Gattis, Acting Clerk Minutes of the Board of Commissioners (Public Hearing) January 25, 1967 The Orange County Board of Commissioners met in adjourned session on Wednesday, January 252 1967, at 7:30 o'clock p.m. in the gymnasium of the Chapel Hill High School. Members present: Chairman Harvey D. Bennett, Commissioners Carl M. Smith, Henry S. Walker, Ira A. Ward and William C. Ray. Members absent: None Chairman Bennett announced that this meeting was being held in compliance with the General Statutes of North Carolina for the purpose of holding a public hearing on the proposed Draft #7 of the Chapel Hill Township Ordinance dated August 31, 1966. The following persons were introduced by Chairman Bennett: C. T. Kaylor, Chairman of the Planning Board, and Harry Palmer, Secretary of the Planning Board. Chairman Bennett announced that the Honorable A. H. Graham, County Attorney, had been designated by the Board of Commissioners to act as Presiding Officer for said public hearing and that S. M. Gattis, County Administrator, had been designated by the Board of Commissioners to act as Clerk for said public hearing. A. H. Graham, Presiding Officer, assumed the Chairmanship of said hearing and announced that the following rules of procedure, as approved by the Board of Commissioners, were to be the policy for conducting said public hearing. They were: 1. That a one hour presentation period would be allocated to the proponents of the proposed Draft #7 of the Chapel Hill Township Ordinance and that a one hour presentation period would be allocated to the opponents of the proposed Draft #7 of the Chapel Hill Township Ordinance. 2. That a period of fifteen minutes would be allocated to the proponents and to the opponents for rebuttal presentations. . 3. That a Chairman be selected as the representative and spokesman for each group. Harold R. Roberts of Jones Perry Road, Chapel Hill, N. C., was named as Chairman for the proponents and A. B. Coleman, Jr., Attorney, of Hillsborough, N. C., was named as Chairman for the opponents. Chairman Graham recognized Mr. Roberts. Mr. Roberts made his presentation in favor of the proposed zoning ordinance and cited many benefits it would afford the citizens of the Chapel Hill Township community areas. He then presented to the hearing the following persons who made statements urging the adoption of the proposed Draft #7 of the Chapel Hill Township Zoning Ordinance. Those persons were: Delois O'Daniel of the Jones Perry Road Community Mrs. Mary Brandon of the Poplar Hills Community Robert Lester of the Cedar Grove Community Furman Herring of the Poplar Hills Community John Wilson of the Union Grove Community Richard Walker of the Timberlake Estates Development Jim Grizzle of the Damascus Church Community Newton Fischer of Airport Road, Chapel Hill, N. C. Logan Ervin of Jones Ferry Road, Chapel Hill, N. C. A. J. Altemueller of the Homestead Community Mr. Altemueller introduced the following persons from the Homestead Community and these persons spoke in favor of the Chapel Hill Township Zoning Ordinance. They were: Henry Hogan, Watts Scott, Charles Johnson, Mrs. John Kepley and Randy Williams. Mr. Altemueller stated that C. X. Tilson and Eugene Blackwood, both of the Homestead Community, favored said ordinance but were unable to attend this hearing. Mr. Roberts recognized Mrs. Mary Scroggs, member of the Chapel Hill School Board, who presented the sentiments of the Chapel Hill School Board and urged the adoption of the proposed Township Zoning Ordinance. Mr. Roberts stated that the proponents of the proposed zoning ordinance had completed their presentation and turned the hearing back to chairman Graham. Chairman Graham adjourned the hearing for a recess period. The public hearing was again called to order by Chairman Graham, who then recognized A. B. Coleman, Jr., Chairman of the opponent's group. Mr. Coleman stated that he was not representing, in an official capacity, all He tho didse persons present who opposed the proposed Chapel Hill Township Zoning Ordinance. , however, represent certain groups and individuals, as their Attorney, who were opposed to the said proposed zoning ordinance. He further stated that he would speak for those persons, whom he represented, and urged all other persons who were opposed to the said proposed zoning ordinance to speak for themselves. Mr. Coleman moved for the adjournment of the public hearing citing his reasons for such motion as being: first, that there had been a failure of the statutory requirements of timely notice to the public of the public hearing and second, that the published notice of the public hearing had been directed to the citizens of Chapel Hill Township. He stated that the statutues clearly state that all citizens in the county have a right to be heard at a public hearing and that the proceedures as approved by the Board of Commissioners for conducting the hearing, allocating one hour presentation periods to the opponents and to the proponents, was insufficient time for all intereated'oitizens to make their presentations. Mr. Coleman made his presentation in opposition to the proposed zoning ordinance citing the many disadvantages that would be placed upon the individual property owners and the mobile park owners. He asked that all persons desiring to speak in opposition to the said proposed zoning ordinance raise their hands in order that he might recognize them for their presentations. Those persons speaking in opposition to the proposed Draft #7 of the Chapel Hill Township Zoning Ordinance were: Russell G. Wright of the Airport Road Community Clyde Williams of Route 1, Durham, N. C. Gera P. Sykes of Route 2, Hillsborough, N. C. John Childs of Route 1, Durham; N. C. Harold Moody of Pine Grove Mobile Court, Chapel Hill, N. C. Edward Underwood of Route 1, Durham, N. C. Bill Spencer of Route 1, Hillsborough, N. C. L. W. Sparrow of Farrington Road Community C. Lee Byrd of Route 3, Hillaborough, N. C. Janet Grouts of Geddy Carlisle of Tom Dix of Durham County Mrs. Florence Johnson of Durham County but who is a mobile home owner Lloyd W. Gardner of Michaux Road, Chapel Hill, N. C. Robert Satterfield, Attorney, of Hillsborough, N. C., spoke in behalf of Avery Maddry who resides at Route 2, Chapel Hill, N. C. A member of the audience, who identified himself as a Mr. Sprouse, attempted to question Chairman Harvey Bennett from the floor. He was ruled out of order by Chairman Graham, for the reason that the opponents were presenting their arguments, and that it was not a question and answer period. Chairman Graham advised Mr. Sprouse that he had the priviledge of speaking in opposition to the proposed zoning ordinance if he so desired. Mr. Coleman stated that the opponents had completed their presentation and turned the hearing back to Chairman Graham. Mr. Roberts, Chairman of the proponents, introduced Logan Ervin, who presented the rebuttal remarks for the proponents of the said proposed zoning ordinance. Mr. Coleman, Chairman of the opponents, requested that all persons who had 'ailed to receive the opportunity to speak in opposed to the proposed Chapel Hill ownship Zoning Ordinance but who would have liked the opportunity to be heard on said matter, if they would at the conclusion of his presentation, rise and take their daces to the roar of the speakerls stand. Mr. Coleman then presented the rebuttal remarks for the opponents of the proposed zoning ordinance. Chairman Graham stated that the time allocated to both the proponents and to he opponents had expired. He thanked all present for attending the public hearing nd for giving to the Board of County Commissioners their opinions regarding the roposed zoning ordinance.
