To consider the legal notice for the February 21, 2000 Joint Planning Area Public Hearing.
This Joint Planning Area public hearing (necessary for the Greene Tract rezoning) is in
addition to the traditional date in April, but is completely consistent with previous
discussions and the process outlined by the governing boards of Chapel Hill and Orange
County. The purpose of the hearing is to consider rezoning the Greene Tract from Chapel
Hill Rural Transition (RT) to Chapel Hill Materials Handling District (ME).
The Chapel Hill Town Council along with the Carrboro Board of Aldermen and Board of
County Commissioners has approved and executed an Interlocal Agreement for management
of solid waste. A component of the Agreement calls for rezoning 60 acres of the 169 acre
Greene Tract to permit a Solid Waste Handling Facility.
In November, Chapel Hill amended its Development Ordinance to create a new zoning
district called, "Materials Handling District." The schedule for implementation of the
Interlocal Agreement calls for the Greene Tract to be rezoned to this new district by March
20, 2000. Since the Greene Tract is located in Chapel Hill's Joint Planning Transition Area,
a Joint Planning process needs to be followed.
Another component of the Interlocal Agreement calls for the three governing bodies to agree
on which 60 acres of the 169 acre Greene Tract will be transferred to the County. It is this
land that would be rezoned and possibly used for the materials handling function.

The Administration recommends approval of the Notice of Joint Planning Public Hearing
for February 21, 2000.

NOTICE OF PUBLIC HEARING
ORANGE COUNTY BOARD OF COMMISSIONERS
CHAPEL HILL TOWN COUNCIL
A public hearing will be held at the Chapel Hill Town Hall, 306 North Columbia Street, Chapel
Hill, North Carolina, on Monday, February 21, 2000 at 7:30 p.m. The purpose of the public
hearing is to give all interested citizens an opportunity to speak for- or against the proposed
rezoning of a portion of the 169 acre "Greene Tract." The proposal is described more fully as
follows:
ORANGE COUNTY ZONING ATLAS
The initial request is to rezone the 169 acre "Greene Tract" from Chapel Hill Rural Transition
(RT) to Chapel Hill Materials Handling District (MH) to implement an interlocal agreement for
management of solid waste. Prior to adoption, a specific 60 acre tract will be selected from the
larger 169 acre tract under initial review. The Greene Tract is owned jointly by Orange County
and the Towns of Chapel Hill and Carrboro. It is located in the Chapel Hill Joint Planning
Transition Area and bounded generally by the University Branch of the Southern Railroad to the
east, Homestead Road to the south, Rogers Road to the west, and Eubanks Road to the north. It is
identified by Parcel Identification Number (PIN) 9870-84-3271. If approved, the Chapel Hill.
zoning designation will be incorporated by reference into the Orange County Zoning Atlas. This
amendment requires the approval of the governing boards of Orange County and Chapel Hill.
All interested citizens are invited to attend this hearing and be heard. Public comment will be
received during the public hearing. Following the close of the public hearing, only evidence
received in writing by the date of the Orange County Planning Board meeting following the
public hearing will be considered by the Board of Commissioners for decision.
Changes may be made in the advertised proposals which reflect debate, objections and discussion
at the hearing.
