PURPOSE: To consider awarding a bid for construction of recycling facilities at the Orange
County Landfill.
BACKGROUND: On December 11, 2001, the Board adopted the Regulated Recyclable
Materials Ordinance (RRMO). That action represented the culmination of the vision of the
BOCC-appointed Construction and Demolition (C&D) Recycling Task Force that met from late
1999 through mid-2000 and presented its report and recommendations to the BOCC in August
2000. The ordinance and its related personnel, equipment and facilities have been the subject
of several discussions by the Board.
The adoption of the RRMO necessitates the acquisition of equipment to manage and haul the
materials to market, new personnel to operate the equipment, to inspect the incoming loads for
compliance, for education and enforcement, and to issue permits and licenses. The ordinance
also necessitates the construction of C&D recycling facilities at the landfill, which were included
in the Facilities Master Plan adopted by the Board on October 1, 2001. On June 11, 2002, the
Board authorized the creation of three new positions and authorized the purchase of five major
pieces of equipment (a Road Tractor was not included and must be rebid due to the vendor
withdrawing the bid).
The necessary facilities include:
• Construction of a covered cardboard/drywall receiving/loading station
• Construction of a scrap metal/white goods receiving/loading station
• Shifting the existing yard waste/mulching area to the north and incorporating a clean wood
waste recycling area, and construction of a four bay mulch/compost storage bunker

• Construction of an electronics storage building (combined with the C&D recycling
construction project for reasons of economy)
Eight general contractors contacted the County for plans for this project and attended the pre-
bid conference on June 3, 2002. The bid opening was scheduled for 3:00 PM June 10, 2002,
however,,only two responses were received. Pursuant to State bidding laws, which require a
minimum of three bids for the first solicitation, the bids were not opened on June 10, 2002. The
project was re-advertised and a new bid opening was scheduled for June 20, 2002. Three
bidders responded, with Van Thomas Contractor, Inc., Siler City, NC submitting the lowest bid
that was responsive in an amount of$607,648.70. Since this amount exceeded the funding
identified by the Landfill staff for this project, the bid was negotiated downward with the low
bidder. Through a variety of deletions and/or modifications, the bid price was reduced by
$132,648.70 to $475,000. A summary of the changes as submitted by Landfill staff is attached.
FINANCIAL IMPACT: Funds for facilities construction are available in the Solid Waste
enterprise fund. No General Fund money will be utilized-for this project. An additional
$23,750 (5%) will be appropriated as a project contingency. Staff proposes to budget funding
for this project by adding a resulting total of$498,750 to the amount included in the Manager's
Recommended Budget for the Solid Waste Management Department in the FY 2002-03 budget
ordinance, which is scheduled for adoption by the Board elsewhere on this June 27, 2002
meeting agenda.
RECOMMENDATION(S): The Manager recommends that the Board:
1) award the bid for the solid waste recycling facilities to Van Thomas Contracting, Inc., Siler
City, NC in the amount of$475,000, contingent upon approval of the 2002-2003 Solid
Waste Management Enterprise Fund budget;
2) authorize the Chair to sign a contract, contingent upon attorney and staff review; and
3) authorize the Manager to approve change orders within total available project funding of
$498,750.
