PURPOSE: Ta consider retaining services of an environmental engineering firm to provide
technical services for preparation of a Limited Site Assessment Report (LSA) to the Ground
Water Section of the State Division of Water Quality.
BACKGROUND: Following construction of the automated fueling station at the Orange County
Public Works complex in 1997, the previous underground storage tanks (UST) and fuel pumps
were permanently closed and removed on May 14, 1997. At the time of closure, three
underground storage tanks were removed. Soil sampling .at the time of UST closure indicated
elevated concentrations of petroleum products were present. In accordance with State
regulations, a required report was completed and submitted in May 1997 to the North Carolina
Department of Environment, Health and Natural Resources, Division of Water Quality, Ground
Water Section.
In August 2000, the North Carolina Department of Environment and Natural Resources,
Division of Waste Management, contacted the Public Works Department in follow-up to the
report the County submitted 3 '/2 years ago. Since 1997, potentially contaminated soil that was
excavated by the motor pool contractor from the area surrounding the old storage tanks
removed in 1997 has been retained in a segregated area at the Public Works Department,
pending disposition instructions from the State. The State's UST Section recently advised that
a Soil Contamination Report and/or Limited Site Assessment Report (LSA) must now be
prepared and submitted to ascertain whether there is any remaining contamination in the
immediate vicinity of the 1997 tank excavation. Public Works Director Wilbert McAdoo recently
requested and received a 90-day extension to the 90-day deadline established in the August
2000 DENR letter, to allow completion of required work.
Na member of County staff has the requisite technical knowledge and expertise to carry out the
highly specialized analytical work that must be done to support this latest report submission to
the State. Proposals were requested from several environmental engineering companies to
complete 'the necessary technical work to allow preparation of these reports. Proposals far
provision of technical services were received from three firms -Engineering Consulting
Services, Ltd.; Quantum. Environmental, Inc.; and Trigon Engineering Consultants, Inc. These
proposals are reflected in the attached Bid Summary.
The staff recommendation to select Quantum Environmental Inc, is based on that firm's
demonstrated ability, qualifications and cost for providing the services required by the County.
FINANCIAL IMPACT: Quantum Environmental, Inc. submitted the lowest cost proposal for the
services outlined above. The company's proposal totals $1$,145. Staff also requests
authorization of $2,500 for change orders, bringing the total project cast to $20,645. Funds to
cover $15,000 of the proposal cost are included in a previously approved County capital project,
Fuel Tank Replacements. Remaining funds far the proposal can be accommodated in the
current year Public Works budget.
RECOMMENDATION(S): The Manager recommends that the Board approve the bid award for
preparation of a Limited Site Assessment to Quantum Environmental, Inc. in an amount not to
exceed $18,145 and authorize the Chair to sign a contract with Quantum Environmental, Inc.,
subject to final review and approval by staff and the County Attorney, and that the Board also
authorize the Manager to sign any change orders far additional work required, in an amount nofi
to exceed $2,500.

Dear Ms. Buckner
A review of our files confirms a release ar discharge from a petroleum underground storage
tank (UST) system of 3000 gallons diesel, 2000 gallons diesel, and 10000 gallonsgas at the
above-referenced location. The file contains an Underground Storage Tank Closure Report
but there is no indication that any additional assessment work was performed. Records
indicate that you are the (owner and/or operator) of this UST tank system. This letter is a
standard native explaining the actions you must take as a result of the release or discharge its
accordance with North Carolina statutes and rules. The UST Section of the Division of
Waste Management administers the state's rules far USTs and the required response for
petroleum releases. Those rules are located in Title 1 SA, Subchapter 2L and Title 1 SA,
Subchapter 2N of the North Carolina Administrative Cade (NCAC).
As a responsible party, you are required to comply with the release response and corrective
action requirements of 1 SA NCAC 2L .0115(c); which include the requirements established
in 1 SA NCAC 2N. Listed is a general description of actions you must take to comply with
State rules. or a detailed descri tian of our re uirements lease refs to the enclosed rule

the regulated substance into the environment and to identify and mitigate any fire, explosion and
vapor hazards; remove any free product; and comply with the requirements ofRules .0601 through
.0604 and .0701 through .0703 and .0705 of Subchapter 2N;

2)Incorporate the requirements of 1 SA NCAG 2N .0704 into the report to be submitted in
accordance with l SA NCAC 2L .0115 (cx3) or (c)(4), whichever is applicable (see Item #3
below)., This shall constitute compliance with the reporting requirements of 15A NCAC 2N
.0704(6);
~. • ~ 3) Ifyou can demonstrate that no soil remains in the unsaturated zone in the sidewalls and at the base
ofthe UST system excavation with contaminant levels exceeding either the "sail-to-groundwater"
or the residential maximum soil contaminant concentrations (see Guidelines}, whichever are lower,
then submit a Soil Contamination Report in accordance with 15A NCAC 2L.011 S(cx3). The Sail
Contamination Report, if applicable, is due in this office within 90 days of the date of receipt of
this notice. Upon approval of this report, the Department will issue a notice indicating that no
further action related to this incident is required; or,
4) If the requirements of 1SA NCAC .0115(c)(3) cannot be met as described in Item #3 above,
.. submit a Limited Site Assessment (LSA) Report in accordance with 15A NCAC 2L A 115(c)(4),
containing information needed by the Department to classify the level of risk to human health sand
the environment posed by the discharge or release. The LSA Report is due in this office within
' 120 days of the date of receipt of this notice. Based on a review of the information submitted in
the LSA, the Department will classify the risk of the discharge or release as high, intermediate or
low. At that time, the Department will also classify the land use of the site as either residential or
industriaVcommercial. Yau will be notified of the risk and land use classifications once review~of
your LSA Report is completed.

Your prompt attention to the items described herein is required. Failure to comply with the State's rules in
the manner and time specified, may result in the assessment of civil penalties and /or the use of other

of receipt of this letter.
Please note that performing assessment and cleanup work that is not required under 15A NCAC 2L.O l 15
is not reimbursable from the Commercial or Noncommercial Leaking Petroleum Underground Storage
Tank Cleanup Funds.

Either a Soil Contamination Report should be submitted to this office within 180 days of
receipt of the NORR or a Limited Site Assessment should be submitted with 210 days,
depending on the conditions outlined in the NORR.
