PURPOSE: To consider awarding a contract for the purchase 2,100 mill can conioners from
Toter Incorporated of Statesville, North Camlina.
BACKGROUND: As part of the FY 2002-03 budget deliberations, the Orange County
Commissioners approved assumption by Solid Waste Management staff of the collodion of
recyclable materials from mufti-family housing sites throughout the County. For many years,
this service had been performed by an Outside contractor Staff prepared an analysis of the
financial implications of assuming the provision of this service in-house rather then continuing to
contract, and determined that approximately $100,000 annually could be saved by Orange
County baking over this service. The Solid Waste Advisory Board recommended this change to
the BOCC, which approved program implementation tuning for staffing, equipment, and
operations in the Solid Wadell-andfill Eraerpdse Fund budget for FY 2002-03. The BOCC
approved the purchase of two new recycling trucks for this program at the September 17, 2002
meeting. Staff also need to purchase and deploy 2,100 roll can containers, which will be
positioned at multi-family housing sites when the County begins provision of this service on
January 1, 2003..
Under certain circumstances, North Carolina General Statute 143-129 allows local governments
to make purchases without a separate bidding procedure. This type of acquisition can be made
from any contractor that has, within the past 12 months, contracted N fumish the item to: (1)the
federal government or any federal agency; (2) the date of North Carolina or any agency or
political subdivision of the state; or (3) any other date or agency or poltical subdivision of that
state, if the contractor is willing to extend the same or more favorable price and other farms W
the local government. This process Is called "piggy-backing" a bid, and has been used by
Orange County on a number of occasions to achieve substantial savings on major equipment

purchases.
Staff proposes to "piggy back on the City of Fayetteville bid number 200207 that was awarded
to Toter Incorporated of Statesville, North Carolina on March 4, 2002 for 95 gallon containers,
model number 40505. Unit cost far the containers is $36.87 each. By taking advantage of the
volume discount extended to the City of Fayei the cast of the cart is well below the cast
that had been anticipated in the program budget of$50 each. The carts will be purchased from
a North Carolina vendor. Pursuant to the statute, Orange County advertised its intentions ten
(10)days before this meetirg.
FINANCIAL IMPACT: Total mat of this action, R approved by the Board, would be$77,427.
Sufficient funds are allocated in the Solid Waste Management Department FY 2002103
operating budget. The estimated annual savings of$100,000 from bringing this program N-
house are net savings after the purchase of these roll cads,the previously approved recycling
truck purchases, and other program costs have been factored into the calculefions.
RECOMMENDATION(Sf: The Manager recommends that the Board award the contract to
Toter Incorporated of Statesville. North Carolina in the amount of$77,427,00; and authorize the
Purchasing Director to execute the appropriate paperwork.
