PURPOSE:
To declare items on the attached list as surplus (including three vehicles far the Wheels for
Work Program); and
To adopt a resolution authorizing the Director of Purchasing and Central Services to conduct
an auction of those personal property items declared surplus or confiscated, said auction to
be held on Saturday, July 31, 2004 at the Public works Department, Highway 86,
Hillsborough; and
To authorize the transfer of three vehicles to the Wheels for Wark Program; and
To approve the continued reallocation of certain surplus personal computers to non-profit
organizations meeting criteria as set out below.
BACKGROUND: General Statute 160A-270(b) stipulates the procedure for disposing of
surplus personal property. Actions requested herein are pursuant to that statute.
Phillip Walker Auction Service of Hillsborough, North Carolina has agreed to conduct the sale
for a fee of 5%,
Pursuant to statute, a notice of the Auction will be published in the newspaper thirty days prior
to the date of the sale. In addition to the legally required advertisement, the sale will be
publicized as follows:
General advertisement in the Durham, Chapel Hill and Hillsborough newspapers.
Advertisements will appear in the Sunday paper one week prior to the sale and will provide a
complete listing of items. A reminder ad will appear in the Durham and Chapel Hill
Newspapers on Friday, .July 30, 2004 and Saturday July 31, 2004; and
• Information will be included on the County's web-site; and
• The auctioneer will circulate the handbills in a manner that would provide the best coverage;
and
• Copies of the handbill will also be mailed to persons who have requested copies,
In August of 2000, the BOCC approved reallocating functioning personal computers to certain
agencies, This program has been successful with over 140 computers reassigned. The criteria
for selecting these agencies has included:
• Recipient agency receives funds from the County;
• Recipient agency must have 501-C(3) status;
• Recipient must state intended purpose of the computer(s) so that evaluators can
determine software compatibility with the units intended for transfer;
• Equipment must be used directly for programs of the recipient agency for no less than
one year following transfer;
• Additional criteria as the Board may think appropriate.
The County would continue to notify both School Districts regarding the availability of surplus
computers before they are made available for reallocation to non-profit agencies. Non-profits
are notified that computers are available from the County through email notification and
response to individual organizations' inquiries. Computer availability information is also
provided for non-profits on the County's web site..
Eighty-five dumpsters are among the items declared surplus this year, Solid Waste has agreed
to crush the dumpsters and transport them to a metal recycler. The estimated revenue from
this is $2,200 and it eliminates the chance these bulky dumpsters would become an eyesore in
the community.
In a separate and unrelated issue, the County Manager's Office has also notified non-profit
tenants at the Northern Human Services Center in Gedar Grove of the need to remove by June
30 any of their belongings they may have unused or in storage at that facility, Any items that
remain past June 30 will not belong to the County, will not be included or considered as surplus
by the County, and will be recycled or disposed as appropriate,
FINANCIAL IMPACT: Assuming the Baard's continued support of the computer reallocation
program to non-profit agencies, staff would anticipate reduced revenue from the auction of
approximately $2,000, Auction proceeds have been historically in the range of $25,000--
$30,000, The estimated revenue from recycling the metal dumpsters is $2,200.
Funds for the sale of abandoned and confiscated property will be evenly divided between the
two school systems after deducting for expenses, as provided in the North Carolina Statutes,
RECOMMENDATION(S): The Manager recommends that the Board:
• Declare items surplus (including three vehicles far the Wheel for Work Program); and
• Authorize the transfer of three vehicles to the Wheels for Work Program; and
• Approve recycling the metal dumpsters as scrap; and
• Approve the continued reallocation of certain surplus personal computers to non-profit
organizations meeting the criteria as set out in this abstract; and
• Adopt the resolution authorizing the Director of Purchasing and Central Services to conduct
an auction to dispose of the items on Saturday, July 31, 2004.

ORANGE COUNTY BOARD OF COMMISSIONERS
RESOLUTION
WHEREAS: Orange County desires to dispose of surplus, confiscated and abandoned
property in a manner prescribed by North Carolina State Law,
WHEREAS: Orange County has given its own departments and funded agencies the
opportunity to acquire this property prior to its disposal,
WHEREAS: Orange County has determined that public auction would be the most
equitable way to dispose of surplus, confiscated and abandoned property and
at the same time produce the most revenue for the County;
NOW THEREFORE, BE IT RESOLVED THAT:
The Orange County Board of Commissioners authorizes the Director of
Purchasing and Central Services to conduct a public auction of these surplus
acid confiscated items fow~d on the attached list on July 31, 2004, the
auction to be held at 9:00 a.m. at the Orange County Public Works
Department and to be conducted on an as is, highest bidder basis. The
auction will be conducted by Phillip Walker Auction Service.
FURTHERMORE, BE IT RESOLVED THAT:
The Orange County Board of Commissioners does hereby authorize the
Director of Purchasing and Central Services to sign over the title of those
vehicles being sold at auction so that ownership may pass to the buyer and to
direct the Clerlc to the Board of Commissioner to send notice of such
authorization to the North Carolina Division of Motor Vehicles and do
hereby authorize the Director of Purchasing and Central Services to make
the necessary adjustments in inventory for items listed and items that have
been stolen, salvaged, or destroyed or mistakenly planed in inventory,
