HomeMy WebLinkAboutMinutes - 19670417 588 MINUTES OF THE ORANGE COUNTY BOARD OF COMMISSIONERS April 17, 1967 The Board of Commissioners for the County of Orange, North Carolina, met in adjourned regular session at the County Courthouse in Hillsborough, the regular place of meeting, at 10:00 o'clock A.M., April 17, 1967. Present: Chairman Harvey D. Bennett and Commissioners William C. Ray and Henry S. Walker. , Absent: Commissioners Carl M. Smith and Ira A. Ward. Also present: Betty June Hayes, Register of Deeds and ex officio Clerk of the Board of Commissioners. The Chairman announced that this was the date and hour fixed by motion duly made and carried by the Board on April 31 1967 for the public hearing upon the order passed on first reading by the Board on April 3, 1967, entitled: "ORDER AUTHORIZING $3,000,000 SCHOOL BUILDING BONDS", and that the Board would immediately hear any and all citizens and taxpayers who might desire to protest against the issuance of said bonds. No citizen or taxpayer of the County appeared, either in person or by attorney, to protest against the issuance of any of said bonds, and the Clerk announced that no protest in writing, signed by any citizen or taxpayer, had been presented. Thereupon, upon motion of Commissioner Walker, seconded by Commissioner Ray and carried, the order introduced and passed on first reading on April 3, 1967 entitled: "ORDER'AUTHORIZING $3,000,000 SCHOOL BUILDING BONDS", was read a second time and placed upon its final passage. The vote upon the final passage of said order was: Ayes: Commissioners Harvey D. Bennett, William C. Ray and Henry S. Walker. Noes: none The Chairman then announced that the order entitled: "ORDER AUTHORIZING $3,000,000 SCHOOL BUILDING BONDS" has passed. The Clerk was thereupon directed to publish said order in The News of Orange County, once in each of two successive weeks, and to publish at the foot of said order the appended note as required by The County Finance Act, as amended. Thereupon Commissioner Ray introduced the following resolution which was read: "RESOLUTION CALLING A SPECIAL BOND ELLECTION BE IT RESOLVED by the Board of Commissioners for the County of Orange: Section 1. A special bond election is hereby called to be held on Tuesday, May 239 1967, between 6:30 A.M. and 6:30 P.M., Eastern Daylight Saving Time, at which there shall be submitted to the qualified voters of Orange County the following question: Shall an order finally passed on April 17, 1967, authorizing the County of Orange, North Carolina, to contract a debt, in addition to any and all other debt which said County may now or hereafter have power or authority to contract, and in evidence thereof to issue School Building Bonds in an aggregate principal amount not exceeding $3,000,000 for the purpose of providing funds, with any other available funds, for erecting additional school buildings and other school plant facilities, remodeling, enlarging and reconstructing existing school buildings and other school plant facilities and acquiring necessary land and equipment therefor to provide additional school facilities in the County of Orange to maintain the six months' school term in said County as required by Section 3 of Article IX of the Constitution, and authorizing the levy and collection of a sufficient tax for the payment of the principal of and the interest on said bonds, be approved? beginning Saturday, day during such . The Register of Deeds and ex officio Clerk of th the Commissioners shall cause a notice-to be published in The News of least thirty days before the election, and thereafter ttaice before at intervals of at least one week between publications,.reading s follows: 111-1 April 17, 1967 Minutes Continued NOTICE OF SPECIAL BOND ELECTION AND SUPPLEMENTAL REGISTRATION= THE COUNTY OF ORANGE, NORTH CAROLINA A, special bond election will be held throughout Orange County between 6:30 A.M. and 6:30 P.M., Eastern Daylight Saving Time, on Tuesday, May 23, 1967, at which there will be submitted to the qualified voters of said County the following questio : Shall an order finally passed on April 17, 1967, authorizing the County of Orange, North Carolina, to contract a debt, in addition to any and all other debt which said County may now or hereafter have power or authority to contract, and in evidence thereof to issue School Building Bonds in an aggregate principal amount not exceeding $3,000,000 for the purpose of providing funds, with any other available funds, for erecting additional school buildings and other school plant facilities, remodeling, enlarging and reconstructing existing schoo; buildings and other school plant facilities and acquiring necessary land and equipment therefor to provide additional school facilities in the County of Orange to maintain the six months' school term in said County as required by Section 3 of Article IX of the Constitution, and authorizing the levy and collection of a sufficient tax for the payment of the principal of and the interest on said bonds, be approved? The question hereinabove set forth contains a statement of the purpose for which the bonds are authorized by the order referred to in said question. If said bonds are issued a tax will be levied upon all taxable property in the County of Orange for the payment of the principal of and the interest on said bonds. For said election the regular registration books for elections in said County will be used, and such books will be open for the registration of voters, not theretofore registered, from 9 A.M. until sunset on each day beginning Saturday, April 29, 1967 and closing Saturday, May 13, 1967. On each Saturday during such registration period said books will be open at the polling places. Saturday, May 20, 1967, is Challenge Day. The location of the precincts and polling places and the names of the registrars and judges set forth in the foregoing form of election notice are the precincts and polling places fixed by, and the registrars and judges appointed by, the County Board of Elections of Orange County, and such precincts and polling places and such registrars and judges shall be the precincts, polling places and the registrars and judges for said election. Section 5. The form of the ballot to be used at said election shall be substantially as follows: OFFICIAL BALLOT SPECIAL BOND ELECTION IN THE COUNTY OF ORANGE, NORTH CAROLINA May 23, 1967 Instructions 1. The Register of Deeds and ex officio Clerk of the Board of Commissioners is hereby directed to certify immediately a copy of this resolution to said County Board of Elections of Orange County. Thereupon, upon motion of Commissioner Ray, seconded by Commissioner Walker, the foregoing resolution entitled: "RESOLUTION CALLING A SPECIAL BOND ELECTION" was passed by the following vote: Ayes: Commissioners Harvey D. Bennett, William C. Ray and Henry S. Walker. Noes: None Chairman Bennett advised the Board that considerable interest and concern relative to the purported Texas Gulf Mining and Mineral search in the county and that interestet citizens were requesting the Board of Commissioners to take legal steps to prevent thi; company from any type of mining Operation: A. H. Graham, County Attorney, advised the Board that they had no legal authority to prevent Texas Gulf Company or any other company from mining operations. Mr. Graham stated further that a special local act would be of no value as it would be ruled discrimatory and unconstitutional. Furhter discussion ensued and it was agreed that a special meeting would be held in the Courtroom at the Courthouse in Hillsborough on Wednesday, April 19, 1967 in order that all interested persons might attend and discuss the purported mining operation. There being no further business to come before the Board said meeting was adjourned to meet again on Wednesday, April 19, 1967 at 7:30 P.M. in the Court Room at the. Court House in Hillsborough. Pearson Stewart, representative from the Research Triangle, suggested that Dr. Virgil Mann, Chairman of the University of North Carolina Department of Geology, and Dr. Stephen Conrad, State Geologist, explain to the audience what is involved with strip mining. Dr. Stephen Conrad, State Geologist, said his office had known of commercial interest in this area for about two years. He reaffirmed the statements of Dr. Mann in general, particularily those made about the "grouhd rules". Various types of mining operations were explained by Dr. Virgil Mann. He stated h was opposed to any type of mining operations being conducted in Orange County as it wou create a change in the ecology of the area.
