BACKGROUND: During the budget deliberations in FY 2001-2002, the Board of Commissioners agreed to a four-year plan for achieving a goal of a full-time school nurse in every public school in both the CHCCS and the OCS systems. The funds appropriated for fiscal year 2001-2002 were to support one additional full-time nurse in Orange County Schools and two additional full-time nurses in Chapel Hill Carrboro City Schools and their associated operating expenses. These funds were authorized for a partial rather than a full year due to budgetary constraints. The budget approved for the current year holds the number of nurses in each system funded under this agreement to the same level as FY 2001-2002. However, funding for the entire 10 month school year is included for all three positions. FINANCIAL IMPACT: The total cost of the agreements is $162,215 and was authorized in the approved budget for FY 2002-2003. RECOMMENDATION(S): The Manager recommends that the Board approve the agreements and authorize the Chair to sign. 2 t Contract for School Nursing Services between the County of Orange and the Chapel Hill Carrboro City Schools July 1,2002-June 30,2003 This contract between the Orange County Health Department,hereinafter referred to as the "Department"and the Chapel Hill Carrboro City Schools,hereinafter referred to as the"School"is entered into for the purpose of providing school nursing services to the students of the Chapel Hill Carrboro City School system. Whereas both the Department and the School mutually agree that the purpose of providing school health nursing services is to promote the optimal health and well-being of all students in the Chapel Hill Carrboro City Schools,and Whereas both the Department and the School mutually agree to continue providing school nursing services as specified in the annually developed"Memorandum of Agreement between Orange County Health Department and Chapel Hill Carrboro City Schools;" NOW,THEREFORE,in consideration of the premises and the following mutual covenants and conditions and any sums to be paid,the Department and the School agree as follows: The Department agrees: 1. To provide funds not to exceed$110,044 to the School for the purpose of supporting two 10 month registered nurses to provide school nursing services for the 2002-2003 school year. 2. That the funds will be paid quarterly upon submission of an invoice that specifies personnel costs and that the Department shall pay the School within thirty(30)days of receipt of the School's invoice. Any adjustments to the invoice shall be taken into account in the next succeeding invoice or as soon thereafter as reasonably practicable. 3. That the funds may be used in their entirety for personnel costs including associated benefits and the local supplement. 4. To assign a nursing supervisor to coordinate the implementation of this contract and to initiate the annual development of the Memorandum of Agreement that specifies operating procedures. 5. To arrange for and provide at least three continuing education offerings for all nurses in the School during the school year at a mutually agreed upon time,whenever possible arranging for the sessions so as to minimize time away from the individual school assignments. The School agrees: 1. To utilize fiords not to exceed$110,044 for the purpose of supporting two 10 month registered nurses to provide school nursing services for 2002-2003 school year. The nurses will provide direct nursing services to students within individual schools. The School agrees that the funds will not be utilized to support a nurse with a supervisory role. 2. To submit an invoice to the Department quarterly that specifies personnel costs for the period. 3. To provide adequate space,computer,equipment and supplies for the designated positions through other funds at a level comparable to the support provided to all school nurses supported by the School. 4. To inform the.Department of the employment of the nurses,and in the event of termination,whether voluntary or involuntary,of the date of termination. 5. To maintain documentation that each of the nurses employed under this contract is/are and remain current in his/her licensure as a Registered Nurse in good standing with the North Carolina Board of Nursing. 6. To provide nursing supervision within the School consistent with the annual Memorandum of Agreement. 1 3 7. To release all school nurses to attend at least three continuing education events during the school year at mutually agreed upon times. 8. To assume the full responsibility for negligence of its employees that provide nursing services under the terms of this contract for the contract positions and for all nurses employed directly by the School but functioning under the direction of the annual Memorandum of Agreement. 9. School shall provide or cause to be provided,insurance covering professional liability of nursing personnel of at least$1 million.Proof of insurance shall be submitted to the Department annually. This contract shall be in effect for the period July 1,2002 through June 30,2003 and is renewable annually thereafter. Either party may terminate this contract with or without cause upon 90 days written notice. Whereas both the Department and the School mutually agree that the purpose of providing school health nursing services is to promote the optimal health and well-being of all students in Orange County Schools,and Whereas both the Department and the School mutually agree that the long-term purpose of these funds is to provide full-time nursing services to each school in the system;and Whereas both the Department and the School mutually agree to continue providing school nursing services as specified in the annually developed"Memorandum of Agreement between Orange County Health Department and Orange County Schools;" NOW,THEREFORE,in consideration of the premises and the following mutual covenants and conditions and any sums to be paid,the Department and the Schools agree as follows: The Department agrees: 1., To provide funds not to exceed$52,171 to the School for the purpose of supporting one 10 month registered nurse to provide school nursing services for the 2002-2003 school year.
