PURPOSE: To update the Board of County Commissioners on progress of the Orange County/
Durham 1-85 / US 70 Economic Development District Cooperative Planning Area Agreement and
note the timeliness of bringing this agreement to term.
BACKGROUND:
1. The Orange County/Durham Cooperative Planning Agreement comes forward at an
important juncture in the land use planning of the area between Hillsborough and the
Durham County line. This year, water and sewer boundary agreements have been
approved for the area. The Water and Sewer Management Plan and Boundary Agreement
and Map indicates areas of Hillsborough `Primary Interest' and Orange County 'Primary
Interest' and 'Long Term Interest.'
2. The land development potential of this general area is increasing as population and
businesses gravitate to undeveloped or underdeveloped areas. For example, some of the
largest single ownership undeveloped properties adjacent to the environmental areas of the
Eno River and Stoney Creek basins are located in this general area. This could prompt
strong interest in water and sewer extension. Therefore, proactive land use and
infrastructure (transportation, water, sewer, stormwater) planning is critical to manage the
impending growth and preservation of natural areas. This land use pattern should be
understood by all affected parties; local governments (Town of Hillsborough, Orange County
and City of Durham), public service providers, neighborhoods and property owners.
3. A cooperative planning agreement can set forth these growth controls in a comprehensive
and timely manner.
4. Respective Orange County and City of Durham staffs have developed some preliminary
recommendations regarding cooperative planning systems between both jurisdictions.
Discussion, research, and analysis have been in progress since June of 2001 to evaluate

topics of joint interest. Those topics include:

II. Water and Sewer
III. Annexation
IV. Financing of Utilities of areas near 1-85/US 70
After this progress report work-session, planning staffs are prepared to present preliminary reports
to respective managers and then to governing boards in the next few months. The purpose of
these cooperative planning efforts is to improve land use and transportation decisions, improve
intergovernmental coordination and information sharing, and be able to consistently respond to
inquiries for development in the area, as well as, respond to public health emergencies such as
failed septic systems.
There are six companion studies, plans and agreements that affect this area.

North Carolina, the Durham County, North Carolina, the Town of Chapel Hill, North
Carolina, and Orange County, North Carolina relating to land use planning along and
near jurisdictional boundaries.
Joint staffs are working on an abridged list of potential government actions by the respective
jurisdiction. A map is attached which illustrates some areas of potential use and cooperation.
FINANCIAL IMPACT: None at this time.
RECOMMENDATION(S): Receive the status report and offer comment and direction to the staff.
