PURPOSE: To receive authorization to submit the Quarterly Public Hearing Legal
Advertisement for publication for the November 25, 2002 public hearing.
BACKGROUND: The next regular quarterly public hearing is scheduled for November 25,
2002. A summary of each item proposed for public hearing is provided. Staff is available to
research and answer questions prior to the public hearing.
Requests:
A. ORANGE COUNTY SUBDIVISION REGULATIONS
1. Amend Section III-D-1-d to require posting of property proposed for subdivision
Development (all County jurisdictions).
2. Amend Section III-D-2-a to require notification of adjacent property owners, posting of
property proposed for subdivision development, and a neighborhood information meeting
in the Rural Buffer.
Purpose: To provide for consistent regulations throughout the County's planning
jurisdiction concerning public notification of proposed major subdivision development.
3. Amend Section IV-13-10.13 to allow all Flexible Development options except the village
option in the Rural Buffer.
Purpose: To provide additional residential development options in the Rural Buffer that
do not change existing requirements regarding the existing two-acre minimum lot size, but
would provide for additional open space.

4. Create a special use permit process for the subdivision of land creating 20 or more lots or
involving 20 or more acres.
Purpose: To more effectively address and manage the impacts of large residential
developments occurring in the County's planning jurisdiction.
B.ORANGE COUNTY ZONING ORDINANCE
1. Amend Article 6.18 to allow development of a "Master Telecommunications Plan" which
identifies sites within the County where an applicant may construct a wireless
telecommunications facility by seeking issuance of a building permit in accordance with
the specifications set forth in the Plan.
Purpose: To allow administrative approval of telecommunication facilities less than 200
feet in height on a predetermined set of suitable sites in the County's planning jurisdiction.
2. Amend Article 8 to create a special use permit process for the subdivision of land creating
20 or more lots or involving 20 or more acres.
Purpose: To more effectively address and manage the impacts of large residential
developments occurring in the County's planning jurisdiction.
3. Amend Article 6.29.3 to create a Secondary Development Area south of 1-85 in the 1-85/
Buckhorn Road Economic Development District (EDD).
Purpose: To create consistency between the description of the 1-85/Buckhorn Road EDD
and the EDD Permitted Use Table which would allow for mixed uses.
C.ORANGE COUNTY BICYCLE TRANSPORTATION PLAN
1. Amend the Orange County Bicycle Transportation Plan Map to include New Grady Brown
School Road as a Secondary Priority Route.
Purpose: To provide for safe bicycle and pedestrian access to Grady Brown
Elementary School and the new Cedar Ridge High School.
D. OTHER ITEMS
1. Establish Commercial and Residential Plans Review Fees
Purpose: To establish commercial and residential plans review fees to implement more
thorough plan review services to maintain and upgrade Insurance Services Office, Inc.
(ISO) ratings that are used by insurance companies to develop property owner insurance
rates and more fully offset the operating costs of the Inspections Division.
E. NON-PUBLIC HEARING ITEM
1. Orange County Comprehensive Plan — Land Use Element
Purpose: To receive a status report on the preparation of a new Orange County
Comprehensive Plan — Land Use Element. The Comprehensive Plan Land Use

Committee (CPLUC) has met four times to discuss planning issue areas (e.g., urban
sprawl, etc.), possible growth management tools, and future smart growth challenges.
FINANCIAL IMPACT: There is no financial impact associated with this decision.
Advertisement costs are included in the departmental budget for County initiated items.
RECOMMENDATION(S): The Administration recommends approval of the proposed
November 25, 2002 Quarterly Public Hearing legal advertisement.

NOTICE OF PUBLIC HEARING
ORANGE COUNTY BOARD OF COMMISSIONERS
A public hearing will be held in the Judge F. Gordon Battle Superior Courtroom of the
New Orange County Courthouse, 106 E. Margaret Lane, Hillsborough, North Carolina, on
Monday, November 25, 2002, at 7:30 PM for the purpose of giving all interested citizens
an opportunity to speak for or against the following items:
A. ORANGE COUNTY SUBDIVISION REGULATIONS TEXT AMENDMENTS
1. Amend Section III-D-1-d to require posting of property proposed for
subdivision development (all County jurisdictions).
2. Amend Section III-D-2-a to require notification of adjacent property

Changes may be made in the advertised proposals that reflect debate, objections
and discussion at the hearing.
Accommodations for individuals with physical disabilities can be provided if the
request is made to the Director of Planning at least 48 hours prior to the Public
Hearing by calling the appropriate number listed below. The full text of the
changes may be obtained after November 20, 2002 from the Planning Department.
Also, the text may be obtained at the County website www.co.orange.nc.us at the
Agendas and Reports link prior to the meeting.
