MINUTES OF THE ORANGE COUNTY
BOARD OF COMMISSIONERS
A ril 3 1967
The Board of Commissioners for the County of Orange, North Carolina, met in
regular.session at the County Courthouse in Hillsborough, North Carolina, the
regular place of meeting, at 10:00 o'clock A.M., on April 3, 1967.
Present: Chairman Harvey D. Bennett, and Commissioners William C. Ray, Carl M.
Smith, Ira A. Ward and Henry S. Walker.
Absent: None
Also present: Betty June Hayes, Register of Deeds and ex officio Clerk of
Board of Commissioners and S. M. Gattis, County Accountant.
The Register of Deeds and ex officio Clerk of the Board of Commissioners presen d
certified copies of resolutions which had been received from The Orange County
Board of Education and the Chapel Hill City Board of Education.
Thereupon Commissioner William C. Ray introduced the following order
authorizing bonds which was read:
ORDER AUTHORIZING $3,000,000
.SCHOOL-BUILDING BONDS
WHEREAS, The Orange County Board of Education has certified to this Board a
resolution passed on March 6, 1967, showing that adequate school facilities are not
now available in Orange County to comply with the requirements of Section 3 of
Article IX.of the Constitution of North Carolina for the maintenance of schools six
months in every year, and that it is necessary, in order to maintain such six months'
school term as required by said Section 3 of Article IX of the Constitution, to
erect additional school buildings and other school plant facilities, remodel, enlarge
and reconstruct existing school buildings and other school plant facilities and
acquire necessary land and equipment therefor to provide additional school facilities
in said County, the estimated cost of which is $1,000,000.00; and
WHEREAS, The Chapel Hill City Board of Education has certified to this Board a
resolution passed on March 13, 1967 showing that adequate school facilities are not
now available in The Chapel Hill City Administrative Unit co comply with the require-
ments of Section 3 of Article IX of the Constitution of North Carolina for the
maintenance of schools six months in every year, and that it is necessary, in order
to maintain such six months' school term as required by said Section 3 of Article IX
of the Constitution, to erect additional school buildings and other school plant
facilities, remodel, enlarge and reconstruct existing school buildings and other
school plant facilities and acquire necessary land and equipment therefor, in order
to provide additional school facilities in said Unit, the estimated cost of such
additional school facilities being $2;000,000.00; and
WHEREAS, said resulutions request the Board of Commissioners to take all
necessary steps, by the issuance of bonds or otherwise, in order that such school
facilities may be provided; and
WHEREAS, the Board of Commissioners has carefully examined the facts and has
determined and does hereby find as a fact that said statements of the above mentione
resolutions are true and that it has become the duty of said Board of Commissioners,
acting as an administrative agent of the State in providing a State system of public
schools, to order the issuance of bonds of the County of Orange so that the school
facilities mentioned in paragraph 1 of this order and in said resolutions may be
provided in order to maintain the six months' school term in the County of Orange as
required by Section 3 of Article IX of the Constitution; now, therefore,
BE IT ORDERED AND RESOLVED by the Board of Commissioners for the County of
Orange:
1. That, pursuant to The County Finance Act, as amended, and in order to mainta
the six months' school term in the County of orange as required by Section 3 of
Article IX of the Constitution, the County of Orange, North Carolina is hereby
authorized to contract a debt, in addition to any and all other debt which said Count
may now or hereafter have power or authority to contract, and in evidence thereof to
issue School Building Bonds in an aggregate principal amount not exceeding $3,000,000
for the purpose of providing funds, with any other available funds, for erecting
additional school buildings and other school plant facilities, remodeling, enlarging
and reconstructing existing school buildings and other school plant facilities, and
acquiring necessary land and equipment therefor to provide additional school faciliti,
ithe County of Orange.
2. That a tax sufficient to pay the principal of and the interest on said bonds
when due shall be annually levied and collected.
3. That a statement of the County debt has been filed with the Clerk and is ope.
to public inspection.
4. That this order shall take effect when approved by the voters of the County
at an election as provided in said Act.
The Board thereupon designated the County Accountant as the officer to make and
`ile with the Clerk the statement of debt and assessed valuation of the County as
'equired by The County Finance Act, as amended, to be filed before the final passage
)f the order which was introduced at this meeting.

Thereupon the County Accountant filed with the Clerk, in the presence of the .
Board, the statement of debt and assessed valuation as so required.
Thereupon-the order authorizing $3,000,000 School Building Bonds was passed on
first reading.
On motion duly made and unanimously carried the Board fixed 10 o'clock A.M.,
April 17, 1967, as the hour and day for the public hearing upon the foregoing order,
and directed the Clerk to publish said order, together with the appended note as
required by The County Finance Act, as amended, in The News of Orange County not
later than the tenth day before said date.

STATEMENT CONCERNING SCHOOL INDEBTEDNESS
Z, S. M. Gattis, County Accountant of Orange County, North Carolina, do make
and file the following statement of the financial condition of said County concernin
school indebtedness, having been designated by the Board of Commissioners for that
purpose. Said statement includes a statement of debt incurred and to be incurred fo
school purposes under orders either introduced or passed, whether evidenced by bonds
notes or otherwise, and whether incurred by original creation of the debt or by
assumption of debt, and including debt incurred by the County Board of Education, an
debt to the State or any department thereof, but not including obligations incurred
to meet appropriations in anticipation of revenues to an amount not exceeding the
amount of the last preceding tax levy for school purposes:

Commissioners for the County of Orange, North Carolina, DO HEREBY CERTIFY that the
foregoing is a true copy of astatement filed with me on April 31 19679 after the
introduction of an order authorizing $3,000,000 School Building Bonds of the County
of Orange, which statement is open to public inspection in my office.

Minutes of the March meetings were read and approved after some corrections.
Members of the Orange County Board of Education were present. Superintendent
Paul Carr introduced A. B. Coleman, Jr., the new member of the County School Board,
and C.W. Stanford, former Chairman and member of the school board spoke briefly to
those present.
Chairman Bennett read a letter from Victor Sharpe. Said letter contained the
resignation and refusal of Mr. Sharpe to serve as a member on the County Alcoholic
Beverage Control Board.
Upon motion of Commissioner Ray, seconded by Commissioner Walker it was moved
and unanimously adopted that Mr. Sharpe's letter of resignation be accepted.
Upon motion of Commissioner walker, seconded by John Efland, County School Board
member, it was moved and unanimously adapted that Dr. H. W. Moore of Hillsborough
be appointed to serve as a member of the County Alcoholic Beverage Control Board to
fill the unexpired term of Giles Long.
The following road petitions were accepted and the clerk was authorized to
forward same to the State Highway Commission.

Hebron, Church Road
Finley Parker of Cedar Grove was present to inquire as to the status of road
# Sr 1366. Mr. Parker requested that said road be widened and that proper drains
be installed. Chairman Bennett advised that a letter would be forwarded to E. F.
Hoover, District Engineer, containing said request.
Commissioner Ray requested that the clerk write the State Highway Commission
requesting that a progress or status report be forwarded on road.-numbers SR 1514
and the Thomas McBroom road.
A. H. Graham, County Attorney, informed the Board that a suit had been institute
by the Concerned Citizens Committee relative to the Chapel Hill Township Zoning
Ordinance. Upon motion of Commissioner Smith, seconded by Commissioner Ray the
County Attorney was instructed to answer said suit and take all necessary legal
steps to protect the County's position in said matter.
Discussion ensued concerning the interpretation of the Chapel Hill Township
Zoning Ordinance section applicable to the number of board members required by said
ordinance for the establishment of the Chapel Hill Township Board of Adjustment.
Harry Palmer reported that according to Phil Greene, Assistant Director of The
Institute of Government, the ordinance required that four members be appointed to
said Chapel Hill Township Board of Adjustments and that the section further provided
that the Vice Chairman of the Chapel Hill Township Planning Board be appointed as a
member of the Chapel Hill Township Board of Adjustments.
Upon motion of Commissioner Smith, seconded by Commissioner Walker, it was moved
and adopted that Eugene M. Blackwood of Box 69, Route #2, Chapel Hill, N. C., be
appointed as one of the alternate members to the Chapel Hill Township Board of
Adjustments.
Upon motion of Commissioner Smith, seconded by Commissioner Ward, it was moved
and adopted that the vice Chairman of the Chapel Hill Township Planning Board be
appointed as a member of the Chapel Hill Township Board of Adjustments.
Commissioner Ray read a letter from Carl W. Crabtree of Route 42, Hillsborough,
N. C. Said letter was in regards to the land used by The Town of Hillsborough for a
garbage dumping area. Mr. Crabtree asked that action be taken to assure that
protection would be afforded to him and his family as people were using the dumping
area for target practice and as a hunting ground. Discussion ensued between the
Board and Sheriff Knight relative to said letter. Commissioner Smith suggested that
Mr. Crabtree's letter be forwarded to the Town of Hillsborough as it pertained to the
land owned by said town.

continued 31 1967 minutes Chairman Bennett read a letter from Eugene A. Jackson, Assistant Agricultural
Extension Agent. Mr. Jackson requested that a six months leave of absence be
granted to him in order that he might complete his active reserve duty. Chairman
Bennett informed the Board that Ed Barnes, Agricultural Extension Agent, had
agreed to issue this six months leave of absence.
Upon motion of Commissioner Smith, seconded by Commissioner Ray, it was moved
and adopted that a leave of absence be extended to Eugena A. Jackson.
Sheriff Knight was present to discuss and review with the Board the report
submitted by the State Jail Inspector. Discussion ensued concerning said facilities
and problems involved in instituting certain needed improvements to the jail
premises and facilities.
S: M. Gattis, County Administrator, presented.to the Board a draft submitted by
Dr. 0. David Garvin, District Health Officer, relative to a proposed franchised
garbage disposal collection ordinance. It was agreed that this proposed draft would
be reviewed by the County Attorney and that the matter would be discussed at a
later meeting.
Don S. Matheson, Senator for Orange County, requested through Chairman Bennett
that a letter of approval and endorsement for proposed legislation concerning the
zoning of the extra territorial jurisdiction for the Town of Mebane and the
industrial park area be forwarded to him.
The Orange County Board of Commissioners instructed the clerk to notify Senator
Matheson that they had no objection to the proposed zoning legislation.
Discussion ensued concerning the mental health program as presented in previous
occassions to the Board. Commissioner Smith pointed out that Orange County is a
member of the Health Planning Council and that the separate proposals which had been
received from Dr. David Galinski.and Dr. Fernando Colon be forwarded to this council
for investigation and study.
Upon motion of Commissioner Smith, seconded by Commissioner Ward the clerk was''
instructed to write a letter to George Stockbridge, Executive Secretary of the
Health Planning Council, requesting that the council's opinion be secured concerning
all mental health programs thus far presented to Orange County.
Chairman Bennett brought to the Boards attention the matter of local option
sales tax and the fact that same had not yet been enacted by the General Assembly.
The clerk was instructed to write Representative Clarence Leatherman informing him
of the orange County Boards endorsement of the local option sales tax legislation.
Commissioner Ray informed the Board that an appointment to the board of
Resource Conservation and Development Committee needed to be made by Orange County
as there was a vacancy on said committee. Upon motion of Commissioner Ray,
seconded by Commissioner Walker it was moved and adopted, teat C. W. Davis of
Route 03, Hillsborough, N. C,. be appointed as Orange Countys representative to the
Resource Conservation and Development Committee.
RESOLUTION OF THE BOARD OF COMMISSIONERS OF ORANGE COUNTY,
NORTH CAROLINA, ORDERING AND CALLING FOR A SPECIAL ELECTION
IN THE CHAPEL HILL SCHOOL DISTRICT DETERMINING WHETHER THE
SPECIAL SUPPLEMENTARY SCHOOL TAX SHALL BE INCREASED NOT TO
EXCEED 35¢ PER HUNDRED DOLLAR VALUATION.
Commissioner Smith moved that the following resolution be adopted:
WHEREAS, The Chapel Hill City Board of Education by resolution dated March 6,
1967, has requested and petitioned the Board of Commissioners of Orange County,
North Carolina, to call an election in the area comprising the Chapel Hill School
District to determine the will of the people on the following question:
"Shall there be levied and collected within the area constituting the Chapel
Hill School District an additional special tax, over and above the present 20¢
per hundred dollar property valuation special tax now in effect, increasing sai
20¢ per hundred dollar valuation special tax to not exceeding 35¢ per hundred
dollar property valuation within said area, to further supplement the current
expense funds from State and County allotments and thereby operate schools of
the Chapel Hill Administrative Unit within the Chapel Hill School District of a
higher standard by supplementing any item of expenditure in the school budget?"
AND WHEREAS, that on said petition, copy of which is attached hereto, that the
Board of County Commissioners is required to hold said election: NOW, THEREFORE,
BE IT RESOLVED by the Board of.Commissioners of Orange County as follows:
1. That a special election be held on Tuesday, May 23, 1967, in the area
described in the petition of the Chapel Hill City Board of Education, and also here-
inafter set forth in the Notice of Special Election, which area constitutes the Chap 1
Hill School District of Orange County for the purpose of submitting to the qualified
voters in said area and district the following question:

per hundred dollar property valuation special tax now in effect, increasing
said 202 per hundred dollar valuation special tax to not exceeding 35e per
hundred dollar property valuation within said area, to further supplement the
current expense funds from-State and County allotments and thereby operate
schools of the Chapel Hill Administrative Unit within the Chapel Hill School
District of a higher standard by supplementing any item of expenditure in the
school budget?"
Said election shall be held pursuant to and in accordance with the pertinent
provisions of Chapter 115, Subchapter V, of the General Statutes of North Carolina
and the laws governing general elections.
2. The polling places within the Chapel Hill School District, which are
designated below in the form of "Notice of Special Election" to be held and the po
for said election shall open and close at. the hours specified in said Notice. The
election officials whose names appear in said Notice have been appointed by the
Board of Commissioners.
. 3. The Clerk of the Board of Commissioners is hereby authorized and directed tc
publish said Notice of Special Election in The News of Orange County and the Chapel
Hill Weekly, newspapers published in Orange County, North Carolina, and having
general circulation in the area referred to in this resolution; at least thirty days
before the date hereinbefore fixed for said election and thereafter twice before the
election at intervals of at least one week between publications, such notice to be
substantially in the following form:

AND SUPPLEMENTAL REGISTRATION
IN THE
CHAPEL HILL SCHOOL DISTRICT
ORANGE COUNTY
A special election will be held on Tuesday, May 239 1967, between the hours of
6:30 o'clock a.m. and 6:30 p.m., Daylight Savings Time, in the area hereinafter
described, which area constitutes the Chapel Hill School District of Orange County,
.for the purpose of submitting to the qualified voters residing in said area the
following question:
"Shall there be levied and collected within the area constituting the Chapel H`
School District an additional special tax, over and above the present 202 per
hundred dollar property valuation special tax now in effect, increasing said 2(
per hundred dollar valuation special tax to not exceeding 352 per hundred do11E
property valuation within said area, to further supplement the current expense
funds from State and County allotments and thereby operate schools of the Chape
Hill Administrative Unit within the Chapel Hill School District of a higher
standard by supplementing any item of expenditure in the school budget?"
If said tax is levied it will be levied upon all taxable property situated
within the Chapel Hill School District, as described herein, for the purposes above
set forth. Each ballot provided for the use of voters in voting on the above
question in said special election shall have the above question printed thereon and
shall bear the words "FOR Local Special Tax" and "AGAINST Local Special Tax", and
shall contain squares opposite the affirmative and negative forms, in one of which
squares the voter may make a cross (X) mark.
The area which comprises the Chapel Hill School District of Orange County is th
area contained within the following boundaries:
BEGINNING at a point in the intersection of the center line of the county road
that leads from Eubanks westwardly to old N. C. Highway #86 and the center line
of State University Railway at Eubanks, running thence in a Northeasterly
direction to a point where Louis Freeland's drive enters N. C. Highway #86,
thence in an Easterly direction to the intersection of Erwin Road and New Hope
Creek near the Durham County line and thence in an Easterly direction to the
Durham County line, thence in a Southerly direction along the Durham County lin
to its intersection with the Chatham County line; thence in a Westerly directio
along the Chatham County line to the intersection of said county line with the
township line between Bingham and Chapel Hill Townships; thence due north along
said township line crossing the Jones Ferry Road 1.25 miles Northeasterly from
its intersection with the Orange and Chatham County line; crossing Antioch Road
at its intersection with N. C. Secondary Road #5163, crossing N. C. Highway #54
just West of Bates Store, crossing N. C. Secondary Road #56 at Bethel Church, a
total distance of 39,177 feet to the intersection of N. C. Secondary Road #512
with the paved road that leads from Dodson's Crossroads Southeasterly to Calvani
(N. C. Secondary Road 4511); thence along and'with the center of said N. C.
Secondary Road #512 in a Northeasterly direction 1,584 feet to a point in the
center of said road; thence South 72 deg. 30 min. East 4,382 feet to a.point in
the center of the East side of loop road, said point being 3,696 feet North of
the first intersection North of Neville's Store; thence South 80 deg. 45 min.
East 4,752 feet to a point in the center of the old N. C. Highway #86, said poil
being 2,640 feet North of the first intersection North of Calvander; thence Soul
74 deg. 00 min. East 8,190 feet to the beginning point.

In said election the regular registration books for elections will be used.
However, said registration books will be open for the registration of such voters,
not theretofore registered, beginning Saturday, April 29, 1967, and closing Saturday,
May 13, 1967. On each Saturday during said period the registration books shall remai
open at the polling places to afford opportunity for unregistered voters to have thei
r„ named suly entered.
The polling places and the names of election officers, subject to change as
provided by law, are as follows:

Any person who is not certain as to where he should register should contact the
Register of Deeds and ex officio Clerk of the Board of Commissioners at her office in
the County Courthouse in Hillsborough.
After canvass by the Board of County Commissioners of the results of said specia
election when the returns have been filed with them by the officers holding the
election, and if said election shall be carried by a majority of the votes cast in
said election, then and in such event there shall be levied in said area, effective
as of July 1, 1967, a special school tax which, indluding the present 20t per hundred
dollar valuation special tax, will not exceed 35C per hundred dollar valuation tax.

4. That the persons whose names are mentioned in the foregoing form of election
notice are hereby appointed Registrars and Judges for the polling places therein

Commissioner:Ward- secoinded the. motion to adopt said resolution, and after
discussion, said resolution was put to a vote. Chairman Bennett called for a vote
on said motion. Voting aye were Commissioners Smith, Ward, Walker and Bennett.
Voting Nay was Commissioner Ray. Chairman Bennett declared the motion carried.
Upon motion of Commissioner Ray, seconded by Commissioner Walker, Chairman

There being no further business to come before the Board said meeting was
adjourned to meet again on Tuesday, April 11, 1967 at 7:30 P.M. in the Commissioners
