PURPOSE: To enter into a contract with OCR, Inc. to provide EMS coverage at events and
races.
BACKGROUND: The County has contracted with the Raceway in the past to provide and
ensure adequate Emergency Medical coverage at the racing events. This is essentially the
same agreement as in past race seasons, except for three specific modifications: (1) The fees
were increased to reflect the increased cost of providing the service and achieve full cost
recovery, (2) an option for partial privatization of medical services with County oversight was
included, and (3) specific timeframes for invoicing and payment of fees are explicitly defined.
There are approximately 20 race events scheduled this season that require coverage. The
coverage will consist of two ambulances, one County paramedic, and four basic Emergency
Medical Technicians (EMT) from either Orange EMS & Rescue Squad or a franchised private
provider.
The fees charged for this coverage are based on full cost recovery, including overtime rates for
EMT and Paramedic personnel plus equipment and indirect cost. The charges were increased
this year to $60 per hour for a Paramedic with equipment, $70 per hour for an ambulance with
two EMTs, and $24 per hour for each additional EMT. Fees are charged from the time the unit
and crew depart from the Emergency Management facility until the crew and unit return to that
facility, usually one hour more than the actual time on the scene at the event.
FINANCIAL IMPACT: The hourly fees charged offset the direct and indirect costs to the
County for personnel, vehicle(s), and equipment used in providing this coverage.
RECOMMENDATION(S): The Manager recommends that the Board approve the contract and
authorize the Chair to sign the contract.

This Contract dated Maxch 14, 2003, between OCR, Inc. (the "Speedway") and
the County of Orange (the "County") for joint and cooperative arrangements for the
provision of emergency medical services at certain Speedway events.
WITNESSETH
WHEREAS, the County and the Speedway propose to work jointly on matters of
concern or interest; and
WT~EREAS, certain events at the Speedway bring spectators to Orange County
to enjoy the events; and
WHEREAS, the provision of adequate emergency medical care at such events is
a matter of mutual concern and interest to the Speedway and the County; and
WHEREAS, detailed joint and cooperative arrangements with respect to such
events will mutually benefit the Speedway and the County; and
wHEXtEAS, the County and the Speedway desire to provide such cooperative
emergency medical Gaze;
NOW THEREFO~2.E, in consideration of the premises and the mutual covenants
and conditions set forth below, the County and the Speedway agree as follows:
The County agrees to provide emergency care providers certified at the
Emergency Medical Technician and/or Paramedic level for events at the Speedway
as outlined in the Orange County Speedway 2003 Schedule. (Attachment A)

2. The County agrees to provide two ambulances, one (1) paramedic with
equipment, and four (4) Emergency Medical Techzucians for scheduled spectator events.
Additional coverage will be negotiated at the time of need. The County agrees to provide
(1) paramedic with equipment for oversight of private EMS resources hired by the
Speedway to provide coverage at Speedway events in lieu of County EMS.
3. The County agrees tv keep records of patients seen at the Speedway while
coveting Speedway events under this contract and, with the consent of~the patient, to
provide such records to the Speedway, upon its request. Data available to the County
from the records of patients seen at the Speedway which is clearly not patient identifying
may be provided to the Speedway, upon request of the Speedway anal when appropriate.
4. The Speedway shall compensate the County for emergency medical services
provided pursuant to this contract by paying to the County a sum based on a rate of
$60.00 per hour per paramedic, $70.00 per hour per ambulance, and $24.00 per hour per
each additional EMT (above the two included with each ambulance) for each event
covered. These hours will include preparation and travel time of one (1) hour for each
event plus the coverage time per event. The county shall submit an invoice for these
events within 14 calendar days of the event and payment by the Speedway shall be made
within 14 calendar days of the invoice date to the order of the County and mailed to
Orange County Emergency Management , P. O. Box 8181, Hillsborough, N. C. 27278.
S. The personnel providing the emergency medical services shall report to the
Speedway at the time agreed upon by the Speedway and the County.
6. The contxact may be reviewed annually no later than January 1, and maybe
renewed, modified, or amended at that time, or at any other tune, upon the xrautual
written agreement of the parties.
7. This contract may be terminated at any time by either party by giving 90 days
ztotice to the other parry in writing.
8. If either party defaults in its obligations iztcluding remitting timely payments and
does not cure such default within ten (10) days of receipt of notice of such default, the
non,defaulting party may immediately terminate the contract.
IN WITNESS WHEREOF, the parties hereto have duly and validly authorized
and executed this contract as of this day of , 2003.
