PURPOSE: To receive a report on the Orange County/City of Durham/Durham County Courtesy
Review Planning Agreement.
BACKGROUND: The respective staffs have researched and worked on the attached resolution in
some form for over a year. Both the Orange County Manager and the Durham County Manager
have been involved in the process. Orange County Economic Development Director Dianne Reid
and County Engineer Paul Thames have also contributed in this effort. This is part of a larger
planning program that will at first include:
1. Courtesy Review (See Attachment 1),
And eventually:
2. Annexation Agreement
3. Cooperative Planning Agreement.
This agreement is consistent with the Orange County/City of Durham/Chapel Hill Work Group
Resolution of Cooperation (See attachment 2). It is also, similar to an agreement that City of
Durham, County of Durham and Chapel Hill have been working on in their mutual interest area.
The agreement is ready for discussion by the BOCC.
The Durham Joint City-County Planning Committee will review the agreement in July to make its
recommendation to the Durham City Council in September.
FINANCIAL IMPACT: The financial impact associated with this decision will be additional staff
review time.
RECOMMENDATION(S): The Manager recommends that the Board receive the report, offer
comments and send forward for adoption at a future meetina_

A RESOLUTION ESTABLISHING THE INTENT OF DURHAM COUNTY,
DURHAM CITY, AND ORANGE COUNTY TO COOPERATE WITH
REGARD TO PLANNING DECISIONS IN CERTAIN DEFINED AREAS
WHEREAS, the governing bodies of Durham County, NC; the City of Durham, NC; and Orange
County, NC desire to foster good relations; and
WHEREAS, all three governing bodies and their staffs wish to engage in a process of mutual
dialogue to obtain a better understanding of the needs and goals of each community; and
WHEREAS, all three governing bodies seek to have appropriately planned development for
their respective areas;
WHEREAS, all three governing bodies currently carry out established public review processes
on planning activities that provide an opportunity for public review and comment from citizens
as well as from other jurisdictions; and
WHEREAS, all three governing bodies acknowledge the urbanization potential of properties
near the Orange/Durham County line in the vicinity of I-85/US70 and consequently the need to
coordinate land use and transportation, development, and service delivery issues that arise in this
general vicinity; and
WHEREAS, cooperation amongst neighboring jurisdictions will foster and maintain a system of
sound land use planning and regulation which can be relied upon by the public and private
owners of land as a basis for investment decisions, the protection of the environment, and a
climate conducive to the healthy economic and social growth and development of the three
jurisdictions;
NOW, THEREFORE BE IT RESOLVED that
1) The administrative staffs of each jurisdiction shall coordinate with each other on a
timely basis within the current framework and schedule of the local development
review process in order to provide an opportunity for review and comment on
rezoning requests, special use permits, subdivisions, site plans, and annexations
proposed for land within the Joint Review Area, near the Orange/Durham County
line, as shown in Attachment A.
2) A. The administrative staffs of each jurisdiction shall pursue cooperative efforts to:
1. coordinate future land use plans and develop comparable zoning districts with
design standards to implement the general intent of the land use plans;
2. provide an opportunity for review and comment on a timely basis and within
the established project schedules for land within the Joint Review Area, near
the Orange/Durham County line, as shown in Attachment A;
3. create a conceptual utility master plan for the Orange County portion of the
Joint Review Area; and

4. provide enhanced annexation notification procedures when the city annexes
into Orange County.
2) B. The objectives of this cooperation are to:
1. Seek compatible uses of land and natural resources;
2. Achieve a smooth transition between areas of development within each
jurisdiction;
3. Provide an appropriate entryway into each jurisdiction from the other; and
4. Encourage orderly development and the efficient delivery of urban services,
which will maintain and enhance property values in each jurisdiction.
3) This resolution shall be effective upon its adoption by all of the above jurisdictions;
4) Any signatory jurisdiction may rescind their agreement with this resolution by
subsequent resolution of its governing Board.

RESOLUTION OF COOPERATION
A resolution of cooperation between the City of Durham North Carolina, the
Durham County, North Carolina, the Town of Chapel Hill, North Carolina, and
Orange County, North Carolina relating to land use planning along and near
jurisdictional boundaries.
WHEREAS, all four governing bodies seek to have appropriately planned development for their
respective areas; and
WHEREAS, Durham County, the City of Durham, the Town of Chapel Hill, and Orange County
desire to foster good relations; and
WHEREAS, officials from all four jurisdictions have met jointly to discuss their' mutual
concerns;
NOW, THEREFORE, BE IT RESOLVED that, in order to foster and maintain a system of
sound land use planning and regulations which can be relied upon by the public and private
owners of land as a basis for investment decisions, the protection of the environment and a
climate conducive to healthy economic and social growth and development of our four
jurisdictions, by mutual consent it is agreed by the governing bodies of the City of Durham, the
County of Durham, the Town of Chapel Hill, and Orange County that:
(1) A Durham/Chapel HilUOrange County Work Group will be established,
made up of two representatives from each of the four elected bodies of Durham City,
Durham County, Chapel Hill and Orange County, along with one representative from each
jurisdiction's Planning Board. This Work Group will meet at regular intervals to discuss
issues of common concern to the four jurisdictions, and to serve as a mechanism for
exchange of information between the elected boards. The location of the Work Group
meetings will alternate between Durham City and County, Chapel :Hill and Orange
County, with a representative of the host community chairing the
rou ~•
(2) The role, purpose, and function of the Work Group will be to enhance
coordination and consultation among the governments. This will not be adecision-making
body, and no votes will be taken.
(3) The group's objectives are to cooperatively
a. Seek compatible uses of land and natural resources:

jurisdiction
c. Provide appropriate entryway into each Jurisdiction from the other and
d. Encourage orderly development an d the efficient delivery of urban services which
will maintain and enhance property values in each Jurisdiction
(4) The list of issues to be discussed by this Work Group shall include but not be limited to
the list that appears as Attachment 1 to this resolution, as reviewed and revised from
time to time bye ~overnin~ bodies.
(5) The administrative staffs of the jurisdictions
a. shall report to their respective Boards, on a timely basis, information concerning
develpoments in their areas of mutual interest, as defined in (b) below. as well as
information concerning other activities of the work groin
b. shall mutually exchange and review zoning requests, special use permits,
subdivisions, site plans or annexations requested for land fronting on any of the corridors
and within areas of mutual interest.
(6) The administrative staffs of each jurisdiction shall pursue cooperative efforts to
coordinate plans for improvements to the public rights-of--way in the corridors or areas of
mutual interest. Such plans shall include streetscape plans, landscaping projects, sign
regulations unique to the corridor or roadway construction or any development
regulations specifically designed for the comdor or area of mutual interest.
(7) The administrative staffs of each jurisdiction shall pursue cooperative efforts to
coordinate long range land use plans.
