BACKGROUND: The Tuscany Ridge Subdivision is a 22-lot development on 56 acres of land in the Joint Planning Area (JPA) `Rural Buffer' along Arthur Minnis Road, west of Rocky Ridge Road. The subdivision was processed as a major subdivision during the first and second quarters of this year with the Board of County Commissioners granting approval on June 27, 2002. Subsequent to BOCC approval in June, a number of issues arose from property owners either residing or owning property in the general vicinity of the Tuscany Ridge development. A list of citizen issues -- ranging from administrative approval procedures to adherence to sound planning principals -- was raised at the Planning Board level. These issues were compiled, by planning staff, into a document and the staff generated a response to each issue. After the Planning Board meeting, a Special Presentation was provided at the BOCC August 20, 2002 regular meeting agenda for citizens to publicly address the BOCC with their concerns. At that August meeting, staff presented the abovementioned list of citizen issues that were raised at the Planning Board and citizens followed with these and some other concerns. Staff from Planning, Environmental Health, NCDOT and County Engineer were involved in generating responses to these issues. Additional discussion occurred at the November 6, 2002 BOCC meeting to consider the responses that were generated by Planning, Environmental Health, NCDOT, and the County Engineer. In that meeting five additional concerns were noted and are in the process of being addressed by appropriate agencies (see attached report page 3). FINANCIAL IMPACT: There is no financial impact associated with additional discussion to issues raised regarding the Tuscany Ridge subdivision. Edwards. He has spoken to the residents in August of this year on Arthur Minnis Road and the concerns that they have. These issues were resolved at that time. Arthur Minnis Road has been removed from our current secondary road improvement plan. The developer has requested an encroachment for this road dealing with grade, drainage, base and paving and this encroachment has been approved. The developer is doing this because the Orange County Planning Board has required the road to be paved before the developer could continue with his subdivision. In that meeting one of the concerns expressed was that NCDOT should meet with the Residents to try to alleviate their problems and questions or concerns that have been expressed.
