(There is no building buffer requirement for conventional subdivisions.) Private Recreation Space • The spplicerd must reserve a minimum of 36,852 square feet of open space for private recreation use (Per Section IV-B4-b Recreation Sites, Orange County Subdrvlsion Regulations and Articles 5.1.1 8 R.12 of the Orange County Zoning Ordinance). •- The proposed pedestrian trail and mini-par satisfy this requirement. Dandolopment P Schedule, Agficion • First Action: Planning Board to consider Concept Plan The Planning Board approved the conventional development concept plan for James Woods (renamed Eno Ridge)on December 6, 2001 with the following conditions: (Please note chat while the road names have been changed and the Iota have been renumbered, the overall design of Eno Ridge Subtl vision is the same es James Woods. All six proposed roads (James Woods Drive,Turtle Court,Wolf Court, Frog Court, Owl Dill and Bobcat Card)shall be public rightsof-way,constructed to NCOOT standards with additional five (5)foot utility easements on each side. The applicant must receive approval from Orange-Alamance to extend public water services from the Orange-Namance Water System into the James Woods Subdivision or make provisions for Individual walla on each poll residential lot. 7. Each lot shall contain an adequate area far septic disposal and a repair area as approved by the Orange County Division of Envlmnmental Health. 8. The preliminary plat shall indicate areas for on-site Intimation of storm water that demonstrates compliance with Article 6.23.38 of the Orange County Zoning ONinaoce. 9. The preliminary plat shell show the location of tree protection fencing and contain a note requiring the Installation of tree protection fencing prior to any grading W ensure the protection of vegetation within all buffers and open space. 5 10.The applicant shall dedicate a minimum of 24,384 square feet(1157 acre per residential lot) for public recreation space, or pay an in-lieuaf fee, as part of the preliminary plat approval process. The Board shall consider the application within a reasonable amount of time. 2. During deliberations and consideration of the application the Board may defer consideration at any point to pursue additional analysis and review. 3. If the Preliminary Plat is approved by the County Commissioners the applicant shall have one (1)year b prepare and file a Final Plat or to request a one-year extension from the Planning Director. All foods shall be inevocably dedicated to the general public and be constructed to standards of 0e North Carolina Department of Transportation (NCOOT). The approval of this resolution authorizes and directs the Orange County Manager to accept for the County, and on behalf of 0e public generally, the offer of dedication of Nev, Sell Drive,Trumpet Court, Vine Court, Bee Balm Count Onslow Court, Climbing Aster Couh and the new portion of High Ridge Drive. This acceptance of dedleation to the general public shell be without maintenance responsibility. Construction shall be inspected and approved by NCDOT. Pavement width for New Selou Ddve and High Ridge Drive shall be a minimum of 20 feet in width. OR A latter of credit or aeaow agreement or other security shall be submifted to secure construction of New Salou Drive, Trumpet Court, Vine Coup, Bee Balm Court, Onslow Court, Climbing Aster Court, and the new portion of High Ridge Drive to NCDOT standards. An estimate of the construction cast must be prepared by a celfifedllicensed engineer or grading contractor and submitted to the Orange County Planning Department and approved by the County Engineer. I was asked to evaluate the condition of the forest relative to it being categorized as Prime Forest on a 1988 map found In the Orange County Comprehensive Plan. The most recent(1998) aerial orthcphotos of the property indicate that the vast majority of the forested area is dominated by hardwoods (about 90 acres). The southeast corner appears to be predominantly pines (about 6 acres). The age and condition of the woodlands can only be determined on site. We entered the southeast corner of the property from an unimproved roadway off Frazier Road, From there we walked the perimeter of the tract and through representative areas of the forest. Throughout all of the woodlands, we saw evidence of selective timbering performed within the last 10 years. There were numerous stumps from mature pines and hardwoods that were harvested and removed. There was a large area (several acres) of young trees and undergrowth where walking was quite difficult. That area corresponds with a section marked as thicket on a site plan of the property that you provided me. In fact, we found another smaller area of dense growth in the northwest section of the tract that was not Indicated an the plan. In short, It Is my opinion that although sections of this property contain relatively .mature hardwoods, the timbering that seems to have occurred sometime within the last decade has altered the property to the extent that I would no longer classify it as"prime forest."
