December 15, 1966
The Board of Commissioners for the County of Orange, North Carolina, met in
adjourned regular session at the County Courthouse in Hillsborough, North Carolina,
at 11 o'clock A.M. on December 15, 1966.
Present: Chairman Harvey D. Bennett, and Commissioners William C. Ray, Henry
S. Walker, Ira A.-:.Ward
Absent: Carl M. Smith
At 11 o'clock A.M. the members of the Board of Commissioners for the County of
Orange met with the Countv Board of Elections of Orange County and the two Boards,
as two separate bodies, separately received from the registrars and judges of
election in the various precincts of the County of Orange the returns of the special
bond election held on December 13, 1966.
After said returns had been canvassed by said Board of Commissioners, such
canvass being simultaneous with the canvassing thereof by the County Board of
Elections in the same place, Commissioner Walker introduced the following
resolution which was read:
RESOLUTION CANVASSING THE RETURNS OF THE
SPECIAL BOND ELECTION HELD DECEMBER 13,
1966, IN THE COUNTY OF ORANGE AND DETER-
MINING AND DECLARING THE RESULT THEREOF
BE IT RESOLVED by the Board of Commissioners for the County of Orange:
Section 1. The returns of the special bond election held in the County of
Orange on December 13, 1966, having been received from the proper election officers
and having been canvassed, the Board has found and determined and does hereby declar :
(a) That each registrar and judge for the special bond election held in the
County of Orange on December 13, 1966, was duly qualified by law and had taken the
necessary oath.
(b) That the election officers had incorporated in their returns not only the
number of votes cast for and against the questions submitted but also the number of
voters registered and qualified to vote in each precinct in the election.
(c) That at said election there were submitted to the qualified voters of said
County the following questions:
1. Shall an order finally passed on October 3, 1966, authorizing the County of
Orange, North Carolina, to contract a debt, in addition to any and all other
debt which said County may now or hereafter have power or authority to
contract, and in evidence thereof to issue Water Bonds in an aggregate
principal amnunt not exceeding $560,000 for the purpose of providing funds,
with any other available funds, for the construction of a water-works syste
in Orange County, including the construction of a dam and water storage
facilities, the installation of mains and lines, and-the acquisition of
necessary land and rights of way, and authorizing the levy and collection
of a sufficient tax for the payment of the principal of and the interest on
said bonds, be approved?
2. Shall an order finally passed on October 3, 1966, authorizing the County of
Orange, North Carolina, to contract a debt, in addition to any and all other
debt which said County may now or hereafter- have power or authorizing to
contract, and in evidence thereof to issue Sanitary Sewer Bonds in an
aggregate principal amount not exceeding $90,000 for the purpose of providi
funds, with any other available funds, for the construction of a sanitary
sewer system in Orange County, including the acquisition of necessary land
and rights of way, and authorizing the levy and collection of a sufficient
tax for the payment of the principal of and the interest on said bonds, be
approved?
Section 2. The following schedule correctly shows the designations of the
several precincts in which said election was held, the number of.voters registered
and qualified to vote in each precinct in the election, the number of votes cast in
each precinct in favor of each question submitted, the number cast against each
question, and the totals of such numbers:

Section 3. From the canvass so made by this Board it is determined and
declared:
II (a) That 12,941 voters were registered and qualified to vote. /

(b) That at said election 3296 votes were cast for the order authorizing the
County of Orange to contract a debt and in evidence thereof to issue not exceeding
$560,000 Water Bonds for the purpose of providing funds, with any other available
funds, for the construction of a waterworks system in orange County, including the
construction of a dam and water storage facilities, the installation of mains and
lines, and the acquisition of necessary land and rights of way, and authorizing the
levy and collection of a sufficient tax for the payment of the principal of and the
interest on said bonds, and 1013 votes were cast against said order., that a majorit
of the qualified voters of said County who voted thereon.at said election voted in
favor of said order, and said order was thereby approved and is in force and effect
(c) That at said election 3270 votes were cast for the order authorizing the
County of Oranc!e to contract a debt and in evidence thereof to issue not exceeding
$90,000 Sanitary Sewer Bonds for the purpose of providing funds, with any other
available funds, for the construction of a sanitary sewer system in Orange County,
including the acquisition of necessary land and rights of way, and authorizing the
levy and collection of a sufficient tax for the payment of the principal of and the
interest on said bonds, and 999 votes were cast against said order, that a majority
of the qualified voters of said County who voted thereon at said election voted in
favor of said order, and said order was thereby approved and is in force and effect.
Upon motion of Commissioner Walker, seconded by Commissioner Ward, the fore-
going resolution entitled: "RESOLUTION CANVASSING THE RETURNS OF THE SPECIAL BOND
ELECTION HELD DECEMBER 13, 1966 IN THE COUNTY OF ORANGE, AND DETERMINING AND DECLAR-
ING THE RESULT THEREOF" was passed by the following vote:
Ayes: Commissioners Bennett, Ray, Walker and Ward
Noes: None
Thereupon Commissioner Walker introduced the following resolution which was
read:
RESOLUTION ADOPTING A STATEMENT OF THE
RESULT OF THE SPECIAL BOND ELECTION HELD
DECEMBER 13, 1966 IN THE COUNTY OF ORANGE,,
AND PROVIDING FOR THE RECORDING, FILING
AND PUBLICATION THEREOF
BE IT RESOLVED by the Board of Commissioners for the County of Orange:
Section 1. The Board of Commissioners has prepared and does adopt the
following statement of the result of the special bond election held in the County of
Orange on December 13, 1966:
STATEMENT OF RESULT
of
SPECIAL BOND ELECTION
held in the
COUNTY OF ORANGE, NORTH CAROLINA
on December 13, 1966
At a special bond election held throughout the County of Orange, North Carolina
on December 13, 1966, 12,941 voters were registered and qualified to vote.
At said election 3296 votes were cast for the order authorizing the County of
Orange to contract a debt and in evidence thereof to issue not exceeding $560,000
Water Bonds for the purpose of providing funds, with any other available funds, for
the construction of a waterworks system in Orange County, including the construction
of a dam and water storage facilities, the installation of mains and lines, and the
acquisition of necessary land_.and rights of way, and authorizing the levy and
collection of a sufficient tax for the payment of the principal of and.the interest
on said bonds, and 1013 votes were cast against said order, that a majority of the
qualified voters of said County who voted thereon at said election voted in favor
of said order, and said order was thereby approved and is in force and effect.
At said election 3270 votes were cast for the order authorizing the County of
Orange to contract a debt and in evidence thereof to issue not exceeding $90,000
Sanitary Sewer Bonds for the purpose of providing funds, with any other available
funds, for-the construction of a sanitary sewer system in orange County, including
the acquisition of necessary land and rights of way, and authorizing the levy and
collection of a sufficient tax for the payment of the principal of and the interest
on said bonds, and 999 votes were cast against said order, that a majority of-the
qualified voters of said County who voted thereon at said election voted in favor of
said order, and said order was thereby approved and is in force and effect.
This statement is given by order of the Board of Commissioners for the County o
Orange, this 15th day of December, 1966.

Section 2. When the foregoing statement shall have been signed by a majority
of the members of this Board and delivered to the Clerk, the latter shall record
it in the minutes of the Board, and such statement shall be filed in the office of
said Clerk and published by said Clerk once in The News of Orange County. A notice
in substantially the following form, with the printed signature of the Clerk
appended thereto, shall be published with the foregoing statement:
TO THE CITIZENS AND TAXPAYERS OF ORANGE COUNTY:
No right of action or defense founded upon the invalidity of the election
mentioned in the foregoing statement shall be asserted, nor shall the validity of
such election be open to question in any court upon any ground whatever, except in
an action or proceeding commenced within thirty days after the publication of the
foregoing statement.

Upon motion of Commissioner ward, seconded by Commissioner Walker, the fore-
going resolution entitled: "RESOLUTION ADOPTING A STATEMENT OF THE RESULT OF THE
SPECIAL BOND ELECTION HELD DECEMBER 13, 1966 IN THE COUNTY OF ORANGE, AND PROVIDING
FOR THE RECORDING, FILING AND PUBLICATION THEREOF" was passed by the following vote:
Ayes: Commissioners Bennett, Ray, Walker and Ward
Noes: None
The County Administrator reported to the Board the results of a conference
with the Medical Care Commission, attended by Chairman Bennett, Dr. 0. David Garvin
and himself, concerning the proposed public health building which is to be built
East of the courthouse on Margaret Lane. The Medical Care Commission estimates that
the cost of this building will be approximately $132,097.24. The Commission has
agreed to provide $50,000.00 of the total suns necessary to build and equipt this
proposed health building. The Commission also is of the opinion that $11,250.00
is necessary to adequately equipt said building. The County has provided in the
"1964-196V budget the sum of $25,000.00 and there was also provided in the 1966-1967
budget the sum of $60,000.00, this means that an additional committment of
$7,347.25 must be provided for by the County.
Upon motion of Commissioner Ward, seconded by Commissioner Ray, it was moved
and unanimously adopted that the County Administrator be authorized to write the
Medical Care Commission and advise them that Orange County does commit the
additional sum of $7,347.25 to the construction and equipment of the proposed
health building.
Discussion ensued concerning smoking in the courtroom. The Board requested the
County Attorney to draft an ordinance prohibiting smoking in the courtroom of the
courthouse and requested that said ordinance be presented to them for consideration
at the next regular Commissioners meeting.
The County Administrator presented a proposed contract with Mrs. Faye Hewlett,
court reporter, covering the calender year of 1967. The terms of this contract were
the same as the previous contract, between the County and Mrs. Hewlett, which expire:
on December 21, 1966. The financial agreement of said contract paid Mrs. Hewlett
was $150.00 per week plus expenses estimated at $40.00 per week.
Upon motion of Commissioner Ray, seconded by Commissioner Walker, it-was moved
and unanimously adopted, Chairman Bennett was authorized to execute the contract
between Orange County and Mrs. Faye Hewlett, Court Reporter.
There being no further business to come before the Board said meeting was
adjourned.
