Courthouse in Hillsborough, North Carolina on Friday, March 39 1967 at 8:00 P.M. 4 Members Present: Chairman Harvey D. Bennett, Commissioners William C. Ray, Carl M. Smith, Ira A. Ward and Henry S. Walker. Members absent: None The following persons were present: A. H. Graham, County Attorney; Roland McClamroch, Sr., Mayor of the Town of Chapel Hill; Roy Lindahl, W. M. Scarborough and representatives of Youth For Better Life Organization. The purpose of this meeting was to receive the following petition as provided by Chapter 1107 of the 1965 Session Laws as Amended: PETITION TO: THE BOARD OF COMMISSIONERS OF ORANGE COUNTY WE, THE UNDERSIGNED, resident freeholders all residing within the recreation district herein petitioned for, do hereby request the Board of County Commissioners of Orange County to exercise the authority granted to it by the 1965 General Assembly (Chapter 1107, 1965 Session Laws, as said Act may be amended by the 1967 Session Laws) with the following action: (1) The creation of a recreation district coterminous with the present boundaries of the Chapel Hill School District, which district is more particularly described in Attachment A hereto, the object proposed to be accomplished by the creation of such district being the providing of public recreation facilities in order to preserve and promote the public good and general welfare, and (2) The calling of a special election within said district for the purpose of voting upon the levy of an annual tax of not less than three cents nor more than ten cents on each $100.00 of assessed valuation of the taxable property within such district for the provision, establishment, maintenance and operation of the recreation facilities, the amount of said tax to be set by the Board of County Commissioners within said range. IN WITNESS WHEREOF, we have hereunto set our hands. NAME ADDRESS ATTACHMENT A - The boundaries of the proposed recreation district are as follows: BEGINNING in the center line of State Road No. 1112, where the Chapel Hill and Bingham Township line crosses said road; thence in a Southeasterly direction along the center of said road 250 feet to a point where the center line of State Road No. 1113 intersects with State Road No. 1112; thence in a Northeasterly direction along State Road No. 1113, 1,525 feet to a concrete marker in the center of said road; thence South 71° 20' East 4,390 feet to a concrete marker in the East side of State Road No. 1179; thence South 82° 30, East 5,480 feet to a concrete marker in the East side of Old N. C. Highway 86; thence South 81° 09, East 8,780 feet to a point 50 feet East of the center line of State University Railroad; thence in a Northerly direction parallel with the center line of State University Railroad 3,350 feet; thence North 87° 15, East 23,940 feet to the Durham County line; thence in a Southerly direction along the Durham County and Orange County line 53,750 feet to its intersection with the Chatham County line; thence in a Westerly direction along the Orange County and Chatham County line 39,475 feet to the intersection of said County line with the township line between Chapel Hill arid-Bingham Township; thence in a Northerly directi n along the Bingham and Chapel Hill Township line 40,425 feet to the point of BEGINNING Resolutions from the Aldermen of the Town of Chapel Hill and Carrboro were delivered to the Board. RESOLUTION RELATING TO THE CREATION OF A RECREATION DISTRICT BE IT RESOLVED by the Board of Aldermen of the Town of Chapel Hill: Section 1. The Board of Aldermen has determined and does hereby find and declar (a) That, pursuant to the provisions of Chapter 1107, Session Laws of 1965, as amended in 1967, a copy of a petition, addressed to the Board of Commissioners of Orange County, has been received by this Board in the following form: "PETITION TO: THE BOARD OF COMMISSIONERS OF ORANGE COUNTY WE, THE UNDERSIGNED resident freeholders all residing within the recreation district herein petitioned for, do hereby request the Board of County Commissioners o Orange County to exercise the authority granted to it by the 1965 General Assembly ( (Chapter 1107, 1965 Session Laws) with the following action: - -- 56g-B (1) The creation of a recreation district coterminous with the present boundaries of the Chapel Hill School District, which district is more particularly described in Attachment A hereto, the object proposed to be accomplished by the creation of such district being the providing of publi recreation facilities in order to preserve and promote the public good and general welfare, and (2) The levy of an annual tax of not less than three cents nor more than ten cents on each $100.00 of assessed valuation of the taxable property within such district for the provision, establishment, maintenance and operation of the recreation facilities, the amount of said tax to be set by the Boar of County Commissioners within said range." NAME ADDRESS (In the copy of the petition set forth in the minutes of the March 2, 1967 meeting of the Board of Aldermen the signatures of more than 1,000 resident freeholders appear at this point) ATTACHMENT A The boundaries of the proposed recreation district are as follows: BEGINNING in.the center line of State Road #1112, where the Chapel Hill and Bingham Township line crosses said road; thence in a Southeasterly direction along the center of said road 250 feet to a point where the center line of State Road #111 1,525 feet to a concrete marker in the center of said road; thence South 71° 20' Eas 4,390 feet to a concrete marker in the East side of State Road #1179; thence South 82° 30' East 5,480 feet to a concrete marker in the East side of old N. C. Highway 8 thence South 81° 09' East 8,780 feet to a point 50 feet East of the center line of State University Railroad; thence in a Northerly direction parallel with the center line of State University Railroad 3,350 feet; thence North 87° 15' East 23,940 feet to the Durham County line; thence in a Southerly direction along the Durham County and Orange County line 53,750 feet to its intersection with the Chatham County line; thence in a Westerly direction along the Orange County and Chatham County line 39,47 feet to the intersection of said County line with the township line between Chapel Hill and Bingham Township; thence in a Northerly direction along the Bingham and Chapel Hill Township line 40,425 feet to the point of BEGINNING." (a) That said petition prays that a recreation district be created within the territory described in said petition, the object proposed to be accomplished by the creation of such district being the providing of public recreation facilities in order to preserve and promote the public good and general welfare. (b) That said petition further prays that a special election be held within such district for the purpose of voting upon: (1) the levy of an annual tax of not less than three cents nor more than ten cents on each $100.00 of assessed valuation of the taxable property within such district for the provision, establishment, main- tenance and operation of the recreational facilities, the amount of said tax to be set by the Board of County Commissioners within said range. (c) That the Town of Chapel Hill is located within the boundaries of such proposed recreation district. Section 2. Said petition is hereby approved in all respects and the Board of ... Aldermen hereby request the Board of Commissioners for the County of Orange to exercise the authority granted to it by said Chapter 1107, as amended, by taking the action requested in said petition. Section 3. A copy of this resolution shall immediately be certified to the Board of Commissioners for the County of Orange. Section 4. This resolution shall become effective upon its passage. Alderman Kage moved the passage of the foregoing resolution entitled: RESOLUTION RELATING TO THE CREATION OF A RECREATION DISTRICT" and Alderman Varley seconded the motion and the resolution was passed by the following vote: Ayes: Page, Giduz, Strowd, Varley, Kage and Smith. Noes: None This is to certify that the foregoing is an accurate copy of the resolution passed by the Board of Aldermen on March 21 1967. Roberts - Town Clerk SEAL RESOLUTION REGARDING RECREATION DISTRICT To: Orange County Board of Commissioners, Hillsborough, N. C. WHEREAS, the Board of Commissioners of the Town of Carrboro has been requested to approve the petition heretofore submitted to the Board of Orange County Commissioners to create a recreation district to coincide with the Chapel Hill School District and to call an election on this question, and WHEREAS, at a recent election on the same question, a majority of the voters in the Town of Carrboro voted against the creation of a district and the establishment of a special tax, and WHEREAS, it is the opinion of this Board that it cannot approve the petition, but it does not want to deny the voters of the district the privilege of voting on the question involved, NOW, THEREFORE be it resolved that if the Board of Commissioners of the County of Orange exercises the authority granted to it by Chapter 1107 of the 1965 Session Laws, as amended, and calls an election on the question involved, that prior to the calling of this election, the Board of County Commissioners create a Recreation Commission of seven (7) members to consist of two (2) persons from the Town of Carrboro, two (2) persons from the Town of Chapel Hill, two (2) persons from the rural area and one (1) person at large to constitute the Recreation Commission, if and when a Recreation District has been created by a favorable vote. Motion was made, duly seconded and passed by a majority vote of the Board of Commissioners for the Town of Carrboro, adopting the above resolution at a special called meeting of the Board of Commissioners on March 2, 1967. I, R. B. Todd, Town Clerk for the Town of Carrboro, do hereby certify that Mayor H. B. Hackney called a special meeting of the Board of Commissioners for the Town of Carrboro on March 2, 1967, at which time the above resolution was adopted and is found in Minute Book #7, Page 291. March 2 1967 Signed s R. B. Todd (Date) R. B. Todd, Town Clerk Discussion ensued concerning the resolution submitted by the Town of Carrboro. It was ruled that said resolution was inadequate to meet the requirements of Chapter 1107 of the 1965 Session Laws. Due to the inadequancy of said resolution the Orange County Board of Commissioners could not act on the petition to create a Recreation District. The County Attorney was directed to inform the Carrboro Town Attorney as to the status of said Town of Carrboro resolution and to request of said Town Attorney that a sufficient resolution for the Town of Carrboro must be secured before the Orange County Board of Commissioners could consider the petition pertaining to the said Recreation District election.
