BOARD OF COMMISSIONERS
January 3, 1967
The Board of Commissioners for the County of Orange, North Carolina, met in
regular session at the County Courthouse in Hillsborough, North Carolina, at
10:00 o'clock A.M. on January 3, 1967.
Members Present: Chairman Harvey D. Bennett, and Commissioners, William C.
Henry S. Walker, Carl M. Smith and Ira A. Ward.
Members Absent: None
Minutes of the December meetings were read and approved.
F. W. Albright, Route 1, Mebane, North Carolina, requested that the unpaved
secondary road in the Mebane area which crosses into Alamance County be paved.
He stated that the Alamance County portion of the road had been approved for paving
and that he would appreciate the Orange County Boards assistance in securing paving
for said road. it was learned that no petition had been presented on said requested
road. The Clerk was instructed to write Earl Hoover, District Engineer, as to
the cost and status of the proposed project.
Jim Caldwell, Assistant City Manager for the Town of Chapel Hill and Col.
Thomas J. Spiller, U. S. Army Retired, now Civil Defense Director of the Chapel
Hill-Carrboro area, were present to present their views as to the advantages which
could be derived from a joint county-city Civil Defense department. Discussion
ensued. Commissioner Ward requested Col. Spiller to submit a proposed five (5)
year Civil Defense program and budget to the Board for their further consideration.
Col. Spiller stated that such a program would be made available to the Board at
the earliest possible date.
Tom -Rose, Engineer for the Town of Hillsborough, presented plans showing the
location of a sewerage line which will cross the proposed Health building site.
,----Mr. Rose was requested to prepare a contract for engineering services in
connection with the construction of the proposed Lake Orange Project. Mr. Rose
was further requested by the Board to immediately proceed with the survey phase of
the work on the Lake Orange Project. ?--
The annual Farm Agents and Home Demonstration Agents reports were submitted.

The County Accountant submitted three (3) bills for legal services, same are

Upon motion of Commissioner Smith, seconded by Commissinner Ward, the County
Accountant was authorized to take from the Emergency Fund the necessary monies
in order that these bills might be paid.
Commissioner Ray introduced the following resolution, which was read:
RESOLUTION DEDICATING ADDITIONAL LAND FOR PUBLIC HEALTH BUILDING
WHEREAS, this Board at its meeting held on August 15, 1966, did dedicate a
certain tract or parcel of land on the south side of Margaret Lane in the Town of
Hillsborough as a site for a new public health building and related medical purposes
and
WHEREAS, after the adoption of the above mentioned resolution the County of
Orange has acquired a small tract on the west side of the land heretofore
dedicated, and after careful consideration, it is the opinion of this Board that
said additional land should be included in the site for the public health building
and related medical purposes.
NOW, THEREFORE, BE IT RESOLVED by this Board, that the following described
tract is hereby dedicated as a site for a new health building and related medical
purposes exclusively:
BEGINNING at an iron stake in the South right of way line of Margaret Lane,
which stake is located by measuring from the Southwest intersection of
Margaret Land and South Cameron Street along the South right of way line of
Margaret Lane a distance of 156.22 feet; and running thence West along the
South right of way line of Margaret Lane North 84 deg. 00 min. West 211 feet
to an iron stake, corner with D. T. Roberts; thence with Roberts' line South
5 deg. 37 min. 51 sec. West 266 feet to an iron stake, corner with D. T.
Roberts; thence with Roberts' line South 84 deg. 00 min. East 51 feet to a
stake; thence South 5 deg. 46 min. 30 sec. West 74 feet to an iron stake in
Roberts' line; thence South 84 deg. 00 min. East 160 feet to a stake, corner
with other lands owned by Orange County; thence North 5 deg. 37 min. 51 sec.
East 340 feet to the place or point of beginning.
The description herein set forth includes the original land dedicated plus
additional area.
This resolution in no way rescinds the resolution adopted on August 15, 1966,
but merely enlarges the area to be dedicated.
The foregoing resolution was duly seconded by Commissioner Ward and unanimousl
adopted.
Robert Strayhorn, Vice Chairman of the Orange County Planning Board, and
Harry Palmer,of the Research Triangle Planning Commission, informed the Bo
H ard that
the County Planning Board had completed Draft 7 of the proposed zoning ordinance.
A copy of said ordinance was presented to the Board. They requested that a date
for a public hearing on the zoning ordinance be designated. The auditorium of the
Chapel Hill High School was selected as the place for said public hearing and the
date was-designated for Wednesday, January 25, 1967 at 7:30 P.M.
Chairman Bennett requested that Mr. Strayhorn inquixe of the Planning Board.
as to their opinion on whether or not the triangular area located in the southeaster
corner of Orange County, presently not zoned by the towns of Chapel Hill or
Carrboro, should be brought into the zoning jurisdiction of the town of Chapel Hill.
Mr. Strayhorn agreed to make such an inquiry.
Lawrence Alley, the engineer who was employed by the County to study the
proposed Water Sewerage Extension in the Mebane area, was present to discuss with
the Board the details involved concerning the proposed design of said systems.
Discussion ensued. . The County Accountant was directed to proceed with necessary
details involving options and right of ways as soon as possible.
The following resolution was offered by Commissioner Ra
Commissioner Ward and unanimously adopted. Y. duly seconded by
WHEREAS, the Board of Commissioners of Orange County did, during the summer of
1966, replace the floor covering in the Court=oom of the County Courthouse with a
new and expensive covering; and
WHEREAS, it has been brought to the attention of the Board of County Commissioi
that the floor covering in the Courtroom is now being marred and damaged by the
dropping of lighted cigarettes by persons having occasion to use or attend meetings
in said Courtroom:
NOW, THEREFORE, BE IT RESOLVED, That the Board of County Commissioners of
Orange County hereby prohibits the smoking by any person or persons within the
confines of the Courtroom in the Orange County Courthouse.
That the violation of this ordinance shall be punishable by a fine of not
less than $10.00 plus court costs for the first offense. Any conviction of a
subsequent offense shall carry punishment of not less than $25.00 nor more than
$50.00 for each offense.
It is further ordered that a Copy of this resolution be certified to the
Clerk ^of the Superior Court and to the•Sheriff of Orange County.
It is further directed that the County Manager shall secure appropriate
signs to be.-placed in said Courtroom advising the public generally that no smoking
will be permitted within said room.

There being no further business to come before the Board said meeting was
adjourned to meet again on Wednesday, January 25, 1967, at 7:30 o'clock p.m, in
the gymnasium of the Chapel Hill High School.

Minutes of the Board of Commissioners
(Public Hearing)
January 25, 1967
The Orange County Board of Commissioners met in adjourned session on Wednesday,
January 25, 1967, at 7:30 otclock p.m. in the gymnasium of the Chapel Hill High
School.
Members present: Chairman Harvey D. Bennett, Commissioners Carl M. Smith,
Henry S. Walker, Ira A. Ward and William C. Ray.
Members absent: None
Chairman Bennett announced that this meeting was being held in compliance with
the General Statutes of North Carolina for the purpose of holding a public hearing
on the proposed Draft #7 of the Chapel Hill Township Ordinance dated August 31, 1966.
The following persons were introduced by Chairman Bennett: C. T. Kaylor,
Chairman of the Planning Board, and Harry Palmer, Secretary of the Planning Board.
Chairman Bennett announced that the Honorable A. H. Graham, County Attorney,
had been designated by the Board of Commissioners to act as Presiding Officer for
said public hearing and that S. M. Gattis, County Administrator, had been designated
by the Board of Commissioners to act as Clerk for said public hearing.
A. H. Graham, Presiding Officer, assumed the Chairmanship of said hearing and
announced that the following rules of procedure, as approved by the Board of
Commissioners, were to be the policy for conducting said public hearing. They were:
1. That a one hour presentation period would be allocated to the proponents of
the proposed Draft #7 of the Chapel Hill Township Ordinance and that a one hour
presentation period would be allocated to the opponents of the proposed Draft #7
of the Chapel Hill Township Ordinance.
2. That a period of fifteen minutes would be allocated to the proponents and
to the opponents for rebuttal presentations.
3. That a Chairman be selected as the representative and spokesman for each
group.
Harold R. Roberts of Jones Ferry Road, Chapel Hill, N. C., was named as Chairman
for the proponents and A. B. Coleman, Jr., Attorney, of Hillsborough, N. C., was
named as Chairman for the opponents.
Chairman Graham recognized Mr. Roberts. Mr. Roberts made his presentation in
favor of the proposed zoning ordinance and cited many benefits it would afford the
citizens of the Chapel Hill Township community areas. He then presented to the
hearing the following persons who made statements urging the adoption of the proposed
Draft #7 of the Chapel Hill Township Zoning Ordinance. Those persons were:

Mrs. Mary Brandon of the Poplar Hills Community
Robert Lester of the Cedar Grove Community
Furman Herring of the Poplar Hills Community
John Wilson of the Union Grove Community
Richard Walker of the Timberlake Estates Development
Jim Grizzle of the Damascus Church Community
Newton Fischer of Airport Road, Chapel Hill, N. C.
Logan Ervin of Jones Ferry Road, Chapel Hill, N. C.
A. J. Altemueller of the Homestead Community
Mr. Altemueller introduced the following persons from the Homestead Community
and these persons spoke in favor of the Chapel Hill Township Zoning Ordinance. They
were: Henry Hogan, Watts Scott, Charles Johnson, Mrs. John Kepley and Randy Williams.
Mr. Altemueller stated that C. Y. Tilson and Eugene Blackwood, both of the Homestead
Community, favored said ordinance but were unable to attend this hearing.
