BACKGROUND: Section IV-B-7 of the Subdivision code entitled"Sites for Public Uses' requires that anyone who subdivides land shall dedicate a portion of the properly or make a"payment-in- lieu"for recreation purposes. Presently the code stardom includes: Dedicate 1157 sure per lot quality land 1120 acre per of environmentally constrained land These standards are employed if the Recreation 8 Parks Advisory Board/ER08 determines that the subdivision area has public site suitability for dedication. However,this portion of the bothered has been rarely used because even a 100-unit site would only require 1.75 acre dedication (100 units times 1/57 acre)which is small and chains nor in central area service. Environmental land dedications could total s awes(100 units times 1120 acre). A consultant, Tischler and Associates,was hired to evaluate the standards of Ne existing code and work with Planning Director Craig Benedict, ERCD Director David Stanch and Commissioner Barry Jacobs to update the code provision if warranted through an analysts of existing and proposed park conditions. Initial evaluations that occurred last year noted the need to include the positive impact of the reatioNOpen space search of the bond as an Indicator of future conditions [i.e. higher Levels of Service ILOS7t. That inclusion accordingly would not occur until Ne bond passed. Additional demands of Ne PIL research Include: 1. How much money will be spent? 2. What w0l it be spent on(I a active feollities,active or open space land purchases)? 3. Where is It to be spent to examine service districas The fmmewcrk of developing the answers to these issues have been included in recent BOCC work sessions,so staff is trying to Input this new information into the code provision analysis of future LOS standards. As an added research element, staff Is investigating the use and value of existing or future joint schoollpark facilities so their value can be mduded In the calculation. In summary, whatever standard the seems can achieve by value of its fiscal commitments,tthi the subdividerldevelopment community can be held to a similar alandndi At this time,the consultant has not had enough Information to determine IT the existing dedication or PIL Is high or law.
