BACKGROUND: The Hillsborough Board of Adjustment reviews non-residential building projects, variance requests, and appeals. The Board of County Commissioners appoints two (2) regular members and one (1) alternate member who are all residents of the Hillsborough Extraterritorial Jurisdiction (ETJ). North Carolina General Statute (N.C.G.S.) § 160D-307 indicates that in the event there are "an insufficient number of qualified residents of the extraterritorial area to meet membership requirements, the Board of County Commissioners may appoint as many other residents of the county as necessary to make up the requisite number". N.C.G.S. § 160D-307 also states "If a board of county commissioners fails to make these appointments within 90 days after receiving a resolution from the city council requesting that they be made, the city council may make them". The Hillsborough Board of Commissioners has recommended a non-ETJ county resident in accordance with the referenced statute. RECOMMENDATION(S): The Manager recommends that the Board discuss and approve an appointment to the Hillsborough Board of Adjustment. 3 1Sg0RO(i RESOLUTION 0 1 - - +541% Requesting an Appointment to an Extraterritorial Jurisdiction Seat on the y c Ate°` Hillsborough Board of Adjustment WHEREAS, as a result of an upcoming vacancy, it is necessary to appoint a person to a regular member seat reserved on the Hillsborough Board of Adjustment for persons residing within the town's ETJ (Extraterritorial Jurisdiction); and WHEREAS, a currently appointed Board of Adjustment ETJ alternate member whose first full term on the Board expires June 30, 2026, has expressed interest in serving as a regular member; and WHEREAS, if a resident of the ETJ cannot be identified to fill the position, the Orange County Board of Commissioners may appoint a resident of the county; and WHEREAS, as of the date of this resolution, no person residing within the ETJ has applied to serve on the Board of Adjustment; and WHEREAS, by state statute and town ordinance, the Orange County Board of Commissioners initially has the authority and responsibility to appoint ETJ members to the town's board of adjustment. NOW, THEREFORE, be it resolved by the Hillsborough Board of Commissioners: Section 1. The Orange County Board of Commissioners is respectfully requested to appoint the following individual to an ETJ regular member seat on the Hillsborough Board of Adjustment for a three- year term: Mr. Carl Edward (Eddie) Sain 1010 US 70-A East Hillsborough, NC 27278 Section 2. The Orange County Board of Commissioners is respectfully requested to appoint Mr. Sain for a three-year term ending June 30, 2029. Section 3. If the Orange County Board of Commissioners fails to appoint persons willing to serve in the capacity described above within 90 days of receiving this resolution, the Hillsborough Board of Commissioners may make this appointment. Section 3. The town clerk shall send a copy of this resolution to the Orange County Manager. Section 4.
