BACKGROUND: The applicant/developer has worked with Planning Staff, during the last couple of weeks, to prepare a new plan with more open space. This revised plan is included in the agenda packet on page 46. The applicant/developer has agreed to provide a center turn lane on Frazier Road. This commitment is addressed in the Resolution of Approval on page 8, Condition 9. Request • Applicant: Michael M. Hughes, P.E., Inc. Agent for TSA Development LLC • 54.76 acre tract +/- • Thirty-two (32) single-family residential lots on the conventional development option • Average lot size = 42,491 square feet (0.975 acres); Gross lot size 1.71 acres • Proposed open space = 17.29 acres (31.58% of site) controlled by the Homeowner Association Location • Cheeks Township West side of Frazier Road (SR 1310) between West Lebanon Road (SR 1306) and US Hwy 7n wP~t 2 Conventional Plan Summary: (Per Section IV-B-10 Flexible Development, in the Subdivision Regulations) Flexible developments must consist of at least 33% protected .open space comprised of two' types ofland-Primary Conservation Areas and Secondary Conservation Areas. If the conservation areas consist of less than 33% of the site, the flexible development standard` cannot be met and the conventional option is the appropriate plan. The Eno Ridge site does not contain any natural areas/wildlife habitats, wildlife corridors, floodplain areas, or steep slopes that could: be preserved through the flexible development approach. Conservation Area Breakdown: Primary Conservation Areas: None Secondary Conservation Areas: • Woodlands (Prime Forests) None Approximately 84% (46 acres) of the site has some form of vegetative cover, characterized by a combination of mature and immature mixed forest with significant undergrowth. The former "prime" status of the western portion of the property has been compromised by timbering within the last ten years. • Farmland (Prime Farmland) No significant acreage Approximately 16% (9 acres) of the site is open. The northern half of this area (5 acres +/-) is identified as prime farmland in the Land Use Element of the Comprehensive Plan. Once used for tobacco and more recently hay, this area has been uncultivated (fallow) for the last few years. • Slopes of 15% to 25% None • Historic and/or archaeological sites None • Public and/or private recreation areas and facilities • No public recreation facilities are proposed for this site. • Proposed private recreation areas receive full credit toward meeting the open space requirement. • Scenic Views "views from the road" None Existing Site Conditions Zoning: • Rural Residential (R-1 ); Back Creek Protected Watershed (BACK-PW) and Upper Eno Protected Watershed (U-ENO-PW) • Adjacent Land Uses: Single-family residential and undeveloped lots Physical Description: • Gently sloped land with a mixture of hardwoods and pines • Small area of open land in the north central portion of the property • No drainageways or floodplain areas associated with site Proposed Site Conditions Roads: Eno Ridge Subdivision will be accessed from Frazier Road (SR 1310) via a center turn lane • The subdivision will also connect to West Lebanon Road (SR 1306) through Highridge Subdivision providing two immediate points of access 3 • New Salou Drive will be constructed as a collector, and will provide a future connection with the large undeveloped tract to the west. • All seven roads (New Salou Drive, Trumpet Court, Vine Court, Bee Balm Court, Onslow Court, Climbing Aster Court, and the new portion of High Ridge Drive) will be public and constructed to NCDOT standards. Residential Lots: • Thirty-two (32) single-family residential lots per the conventional development option • Average lot size = 42,491 square feet (0.975 acres); Gross lot size 1.71 acres • Minimum lot size per R-1 Zoning District = 40,000 square feet • Minimum lot size using individual well and septic systems = 40,000 square feet • Minimum to actual lot size ratio (MTAR) = 1.06 • Minimum density per Back Creek and Upper Eno Protected Watersheds = 1 dwelling unit per 40,000 square feet • Minimum to actual density ratio (MTADR) = 1.86 • Impervious Surface limit per Back and Upper Eno PWs = 12% Open Space: • Minimum open space required for Conventional Development = 0% of site • Proposed open space = 17.29 acres (31.58% of site) controlled by the Homeowner Association • Open space includes centrally located mini-park linked to pedestrian trail • Open space along New Salou and High Ridge drives provides for pedestrian travel along main roads outside of rights-of-way. Buffers: • The applicant has self-imposed a 30-foot building buffer area along the site perimeter and between the subdivision and any off-site public street right-of-way. (There is no building buffer requirement for conventional subdivisions.) • A 30-foot Type A Land Use Buffer (semi-opaque: intermittent visual obstructions from the ground to a height of at least thirty feet) is required along Frazier Road and the proposed New Salou Drive per Section IV-B-8. • Typical lot landscape plan specifies primary and secondary tree protection areas Recreation & Parks: Public Recreation Space • The site is located in the Cheeks Township District Park (per the Recreation Service Area Boundaries Map. • No physical dedication is warranted because neither county recreation sites nor conservation sites have been identified for this area, as part of the current Comprehensive Plan. The payment in-lieu of option is viable. Private Recreation Space • The applicant must reserve a minimum of 36,852 square feet of open space for private recreation use (Per Section IV-B-7-b Recreation Sites, Orange County Subdivision Regulations and Articles 5.1.1 & R.12 of the Orange County Zoning Ordinance). • The proposed pedestrian trail and mini-park satisfy this requirement. 4 Well-Septic: • All lots to be served with individual well and septic systems. (See pages 14-15 regarding well data for neighboring subdivisions.) • Final number of lots does not exceed the number approved with the concept plan Agency Comments • Requests for agency review were sent to: NCDOT, Recreation and Parks, Orange County Schools, Soil and Water Conservation, Erosion Control, the County Attorney, and the Fire Marshal. Evaluation of forest from ERCD. • Comments are attached. Planning Staff Comments The Preliminary Plan meets the conditions placed on the Concept Plan approval. Development Process. Schedule, and Action • First Action: Planning Board to consider Concept Plan The Planning Board approved the conventional development concept plan for James Woods (renamed Eno Ridge) on December 6, 2000 with the following conditions: (Please note that while the road names have been changed and the lots have been renumbered, the overall design of Eno Ridge Subdivision is the same as James Woods. The proposed preliminary plan meets the conditions placed on the concept plan.) Conventional Development Plan 1. All six proposed roads (James Woods Drive, Turtle Court, Wolf Court, Frog Court, Owl Drive, and Bobcat Court) shall be public rights-of-way constructed to NCDOT standards with additional five (5) foot utility easements on each side. The right-of-way at the Frazier Road intersection shall be improved to NCDOT standards. Sight distance triangles (10' x 70') shall be delineated on the plat for all intersections in the subdivision. 2. Driveway access points shall be a minimum of 50 feet from the intersection of street rights- of-way. All corner lots shall be designed to access the road with lower traffic volume: lots 1 and 6 shall exit onto Turtle Court, lots 7 and 10 onto Wolf Court, lots 11 and 17 onto Frog Court, and lots 18 and 28 onto Bobcat Court. 3. If an entrance sign is anticipated and will not be placed within the one of the open space areas maintained by the Homeowners Association, a sign easement must be reserved within one of the residential lots. 4. All common areas including landscape buffers must be clearly identified on the preliminary and final plats and maintained by the Homeowners Association. The common areas cannot be subdivided or recombined with adjacent lots. Draft forms of the Homeowners Association documents, including restrictive covenants and conservation easements, that contain use and maintenance provisions for the open space and buffers must be submitted for review by the County Attorney as part of the preliminary plat approval process. The restrictive covenants or conservation agreements shall designate a backup grantee in the event that the Homeowners Association is eliminated. 5. The preliminary and final plats shall contain a note restricting further subdivision. 6. The applicant must receive approval from Orange-Alamance to extend public water services from the Orange-Alamance Water System into the James Woods Subdivision or make provisions for individual wells on each proposed residential lot. 7. Each lot shall contain an adequate area for septic disposal and a repair area as approved by the Orange County Division of Environmental Health. 5 8. The preliminary plat shall indicate areas for on-site infiltration of storm water that demonstrates compliance with Article 6.23.3a of the Orange County Zoning Ordinance. 9. The preliminary plat shall show the location of tree protection fencing and contain a note requiring the installation of tree protection fencing prior to any grading to ensure the protection of vegetation within all buffers and open space. 10.The applicant shall dedicate a minimum of 24,394 square feet (1/57 acre per residential lot) for public recreation space, or pay an in-lieu-of fee, as part of the preliminary plat approval process. (Section IV-B-7-b Recreation Sites, Orange County Subdivision Regulations). 11.The applicant shall provide a minimum of 36,852 square feet for private recreation space as part of the preliminary plat approval process. (Section IV-B-7-b Recreation Sites, Orange County Subdivision Regulations). 12.A11 street names to be reserved with GIS section of Planning Department prior to submittal of preliminary plat subdivision request. The applicant must resolve any issues regarding the future connection of James Woods Drive with High Ridge Drive prior to preliminary plat submittal. Second Action: Planning Board to consider Preliminary Plan The Planning Board recommended approval of the preliminary plan for the Eno Ridge Subdivision on July 10, 2002 in accordance with the attached Resolution for Approval. Third Action: Board of County Commissioners consideration of Preliminary Plan 1. The Board shall consider the application within a reasonable amount of time. 2. During deliberations and consideration of the application the Board may defer consideration at any point to pursue additional analysis and review. 3. If the Preliminary Plat is approved by the County Commissioners the applicant shall have one (1) year to prepare and file a Final Plat or to request aone-year extension from the Planning Director. FINANCIAL IMPACT: A Fiscal Impact Analysis (attached) RECOMMENDATION(S): Administration Recommendation The Administration recommends approval in accordance with the attached resolution. Planning Board Recommendation July 10, 2002 The Planning Board recommends approval in accordance with the attached resolution. All roads shall be irrevocably dedicated to the general public and be constructed to standards of the North Carolina Department of Transportation (NCDOT). The approval of this resolution authorizes and directs the Orange County Manager to accept for the County, and on behalf of the public generally, the offer of dedication of New Salou Drive, Trumpet Court, Vine Court, Bee Balm Court, Onslow Court, Climbing Aster Court, and the new portion of High Ridge Drive. This acceptance of dedication to the general public shall be without maintenance responsibility. These roads shall be maintained by the owner/applicant (TSA Development LLC) until such time as they are accepted for maintenance by NCDOT or some other governmental body. All easements for drainage, pedestrian access or other purposes, all private open space and land use buffers shall likewise be maintained by the owner/applicant until such time as they are transferred to the control of the Homeowners Association or are accepted for maintenance by the County. Before the Final Plat of Eno Ridge can be recorded: A. Sewage Disposal All lots shall contain adequate septic disposal and repair areas, approved by the Orange County Division of Environmental Health. Septic areas shall not extend into required landscape buffers or within twenty feet of the perimeter of the subdivision boundary. 2. Disclosure that the septic system location may restrict the size and location of improvements shall be included in a document describing development restrictions to be recorded concurrently with the Final Plat. 7 A. 1. Wells All lots shall be served with private wells, approved by the Orange County Division of Environmental Health. Wells shall not extend into required landscape buffers or within twenty feet of the perimeter of the subdivision boundary. 2. Disclosure that the well system location may restrict the size and location of improvements shall be included in a document describing development restrictions to be recorded concurrently with the Final Plat. B. Roads and Access New Salou Drive, Trumpet Court, Vine Court, Bee Balm Court, Onslow Court, Climbing Aster Court, and the new portion of High Ridge Drive shall be constructed to NCDOT standards with a 50-foot right-of-way and 5-foot utility easements on each side. Construction shall be inspected and approved by NCDOT. Pavement width for New Salou Drive and High Ridge Drive shall be a minimum of 20 feet in width. OR A letter of credit or escrow agreement or other security shall be submitted to secure construction of New Salou Drive, Trumpet Court, Vine Court, Bee Balm Court, Onslow Court, Climbing Aster Court, and the new portion of High Ridge Drive to NCDOT standards. An estimate of the construction cost must be prepared by a certified/licensed engineer or grading contractor and submitted to the Orange County Planning Department and approved by the County Engineer. The financial guarantee must reflect 110 percent of that estimate and be issued by an accredited financial institution licensed to do business in North Carolina. The document describing development restrictions to be recorded with the Final Plat shall state that the financial guarantee will not be released until the road construction has been inspected and approved by NCDOT. 2. An erosion control plan for the entire project, including all roads (New Salou Drive, Trumpet Court, Vine Court, Bee Balm Court, Onslow Court, Climbing Aster Court, and the new portion of High Ridge Drive), shall be submitted by the applicant to the Orange County Erosion Control Division for review and approval prior to any disturbance on the site. The Erosion Control Plan shall include a stormwater management plan that meets the requirements of both the County and the Neuse River Basin rules. 3. Prior to any construction or any alteration of any existing access within the right- of-way Frazier Road (SR 1342), the developer/owner shall secure a driveway permit from the NCDOT District Office. A copy of the NCDOT-approved permit and letter to the Planning Department shall be submitted at the same time as the request for Planning Department signatures on the Final Plat. Sight distance triangles shall be shown at all intersections within the subdivision, or included within the right-of-way of the proposed street. 4. All lots shall secure access from streets internal to the subdivision. Lots with frontage on more than one road shall be designed to access from the street with lower traffic volume: i.e. lot 1 and 5 to Trumpet Court, lots 6 and 9 to Vine Court, lots 10 and 16 to Bee Balm Court. and lots 28 and 32 to Onslow Court. Driveway 8 cuts shall be a minimum of 50 feet from street intersections. These restrictions shall be stated in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the final plat. Non-vehicular access easements (NVA)--areas where access is prohibited to the roadway--shall also be shown on the final plat. 5. Approved street name signs shall be erected at the intersections of: Frazier Road (SR 1342) and New Salou Drive, New Salou Drive and Trumpet Court, New Salou Drive and Vine Court, New Salou Drive and Bee Balm Court, New Salou Drive and Onslow Court, New Salou Drive and High Ridge Drive, and High Ridge Drive and Climbing Aster Court, as required in Section IV-B-3-c-12 Street Name Signs of the Orange County Subdivision Regulations prior to Planning Department signatures on the Final Plat. 6. The applicant shall construct New Salou Drive to the western edge of the Onslow Court right-of-way, and shall install a disclosure sign (between three and four square feet) at the western end of New Salou Drive indicating its future extension. 7. The internal pedestrian walkway system and mini-park shall be installed as indicated on the Preliminary and Final plats and inspected by Planning Department staff prior to Final Plat approval. The Declaration of Development Restrictions for Eno Ridge Subdivision prepared by the Developer shall include a maintenance agreement for the Homeowners Association to permanently maintain the internal walkway system and mini-park. 8. Dedicate additional five feet of right-of-way along the entire frontage of Frazier Road. Dedication to be shown on final plat. 9. Prior to Planning Department signatures on the final plat a left center turn lane shall be constructed to NCDOT standards, or bonded for, at the entrance to this project on Frazier Road. If the bonding option is chosen the construction of the turn lane shall be completed prior to the issuance of the first certificate of occupancy. 10. Twenty-foot temporary construction easements shall be shown, on the final plat, along both sides the unconstructed portion of New Salou Drive from Onslow Court to the western boundary of the subdivision tract. C. Land Use Buffers and Landscaping Landscaping shall be installed or preserved as indicated on an approved landscape plan and shall be inspected and approved by the Planning Department prior to Final Plat approval and again prior to the transfer of control of the Homeowners Association from the developer to the home owners as provided by the recorded Declaration of Covenants, Conditions and Restrictions for Eno Ridge Subdivision. Landscaping shall include a 30-foot Type A Land Use Buffer along Frazier Road, New Salou Drive, and High Ridge Drive. OR A letter of credit or escrow agreement or other security shall be submitted to secure the required landscape installation and preservation. An estimate of the 9 cost for required preservation, new plantings, and their installation must be provided. The financial guarantee shall reflect 110 percent of the estimate and must be issued by an accredited financial institution licensed to do business in North Carolina D. 2. Provisions for the protection of existing trees as shown on the approved landscape plan shall be included in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. Drainage Impervious surface data for all lots, pursuant to Article 6.23 Extra Requirements for Watershed Protection Overlay Districts of the Orange County Zoning Ordinance, shall be included in the development restrictions and requirements document to be prepared by Planning Staff and recorded concurrently with the Final Plat. The impervious surface limitations for each lot shall indicate whether the impervious surface includes or excludes one-half (1/2) of the roadway width in the calculations. E 2. Drainage easements shall be located on the Final Plat as required following review and approval of the Erosion Control Plan. 3. Drainage culverts shall be sized and located as required by NCDOT and a North Carolina Licensed Professional Engineer. Parkland The proposed thirty-two (32) lot subdivision is located within the Cheeks Township District Park area. As per the decision of the Board of County Commissioners, cash in the amount of $14,560 ($455/lot) shall be paid to Orange County as payment in lieu of parkland dedication. F 2. The second paragraph of Section IV-B-7-b of the Orange County Subdivision Regulations references the Land Use Intensity (LUI) calculations in the Orange County Zoning Ordinance, Articles 5.1.1 and 6.12, which address private recreation space requirements. The developer is providing 17.29 acres (31.58% of the site) for open space, of which 36,852 square feet must be reserved for private recreation use. The combination of the mini-park and pedestrian trail system satisfies this requirement. Miscellaneous The Final Plat shall contain a title block and vicinity map in accordance with Section V-D-2 Title Block and V-D-3 Vicinity Map of the Orange County Subdivision Regulations. 2. The 30-foot perimeter building buffer, land use buffers, minimum building setbacks, easements, open space areas (including the pedestrian trails and mini- park), shall be stated on the plat and in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. 10 3. Drainage easements shall be provided as required by section D. item 2. outlined above. 4. The Final Plat shall contain a note restricting any further subdivision on the site. The Final Plat shall also contain a note prohibiting any subdivision or recombination of lots within the open space or buffer areas. The recorded Restrictions to be prepared by the Developer shall also contain a prohibition of further subdivision of lots in the subdivision and any subdivision/recombination of lots in the open space or buffer areas. 5. All open space areas shall be designated as tracts, rather than as lots, on the final plat. 6. If any condition of this Resolution shall be held invalid or void, the Resolution itself shall be void and of no effect. G. Certifications 1. A Certificate of Survey and Accuracy signed by a Professional Land Surveyor shall be notarized on the face of the Final Plat. 3. A Certificate of Declaration and Maintenance in the form provided in Section V-D- 6-b of the Orange County Subdivision Regulations signed by the landowners and developer shall be on the face of the plat and included in a document describing development restrictions to be recorded concurrently with the Final Plat. 4. The North Carolina Department of Transportation shall certify that all roads have been constructed to State standards or that construction plans have been approved. 5. A Certificate of Approval signed by the Orange County Planning and Inspections Department. 10A NOW, THEREFORE BE IT RESOLVED, by the Board of Orange County Commissioners, that the Preliminary Plan for Eno Ridge subdivision is approved in accordance with the above mentioned conditions and attached Preliminary Plat dated March 18, 2002 (and last revised November 19, 2002). Attached is the compilation of recent well data that I presented to the Planning Board during the meeting for Preliminary Plat approval. I compiled this data from well logs, which were provided by one of the staff members in the Orange County Health Department. The wells were drilled in a subdivision very near the proposed Eno Ridge project. The pedestrian trail is 2,155 feet long on the south side of Sara Lou Drive, and 300 feet long on the north side of Saza Lou Drive. We would propose to build the path 4 feet wide using a hazdwood mulch base. Thus the total azea required for the path on both north and south side of Sara Lou Drive is 9,820 (2,455*4) squaze feet. The area shown for the mini-pazk is 8,580 square feet. Combined the trail and mini-park utilize approximately 0.42 acres of the open space. Lastly, the amount of open space shown in the concept plan was reduced as the plan was modified, as directed by Staff, in order to realign the principal through street to connect to the property on the west, instead of the property to the north as originally shown in the concept plan. This realignment, along with the requirement that none of the driveways connect directly to the principal through street necessitated the addition of another cul-de-sac, named Onslow Court on the preliminary plat. The change in the alignment also required that the street which connects to the property on the north, be lengthened, and two curves added in order to create a 90° intersection, with the appropriate street centerline radius and approach criteria as required by NCDOT road standazds. I was asked to evaluate the condition of the forest relative to it being categorized as Prime Forest on a 1988 map found in the Orange County Comprehensive Plan. The most recent (1998) aerial orthophotos of the property indicate that the vast majority of the forested area is dominated by hardwoods (about 40 acres). The southeast corner appears to be predominantly pines (about 6 acres). The age and condition of the woodlands can only be determined on site. We entered the southeast corner of the property from an unimproved roadway off Frazier Road. From there we walked the perimeter of the tract and through representative areas of the forest. Throughout all of the woodlands, we saw evidence of selective timbering performed within the last 10 years. There were numerous stumps from mature pines and hardwoods that were harvested and removed. There was a large area (several acres) of young trees and undergrowth where walking was quite difficult. That area corresponds with a section marked as thicket on a site plan of the properly that you provided me. In fact, we found another smaller area of dense growth in the northwest section of the -tract that was not indicated on the plan. In short, it is my opinion that although sections of this property contain relatively mature hardwoods, the timbering that seems to have occurred sometime within the last decade has altered the property to the extent that I would no longer classify it as °prime forest." AGENDA ITEM #3: INFORMATIONAL ITEMS a. July Calendar -distributed b. Next Meeting Scheduled for Wednesday, August 7, 2002 Chair Gooding-Ray said that the Planning Board was going to start having a work session at 6:00 p.m. before every meeting unless there is going to be an Ordinance Review Committee meeting. The work session is open to the public. AGENDA ITEM #4: CONSIDERATION OF ADDTIONS TO AGENDA Schofield said that it seems prudent to give a 15-minute block of time to anyone in the audience who would like to address the Planning Board in order to hear concerns. There were people in the audience to speak about the Tuscany Ridge subdivision, which was approved at the last meeting. This will be done after consideration of the Eno Ridge Preliminary Plan. AGENDA ITEM #5: APPROVAL OF MINUTES -June 6, 2002 MOTION: Price moved to approve the minutes for June 6, 2002. Seconded by Lasris. VOTE: Unanimous AGENDA ITEM #6: PUBLIC CHARGE Chair Gooding-Ray read the public charge. AGENDA ITEM #7: CHAIR COMMENTS Chair Gooding-Ray made reference to the work session earlier and said that the Planning Board has interest in convening a joint meeting with the other Planning Boards in the County. She asked for Benedict's thoughts on this. 37 Benedict said that the staff is presently compiling a list of all boards that are associated with Orange County and the local jurisdictions. By next month's meeting this list should be ready and distributed. Chair Gooding-Ray asked about the review process with the Town of Hillsborough and Orange County. Benedict said that the Courtesy Review Agreement would be back on the BOCC agenda for approval in August. The timeline for Hillsborough is very tight and would not fit into the County's process very well. The staff is working on a new system. AGENDA ITEM #8: COMMITTEE/ADVISORY BOARD REPORTS a. Board of Adjustment - no meeting b. Agricultural Preservation Board -Schofield said that he is not yet an official member of this board, but he can start attending on a regular basis. c. Comprehensive Plan Land Use Committee - Tempia said that this committee met for the first time on June 24~'. They reviewed the . GOOD plan and some of the growth strategies already in place. They also discussed some of the growth trends in the County. The next meeting is on July 22°d and the committee will talk about the issues and challenges of growth management. d. Ordinance Review Committee - no meeting AGENDA ITEM #9: SUBDIVISIONS a. Preliminary Plan 1. Eno Ridge 32 Lots -Cheeks Township Moon made this presentation. PURPOSE: Consideration of the Preliminary Plan for Eno Ridge Subdivision (formerly James Woods) BACKGROUND: Request • Applicant: Michael M. Hughes, P.E., Inc. Agent for TSA Development LLC • 54.76 acre tract +/- • Thirty-two (32) lots on the conventional development option • Average lot size = 1.15 acres (50,242.99 square feet); Gross lot size 1.71 acres • Proposed open space = 11.60 acres (21.15% of site) controlled by the Homeowner Association Location Cheeks Township West side of Frazier Road (SR 1310) between West Lebanon Road (SR 1306) and US Hwy 70 West Existing Site Conditions Zoning: • Rural Residential (R-1); Back Creek Protected Watershed (BACK-PW) and Upper Eno Protected Watershed (U-ENO-PW) • Adjacent Land Uses: Single-family residential and undeveloped lots Physical Description: 2 38 • Gently sloped land with a mixture of hardwoods and pines • Small area of tilled agricultural land in the north central portion of the property • No drainageways or floodplain areas associated with site Proposed Site Conditions Roads: • Eno Ridge Subdivision will be accessed from Frazier Road (SR 1310) • The subdivision will also connect to West Lebanon Road (SR 1306) through Highridge Subdivision providing two points of access • All seven roads (New Salou Drive, Trumpet Court, Vine Court, Bee Balm Court, Onslow Court, Climbing Aster Court, and the new portion of High Ridge Drive) will be public and constructed to NCDOT standards • Pavement width of New Salou Drive and Highridge Drive will be 20 feet • New Salou Drive is a major local with no driveways • County Planning Staff is recommending a center turn lane to be constructed on Frazier Road Residential Lots: • Thirty-two (32) lots per the conventional development option • Average lot size = 1.15 acres (50,242.99 square feet) • Minimum lot size per R-1 Zoning District = 40,000 square feet • Minimum lot size using individual well and septic systems = 40,000 square feet • Minimum to actual lot size ratio (MTAR) = 1.26 • Minimum density per Back Creek and Upper Eno Protected Watersheds = 1 dwelling unit per 40,000 square feet • Minimum to actual density ratio (MTADR) = 1.86 • Impervious Surface limit per Back and Upper Eno PWs = 12% Open Space: • Minimum open space required for Conventional Development = 0% of site • Proposed open space = 11.60 acres (21.15% of site) controlled by the Homeowner Association • Open space includes centrally located mini-park linked to pedestrian trail • The bulk of the open space is located with a gently sloped portion of the site with existing hardwoods to the north and a mixture of hardwoods and pines to the south • Open space along New Salou and High Ridge drives provides for pedestrian travel along main roads outside ofrights-of--way Buffers: • The applicant has self-imposed a 30-foot building buffer area along the site perimeter. (There is no building buffer requirement for conventional subdivisions.) • A 30-foot Type-A Land Use Buffer (semi-opaque: intermittent visual obstructions from the ground to a height of at least thirty feet) is required along Frazier Road and the proposed New Salou Drive per Section IV-B-8. • Typical lot landscape plan specifies primary and secondary tree protection areas Recreation & Parks: Public Recreation Space • The site is located in the Cheeks Township District Park (per the Recreation Service Area Boundaries Map) 3 39 • No physical dedication is warranted because neither county recreation sites nor conservation sites have been identified for this area, as part of the current Comprehensive Plan. The payment in-lieu of option is viable. Private Recreation Space • The applicant must reserve a minimum of 36,852 square feet of open space for private recreation use (Per Section IV-B-7-b Recreation Sites, Orange County Subdivision Regulations and Articles 5.1.1 & R.12 of the Orange County Zoning Ordinance). • The proposed pedestrian trail and mini-park satisfy this requirement. Well-Septic: • All lots to be served with individual well and septic systems • Final number of lots does not exceed the number approved with the concept plan Agency Comments Requests for agency review were sent to: NCDOT, Recreation and Parks, Orange County Schools, Soil and Water Conservation, Erosion Control, the County Attorney, and the Fire Marshal. Comments are attached. Planning Staff Comments The Preliminary Plan meets the conditions placed on the Concept Plan approval. Development Process, Schedule, and Action • First Action: Planning Board to consider Concept Plan The Planning Board approved the conventional development concept plan for James Woods (renamed Eno Ridge) on December 6, 2001 with the following conditions: (Please note that while the road names have been changed and the lots have been renumbered, the overall design of Eno Ridge Subdivision is the same as James Woods. The proposed preliminary plan meets the conditions placed on the concept plan.) Conventional Development Plan All six proposed roads (James Woods Drive, Turtle Court, Wolf Court, Frog Court, Owl Drive, and Bobcat Court) shall be public rights-of--way constructed to NCDOT standards with additional five (5) foot utility easements on each side. The right-of--way at the Frazier Road intersection shall be improved to NCDOT standards. Sight distance triangles (10' x 70') shall be delineated on the plat for all intersections in the subdivision. 2. Driveway access points shall be a minimum of 50 feet from the intersection of streetrights-of--way. All corner lots shall be designed to access the road with lower traffic volume: lots 1 and 6 shall exit onto Turtle Court, lots 7 and 10 onto Wolf Court, lots 11 and 17 onto Frog Court, and lots 18 and 28 onto Bobcat Court. 3. If an entrance sign is anticipated and will not be placed within the one of the open space areas maintained by the Homeowners Association, a sign easement must be reserved within one of the residential lots. 4 40 4. All common areas including landscape buffers must be clearly identified on the preliminary and fmal plats and maintained by the Homeowners Association. The common areas cannot be subdivided or recombined with adjacent lots. Draft forms of the Homeowners Association documents, including restrictive covenants and conservation easements, that contain use and maintenance provisions for the open space and buffers must be submitted for review by the County Attorney as part of the preliminary plat approval process. The restrictive covenants or conservation agreements shall designate a backup grantee in the event that the Homeowners Association is eliminated. 5. The preliminary and final plats shall contain a note restricting further subdivision. 6. The applicant must receive approval from Orange-Alamance to extend public water services from the Orange-Alamance Water System into the James Woods Subdivision or make provisions for individual wells on each proposed residential lot. 7. Each lot shall contain an adequate area for septic disposal and a repair area as approved by the Orange County Division of Environmental Health. 8. The preliminary plat shall indicate areas for on-site infiltration of storm water that demonstrates compliance with Article 6.23.3a of the Orange County Zoning Ordinance. 9. The preliminary plat shall show the location of tree protection fencing and contain a note requiring the installation of tree protection fencing prior to any grading to ensure the protection of vegetation within all buffers and open space. 10. The applicant shall dedicate a minimum of 24,394 square feet (1/57 acre per residential lot) for public recreation space, or pay an in-lieu-of fee, as part of the preliminary plat approval process. (Section IV-B-7-b Recreation Sites, Orange County Subdivision Regulations). 11. The applicant shall provide a minimum of 36,852 square feet for private recreation space as part of the preliminary plat approval process. (Section IV-B-7-b Recreation Sites, Orange County Subdivision Regulations). 12. All street names to be reserved with GIS section of Planning Department prior to submittal of preliminary plat subdivision request. The applicant must resolve any issues regarding the future connection of James Woods Drive with High Ridge Drive prior to preliminary plat submittal. Second Action: Planning Board to consider Preliminary Plan Options: 1. Action within two regularly scheduled meetings or; 2. Within such further time consented to in writing by the applicant. 3. If the Planning Board renders a tie vote, or fails to act within the specified period, approval of the Concept Plan is directed to the Board of County Commissioners with the Planning Board's minutes and staff's recommendations. FINANCIAL IMPACT: A Fiscal Impact Analysis (attached) RECOMMENDATION(S): Staff Recommendation 5 41 The Planning Department Staff recommends APPROVAL in accordance with the attached resolution. Michael Hughes, civil engineer, was representing the developer. He said that the Planning Department staff has requested alert-turn lane on Frazier Road. They do not understand why this has been suggested because left-turn lanes are typically for subdivisions with more than SO lots. This places a big burden on the developer. Davis said that the main reason for the turn lane is for safety purposes on Frazier Road. There have been increasing numbers of developments along Frazier Road and West Lebanon Road. This is a 45-mile an hour street and, for general safety purposes, the County can and does require turn lanes where NCDOT would not. Preston asked how this would affect the residents that are presently living on Frazier Road and if they had been asked how they felt about the turn lane. Davis said that there would be no notification requirement if improvements are made within the right-of--way of DOT. Price asked why it was incumbent upon this developer to pay for the turn lane and not for the people who develop the 148 adjacent acres later, if that happens. Davis said that it would be pretty far for the future developer to make an off-site improvement at this point in the road. Price is concerned that this will encourage more traffic on Frazier Road. Davis said that they were not encouraging more traffic, but realizing that Frazier Road is becoming more and more developed and they are looking at safety precautions. Schofield said that it seems there has to be a more equitable way to put in the turn lane. He suggested an extension on the decision for this subdivision. Several clarifying questions of the Planning Board members were answered by Davis. It was suggested that this developer make a contribution to the construction of the road and the rest of the cost would be borne by the County. Davis said that it would be difficult to set an amount. It is uncertain when the adjacent property would be developed, if at all. Treibel asked Mr. Hughes if he would see the turn lane as a selling point for the people in the development. Jennifer Hill, a realtor, said that it would not be a selling point because it would drive up the cost of the house and also that a lot of people take Efland-Cedar Grove Road to Lebanon Road to get to Frazier Road and not Frazier Road from US 70. Davis made a suggestion for a reconfiguration of the road in exchange for the left turn lane. Davis gave the different language for condition #9 on page 18 of the agenda packet as follows: A left center turn lane shall be constructed to NCDOT standards, if the turn lane can be accommodated within existing 60-foot right-of--way. Construction of New Salou Drive can stop 20 feet west of Onslow Court. MOTION: McAdams moved to approve the Preliminary Plan for Eno Ridge subdivision, with the conditions as modified. Seconded by Lasris. Lasris said that two meetings ago the Planning Board unanimously accepted a memo to the County Commissioners that we were going to request a moratorium on any subdivision over 20-251ots. Triebel said that he read the memo and the number of lots was not specified 6 42 Preston made reference to the fiscal analysis and said that this subdivision is definitely not paying its own way. She said that we still have not addressed having all of these types of developments with wells. She is not in favor of this development because it is essentially subsidized affordable housing. MOTION: Tadd moved to table the vote on this item. There was a motion already on the floor, so this was made a friendly amendment. McAdams did not accept the friendly amendment. Moon explained the amount of water yield in the area and said that it was sufficient for wells in this subdivision. Hughes spoke about a survey that was done on the water yields in this area and said that it was sufficient for this subdivision. In answer to the question about the fiscal impact analysis, Benedict said that the fiscal impact template is not supposed to be the indication for approval or denial of the subdivision. He said that it was an indication of the housing value and that in most cases rural area subdivisions do not pay for themselves. Schofield asked why this subdivision could not be served by Orange-Alamance Water. He said that this subdivision is not really rural because it is so close to US 70 and I-85. Benedict said that Orange- Alamance has used their allocation from the Eno system and they cannot take on any new customers in this area. VOTE: Ayes, 7; Noes, 3 (Goodwin, Price, and Lasris) Bryan requested that the staff make a report back about criteria for analyzing well capacity. Chair Gooding-Ray asked for the reasons for the negative votes. Goodwin said that he has concerns about traffic and water and the density of the development. Price said that she does not agree with the uncertainty of the modified condition. She is concerned about the imposed responsibility on various developers. Lasris said that there would be a serious fiscal impact on the County.
