PURPOSE: To consider the legal advertisement for items to be presented at the Joint
Planning Area Public Hearing scheduled for October 15, 2003.
BACKGROUND: The Board of County Commissioners reviews proposals to be considered at
public hearing for consistency with general County policy and presentation format. The
following items are proposed for consideration at the October 15, 2003 Joint Planning Area
Public Hearing.
Chapel Hill Joint Planning Area Transition Area Zoning Atlas Amendments
1. Purpose: To hear public comment on a proposed rezoning of property on the east side of
Rusch Road within the Chapel Hill portion of the Joint Planning Area Transition Area. The
rezoning proposal, requested by Habitat for Humanity of Orange County to allow the
construction of 14 single-family and five rental housing units, is as follows:

From: Residential-1
To: Residential-Special Standards-Conditional
Size: Approximately 4 acres
Location: East side of Rusch Road
Identification: Chapel Hill Township, Tax Map 23, Block D, Lots 14,15, 17, and 20.
2. Purpose: To hear public comment on the proposed "Chapel Watch Village" Zoning Atlas
Amendment within the Chapel Hill portion of the Joint Planning Area Transition Area. The
rezoning proposal, requested by Campus Estates, LLC, includes a request for a Special Use
Permit to construct amulti-family residential development. The proposed development
would consist of 19 buildings, including 13 apartment buildings with a total of 282 dwelling
units, encompassing a total of 305,607 square feet of floor area. Forty-two (15%) of the
units are proposed as affordable housing (priced so as to be affordable to families earning
80% of the Median Income for the Raleigh-Durham-Chapel Hill Metropolitan Statistical
Area). The development is proposed to include 469 parking spaces with access from
Eubanks Road. Additional information includes:

Size: Approximately 35 acres
Location: South side of Eubanks Road opposite the Chapel Hill Park & Ride Lot.

Both amendments require the approval of the Orange County Commissioners and Chapel Hill
Town Council.
FINANCIAL IMPACT: None.
RECOMMENDATION: The Administration recommends approval of the Notice of Public
Hearing for October 15, 2003.

A public hearing will be held in the Southern Human Services Center, 2501 Homestead
Road, Chapel Hill, North Carolina on Wednesday, October 15, 2003 at 7:30 P.M. for the
purpose of giving all interested citizens an opportunity to speak for or against the
following items:
