Home My WebLink About2025-691-E-Child Support-Orange County Attorney-Legal Services 1 CHILD SUPPORT ENFORCEMENT LEGAL SERVICES MEMORANDUM OF AGREEMENT This Memorandum of Agreement (“Agreement”) is entered into this 13th day of November, 2025, by and between the Orange County Child Support Services Department (“CSS”) and the office of the Orange County Attorney (“Legal”) (referred to collectively as the “Parties”). WHEREAS, CSS is mandated to collect child support payments and establish, modify, and enforce child support payment judicial orders; and WHEREAS, Legal is a department of Orange County Government organized by and reporting to the Orange County Board of Commissioners; and WHEREAS, the Parties desire to enter into this Agreement in order to establish the mutually agreed upon conditions upon which Legal will provide certain services to CSS in connection with child support enforcemen t. NOW, THEREFORE, the Parties to this Agreement hereby agree as follows: 1. Legal will provide consultation, legal advice, and representation as requested by CSS on legal matters arising from the duties of CSS under Article 9 of Chapter 110 of the North Carolina General Statutes, Title IV-D of the Social Security Act, and the federal regulations lawfully promulgated pursuant thereto. 2. Legal will appear in court and represent CSS as needed. If an attorney other than the assigned IV-D attorney will be representing CSS, Legal will notify CSS in writing as soon as reasonably possible. If Legal has a conflict of interest under the Rules of Professional Conduct governing attorneys Legal shall notify CSS within ten (10) days of discovering the existence of the conflict. 3. Legal will comply with all applicable laws, rules, and regulations, and more specifically with the requirements of Article 9 of Chapter 110 of the North Carolina General Statutes, Title IV-D of the Social Security Act, and the regulations promulgated pursuant thereto relating to the performance of the legal services including, but not limited to, maintaining such records as are required by CSS, to assist with reports for federal or state audit, if required, and to assist with progress reports as may be needed. 4. Legal will maintain accurate records of time spent on work provided under this Agreement and shall invoice CSS for each month’s work by the 5th day of the following month. 5. For the services under this Agreement, CSS agrees to pay Legal Ninety-One Dollars and Ninety-Nine Cents (91.99) per hour for each hour spent providing legal services to CSS. The payments shall encompass all expenses, including Docusign Envelope ID: 3ED8D2CA-0921-45B2-901C-020895D5E363 2 but not limited to, those for salary, benefits, office space, heating and maintenance for office space, telephone service, long -distance telephone calls, technology, copying, and any other itemized costs directly attributable to the legal services provided herein. 6. For any administrative attorney services, defined as activities engaged in by an attorney, which are outside the realm of legal services as detailed in the preceding paragraph, including but not limited to training, conferences, and seminars, and professional meetings, CSS will reimburse Legal at a rate of up to $55.00 per hour, which rate will not exceed $440 per day, inclusive of registration fees. 7. CSS is responsible for all court costs and filing fees that are required to be paid in conjunction with the legal services provided by Legal under this Agreement.
