Evidence submitted by the appellant:
• The appellant is requesting a reduction in value based on an independent fee appraisal as of
January 1, 2025,with an indicated value of$3,550,000 from the sales comparison approach,
$3,700,000 from the income approach and a reconciled value of$3,650,000.
Evidence submitted by the county representative:
• The appellant has submitted an appraisal into evidence. Generally speaking,the report aligns
with the County's schedule of values and is considered reasonable evidence. However, there
are three key points that seem to create a greater difference in the County assessment and the
owner's estimate of value than might otherwise exist.
1.) The appraisal downplays the retail component of the property,which includes long-term
tenants such as Subway. There is over 24%retail in this building,which has lower vacancy
rates and capitalization rates than office spaces enjoy. CoStar Market Reports show that near
end 2024 vacancy sat at 1.3%in Orange County. There was very little new construction and
asking rates were on the rise.
2.) It doesn't give enough credit to the walkable location,which is considered very desirable
for office space. It is considered one of the main amenities that separates desirable from
undesirable office locations.
3.) The property has some medical (dental) space. Medical office buildings (MOBS)greatly
outperform typical office in terms of vacancy, rents and capitalization rates.
• The attached income approach uses the same income as the appraisal but adjusts the vacancy
from 10%to 7%to better reflect the medical and retail nature of this walkable building.
Expenses are similar. Comparables for the extraction of the capitalization rate are also
provided.
• The indicated value from the income approach is$3,757,583. As a result,the County
recommends increasing the economic depreciation of the buildings from 35%to 49%for a
revised value of$3,751,200.

1.)Vacancy and Collection loss at 8%seems to be too high. Retail vacancy in Orange County
was less than 2%at the end of 2024.
2.) The expenses are high, and the appraiser does not present support for why this simple
property runs higher expenses than everything else.
• The County has prepared an income approach that uses a more typical vacancy estimate and
more typical expenses for retail. The suggested valuation from the County's income approach
is $1,875,824. As a result,the County recommends applying 5% economic depreciation to the
subject for a revised assessed value of$1,863,200.

• The appellant has submitted an appraisal into evidence. Generally speaking,the document

2.) It doesn't give enough credit to the walkable location,which is considered very desirable

3.) The property has a large amount of medical office space. UNC Medical is a significant
tenant. Medical office buildings(MOBS)greatly outperform typical office in terms of
vacancy, rents and capitalization rates. Per CBRE,the leading global commercial real estate
firm, on a national basis 2024 vacancy was 5% lower for MOB than conventional office, rents
were higher and capitalization were at least 0.5%lower. A sheet of local capitalization rates is
included by the County with 205 Sage Road and 930 Martin Luther King, Jr. Boulevard being
worthy of special interest.
• The County income approach utilizes the same income as the appraisal but adjusts the vacancy
from 10%to 5%to better reflect the medical and retail nature of this walkable building.
Expenses are similar. The capitalization rate is adjusted to 7%from 7.5%to acknowledge the
property's strengths with an indicated value of$9,885,181. As a result,the County
recommends changing the land's market adjustment from -50%to -55%and increasing the
economic depreciation from 12%to 18% on the building. This would result in a revised value
of$9,877,200.

• These apartments are located behind(and North of)Merritt's Store in a student area of Chapel
Hill,walkable to the Dental and Medical Schools. This is an extremely good location for
apartments as evidenced by the ongoing construction of a student project nearby.
• The owner has suggested a"tear-down"level assessed value of$74,900 per unit. The County
has an assessment of$116,574, which is very conservative even for an older property in this
very good location. Similar sales are attached,but only one is below the subject property on a
price per unit basis. The nearby sale on Dawes was also older with few updates and sold for
$160,000 per unit. If anything,the property appears undervalued.
• The County was not provided with any income and expense information on this property to
compare with known market data for similar properties. However, a market data income
approach would look like below,which supports the current value.

square foot day care. The property has a very good infill Chapel Hill location on the bus line
and is easy to access from 15-501 and Highway 54. On the downside, it is older and very close
to the road. Infill daycares with older construction are rare but typically sell for more than
$200 per square foot. Attached is a list of sales of older daycares in good locations within the
Triangle area. These sales support the assessment as the subject's value per square foot is well
within range indicated by the sales. Also,the subject's 2001 effective year built and 52%total
accrued depreciation is felt to accurately reflect the condition of the structure. As a result,no
change in value is recommended.

to the current$3,267,200. The value of the 22,214 square foot building was reduced from
$1,195,000 to $254,200 or$11.44 a square foot and the current assessment is supported by
land values alone. It is very important to note that many properties, such as the recently built
midrise apartments next door, are built on flood plain land. No further reductions are
supported because, despite the unfortunate issues with flooding, the property is marketable for
redevelopment.

Evidence submitted by the appellant:
• I am writing to respectfully appeal the 2025 assessed tax value of my property located at 420
Hillsborough Street in Chapel Hill.
• This building has remained vacant since 6/l/2024 following the departure of a prior tenant(a
fraternity organization)that severely damaged the property. The extent of the interior
destruction rendered the building uninhabitable, and I have since been working at great
personal and financial cost to make repairs. Unfortunately,the restoration process has taken far
longer than expected, and is still ongoing.
• In addition to the physical damage,I am currently pursuing legal action against the former
tenant for negligence and breach of contract. During this entire period,the building has been
completely non-operational, generating no rental income, while still incurring significant
carrying costs such as monthly mortgage,higher interest payments due to non-tenant income,
insurance, maintenance and utilities.
• The recent reassessment nearly doubled my property tax, at a time when the building is
unusable through no fault of my own. Given the unique circumstances, I respectfully request
temporary tax relief for the 2025 tax year. I would be grateful for the opportunity to provide
any supporting documentation that may assist in reviewing this request.
• I've made every effort to responsibly maintain this property, even through hardship. I hope the
Board can take into consideration the exceptional circumstances and offer temporary relief
based on the actual usability and income potential of the property at this time.

Evidence submitted by the county representative:
• The owner has provided many pictures that demonstrate significant differed maintenance.
They have provided a breakdown of 2024 costs in excess of$200,000 as well as a list of items
that still need to be addressed,but there is no documentation for what these items will cost to
correct. It's likely that some of this deferred maintenance existed when the property was
purchased In July 2021 for$2,600,000. However,based on the submitted photo evidence,
some adjustment to value is warranted for the condition of the building, despite a documented
construction estimate to detail the expenses to get the property back to a workable state,
• The County recommends reducing the 2000 effective year built of the building and paving to
their actual year built of 1990 and applying additional 10%depreciation to the building. These
recommended changes would reduce the current value to $1,919,200.

9851081354 is $26,902 acre. This appraisal is inexplicably higher than the adjoining property

6ARTHMNS neighborhood for the previous valuation period. We request that the appraised

o Upon researching the assessment history of the subject lot,it is noted the lot has had a
-85%land influence factor since 2005. This is due to the parcel being unbuildable due
