Construction Contract Jamael Wiley, Transit Planning and 2. Proposal Operations Manager, 919-245-2006 Jovana Amaro, 919.245.2651 Angel Barnes, 919.245.2628 PURPOSE: To: 1) Approve the County entering into a construction contract with Stelco Electric LLC for the installation of Electric Vehicle Charging Stations (EVCS) at the Orange Transportation Services Facility; and 2) Authorize the County Manager to execute the Agreement, subject to final review by the County Attorney, and any subsequent amendments for contingent and unforeseen requirements up to the approved budget amount on behalf of the Board. BACKGROUND: Orange County Public Transportation (OCPT) issued a solicitation for the Electric Vehicle Charging Station (EVCS) Installation Project located at the Orange Transportation Services facility to support the County's transition to zero-emission transit vehicles and to provide the necessary charging infrastructure at the Transit Operations Facility. The project is funded through a combination of Federal Transit Administration (FTA) discretionary funds administered by the North Carolina Department of Transportation (NCDOT) Integrated Mobility Division (IMD), along with required local match funds. The project entails the turnkey construction of three (3) direct current fast charging (DCFC) stations for commercial charging, with integrated infrastructure for future expansion. The scope of work includes installing a new dedicated transformer, a utility power meter, and a primary distribution power panel to safely manage high-voltage electrical demand, and two (2) power units to distribute power to each charging station. Additionally, the contractor will handle all required underground trenching and conduit routing, install properly rated high-capacity wiring, and anchor the power modules and direct current fast charging stations. Finally, the contractor will manage network integration, safety testing, and final code inspections to deliver a fully operational, scalable, and code-compliant rapid-charging system. Staff received four (4) responses and evaluated the submittals in accordance with County procurement policies and applicable FTA and NCDOT requirements under Request for Proposal (RFP) #367-005477. 2 The initial bids received exceeded the approved budget. According to North Carolina General Statute § 143-129(b), staff had the option to negotiate with the lowest responsive and responsible bidder. This negotiation involved making reasonable changes to the plans and specifications to align the contract price with the available funds. As a result, Orange County staff negotiated a $705,000 contract with Stelco Electric, LLC. The adjustments included reducing the number of electric vehicle charging stations from 5 to 3 and shortening the warranty period from 5 to 3 years. This project is funded by the NC Department of Transportation (NCDOT) FTA_2019_5339b Discretionary Award to purchase five (5) electric buses and provide charging stations. The project totals $1,600,000, including the 20% local match of $320,000, and was approved by the Board with budget amendments at the October 20, 2020, and December 10, 2024, Business meetings. The grant period ends on December 31, 2026. The five (5) electric buses have already been procured and are currently in use. FINANCIAL IMPACT: The Construction Agreement fee for the installation of the Electric Vehicle Charging Stations at the Orange Transportation Services Facility is $705,000. These funds are currently budgeted within the County Capital Fund. ALIGNMENT WITH STRATEGIC PLAN: This item supports: • GOAL 1: ENVIRONMENTAL PROTECTION AND CLIMATE ACTION OBJECTIVE 1: Identify the priorities and resources necessary to implement the Climate Action Plan. OBJECTIVE 2. Invest in our infrastructure to reduce the environmental impact of the County fleet/facilities and improve safety. RECOMMENDATION(S): The Manager recommends that the Board: 1) Approve the County entering into a construction contract with Stelco Electric, LLC., for the installation of Electric Vehicle Charging Stations (EVCS) at the Orange Transportation Services Facility; and 2) Authorize the County Manager to execute the Agreement, subject to final review by the County Attorney, and any subsequent amendments for contingent and unforeseen requirements up to the approved budget amount on behalf of the Board. 3 [Departmental Use Only] TITLE OPT EVCS FY 2025-2026 RFP5477 NORTH CAROLINA CONSTRUCTION AGREEMENT OVER $250,000.00 ORANGE COUNTY THIS CONSTRUCTION AGREEMENT (hereinafter called "Agreement"), made as of the 3rd day of June, 2026, by and between Stelco Electric, LLC, (hereinafter called the "Contractor"), and Orange County, a political subdivision of the State of North Carolina, (hereinafter called the "County," "Orange County," or "Owner").
