BOARD CF COMMISSIONERS
July 3, 1967

The Orange County Board of Commissioners met in regular session on Monday,
July 3, 1967 at ten o'clock a.m. in the Commissioners Room at the Courthouse in
Hillsborough.
Members Present: Chairman Harvey D. Bennett, and Commissioners William C. Ray,
Carl M. Smith, Henry S. Walker and Ira A. Ward.
Members Absent: None,
Minutes of the previous meetings were read and approved.
Comma Byrd, resident of Eno Township, presented the following letter and
petition.
"ENO PRECINCT DEMOCRATIC COMMITTEE
The Honorable Harvey Bennett
Chairman, Orange County Board of Commissioners
June 26, 1967
The Eno Precinct Democratic Committee, Eric Township, respectfully request
that the people of Eno Township be allowed the right to vote on the zoning issue.
We wish to maintain a state of tranquility in this precinct and township
and this is the one way, in fact, the only way we can see of doing it.
We submit herewith a petition signed by 496 residents, voters and freeholders
of Eno Township requesting, also, that the people be allowed to vote on the
zoning issue.

"We, the people of Eno Township and being in Orange County,'N. C. petition
our County Commissioners not to enact any kind of zoning in our township and or
county without the right of we the people to vote on the zoning ordinance and or
taxes to operate said zoning.
We also petition our state legislators in our county and state to enact laws
to allow us the right to vote on any zoning ordinance and or taxes for its operation
as the only method for enacting said ordinances.

The following road petitions were presented and the clerk was directed to
forward to State Highway Commission:
Barnes Street (Lincoln Park Subdivision)
Murray Avenue, West Hillsborough, N. C.

Northside Drive, Chapel Hill, N. C.

A petition signed by residents of the Orange Grove-Calvander Community
requested that Secondary Road 41177 be named Dairy Land Road and that a sign
so designating the name of said road be erected by the State Highway Department.
The clerk was advised to forward said petition stating the approval of the Board
to said petition,.
Discussion ensued concerning a letter received from W. Marshall Smith,
Recorders Court Judge. Judge Smith had requested a leave of absence from this
position effective as of July 1, 1967. It was moved and duly adopted that leave
of absence be-granted to W. Marshall Smith.
Upon motion of Commissioner Walker, seconded by Commissioner Ward, it was
moved and unanimously adopted that Dalton H. Loftin, Attorney at Law, be appointed
as Judge of Orange County Recorders Court effective as of July 1, 1967 until
August.31, 1967. The clerk was requested to advise Mr. Loftin of this appointment.
Discussion ensued relative to a petition being circulated in the Dogwood Acres
area relative to the establshment of a sanitary district.
Discussion ensued concerning O.E.O.and the Joint Orange-Chatham Action, Inc.
requested budget. It was agreed that the Orange County Board of Commissioners
would discuss this matter further with the Chatham County Board of Commissioners.

hazrman Bennett informed the Board that there existed some confusion as to the
location of the Orange County and Durham County line in the Southeast area of the
county. Discuss ion ensued concerning the method which should be used to establish the
eastern boundary line of the county. It was agreed that a meeting with the Durham
County Board of Commissioners should be arranged in order that the two boards might
work together in the establishment of the adjoining county line.
The followi ng amendments to the Chapel Hill Township Zoning Ordinance were presented:
AMENDMENTS TO THE CHAPEL HILL TOWNSHIP ZONING ORDINANCE
(ADOPTED July 3, 1967)
Section 2: Amend to read, "The effective date of this ordinance is February
67 1967. All amendments to this ordinance shall be effective on
the dates of their adoption by the Orange County Board of County
Commissioners."
Section 6.2: Amend Residential District to read: "1 acre per dwelling unit;
15,000 square feet only in areas where both public or community
water and sewerage facilities are provided."
Section 6.3: Minimum Lot Width:
150 feet for 1 acre or larger lots; 100 feet for lots less than
1 acre. Minimum lot widths shall be measured at the setback line,
or at the building line only if the building lire equals or exceeds
the minimum required setback distance.
Section 6.8: Amend Residential District to read: "Two off-street parking spaces
per dwelling unit."
Section 6.9: Delete the language "General Purpose Advertising Signs or Bill-
boards with a maximum area of no more than 500 square feet and
located no closer than 1,000 feet from any other sign" from the
General Commercial District and the Industrial District.
Section 10.1: Amend to add "For purposes of this ordinance all buildings and other
structures upon which substantial construction was begun prior to
adoption of this ordinance or amendment to '_t, and which do not con-
form to the requirement of said ordinance or amendment shall be
classified as non-conforming buildings or structures. No other
beginnings of buildings or structures or uses of land which do not
conform to the provisions of this ordinance shall entitle said
buildings or structures or uses of land to non-conforming status
under the provisions of this ordinance."
Section 10.2: Amend to add: "No non-conforming uses of land which do not also
include use of a building constructed or a building upon which
substantial construction was begun prior to the adoption of this
ordinance or amendment to it shall be permitted to continue in
that use or proposed use for more than ninety days following said
adoption."
Section 12.3.5: Change to Section 12.3.6. Add new Section 12.3.5 as follows: "The
Board of Adjustment shall be empowered to issue any temporary or
other special permits required by this ordinance only as specifically
authorized by this ordinance. In the exercise of this power the
Board shall follow the language of the ordinance exactly."
Section 13.2.2: Amend to read "The Board of Commissioners and the Planning Board
shall hold a joint quarterly public hearing on any proposed
amendments to this ordinance, advertising such hearings once a week
for two consecutive weeks with the first advertisement appearing
not less than 15 days prior to each hearing, in a newspaper of
general circulation in the appropriate portion of the County before
taking action concerning proposed amendments."
Section 14.1: Amend to add: "Each calendar week that a violation continues to
exist shall be considered a separate offense."
Section 16: Amend Lot definition to read: "A parcel or tract of land in-
single ownership, including joint tenancy or other undivided interest,
occupied or intended for occupancy by a structure, or structures,
together with the accessories and the required open space belonging
to them.
Section 16: Amend Lot Depth definition to read: "The shortest perpendicular
distance from the front lot line to the rear lot line shall be the
lot depth."
Section 16: Amend Premises definition to read: "See Lot."
upon motion of Commissioner Ray, seconded by Commissioner Ward, it was moved that
the amendments to the Chapel Hill Township Zoning Ordinance be adopted.
The Zoning Administrator advised the Board of Commissioners that the Planning
Board does make the following recommendations:

1. That the petition of Harvey Lucas of Greenway Projects requesting
rezoning from a residential area to a mobile home park area be denied.
Unon motion of Commissioner ward, seconded by Commissioner Ray, it was moved
and unanimously adapted, that the recommendation of the County Planning Board be
upheld.
2. That the petition of Wade Parrish for rezoning from a residential area
to a mobile home park area be tabled until such time as Mr. Parrish
presents letters of approval showing that the waste disposal facilities
for his project has been approved by all of the appropriate State
agencies.
Upon motion of Commissioner Smith, seconded by Commissioner Ward, it was
moved and unanimously adopted,that the recommendations of the County Planning
Board be upheld.
3, That the Planning Board recommended that any action on the apartment
district proposal be deferred until the first Monday in August.
Upon motion of Commissioner Wald, seconded by Commissioner Smith, it was
moved and unanimously adopted,that the recommendations of the County Planning
Board be upheld.
James R. Farlow of Chapel Hill questioned the Board about the Dogwood
Acres sanitary district proposal petition. Mr. Farlow was advised that said
petition had been referred to the Countv Attorney with the request that the
County Attorney consult the Bond Attorneys to secure their opinions concerning
the sufficiency and legal status of said petition.
Budget discussion ensued.
There being no further business to come before the Board, the Board meeting
was adjourned to meet again in adjourned sessions on Friday, July 14, 1967

MINUTES OF THE ORANGE COUNTY
BOARD OF COMMISSIONERS
July 14, 1967
The Orange County Board of Commissioners met in adjourned session
on Friday, July 14, 1967 at eight o'clock p.m. in the Commissioners Room
at the Courthouse in Hillsborough.
Members Presents Chairman Harvey D. Bennett, and Commissioners William C.
Ray, Henry S. Walker and Ira A. Ward.
Members Absent: Commissioner Carl M. Smith.
f Marvin Walker, Mayor of the Town of Mebane, members of the Mebane Town
Board, Sam Pender and June Crumpler were present for this meeting.
June Crumpler was spokesman for the assembled group. He stated that a
large industry was interested in locating in Alamance County just, across the
Orange County line and that the Town of Mebane c,as requesting that orange County
extend its current water contract to include a twelve inch (12") water line
along Eighth Street from the railroad to the Southern border of Mebane and Mr.
Crumpler further requested that the proposed water line be increased from a
ten inch (10") pipe to a twelve inch (12") pipe from the intersection of Fifth
Street to Eleventh Street. Discussion ensued concerning this request.
dr Unon motion of Commissioner Ray, seconded by Commissioner Walker, it was
?.: unanimously adopted that the proposed water line from Fifth Street to Eleventh
Street be increased from a ten inch (1011) pipe to a twelve inch (12") pipe.
The representatives of the Town of Mebane were advised that Orange County
was not in the position to construct an additional water line along Eighth
Street to the southern border of the Town of Mebane.
