NCDOT Petition Information for Road Deletion Pat Mallett, 919-245-2577 Jack Moran, 919-245-2571 Cy Stober, 919-245-2585 PURPOSE: To make a recommendation to the North Carolina Department of Transportation (NCDOT) and the North Carolina Board of Transportation (NC BOT) concerning a petition to add Sehon Circle and Lucia Lane to the State Maintained Secondary Road system and remove a portion of Tinnin Road (SR 1313) from that same State system. These roads are located with the Tinnin Woods Subdivision in Orange County’s jurisdiction. BACKGROUND: This request includes an NCDOT petition for two (2) road additions to the State Maintained Secondary Road System. The road lengths and widths are as follows: Road Name Length in Miles Number of Frontage Lots with Houses Pavement and Right-of-Way Widths in Feet Sehon Circle 0.05 9 22-ft pavement, 50-ft Right-of-Way Lucia Lane 0.05 7 22-ft pavement, 50-ft Right-of Way Total 16 The petition also includes a NCDOT petition for one (1) partial deletion from the State Maintained Secondary Road System. The road length and width are as follows: Road Name Length in Miles Number of Frontage Lots with Houses Pavement and Right-of-Way Widths in Feet Tinnin Road SR1313 (abandoned and removed) 0.06 1 N/A (Private Driveway) Tinnin Road SR1313 (retained) 0.04 1 22-ft pavement, 50-ft Right-of-Way Total 1 1 The Tinnin Woods Subdivision is located in Orange County along School House Road (SR 1314), Fuller Road (SR 1315) and Tinnin Road (SR1313), and located north of US Highway 70 West (Attachments 1 and 2). This single-family residential subdivision is within Orange County’s Planning Jurisdiction. Per North Carolina General Statutes §136-62, the Board of County Commissioners (BOCC) is the appropriate governing body to approve the road addition and deletion requests associated with the subdivision. There are no known violations associated with the subdivision. The Tinnin Woods Subdivision was recorded on September 22, 2014 (Plat Book 113 Pages 100- 101) (Attachment 3). Sehon Circle and Lucia Lane were intended, designed, and constructed to become public roads. The required conditions have now been met for NCDOT maintenance responsibility and ownership criteria, as reflected on the recorded plat. A portion at the end of Tinnin Road does not meet those criteria and has been deemed unnecessary for retention in the State maintenance system (Attachment 5). NCDOT has investigated this request and has submitted a petition to the BOCC for its recommendation (Attachments 4 and 5). North Carolina General Statutes §136-62 and §136- 102.6 require that road petitions for additions and deletions to the state system be made by the governing body (i.e. Orange County). Conclusion: The above-referenced application meets the criteria endorsed by the BOCC for recommending acceptance of public roads into the State Maintained System for roads approved through the governing jurisdiction’s subdivision process (NCDOT Subdivision Roads Minimum Construction Standards, January 2010, revised July 2020). FINANCIAL IMPACT: There is no direct financial impact to the County associated with this item. NCDOT will incur additional maintenance responsibilities and costs. RECOMMENDATION(S): The Manager recommends that the Board: 1. Forward the petition for addition to the State Maintained System to the NCDOT for Sehon Circle and Lucia Lane; 2. Forward the petition for deletion from the State Maintained System to NCDOT for a portion of Tinnin Road; and 3.
