This committee would work out the necessary details of the proposed mental health program and report all plans to their respective boards. Gatti_s, Acting Clerk --------------------------------------------------------------------------- MINUTES OF THE ORANGE COUNTY BOARD OF COMMISSIONERS July 24, 1967 The Board of Commissioners for the County of Orange, North Carolina, met in adjourned regular session at the County Courthouse in Hillsborough, North Carolina, the usual place of meeting, at 8:00 o'clock P.M., July 242 1967. Present: Chairman Harvey D. Bennett, and Commissioners William C. Ray, Carl M. Smith, Henry S. Walker and Ira A. Ward. Absent: None Commissioner Smith introduced the following resolution which was read: RESOLUTION PROVIDING FOR THE ISSUANCE OF $650,000 WATER AND SEWER BONDS BE IT RESOLVED by the Board of Commissioners for the County of Orange: Section 1. The Board of Commissioners has determined and does hereby find and declare: (a) That an order authorizing $560,000 Water Bonds and an order authorizing $90,000 Sanitary Sewer Bonds of the County of Orange were finally passed by the Board of Commissioners on October 3, 1966, which orders were approved by the vote of a majority of the qualified voters of said County who voted thereon at an election duly called and held on November 8, 1966.- (b) That none of said $560,000 Water Bonds has been issued, and that no notes have been issued in anticipation of the receipt of the proceeds of said bonds. (c) That nine of said $90,000 Sanitary Sewer Bonds has been issued and no , notes have been issued in anticipation of the receipt of the proceeds of said bonds. (d) That it is necessary that the County of Orange issue at this time all of said Water Bonds and all of said Sanitary Sewer Bonds authorized by said orders. (e) That the period of the life of the waterworks system to be constructed from the proceeds of said Water Bonds is forty years, that the probable period of the life of the sanitary sewer system to be constructed from the proceeds of said Sanitary Sewer Bonds is forty years, and that the average of said two periods, com- puted from October 3, 1967, a date not more than one year after final passage of said orders, and taking into consideration the amount of bonds to he issued for each purpose, is a period expiring on October 3, 2007. (f) That said $560,000 Water Bonds and said $90,000 Sanitary Sewer Bonds shall be consolidated into an issue of $650,000 bonds of the County of Orange, designated "Water and Sewer Bonds". Section 2. For the purposes provided in said orders there shall be issued the negotiable coupon bonds of the County of Orange in the aggregate principal amount of $650,000 designated "Water and Sewer Bonds", dated June 1, 1967, consisting of 130 bonds of the denomination of $59000 each, numbered 1 to 130, inclusive, unless, pursuant to the provisions of the notice of sale for said bonds published by the Local Government Commission, the successful bidder for said bonds shall request $1,000 denominations, in which event said bonds shall consist of 650 bonds of the denomination of $1,000 each, numbered 1 to 650, inclusive. Said bonds shall mature annually, June 1, in numerical order, lowest numbers first, $20,000 1968, $20,000 1969, $25,000 1970 to 1980, 130,000 1981 to 1985, all inclusive, $35,000 1986, and $50,000 1987 to 1989, inclusive, without option of prior payment, and bear interest from their date at a rate or rates not exceeding 6% per annum to be determined by the Local Government commission at the time the bonds are sold, which interest to the maturity thereof shall be payable semi-annually on the 1st days of June and December of each year, and both the principal of and the interest on said r 90,CK 1 mE (i bonds shall be payable at Bankers Trust Company, in the Borough of Manhattan, City and State of New York, or, at the option of the holder or registered owner, at Wachovia Bank and Trust Company, in the City of Raleigh, North Carolina, in any coin or currency of the United States of America which, at the respective dates of payment thereof, is legal tender for the payment of public and private debts. Section 3. Of the proceeds of each bond issued hereunder 56/65 shall be applied to the construction of a waterworks system in said County, and 9/65 shall be applied to the construction of a.sanitary sewer system in said County, and that upon the payment of each one thousand dollars of bonded indebtedness, $861.54 shall be deemed to be the amount of water debt paid and $138.46 the amount of sanitary sewer debt paid. Uoon motion of Commissioner Smith, seconded by Commissioner Walker, the fore- going resolution entitled: "RESOLUTION PROVIDING FOR THE ISSUANCE Or^ 5650,000 - WATER AND SEWER BONDS" was passed by the following vote: Ayes: Commissioners Bennett, Ray, Smith, Walker and Ward. Noes: None Thereupon Commissioner Ward introduced the following resolution which was read: RESOLUTION PROVIDING FOR THE ISSUANCE OF $130,000 COUNTY OFFICE BUILDING BONDS BE IT RESOLVED by the Board of Commissioners for the County of Orange: Section 1. The Board of Commissioners has determined and does hereby find and declare: (a) That. an order authorizing $130,000 County Office Building Bonds of the County of Orange was finally passed on March 20, 1967. (b) That none of said bonds has been issued and that $130,000 County Office Building Bond Anticipation Notes have been issued in anticipation of the receipt of the proceeds of a like amount of said bonds, which notes are dated June 15, 1967, mature on September 1, 1967, bear interest at the rate of 2.54% per annum and consist of 1 note of the denomination of $30,000, numbered 1, a_nd 1 note of the denomination of $100,000, numbered 2. (c) That it is necessary that the County of Orange issue all of said $130,000 County Office Building Bonds, the proceeds thereof to be used to pay said notes at their maturity. (d) That the period of the life of the county office building to be constructed and equipped pursuant to said order is estimated as:a period of thirty years from March 20, 1968, being a date not later than one year after the final passage of said order, and that such period expires on March 20, 1998. Section 2. For the purpose of providing the county office building pursuant to said order there shall be issued the negotiable coupon bonds or the County of Orange in the aggregate principal amount of $130,000, designated "County Office Building Bonds", dated June 11 1967, consisting of 26 bonds of the denomination of $5,000 each, numberer - :c 26, inclusive, unless, pursuant to the provisions of the notice of sale fer said bonds published by the Local Government Commission, the successful bidder for said bonds shall request $1,000 denominations, in which event said bonds shall consist of 130 bonds of the denomination of $1,000 each, numbered 1 to 1307 inclusive. Said bonds shall mature annually, June 1, in numerical order, lowest numbers first, $10,000 1968 to 1980, inclusive, without option of prior payment, and bear interest from their date at a rate or rates not exceeding 6%. Noes: Norte i Thereupon Commissioner Smith introduced the following resolution which was read: J RESOLUTION FIXING THE FORM AND MANNER OF EXECUTION OF $650,000 WATER AND SEWER BONDS AND $130,000 COUNTY OFFICE BUILDING BONDS TO BE ISSUED 'U'NDER DATE OF JUNE 1, 1967, PROVIDING FOR THE REGISTRATION THEREOF AND RATIFYING APPLICATION TC LOCAL GOVERNMENT COM"LISSICN FOR THE ADVERTISEMENT AND SALE OF SAID BONDS BOOK ) FACE BE IT RESOLVED by the Board of Commissioners for the County of Orange: Section 1. The $650,000 Water and Sewer Bonds and $130,000 County Office Building Bonds to be issued by the County of Orange under date of June 1, 1967, shall be signed by the Chairman of the Board of Commissioners and by the Register of Deeds and ex officio Clerk of said Board, and the corporate seal of said Board shall be affixed to the bonds, and the interest coupons to be attached to said bonds shall be executed with the facsimile signature of said Register of Deeds and ex officio Clerk. Here insert in the Water and Sewer Bonds, the following paragraphs: "This bond is one of a series issued by said County for the purpose of providing funds, with any other available funds, for constructing a water- works system and sanitary sewer system in said County, and this bond is issued under and pursuant to The County Finance Act, as amended, and the Local Government Act, as amended, and two orders which were approved by the vote of a majority of the qualified voters of said County who voted thereon at an election duly called and held and resolutions duly passed by the Board of Commissioners for said County. 111t is hereby certified and recited that all acts, conditions and things required by the Constitution and laws of North Carolina to happen, exist and be performed precedent to and in the issuance of this bond have happened, exist and have been performed in regular and due form and time as so required; that provision has been made for the levy and collection of a direct annual tax upon all taxable property within said County sufficient to pay the principal of and the interest on this bond as the same become due; and that the total indebtedness of said County, including this bond, does not exceed any constitutional or statutory limitation thereon." and insert in the County Office Building Bonds the following paragraphs: "This bond is one of a series issued by said County for the purpose of providing funds, with any other available funds, for constructing and! equipping a county office building on land now owned by said County to provide offices and facilities for the various departments, bureaus and agencies of the County government, and this bond is issued under and pursuant to The County Finance Act, as amended, and the Local Government Act, as amended, and an order which has taken effect and resolutions duly passed by the Board of Commissioners for said County. "It is hereby certified and recited that all acts, conditions and things required by the Constitution and laws of North Carolina to happen, exist and be performed precedent to and in the issuance of this bond have happened, exist and Y. have been performed in regular and due form and time as so required; that provision has been made for the levy and collection or a direct annual tax upon all taxable property within said County sufficient to pay the principal of and the interest on this bond as the same shall become due; and that the total in- debtedness of said County, including the indebtedness evidenced by this bond and all other indebtedness theretofore contracted in the fiscal year in which the indebtedness evidenced by this bond was contracted, does not exceed any con- stitutional or statutory limitation thereon." EASTERLING, Secretary, Local Government Commission By: Designated Assistant PROVISIONS FOR REGISTRATION This bond may be registered as to principal alone in the Bond Register of the County of Orange by the Register of Deeds and ex officio Clerk of the Board of Commissioners as Bond Registrar, at his office in Hillsborough, or by such other Bond Registrar as may be legally appointed by the governing body of said County, upon presentation hereof to the Bond Registrar who shall make notation of such registration in the registration blank below, and this bond may thereafter be transferred only upon a duly executed assignment of the registered owner or his attorney, in such form as shall be satisfactory to the Bond Registrar, such transfer to be made on such Bond Register and endorsed hereon by the Bond Registrar. Such transfer may be to bearer and thereby transferability by delivery shall be restored, but this bond shall again be subject to successive registrations and transfers as before. The principal of this bond, if registered, unless registered to bearer, shall be payable only to or upon the order of the registered owner of his legal representative. No charge shall be made to any bondholder `or the privilege of registration and transfer herein granted. Section 3. The:action of the County Administrator in applying to the Local Government Commission to approve, advertise and sell said bonds and the action of the Local Government Commission in asking for sealed bids for said bonds by publishing a sale notice and printing and distributing circulars be and the same is hereby-ratified and confirmed. Upon motion of Commissioner Smith, seconded by Commissioner Walker, the foregoing resolution entitled: "RESOLUTION FIXING THE FORM AND MANNER OF EXECUTION OF $650,000 WATER AND SEWER BONDS, AND $130,000 COUNTY CFFICE BUILDING BONDS TO BE ISSUED UNDER DATE OF JUNE 1, 1967, PROVIDING FOR THE REGISTRATION THEREOF AND RATIFYING APPLICATION TO LOCAL GOVERNMENT COMMISSION FOR THE ADVERTISEMENT AND SALE OF SAID BONDS" was passed by the following vote: Ayes: Commissioners Bennett, Ray, Smith, Walker and Ward. Noes: None. Thereupon Commissioner Ward introduced the following resolution which was read: RESOLUTION AUTHORIZING THE PRINTING OF THE LEGAL OPINION ON THE $650,000 WATER AND SEWER BONDS AND THE $130,000 COUNTY OFFICE BUILDING BONDS TO BE ISSUED UNDER DATE OF JUNE 1, 1967 BE IT RESOLVED by the Board of Commissioners for the County of Orange that there shall be printed on the reverse of each of the $650,000 Water and Sewer Bonds and the $130,000 County Office Building Bonds to be issued under date of June 1, 1967, the legal opinion of Mitchell, Pershing, Shetterly & Mitchell, Bond Counsel to the County of Orange, with respect to the validity of said bonds, and there shall be printed immediately following such legal opinion a certificate signed with the facsimile signature of the Chairman of the Board of Commissioners for said County, such certificate to be in substantially the following form: I HEREBY CERTIFY that the foregoing is a true and Correct copy of the legal opinion on the bonds therein described which was manually signed by Mitchell, Pershing, Shetterly & Mitchell, New York, N. Y., and was dated as of the date of delivery of and payment for said bonds. Twenty-five per cent (25%) of the proceeds of this tax shall be deposited in the Welfare Accounts and seventy-five (75%) of the proceeds will be deposited in the School Current Expense Fund. (2) A Special School Tax of $0.29 on the $100.00 of property valuation shall be levied on all property in the Chapel Hill School District. (3) A Special Fire Tax of $0.10 on the $100.00 of property valuation shall be levied on all property in the Greater Chapel Hill Fire District. (4) A Special Fire Tax of $0.10 on the $100.00 of property valuation on all property in the Colony Woods Fire Protection District. (5) On each open female dog six (6) months of age or older the sum of $2.00, on allother dogs the sum of $1.00. (6) On each marriage license a tax of $4.00. (7) In accordance with Section B of the Revenue Act (Article 2, Chapter $, of the General Statutes) and any other section of the General Statutes there is hereby levied a privilege license tax in the maximum amount permitted on all businesses, trades, occupations, or professions which the County is entitled to tax. Upon motion of Commissioner Ward, seconded by Commissioner Walker, it was moved and unanimously adopted, that Clarence D. Jones be re-appointed as a member of the Research Triangle Regional Planning Commission. Lawrence Alley, Engineer for the Industrial Park Water Project, presented a program report. Mr. Alley emphasized the necessity for the completion of the access road which runs parallel to I-85 as the pipe contractors would be unable to complete their work. Upon motion of Commissioner Ray, seconded by Commissioner Smith, it was moved and unanimously adopted, that Mr. Alley be employed-to supervise the survey and grading of the proposed access road. There being no further business to come before the Board the meeting was adjourned to meet again.on ,Tuesday, July 25, 1967 at 8 P.M. in the Community Room of Orange Savings & Loan Association building in Chapel Hill, N.
