PURPOSE: To receive authorization to submit the Quarterly Public Hearing Legal
Advertisement for publication for the August 26, 2002 public hearing.
BACKGROUND: The next regular quarterly public hearing is scheduled for August 26, 2002.
A summary of each item proposed for public hearing is provided. Staff is available to research
and answer questions prior to the public hearing. In order to meet publication dates, the legal
advertisement will need to be sent to the newspapers no later than August 9. Any changes to
the ad will need to occur before that date.
Text related to the items proposed for public hearing is under preparation, but will not be
completed in time for review on June 27. Staff will forward this to the BOCC around August 1
via a manager's memo. Any minor comments can be noted or included in the legal
advertisement prior to August 8.

A. ORANGE COUNTY ZONING ORDINANCE TEXT AMENDMENTS
Amend Article 8 (Special Uses), Section 8.8.17a (Telecommunication Towers), of the
Zoning Ordinance to incorporate changes in the regulations relating to, and the review
process of, applications for telecommunication towers within Orange County's planning
jurisdiction.
Purpose: To provide for more stringent regulations and guidelines for the siting of
telecommunication tower facilities. Changes generally include:
a. Annual (one-time-per year) review of tower applications
b. Stronger co-locational requirements

c. Ongoing, annual inspections by County to verify that towers remain in compliance
with regulations
d. Provision of a "Master Telecommunications Plan"
e. Class A/Class B threshold height requirements
f. Other processing and special use guidelines
In tandem, these changes would also provide, through the fee structure, for an outside
consultant to review and provide technical expertise, as well as technical
recommendations, on submitted applications.
A moratorium on the processing of new telecommunication tower applications was
imposed in March of 2002. The County Planning Staff has conducted meetings in
coordination with other County departments, appointed boards, industry representatives,
and other stakeholders, related to the proposed amendments. The moratorium will expire
in early September 2002.
A second public hearing will be convened following discussion of the above item to consider a
County response to proposed text amendments in the Carrboro Land Use Ordinance specific to
the Northern Transition Study Area pursuant to the Joint Planning Agreement (JPA)guidelines.
FINANCIAL IMPACT: There is no financial impact associated with this decision.
Advertisement costs are included in the departmental budget for County initiated items.
RECOMMENDATION(S): The Administration recommends approval of the proposed August
26, 2002 Quarterly Public Hearing legal advertisement.

NOTICE OF PUBLIC HEARING
ORANGE COUNTY BOARD OF COMMISSIONERS
A public hearing will be held in the Judge F. Gordon Battle Superior Courtroom of the
New Orange County Courthouse, 106 E. Margaret Lane, Hillsborough, North Carolina, on
Monday, August 26, 2002, at 7:30 PM for the purpose of giving all interested citizens an
opportunity to speak for or against the following items:

and discussion at the hearing.

changes may be obtained after August 19, 2002 from the Planning Department.
