63. Change or abandonment of roads.
(a) The board of county commissioners of any county may, on its own motion
or on petition of a group of citizens, request the Board of Transportation to
change or abandon any road in the secondary system when the best
interest of the people of the county will be served thereby. The Board of
Transportation shall thereupon make inquiry into the proposed change or
abandonment, and if in its opinion the public interest demands it, shall
make such change or abandonment. If the change or abandonment shall
afFect a road connecting with any street of a city or town, the change or
abandonment shall not be made until the street-governing body of the city
or town shall have been duly notified and given opportunity to be heard on
the question. Any request by a board of county commissioners or street
governing body of a city refused by the Board of Transportation may be
presented again upon the expiration of 12 months.
(b) In keeping with its overall zoning scheme and long-range plans regarding
the extraterritorial jurisdiction area, a municipality may keep open and
assume responsibility for maintenance of a road within one mile of its
corporate limits once it is abandoned from the State highway system.

maintained as constructed. All such improvements and facilities shall further be
maintained and opi9rated in a safe manner:
6. Left and right turn lanes shall he provided on St. Mary's Road at proposed Graham
Drive during the development of Phase I.
7. Graham Drive and Hamilton Way shall have a 60' right-of--way with a 41' paved crass
section.
$. Turn lanes to the east and west shall be constructed on Graham Drive at the
intersection with St. Mary's Road during the construction of Graham Drive during the
development of Phase I. .
9. Curb and gutter shall be provided slang all streets.
10. A sidewalk shall be provided an one side of the street slang all streets in the PD-H-R2
zone with curb cuts far the handicapped at street intersections.
11. Scatswaod Boulevard shall have a 90 foal right-of-way, containing a 65 foot cross
section with 24 fast wide pavement widths and a 12 foot median.
12. Left turn lanes shall be installed on Scatswood Baulevard. into the multi-family and
commercial areas during the development of Phase II-A.
13. The radii of the driveway off Scotswaod Baulevard into the commercial section shall
be reworked to allow easier truck access and shall be approved by the Zoning Officer
and shown an the revised site plan.
14. A cul-de-sac shall be constructed at the southwestern end of Carolina Avenue during
the development of Phase I. The entrance an St. Mary's Raad (SR lOQ2) shall be
closed by governmental action, which actian shall be initiated upon the effective date
of this special use permit.
1S. A stubout to the western property line shall be provided from Scotswood Baulevard.
This stubaut shall be located to connect directly to the southern career of Greentree
Drive. The location of the stubaut shall be approved by the Zoning Officer and shown
on the revised site plan.
16. Temporary turnarounds shall be provided at all stub-out streets.
l7. A third turn lane shall be constructed slang US 7Q between St. Mary's Raad and
Miller Raad (SR 1555) during the constn~ction of Phase I.
1$. Left turns onto or out of the southernmost entrance to the commercial area shall be
restricted and only right turn movements permitted.
